File: GCPD-BR CRIMINAL CHARGES FILED AGAINST AN EMPLOYEE Notification of Superintendent When any public school employee of Botetourt County Schools, whether full-time or part-time, permanent, or temporary, has been charged by summons, warrant, indictment or information with the commission of a felony or misdemeanor, the employee shall notify the Superintendent of such charge if it involves any of the following if in Virginia, or an equivalent offense if in another state or country:
sexual assault or battery or other crime of a sexual nature obscenity, possession or distribution of child pornography, or any related offense any drug-related offense, including but not limited to possession of marijuana or of drug paraphernalia a crime of moral turpitude, including but not limited to embezzlement, fraud or larceny the physical or sexual abuse or neglect of a child public drunkenness driving under the influence of alcohol or drugs disturbing the peace assault and battery or any other crime against a person
An employee shall also notify the Superintendent if he or she is the subject of a Department of Social Services (CPS) investigation into or disposition of an allegation of child abuse or neglect. The notification to the Superintendent shall be in writing and shall be accompanied by the name and address of the complainant, the date of the alleged offense, and a copy of the summons, warrant, indictment, information or other document served upon the employee notifying the employee of the charge. The written notification to the Superintendent from the employee shall be delivered to the Superintendent as soon as practical, and in no event later than the first business day following the service of the summons, warrant, indictment or information upon the employee. Failure of the employee to provide the Superintendent written notice, as set forth above, may be cause for termination of the employee. This policy shall also be applicable to any volunteer coach or activity sponsor who has been required to submit to a criminal background check as a condition of volunteering. Adopted:
