9th National Youth Parliament RESOLUTION NO. NYP-09-12-22 Series 2012 A RESOLUTION URGING THE DEPARTMENT OF LABOR AND EMPLOYMENT (DOLE) ) TO UPHOLD AND PROTECT THE RIGHT TO EQUAL EMPLOYMENT OPPORTUNITIES BY PROHIBITING JOB DISCRIMINATION THROUGH PREFERENCE OF ACADEMIC INSTITUTIONS IN ADVERTISING AND PUBLICIZING JOB QUALIFICATION REQUIREMENTS Introduced by: Committee on Employment and Entrepreneurship WHEREAS, the International Labor Organization, an international organization responsible for drawing up and overseeing international labour standards, encourages endeavors for equal employment opportunities; WHEREAS, All individuals are entitled to equality of employment opportunities by virtue of Article VIII Sec. 3 of the 1987 Constitution which states that, “the state shall afford full protection to labor, local and overseas, organized and unorganized, and promote full employment and equality of employment opportunities for all”; WHEREAS, entities which are hiring employees are not barred from specifying their respective standards and requirements for hiring; WHEREAS, the academic background and educational attainment of an individual are major considerations for hiring and employment for these speaks his knowledge and competencies; WHEREAS, the Commission on Higher Education and other accrediting bodies such as the Philippine Association of Accrediting Schools, Colleges and Universities, Philippine Association of State Colleges and Universities and Luzon, Visayas and Mindanao Associations of State Universities and Colleges assess the quality of education and provide status, ranks and levels to Higher Education Institutions; WHEREAS, these status, ranks and levels which speak of the credibility and reputation of schools and universities are also major factors being considered in the academic background of an individual; WHEREAS, a number of entities recruiting employees would specify preferred graduates of specific academic institutions for recruitment in their respective companies in dealing with applicants and in their announcements and publications for job openings and recruitment such as posters and online announcements; WHEREAS, the General Conference of the International Labour Organisation convened in its 42nd session in Geneva in 1958 defines discrimination as: (a) any distinction, exclusion or preference made on the basis of race, colour, sex, religion, political opinion, national extraction or social origin, which has the effect of nullifying or impairing equality of opportunity or treatment in employment or occupation; (b) such other distinction, exclusion or preference which has the effect of nullifying or impairing equality of opportunity or treatment in employment or occupation; WHEREAS, these practices of having preferred academic institutions in the publication of job qualification requirements such as posters and online announcements fall under the category of discrimination which also directly violate the mandate of the constitution to provide equal opportunities for all; WHEREAS, aside from being a right enshrined in the constitution, an importance must also be given to equal opportunities for all to enter the recruitment process and later on be employed if qualified being a value-adding experience for employees by allowing them to be more competitive and further learn and harness skills so as to suit the qualifications of the entities they are applying for;

THEREFORE BE IT RESOLVED, AS IT IS HEREBY RESOLVED by the chairperson and members of the 9th parliament of youth leaders to urge the Department of Labor and Employment (DOLE) to uphold and protect the right to equal employment opportunities by prohibiting job discrimination through preference of academic institutions in advertising and publicizing job qualification requirements. RESOLVED FURTHER to urge the Department of Labor and Employment having the primary mandate to administer and enforce the Labor Code of the Philippines to promulgate necessary implementing rules and regulations to uphold this constitutional right. ADOPTED this 6th day of May 2012 at Naga City, Philippines.
