Student Eligibility to Attend a Specific Elementary School Elementary age students residing in MSAD #37 towns are generally eligible to attend only in the town where their parent(s) or guardian(s) make a home for them. If parents/guardians move from one District town to another during the summer months, the student must be enrolled in that school of new residence. If parents/guardians move from one District town to another during the school year, the student(s) may remain in the school in which they began the year if that is the parents' desire. Resultant transportation will be the responsibility of the parents or guardians. In the fall of the subsequent school year, the student(s) must be enrolled in the school of new residence. Exceptions: A. District-provided transportation and/or geography may make it more reasonable to attend a school not in the town of residence. B. A student's IEP team meeting, in which the Director of Special Education and both principals are involved in the decision-making process, may determine a student's placement. 1. Harrington, Milbridge, and DW Merritt host the District’s self-contained elementary programs; however, a student placed in one of these programs from another town and who achieves "monitoring status" might return to the town of residency if determined by the IEP team. 2. Recommendations for specific school placement of new students made by outside agencies must be referred to the local IEP team process for special education pupils. C. A student may be allowed to attend school outside the town of residence provided there exists agreement among the two principals involved, and the superintendent. The parent(s) or guardian(s) must make the request for a transfer in writing to the Superintendent of Schools. D. Excepting special education students whose IEP team determines a change of placement, all students presently attending a school outside their town of residence may remain in that school. If a "grandfathered" student is currently attending a specific elementary school outside the parent's or guardian's town of residence, that student's siblings may attend the same school, but extra transportation will not be provided by the District. Notes: 1. A list will be maintained of students who attend an elementary school not in their town of residence as a result of exercising the provisions of this policy. 2. An appeal may be made to the Board of Directors in writing through the Superintendent. Approved by the Board: April 29, 1998 Revised by the board: April 30, 2008
