OVID TOWN BOARD Regular Monthly Meeting OCTOBER 12, 2016 The regular meeting of the Ovid Town Board was called to order at 7:00pm by Town Supervisor Walt Prouty, Also present were Councilmen John Hubbard, Joe Borst, and Erik Holmberg, Town Clerk James Vangalio, Deputy Town Clerk Michele Vangalio, Highway Superintendent Jack Wickham, Town Attorney Steven Getman, members of the press and other interested citizens. Minutes of the September 14, 2016 meeting and September 28, 2016 Budget Workshop were approved, as written, with a motion by Councilman Borst, a second by Councilman Holmberg, and approval by all. A Public Hearing on the 2017 Town Budget was opened at 7:03pm with a motion by Councilman Borst, a second by Councilman Holmberg and approval by all. Hearing minimal comment the Public Hearing was closed with a motion by Councilman Borst, a second by Councilman Hubbard and approval by all at 7:15pm. A second Public Hearing on Proposed Local Law No. 2 of the Year 2016 Town of Ovid, County of Seneca, State of New York, A local law to override the tax levy limit established in General Municipal Law §3-c, was opened at 7:16pm with a motion by Councilman Hubbard, a second by Councilman Borst and approval by all. Hearing little comment the Public Hearing was closed with a motion by Councilman Borst, a second by Councilman Hubbard and approval by all at 7:18pm. Petitioner to the Board Jean Currie spoke regarding Solar Seneca. The Board agreed to have a presentation on Solar Energy at the next meeting. Highway Superintendent Jack Wickham presented his report. Jack also presented his Transfer Station report. The Town Clerk’s Report and moneys collected for September were accepted into the record. Board Members received the Bookkeeper’s report. Supervisor Prouty presented his report. Councilman Hubbard presented his reports regarding EMS and Fire Department Councilman Borst reported on activities with the Transfer Station Committee. Councilman Borst presented his reports regarding the Highway Department

Councilman Holmberg updated the Board on progress on the new web site. Councilman Hubbard updated the Board regarding the Compressive Plan. With a motion by Councilman Hubbard, a second by Councilman Holmberg and approval by all the Board went into executive session to discuss possible litigation at 7:56. With a motion by Councilman Borst, a second by Councilman Hubbard and approval by all the Board resumed regular session at 8:17 announcing that no action was taken. With a motion by Councilman Hubbard, a second by Councilman Borst and approval by all the Board approved Resolution 16-2016 of the Town Board, Town of Ovid, County of Seneca, Sate of New York for acceptance off all legal and maintenance and repair responsibility for certain Town roadways. With a motion by Councilman Borst, a second by Councilman Hubbard and approval by all the Board approved Resolution 17-2016 adopting Proposed Local Law No. 2 of the Year 2016 Town of Ovid, County of Seneca, State of New York A local law to override the tax levy limit established in General Municipal Law §3-c. With a motion by Councilman Borst, a second by Councilman Holmberg and approval by all the Board approved the 2017 Town Budget as presented. Following the Audit of the bills, Vouchers #353-388 were approved for payment with a motion by Councilman Holmberg, a second by Councilman Borst, and approval by all, for Abstract #10 for $26,062.00. Supervisor Prouty adjourned the meeting at 8:50pm with a motion by Councilman Borst, a Second by Councilman Beardsley, and approval by all. Respectfully Submitted,

Whereas, pursuant to GIS Local Roads Project, 2016 of the New York State Department of Transportation at a regular meeting of the Town Board duly called, the following is voted upon and passed; and Whereas, all three of the following roadways, or portions thereof, as described are owned and maintained by the Town of Ovid; Now, therefore be it resolved that the Town Board, Town of Ovid, County of Seneca, and State of New York hereby accepts all legal and maintenance and repair responsibility for the roadways located within the Town of Ovid as follows: Brewer Street, from County Road 139 to Water Street, .08 miles; Sheldrake Park Road, from County Road 139 to around traffic circle, 952 feet; Verona Village Road, from County Road 139 to the flag pole in from of the community Moved By John

Resolution 17-2016 adopting Proposed Local Law No. 2 of the Year 2016 Town of Ovid, County of Seneca, State of New York A local law to override the tax levy limit established in General Municipal w §3-c

WHEREAS, it has been recommended that it is in the best interests of the Town that there be introduced a Local Law as follows: Section 1. Legislative Intent It is the intent of this local law to allow the Town of Ovid to adopt a budget for the fiscal year commencing January 1, 2017, that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c. The Town of Ovid is concerned about uncertainties in the existing tax cap law, including how expenditures mandated by law and expenditures and revenues controlled by the county and state interact with the tax cap, as well as increasing costs over which the town’s control is limited. The town board is accountable to prepare a responsible budget, which meets the Town’s obligations and provides beneficial services, while minimizing the tax burden. The New York State Comptroller has announced that, absent an override, the town must abide by a .68 percent Tax Cap for 2017. Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the Town Board to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of the Town Board. Section 3. Tax Levy Limit Override The Town Board of the Town of Ovid, County of Seneca, State of New York, is hereby authorized to adopt a budget for the fiscal year commencing January 1, 2017, that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c. Section 4. Severability If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5. Effective date This local law shall take effect immediately upon filing with the Secretary of State. AND NOW, THEREFORE, BE IT RESOLVED that Proposed Local Law No. 2 of the year 2016, Town of Ovid, County of Seneca, State of New York, “A local law to override the tax levy

limit established in General Municipal Law §3-c” be and the same is hereby introduced before the Town Board of The Town of Ovid, New York; and BE IT FURTHER RESOLVED that copies of the aforesaid proposed local law be laid upon the desks of each member of the Town Board; and BE IT FURTHER RESOLVED that the Town Board hold a public hearing on said proposed Local Law at the Ovid Firehouse, 2136 Brown St Ovid, NY 14521, at 7:00 p.m. on the 12 day of October, 2016; and BE IT FURTHER RESOLVED that the Town Clerk publish or cause to be published a notice of said public hearing in the official newspapers of the Town at least ten (10) days prior thereto.
