Invitation for Bid Indian Land Fire Department Metal Building Solicitation Number: 500160406 I. Introduction The COUNTY of LANCASTER will receive sealed Bids for a Metal Building to be installed and constructed on the premises of the Indian Land Fire Department at 185 Six Mile Creek Rd, Lancaster, SC 29720; County Bid No. IFB: 50160406. Bids will be received by Bryant J. Cook, County Procurement Officer, 101 North Main Street, Lancaster, South Carolina 29720 until 2:00 P.M. on Wednesday, April 6, 2016. Bids will be publicly opened and read aloud in Council Chambers on the 2nd floor of Lancaster County Admin Building at 101 N. Main St.; Lancaster, SC 29720.

II. Scope of Work Indian Land Fire Department: 185 Six Mile Creek Rd, Lancaster, SC 29720

Construct a 30’ x 40’ x 12’ building 1. (2) service doors 2. (2) 10x10 commercial garage doors 3. 6” concrete slab 30’x40’ fiber reinforced with poly and metal keyway for expansion joints 4. Concrete or asphalt apron from front of building to existing asphalt approx... 40’x40’ 5. 4’ wide concrete or asphalt walkway around the other three sides of the building 6. Placement of doors will be decided by Indian Land Fire Dept. 7. Walls and roof will have minimum 2” reinforced fiberglass insulation 8. The electrical will be 200 amp service (100 amp minimum) run from existing building approx... 140’ 9. Building will have florescent lighting and switches and receptacles will be installed to code and will have outside lighting over all three door

10. Two large ceiling fans will be installed for air circulation centered from the highest point of the building and a side wall exhaust fan with louvers for ventilation 11. Building will consist of 29 gauge 40 year metal and color will be determined by Indian Land Fire Dept. 12. Roof will be screwed and not nailed and be metal roofing 13. Building will have appropriate gutter and down spouts so water runs away from building 14. Building elevation will be set to keep rain runoff from existing parking lot from getting into new building. 15. All Drainage will be diverted towards existing drainage pond. 16. Building will have a 5 year workmanship warranty 17. Builder is responsible for pulling all permit costs All work will be performed and installed according to manufacturer specifications and will be inspected to Lancaster County Building codes. Quality All supplies, materials, equipment, or components used to manufacture or construct covered in this Invitation to Bid must be new (unless otherwise specified), the latest model and of the best and highest quality and workmanship. Materials and equipment must also comply with S.C. State Law, local codes and ordinances and OSHA requirements that are in place at the time this Invitation for Bid contract is awarded

III. Bid Submission Format. A. Bid (1 copy)-The Bidder Info, Bid and a signed copy of the General Provisions/General Conditions (pages N5-N8) should be submitted in a sealed envelope with the responder’s name, the Invitation for Bid title and ID number(found at the top of this document), and the word “Bid”, clearly marked on the outside of the envelope. B. Bid Security (1 copy)- Shall be a certified cashier’s check or a bond provided by a surety company licensed in South Carolina in the amount of 5% of the total base bid, if the cost exceeds $50,000.00. The county accepts no responsibility for any expense incurred by the responders to this IFB. Submittal Instructions Bids must be submitted to the following address: 101 N. Late Bids will not be opened unless the Bids received on time are considered inadequate. Questions All questions regarding this IFB should be addressed to the Procurement Officer at the address indicated above, or emailed to [email protected]. All questions are to be in writing and are to allow sufficient time for distribution to all interested parties. The County of Lancaster will be the sole determiner of sufficient time.

VI. Award of Contract On the designated date and time above the bids will be opened. The lowest responsive, responsible bidder will be acknowledged. Once a winning bidder has been determined a Notice of Award will be issued to the bidder and the successful bidder will be posted on the county website: http://lcprocurement.vze.com

Lancaster County reserves the right to waive any and all formalities or altogether reject any Proposal as in the best interest of the county. Performance and Payment Bonds For bids equal to or greater than $50,000.00, the successful bidders must provide Lancaster County with a performance bond and payment bond equal to 100% of the contract amount. Bond must be submitted to the County upon ten (10) calendar days of the notice of award and the surety company shall comply with U.S. Department of Treasury Circular C570 and be authorized to do business in the State of S.C. Contractor shall also provide a copy of all bonds in all subcontracts. Failure to provide proper bonds in the allotted time shall be just cause for rescinding the Award of the Contract. Award may then be made to the next lowest responsive and responsible bidder.

GENERAL PROVISIONS

1.

THE COUNTY OF LANCASTER RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS/PROPOSALS, TO CANCEL A SOLICITATION, AND TO WAIVE ANY TECHNICALITY IF DEEMED TO BE IN THE BEST INTEREST OF THE COUNTY.

WHEN PRICE IS A DETERMINING FACTOR, UNIT PRICES WILL GOVERN OVER EXTENDED PRICES UNLESS OTHERWISE STATED IN THIS SOLICATATION.

PROHIBITION OF GRATUITIES: SECTION 8-13-705 OF THE CODE OF LAWS OF SOUTH CAROLINA STATES: OFFERING, GIVING, SOLICITING, OR RECEIVING ANYTHING OF VALUE TO INFLUENCE ACTION OF PUBLIC EMPLOYEE, MEMBER OR OFFICIAL, OR TO INFLUENCE TESTIMONY OF WITNESS; EXCEPTIONS; PENALTY FOR VIOLATION; SHALL BE SUBJECT TO THE PUNISHMENT PROVIDED BY SECTION 16-9-210 AND SECTION 16-9-220.

FOR REQUESTS FOR PROPOSALS, AND REQUEST FOR STATEMENT OF QUALIFICATIONS COST PROPOSAL MAY OR MAY NOT BE A FACTOR IN SELECTION, BASED ON THE SELECTION CRITEREA.

WAIVER: THE COUNTY RESERVES THE RIGHT TO WAIVE ANY INSTRUCTION TO BIDDERS, GENERAL OR SPECIAL PROVISIONS, GENERAL OR SPECIAL CONDITIONS OR SPECIFICATIONS DEVIATION IF DEEMED TO BE IN THE BEST INTEREST OF THE COUNTY.

COMPETITION: THIS SOLICITATION IS INTENDED TO PROMOTE COMPETITION. IF ANY LANGUAGE, SPECIFICATIONS, TERMS AND CONDITIONS, OR ANY COMBINATION THEREOF RESTRICTS OR LIMITS THE REQUIREMENTS IN THIS SOLICITATION TO A SINGLE SOURCE, IT SHALL BE THE RESPONSIBILITY OF THE INTERESTED VENDOR TO NOTIFY THE PURCHASING DEPARTMENT IN WRITING WITHIN FIVE (5) DAYS PRIOR TO THE OPENING DATE. THE SOLICITATION MAY OR MAY NOT BE CHANGED BUT A REVIEW OF SUCH NOTIFICATION WILL BE MADE.

GENERAL CONDITIONS

CONTRACT ADMINISTRATION: QUESTIONS OR PROBLEMS ARISING AFTER AWARD OF THIS CONTRACT SHALL BE DIRECTRED TO THE PURCHASING AGENT, 101 N. MAIN ST., LANCASTER, SC 29720, OR BY CALLING (803) 285-6323. THE COUNTY ADMINISTRATOR OR HIS DESIGNEE MUST AUTHORIZE ALL CHANGE ORDERS IN WRITING. LANCASTER COUNTY SHALL NOT BE BOUND TO ANY CHANGE IN THE ORIGINAL CONTRACT UNLESS APPROVED BY THE COUNTY ADMINISTRATOR.

FORCE MAJURE: THE CONTRACTOR SHALL NOT BE LIABLE FOR ANY EXCESS COSTS IF THE FAILURE TO PERFORM THE CONTRACT ARISES OUT OF CAUSES BEYOND THE CONTROL AND WITHOUT FAULT OR NEGLIGENCE OF THE CONTRACTOR. SUCH CAUSES MAY INCLUDE, BUT ARE NOT RESTRICTED TO ACTS OF GOD OR OF THE PUBLIC ENEMY, ACTS OF THE GOVERNMENT IN EITHER ITS SOVEREIGN OR CONTRACTUAL CAPACITY, FIRES, FLOODS, EPIDEMICS, QUARANTINE RESTRICTIONS, STRIKES, FREIGHT EMBARGOES AND UNUSUALLY SEVERE WEATHER; BUT IN EVERY CASE, THE FAILURE TO PERFORM MUST BE BEYOND THE CONTROL OF BOTH THE CONTRACTOR AND SUBCONTRACTOR AND WITHOUT EXCESS COSTS FOR FAILURE TO PERFORM, UNLESS THE SUPPLIES OR SERVICES TO BE FURNISHED BY THE SUCONTRACTOR WERE OBTAINABLE FROM OTHER SOURCES IN SUFFICIENT TIME TO PERMIT THE CONTRACTOR TO MEET THE REQUIRED DELIVERY SCHEDULE.
