We wish to bring to your kind notice the long pending issue of recovery of pay consequent upon the 6th CPC pay fixation in the upgraded pay scale. This matter was raised in the Grievance Redressal Meeting of DG:AIR headed by ADG(A) Shri Naidu and he assured that the matter will be re-examined held in the month of October 2016 but still no concrete action has been taken in this regard. To give you a picture in nutshell, the following is being placed your goodselves for kind consideration and an appropriate decision may be delivered to us: DoPT vide his OM F.No. 18/03/2015-Estt.(Pay-I) dated 2.3.2016 on the subject Recovery of wrongful/excess payment made to Government Servants has clearly mentioned in para 4 point (iii) that recovery of wrongful/excess payment is impermissible on the following condition. Para 4 point (iii) is reproduced below : (iii) Recovery from employees, when the excess payment has been made for a period in excess of five years, before the order of recovery is issued. S-VI Section of DG:AIR vide their circular No. 10/20/2016-S-6/323 dated 1.6.2016 has circulated this circular to implement the same. But S-II section of DG:AIR has its contradictory interpretation. Model Pay Fixation issue Association has several times requested to issue a Model Pay Fixation consequent upon the 6th CPC notification in the light of pay fixation fitment table issued by Deptt. Of Expenditure, MoF in the case of Master Craftmen, so that uniform pay fixation should be made at the stations to avoid audit objections. But no action has been taken by the DG:AIR in this regard. Stations have started recovering the arrears from the Stenographers across the country, causing multiplicity of court cases. In the light of above, it is humbly requested to provide us an opportunity to explain the issue in person so that it may be decided without delay. Till time an order may be issued to keep in abeyance the recovery orders issued by S-II section of DG:AIR in the case of Stenographers. Though S-II is not a nodal agency to deal with the Stenographer cadre cases whereas, it is S-VI. Thanking you, With regards, Regards
