TRUSTEE MARK W & MARION S HOWARD 37 WEST 11TH ST NEW YORK NY 10011 Dear Sirs/Madams It has come to our attention that you or your agent has installed a wastewater system that has crossed under the Shore Road from a house on the water side of the road to a leaching field on the opposite side of the road. The opening of the road was not authorized by any Town of Edgecomb official and the septic system was never inspected by the town’s plumbing inspector as required under state statutes. Another issue we are most concerned with is the fact that when you opened the road to put in the wastewater line your digging up of the road and along both sides of the road created a water runoff situation that has resulted in a dangerous icing condition on the Shore Road. This condition did not exist before work was done by your agents. In order to correct this dangerous icing situation, we require you, or your agents, to fix this problem in a manner that adheres to Town and State codes and which results in the elimination of the icing condition you created. We require the icing situation to be fixed within 14 days of receipt of this letter. If you choose not to comply with our requirement, we will have no other recourse than to have the work done by our Road Commissioner. He will determine the amount of money necessary to do the work, and we will require you to furnish that amount prior to the work being completed so we are assured of payment. Any monies remaining after the work is completed will be returned to you. In addition, prior to any work you choose to have done, we require you to consult Marian Anderson, Edgecomb’s Code Enforcement Officer, and Scott Griffin, Edgecomb’s Road Commissioner. Both should be instrumental in determining the best way to return the road to its condition prior to your illegal digging up of the road. Also, we will require all portions of the wastewater system to be inspected. That will require unearthing the lines that are currently buried from the structures to the septic system on the other side of the roadway. This work will also be done at your expense. These inspections should have been done prior to any lines being buried, as required by the State’s Subsurface Water ordinance. All inspections must be coordinated with the town’s plumbing inspector and code enforcement officer, who will also determine the inspections that are necessary.

We will expect a response to this letter within 7 days of your receipt of this letter, and reconstruction of the roadway must begin within 14 days of receipt of this letter, either by your agents or the Edgecomb Road Commissioner and his crew, as outlined above. Regards, Selectmen sign!
