51st Judicial District Attorney Steve LUPTON has requested Texas Ranger Sergeant Shawn PALMER conduct an investigation of alleged Misuse of Official Information by San Angelo Police Department Chief Tim VASQUEZ. Said alleged Misuse of Official Information is related to the disclosure to San Angelo Standard Times reporter Paul ANTHONY of a subject's status as an informant. The disclosure sterns from an interview related to an assault allegation made against Chief VASQUEZ by a female complainant. Due to this disclosure, the female complainant is identified by the Pseudonym of Jane DOE. Ranger Shawn PALMER interviewed Jane DOE (Pseudonym), Assistant Chief Robert MARTINEZ, Detective Jeff DAVIS, Sergeant Victor VASQUEZ, Sergeant Matt BALDWIN, Sergeant Fred DIETZ and Communications Supervisor Georgana KENNEDY. Ranger Shawn PALMER served several Torn Green County Grand Jury subpoenas. Ranger Shawn PALMER also obtained an affidavit from Paul ANTHONY. DETAILS:

1.1 On Monday

08-20-2007, at approximately 10:45PM, Texas Ranger Sergeant Shawn PALMER received a voice mail message on his (PALMER) cellular telephone. The message was from San Angelo Police Department Officer Jaime PADRON. Officer PADRON requested Ranger Shawn PALMER contact San Angelo Police Department Detective Jeff DAVIS. Ranger Shawn PALMER contacted Detective DAVIS by telephone. Detective DAVIS stated the following: A.

individual (C.T.) who stated she (C.T.) had been at a club in San Angelo over the previous weekend. While at the club, San Angelo Police Department Chief Tim VASQUEZ grabbed the C.I. 's buttocks. There had also been a conversation between the C.I. and Chief VASQUEZ regarding the upcoming election for Chief, in which Detective DAVIS is a candidate. The C.I. had indicated she (C.I.) wanted to report the incident. Detective DAVIS told the C.I. he (DAVIS) could not take a report and she (C.I.) should call the San Angelo Police Department. A San Angelo Police Department officer met with the C.I. in reference to the incident. Detective DAVIS' supervisor Lieutenant Tracy FINCHER had reportedly met with the C.I. regarding the incident. B. Detective DAVIS was concerned efforts were being made to "cover up" the incident and not conduct an investigation of the incident. Detective DAVIS was also concerned about the effect of this incident on narcotics cases which were pending in Federal Court.

1.2 Ranger Shawn PALMER directed Detective DAVIS to have the C.I. call Ranger

1.3 On Tuesday

08-21-2007, at approximately 7:30AM, Ranger Shawn PALMER was contacted by Texas Department of Public Safety Communications. Ranger Shawn PALMER received a message to contact San Angelo Police Department Lieutenant Steve MIDA. Ranger Shawn PALMER contacted Lieutenant MIDA who requested to meet with Ranger Shawn PALMER. At approximately 8:02AM, Ranger Shawn PALMER met with Lieutenant MIDA. Lieutenant MIDA had heard about the allegation made against Chief Tim VASQUEZ. Lieutenant MIDA identified the officer who had taken the initial report as Sergeant Fred DIETZ. Lieutenant MIDA was concerned that Sergeant DIETZ had been pressured not to take a report and the incident would not be investigated. Ranger Shawn PALMER utilized a digital audio recorder to audio record the meeting with Lieutenant Steve MIDA. Said digital audio recording is hereafter identified as Exhibit #1.1.

1.4 Due to the reported

1.5 On Wednesday

08-22-2007, Ranger Shawn PALMER met with Sergeant DIETZ in reference to an unrelated invescigation. Ranger Shawn PALMER asked Sergeant DIETZ if there had been any pressure or inappropriate influence involved the decision to not complete an incident report in reference to the incident involving the female subject and Chief VASQUEZ. Sergeant DIETZ stated there had been no pressure or inappropriate influence involved in the decision. Sergeant DIETZ stated the decision was based on the wishes of the femaYe complainant.

1.6 Following the meeting with Sergeant DIETZ, Ranger Shawn PALMER received a telephone call from Chief VASQUEZ. Chief VASQUEZ had learned about the conversation between Ranger Shawn PALMER and Sergeant DIETZ. Chief VASQUEZ stated the San Angelo City Legal Department had agreed to have an investigation conducted of the alleged incident involving Chief VASQUEZ. Chief VASQUEZ stated the investigator would be the same investigator who had conducted an investigation of the San Angelo Municipal Court Judge.

1.7 On Friday 08-24-2007,

Ranger Shawn PALMER was contacted by Officer Jaime PADRON and Detective Jeff DAVIS. Officer PADRON and Detective DAVIS expressed concern over the way in which the alleged incident involving Chief VASQUEZ was not reported. Ranger Shawn PALMER briefly explained the policy of the Texas Ranger Division as it applies to the investigation of an elected official. Ranger Shawn PALMER again requested Detective DAVIS have the female complainant contact Ranger Shawn PALMER.

1.8 On Monday 08-27-2007,

Ranger Shawn PALMER traveled to Austin, Texas. At approximately 4:00PM, Ranger Shawn PALMER received a telephone call from Special Agent FAGAN. Special Agent FAGAN stated his $upervisors had been contacted in reference to the allegation made against Chief VASQUEZ. Special Agent FAGAN requested to meet with Ranger Shawn PALMER upon his (PALMER) return to San Angelo. A few minutes later, Ranger Shawn PALMER received a telephone call from Chief VASQUEZ. 1~9 On Tuesday

08-28-2007, at approximately 4:00PM, Ranger Shawn PALMER returned to San Angelo, Texas. Ranger Shawn PALMER met with Special Agent FAGAN and discussed the information provided by Detective DAVIS, Lieutenant MIDA and Sergeant DIETZ.

1.10 On Wednesday 08-29-2007, Ranger Shawn PALMER attempted to contact Chief VASQUEZ at his (VASQUEZ) office but Chief VASQUEZ was not available. Later, Ranger Shawn PALMER traveled to the San Angelo Police Department and met with Sergeant Matt BALDWIN in reference to an unrelated investigation. While Ranger Shawn PALMER was in Sergeant BALDWIN'S office, Sergeant DIETZ stopped by and spoke briefly with Sergeant BALDWIN. Sergeant DIETZ talked about completing a report due to a request from the media. Sergeant BALDWIN also indicated he (BALDWIN) would be completing his report. Ranger Shawn PALMER suspected the discussion was related to the allegation against Chief VASQUEZ. Prior to leaving Ranger Shawn PALMER observed that Chief VASQUEZ' office door was closed. 1.11 On or about Friday 08-31-2007, Ranger Shawn PALMER was contacted by Tom Green County Attorney's Office Investigator Mickey ENGLERT. ENGLERT stated his office had been requested to investigate the allegation made against Chief VASQUEZ. ENGLERT contacted Ranger Shawn 'PALMER to ensure that Ranger Shawn PALMER had not initiated an investigation of the allegation. Ranger Shawn PALMER informed ENGLERT he (PALMER) had made inquiries but had not initiated an investigation.

1.12 On 08-31-2007,

at approximately 3:30PM, Ranger Shawn PALMER was contacted by San Angelo City Attorney Mindy WARD. WARD stated a member of the San Angelo City Council had contacted her in reference to the investigation being conducted by ENGLERT. WARD stated the council member had asked about Ranger Shawn PALMER conducting a parallel investigation of the allegation. PALMER to discuss the matter. Ranger Shawn PALMER told WARD to have the council member call and Ranger Shawn PALMER to set up a meeting.

1.13 At approximately

4:00PM, San Angelo City Councilman Daniel CARDENAS call~d the Texas Rangers Office in San Angelo. CARDENAS requested to meet with Ranger Shawn PALMER and Ranger Shawn PALMER directed CARDENAS to come to the office. cARDENAS stated' he wanted to meet in a more "neutral" location. Ranger Shawn PALMER told CARDENAS that the Texas Rangers Office is located in the Texas Department of Public Safety Office and it should be an appropriate meeting place. CARDENAS then asked where Ranger Shawn PALMER'S supervisor was located and Ranger Shawn PALMER replied Midland, Texas. CARDENAS then asked who to contact when he (CARDENAS) arrived at the Texas Department of Public Safety Office. Ranger Shawn PALMER directed CARDENAS on who to contact after arrival. CARDENAS indicated he would be traveling to the office. Ranger Shawn PALMER waited until approximately 5:45PM but CARDENAS did not meet with Ranger Shawn PALMER.

1.14 On Tuesday

09-04-2007, Ranger Shawn PALMER checked the voice mail messages on the telephone at the Texas Rangers Office in San Angelo. There was a message from the female complainant who had made the allegation against Chief VASQUEZ. At approximately 9:46AM, Ranger Shawn PALMER attempted to contact the female complainant with negative results.

1.15 Ranger Shawn PALMER was out of town from 09-04-2007 through Thursday 09-06-2007. On 09-06-2007, Ranger Shawn PALMER checked the voicemail messages at the Texas Rangers Office in San Angelo. There was an additional message from the female complainant .. Ranger Shawn PALMER attempted to contact the female complainant with negative results.

1.16 On Friday 09-07-2007, at approximately

9:03AM, Ranger Shawn PALMER contacted the female complainant by telephone. The female complainant was emotionally upset. The female complainant requested to meet with Ranger Shawn PALMER in reference to the alleged incident involving Chief VASQUEZ as well as an article in the San Angelo Standard Times. Shawn PALMER had reviewed the article which was published that day. The article discussed the allegation made against Chief VASQUEZ. The article included a quote from Chief VASQUEZ which stated "I know her to be an informant for one of my opponents who works in narcotics".

1.17 On 09-07-2007 , at approximately

10 :OOAM, Ranger Shawn PALMER and Texas Department of Public Safety Criminal Intelligence Service Sergeant David JONES met with the female complainant. Due to the disclosure of the status of the female complainant as an informant Ranger Shawn PALMER has chosen to identify the female complainant by the Pseudonym of Jane DOE. DOE (Pseudonym) stated the following: A. DOE (Pseudonym) spoke with Chief VASQUEZ at the Oasis Club at approximately 1:00AM on 08-19-2007. VASQUEZ appeared to be intoxicated. DOE (Pseudonym) told VASQUEZ she (DOE) did not appreciate VASQUEZ running against Jeff DAVIS. VASQUEZ corrected DOE (Pseudonym) by saying that DAVIS was running against VASQUEZ. VASQUEZ grabbed DOE'S (Pseudonym) buttocks. DOE (Pseudonym) told VASQUEZ if he (VASQUEZ) did that again she (DOE) would strike him. B. On 08-20-2007, DOE (Pseudonym) called into the San Angelo Police Department to report the incident. Sergeant DIETZ contacted DOE (Pseudonym) at her residence. DOE (Pseudonym) told Sergeant DIETZ she (DOE) did not want to file charges but wanted to report the incident. DOE (Pseudonym) did not believe VASQUEZ-should be able to assault people simply because he (VASQUEZ) is the Chief of Police. Sergeant DIETZ took the information for a report. At approximately 5:00PM, Sergeant DIETZ met with DOE (Pseudonym) at her work. Sergeant DIETZ presented DOE (Pseudonym) with forms for DOE (Pseudonym) to complete. DOE (Pseudonym) told Sergeant DIETZ she did not wish to fill out the forms and Sergeant DIETZ' report should be good enough. At approximately 7:00PM, Lieutenant Tracy FINCHER and Sergeant David HOWARD met with DOE (Pseudonym) outside of DOE'S (Pseudonym) work. Lieutenant FINCHER and Sergeant HOWARD told DOE (Pseudonym) that VASQUEZ is very vindictive. Lieutenant FINCHER and Sergeant HOWARD stated they were concerned that VASQUEZ might hold a press conference and release information that would compromise DOE (Pseudonym) due to her status as an informant. (Pseudonym) contacted Sergeant DIETZ and requested he not complete a report until DOE (Pseudonym) had an opportunity to speak to an. attorney. DOE (Pseudonym) spoke to an attorney who suggested DOE (Pseudonym) not pursue reporting the incident. DOE (Pseudonym) contacted Sergeant DIETZ and requested a report not be made. 1.18 DOE (Pseudonym) became emotionally upset and stated she feared for her safety and the safety of her family. DOE (Pseudonym) stated she had provided information to law enforcement which involved members of the street gang the Mexican Mafia. DOE (Pseudonym) requested Ranger Shawn PALMER conduct an investigation of the disclosure by VASQUEZ of DOE'S (Pseudonym) status as an informant.

1.19 On 09-07-2007,

at approximately 11:30AM, Ranger Shawn PALMER met with Tom Green County Attorney Chris TAYLOR and Investigator Mickey ENGLERT. Ranger Shawn PALMER learned that VASQUEZ had requested the County Attorney's Office conduct an investigation of the alleged incident involving VASQUEZ and DOE (Pseudonym). VASQUEZ reportedly told TAYLOR that the F.B.I. and Ranger Shawn PALMER had refused to investigate the incident. ENGLERT stated he (ENGLERT) was concerned about the newspaper article and the statement reportedly made by VASQUEZ. ENGLERT allowed Ranger Shawn PALMER to review reports completed by the San Angelo Police Department in reference to the alleged incident. Ranger Shawn PALMER noted Chief VASQUEZ had completed a report supplement in reference tQ the incident.

1.20 On 09-07-2007,

at approximately 2:00PM, Ranger Shawn PALMER met with District Attorney Steve LUPTON. Ranger Shawn PALMER and LUPTON discussed the disclosure by Chief VASQUEZ that DOE (Pseudonym) was an informant. Both Ranger Shawn PALMER and LUPTON agreed this information is considered confidential and not subject to release as identified in the Texas Government Code. LUPTON requested Ranger Shawn PALMER conduct an investigation in reference to the suspected unlawful release of confidential information. Prior to leaving the District Attorney's Office Ranger Shawn PALMER was contacted by Investigator Diane WILSON. 1.21 On 09-07-2007,

at approx~mately 5:07PM, Ranger Shawn PALMER traveled to DOE'S (Pseudonym) residence. DOE (Pseudonym) provided Ranger Shawn PALMER with a clear plastic bag containing one (1) sheet of notebook paper which is hereafter identified as Exhibit #1.4. DOE (Pseudonym) stated the note had been left on her (DOE) vehicle which was parked in the driveway. Ranger Shawn PALMER later examined the note and observed the following written on the paper: "SNITCH You & yours better watch out! Soon!!" Ranger Shawn PALMER utilized a digital audio recorder to audio record the contact with DOE (Pseudonym). Said digital audio recording is hereafter ide~tified as Exhibit #1.5.

1.22 On Tuesday

09-11-2007, District Attorney Steve LUPTON .. provided Ranger Shawn PALMER with a typewritten letter requesting Ranger Shawn PALMER conduct an investigation of the suspected release of confidential information by Chief VASQUEZ. Said letter is hereafter identified as Exhibit #1.6.

1.23 On 09-11-2007,

at approximately 8:55PM, Ranger Shawn PALMER was contacted by Mike RICKMAN who is an attorney for the Combined Law.Enforcement Association of Texas (C.L.E.A.T.). RICKMAN requested Ranger Shawn PALMER contact Detective Jeff DAVIS. RICKMAN stated Detective DAVIS had been directed to meet with Sergeant David HOWARD and Lieutenant Tracy FINCHER because of a threat to the safety of Jane DOE (Pseudonym). Ranger Shawn PALMER contacted Detective DAVIS by telephone. Detective DAVIS stated he (DAVIS) was reluctant to meet with Sergeant HOWARD and Lieutenant FINCHER. While Ranger Shawn PALMER was on the telephone with Detective DAVIS Ranger Shawn PALMER received a telephone call from Texas Department of Public Safety Communications. The communications operator had received a call from Sergeant HOWARD who requested Ranger Shawn PALMER cont,act him at (325) 6574340. Ranger Shawn PALMER called and spoke with Lieutenant FINCHER. Lieutenant FINCHER had received information about a non specific threat to kidnap an informant and transport the informant to Mexico. Lieutenant FINCHER was concerned the threat was directed at Jane DOE (Pseudonym). Lieutenant FINCHER stated he (FINCHER) had contacted the Assistant United States Attorney who directed Lieutenant FINCHER to move DOE (Pseudonym) to a motel room. ENGLERT. Ranger Shawn PALMER attempted to call ENGLERT with negative results. Ranger Shawn PALMER called DOE (Pseudonym}. DOE (Pseudonym) was aware of the plan to move her (DOE) to a motel. DOE (Pseudonym) stated she was willing to be moved to a motel but DOE (Pseudonym) was concerned about the number of individuals who would know which motel. Ranger Shawn PALMER called Lieutenant FINCHER. Lieutenant FINCHER stated he had not been able to contact ENGLERT but he (FINCHER) had spoken with County Attorney Chris TAYLOR. Lieutenant FINCHER stated TAYLOR indicated it was not his (TAYLOR) responsibility. Ranger Shawn PALMER told Lieutenant FINCHER that DOE (Pseudonym) was willing to move to a ,. motel. Lieutenant FINCHER stated he (FINCHER) would coordinate moving DOE (Pseudonym) to a motel. DOE (Pseudonym) later called Ranger Shawn PALMER and stated she (DOE) had been moved and would be staying in a motel.

1.24 On Wednesday

09-12-2007, at approximately 8 :46AM, Ranger Shawn PALMER was contacted by Special Agent Cody SORRELLS of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives. SORRELLS was concerned about the safety and security of Jane DOE (Pseudonym).

1.25 On 09-12-2007,

at approximately 4:00PM, Ranger Shawn PALMER met with Lieutenant FINCHER and Sergeant David HOWARD in reference to this investigation.

4:20PM, Ranger Shawn PALMER met with Chief VASQUEZ, Assistant Chief MARTINEZ and Assistant Chief Kevin HOLLWAY at the San Angelo Police Department. Ranger Shawn PALMER informed them of this investigation and Ranger Shawn PALMER served them with the Grand Jury subpoenas. Assistant Chief MARTINEZ agreed to meet with Ranger Shawn PALMER the following day to provide a statement. Ranger Shawn PALMER left this meeting and then met with Sergeant Matt BALDWIN. Ranger Shawn PALMER served Sergeant BALDWIN with the Grand Jury subpoena.

1.28 At approximately

4:52PM, Ranger Shawn PALMER traveled to the offices of the San Angelo Standard Times Newspaper. Ranger Shawn PALMER met with reporter Paul ANTHONY arid Editor Tim ARCHULETA. Ranger Shawn PALMER requested to interview Paul ANTHONY in reference to this investigation. ARCHULETA stated he (ARCHULETA) would need to contact the legal representative for the newspaper to obtain authorization for the interview.

5:15PM, Ranger Shawn PALMER met with Lieutenant Les BIRD. Ranger Shawn PALMER served Lieutenant BIRD with the Grand Jury subpoena. Lieutenant BIRD stated he (BIRD) was out of town when the call was received on 0820-2007. Lieutenant BIRD stated he was called by Sergeant DIETZ in reference to the call. Lieutenant BIRD stated he (BIRD) directed Sergeant DIETZ to contact Sergeant Matt BALDWIN who is in charge of the Office of Professional Standards.

A. On 08-20-2007, at approximately 12:30PM, MARTINEZ was contacted by Sergeant DIETZ and Sergeant BALDWIN in reference to a call. Sergeant DIETZ, Sergeant BALDWIN and MARTINEZ met with Chief VASQUEZ in the Chief's office. Sergeant DIETZ related the information about the allegation made by a female complainant that VASQUEZ had assaulted the female complainant at the Oasis Club. Sergeant DIETZ stated the female complainant did not want to file charges but wanted the incident "documented". MARTINEZ asked VASQUEZ if he (VASQUEZ) had been at the Oasis Club. VASQUEZ stated he had and then VASQUEZ described the encounter with the female complainant. VASQUEZ stated the female complainant poked VASQUEZ in the chest and said something about VASQUEZ running against a buddy of hers. VASQUEZ stated the female identified her buddy as Jeff DAVIS. MARTINEZ asked VASQUEZ if he (VASQUEZ) recognized the female 'complainant. VASQUEZ stated he did not recognize the female complainant at the club but during the conversation with Sergeant DIETZ a~d Sergeant BALDWIN he (VASQUEZ) recognized her name as an informant for San Angelo Police Department Narcotics Detectives. B. While in the Chief's office there was a discussion about how the female complainant would be listed in a report due to the fact that she (complainant) was an informant. MARTINEZ suggested VASQuEz contact the San Angelo City Legal Department about the situation. There was no discussion in MARTINEZ' presence about releasing the information about the complainant being an informant to the media. Later that night Sergeant DIETZ contacted MARTINEZ and stated the female complainant did not want a report written and she (complainant) wanted to drop everything. Sometime later, VASQUEZ told MARTINEZ that a report would be written about the alleged incident involving the female complainant and VASQUEZ. MARTINEZ was not told why a report would be completed in reference to the alleged incident. 1.33 At approximately lO:OOAM, the interview of MARTINEZ was stopped and Ranger Shawn PALMER prepared a draft statement based on the information provided by MARTINEZ. discussing the article in the San Angelo Standard Times which quoted VASQUEZ as identifying the female complainant as an informant. MARTINEZ ultimately stated that VASQUEZ did not tell MARTINEZ that he (VASQUEZ) had or had not told Paul ANTHONY that the female complainant was an informant. Ranger Shawn PALMER asked if MARTINEZ had ever been misquoted by the San Angelo Standard Times newspaper and MARTINEZ stated yes. Ranger Shawn PALMER asked MARTINEZ what action MARTINEZ took after being misquoted. MARTINEZ stated he (MARTINEZ) and VASQUEZ spoke with the editor about being misquoted. Ranger Shawn PALMER then asked if MARTINEZ or VASQUEZ had spoken with the editor about the quote stating the female complainant was an informant. MARTINEZ stated he did not speak with the editor and MARTINEZ was not aware of VASQUEZ speaking with the editor. MARTINEZ provided Ranger Shawn PALMER with a typewritten statement hereafter identified as Exhibit #1.7. MARTINEZ also provlded Ranger Shawn PALMER with eight (8) pages of printed e-mails (Exhibit #1.8), three (3) pages of typewritten notes (Exhibit #1.9), nine (9) pages of San Angelo P.D. reports (Exhibit #1.10) and one (1) photocopy of a law book page with handwritten notes (Exhibit #1.11) .

at approximately 3 :48PM, Ranger Shawn PALMER interviewed Detective Jeff DAVIS, W/M, DOB/ 10-06-1960. During the interview DAVIS stated he (DAVIS) had digital audio recordings of meetings with Lieutenant FINCHER, Sergeant HOWARD, Sergeant BALDWIN and Chief VASQUEZ.

at approximately 5:00PM, Ranger Shawn PALMER met with Sergeant Matt BALDWIN in reference to this investigation.

at approximately 10:30AM, Ranger Shawn PALMER met with San Angelo City Attorney Mindy WARD, Assistant City Attorney Teresa SPECIAL and San Angelo City Manager Harold DOMINGUEZ in reference to this investigation. Ranger Shawn PALMER with a Tom Green County Grand Jury subpoena for Wayne GILLEY. The G~artd Jury subpoena directed GILLEY to furnish San Angelo Police Department Directiv~s, Memorandums and e-mails. At approximately 2:35PM, Ranger Shawn PALMER served GILLEY with the Grand Jury subpoena. GILLEY and John EADES decided to take possession of the computer equipment of San Angelo Police Department personnel to ensure the collection of the data requested in the subpoena. GILLEY collected computer equipment from the San Angelo Police Department located at 401 E. Beauregard, San Angelo, Texas. At approximately 3:26PM, Ranger Shawn PALMER drove EADES to the office of the San Angelo Police Department Narcotics Division. EADES collected computer equipment. At approximately 3:56PM, Ranger Shawn PALMER drove EADES to the San Angelo Police 'Department Training Academy. EADES then collected a Treo telephone from Lieutenant FINCHER. 1.38 On 09-17-2007, at approximately 4:45PM, Ranger Shawn PALMER obtained a CD containing the digital audio recordings made by Detective DAVIS. Said CD is hereafter identified as Exhibit #1.12. 1.39

On 09-17-2007, at approximately 5:55PM, Ranger Shawn PALMER met with San Angelo Standard Times Editor Tim ARCHULETA. ARCHULETA provided Ranger Shawn PALMER with a notarized affidavit signed by reporter Paul ANTHONY. The affidavit included a copy of the article published on 09-07-2007. Ranger Shawn PALMER reviewed the affidavit which stated the statements contained within the article are true and correct. The quotes contained in the article are statements that were made to ANTHONY by the persons to whom the quotes are attributed in the article. Said affidavit with attached article is hereafter identified as Exhibit #1.13.

A. On 08-20-2007, VASQUEZ was on duty in the San Angelo Police Department Communications Center. Sergeant BALDWIN and Sergeant DIETZ contacted VASQUEZ in reference to a call in reference to the Chief of Police. VASQUEZ played the call for Sergeant BALDWIN and Sergeant DIETZ. VASQUEZ later e-mailed a recording of the call to Sergeant BALDWIN. On 0821-2007, the Chief called VASQUEZ and asked VASQUEZ to bring Erica MANLEY and Georgana KENNEDY to the Chief's office. VASQUEZ took them over one at a time. Assistant Chief Robert MARTINEZ was present with the Chief. The Chief discussed the call in reference to the complaint against the Chief. The Chief stated he was innocent of the allegation. The Chief said something about the complainant being a narcotics informant. B. The Chief said something about the incident had gotten out already and if he (Chief) found out that someone had leaked anything he would fire them. The Chief stated he had requested the incident be investigated by an outside agency.

1.42 Sergeant VASQUEZ provided Ranger Shawn PALMER with a typewritten statement hereafter identified as Exhibit #1.14. Sergeant VASQUEZ also provided Ranger Shawn PALMER with a CD containing audio recordings (Exhibit #1"15), one (1) page of event chronology information (Exhibit #1.16), seven (7) pages of recorded information requests (Exhibit #1.17) and two (2) pages of duty roster information (Exhibit #1.18). Sergeant VASQUEZ also agreed to e-mail Ranger Shawn PALMER a copy of the policy which states an employee can be terminated for discussing incoming call information.

1.43 On Thursday

09-20-2007, at approximately 1:02PM, Ranger Shawn PALMER met with Detective Jeff DAVIS and Combined Enforcement Association of Texas (C.L.E.A.T.) attorney Richard CARTER. DAVIS stated the following:

in San Angelo. DOE (Pseudonym) had spoken with Tim VASQUEZ near the bathroom. DOE (Pseudonym) told VASQUEZ something about him (VASQUEZ) running against a person she was voting for or pushing for. DOE (Pseudonym) mentioned DAVIS' name as the person running against VASQUEZ. As DOE (Pseudonym) was walking away, VASQUEZ grabbed her (DOE) buttocks. DOE (Pseudonym) was upset and wanted to report the incident. DAVIS did not speak with DOE (Pseudonym) on the day of the incident at the Oasis Club. DAVIS was not aware DOE (Pseudonym) would be going to the Oasis Club" DAVIS was not aware VASQUEZ would be there either. B. At approximately 10:00AM or 10:30AM, DAVIS informed Lieutenant FINCHER about the call from DOE (Pseudonym). Later, DOE (Pseudonym) called DAVIS and stated she (DOE) had reported the incident to the San Angelo Police Department. At approximately 6:00PM, DOE (Pseudonym) called DAVIS because Sergeant DIETZ was meeting with DOE (Pseudonym) in reference to some forms. At approximately 7:00PM, Lieutenant FINCHER called DAVIS and stated that Chief VASQUEZ was "pissedll and Lieutenant FINCHER and Sergeant HOWARD were going to speak with DOE (Pseudonym). Later, DOE (Pseudonym) called DAVIS about the meeting with Lieutenant FINCHER and Sergeant HOWARD. DOE (Pseudonym) was scared. DOE (Pseudonym) stated Lieutenant FINCHER and Sergeant HOWARD had told DOE (Pseudonym) that VASQUEZ might call a press conference and then the people DOE (Pseudonym) had provided information about might find out about DOE (Pseudonym) assisting narcotics. DAVIS provided Ranger Shawn PALMER with a typewritten statement hereafter identified as EXhibit #1.19. DAVIS also provided Ranger Shawn PALMER with three (3) pages of yellow notebook paper with handwritten notes hereafter identified as Exhibit #1.20.

Approximately ten (10) minutes later Sergeant DIETZ called BALDWIN and DIETZ asked to meet with BALDWIN. DIETZ met with BALDWIN in BALDWIN'S office. DIETZ told BALDWIN that a female complainant had called in an assault and the suspect was Chief Tim VASQUEZ. DIETZ and BALDWIN walked over to the Communications Center and listened to the call. BALDWIN told DIETZ to go meet with the complainant. B. Approximately one (1) hour later DIETZ returned to BALDWIN'S office. DIETZ told BALDWIN the female complaint did not want to file charges but wanted the incident documented. The female complainant had told DIETZ she (complainant) spoke with VASQUEZ at the Oasis. The two (2) spoke about the election and Jeff DAVIS. The female complainant had told DIETZ that VASQUEZ grabbed her (complainant) ass and walked off. DIETZ and BALDWIN met with Chief VASQUEZ and Assistant Chief Robert MARTINEZ in the Chief's office. BALDWIN told VASQUEZ about the allegation and then DIETZ discussed the specifics of the allegation. VASQUEZ stated he had been at the Oasis but denied grabbing the female complainant's ass. VASQUEZ asked BALDWIN and DIETZ if they knew who the female complainant was. VASQUEZ then told them the complainant was an informant for narcotics. They discussed how the complaint would be handled. VASQUEZ stated they would make a report and he was going to put all the information about the complainant being an informant and her association to Jeff DAVIS in the report. BALDWIN tried to discourage VASQUEZ from including information about the complainant being an informant for DAVIS. VASQUEZ stated if she (complainant) was going to make the allegation then he (VASQUEZ) was going to give up the information about her being an informant and her ties to DAVIS. VASQUEZ asked BALDWIN and DIETZ to step out of the office. Later, VASQUEZ asked BALDWIN and DIETZ to return. VASQUEZ discussed DIETZ going back out to talk to the complainant and telling the complainant about the issue of her being an informant and the possible dangers involved in her being named in a report. BALDWIN tried to discourage this approach. BALDWIN suggested DIETZ present the complainant with external complaint forms. BALDWIN stated there had to be some type of investigation done.

A. DIETZ left to meet with the complainant. DIETZ had difficulty meeting with the complainant. Between 5:00PM and 5:30PM, DIETZ called back and told BALDWIN the complainant was not interested in completing the external complaint forms. DIETZ returned to the station and met with BALDWIN, MARTINEZ and VASQUEZ in the Chief's office. At some point, VASQUEZ had called the San Angelo City Legal Department. VASQUEZ discussed someone from Lubbock conducting an investigation. VASQUEZ also discussed someone talking to the complainant to see if she still wanted the incident reported. BALDWIN told VASQUEZ he (BALDWIN) disagreed with that idea. VASQUEZ discussed the situation with the complainant being an informant and her possibly being in danger if this information was put out. BALDWIN waited until around 6:30PM and then went horne. B. On Tuesday 08-21-2007, at approximately 8:30AM, BALDWIN asked VASQUEZ about the situation and VASQUEZ told BALDWIN that everything had been taken care of. On Friday 08-242007, BALDWIN received an e-mail from Lieutenant Curtis MILBOURNE. The e-mail had attachments which included a request for records filed by C.L.E.A.T. On Monday 08-272007, VASQUEZ told BALDWIN that a report about he allegation filed by the complainant would be written. There was discussion about how the report would be written. VASQUEZ wanted the report put in the computer in a way that it could be locked and only accessed by limited personnel. On Tuesday 08-28-2007, BALDWIN, DIETZ, Assistant Chief Kevin HOLLWAY, Lieutenant FINCHER, Sergeant HOWARD and VASQUEZ met in the Chief's office. There was more discussion about how the report would be written. Lieutenant FINCHER was upset and concerned about making ties to the complainant being an informant anywhere in the report. FINCHER, HOWARD and HOLLWAY all agreed the information about the complainant being an informant should not be detailed in the report as this could burn the informant. The use of a PseudonYm form was discussed. VASQUEZ said to use the form. It was discussed that VASQUEZ would write a supplement report. BALDWIN was not aware of another situation in which an officer wrote a supplement report in response to a criminal allegation against him.

Ranger Shawn PALMER replied to the e-mail asking for assistance locating the section which covers disciplinary action taken for disclosure of information.

On Friday 09-21-2007, at approximately 7:51AM, Ranger Shawn PALMER received a second e-mail from Sergeant Victor VASQUEZ which included additional policy information. The additional information did not appear to contain any specific policy detailing disciplinary action taken for disclosure of information. A printed copy of the second email from Sergeant Victor VASQUEZ is hereafter identified as Exhibit #1.29.

1.49 On 09-21-2007, at approximately 7:33PM, Ranger Shawn PALMER interviewed Sergeant Fred DIETZ, WjM, DOBj 01-24-1964. DIETZ stated the following: A. On 08-20-2007, at 11:22AM, DIETZ was contacted by communications in reference to an assault report. Communications requested DIETZ contact them by telephone. DIET~ contacted communications by telephone and learned the suspect was Chief Tim VASQUEZ. DIETZ contacted his supervisor LieutenantLes BIRD. Lieutenant BIRD directed DIETZ to contact Sergeant Matt BALDWIN. DIETZ met with BALDWIN and both reviewed the recorded call. DIETZ then met with the female complainant. The female complainant immediately told DIETZ she (complainant) did not want to file any charges and that she just wanted to make a report. The complainant described the alleged incident between her and VASQUEZ and stated during the incident VASQUEZ grabbed her (complainant) buttocks. DAVIS or her status as an informant. DIETZ had his in car video equipment activated during the contact with the complainant. B. DIETZ returned to the station and met with BALDWIN, Chief VASQUEZ and Assistant Chief Robert MARTINEZ in the Chief's office. BALDWIN started discussing the allegation and then directed DIETZ to describe the allegation to VASQUEZ. VASQUEZ stated he (VASQUEZ) recalled being confronted by the complainant at the Oasis Club. VASQUEZ denied grabbing the complainant's buttocks. VASQUEZ stated that during the incident he (VASQUEZ) recognized the complainant as a documented informant working for Jeff DAVIS. VASQUEZ was very angry about the allegation made by the complainant. VASQUEZ said something about it not being right that the complainant could get away with making the allegation. VASQUEZ discussed not writing a report about the incident. MARTINEZ, BALDWIN and DIETZ all agreed it should not be handled that way. VASQUEZ stated he (VASQUEZ) wanted the information about the complainant being an informant for DAVIS included in the report. VASQUEZ wanted the report to include the fact the allegation was political. MARTINEZ, BALDWIN and DIETZ told VASQUEZ they were not sure the information about the complainant being an informant could be included in the report. VASQUEZ was mad and said he didn't care what happened to the complainant because it wasn't fair that she could make the allegation against him. DIETZ thought VASQUEZ was just blowing off steam and he would not end up putt~ng this information in the report. DIETZ told VASQUEZ he (DIETZ) was going to meet with the complainant about completing external complaint forms. VASQUEZ told DIETZ to let the complainant know that his (VASQUEZ) side of the story would be included in the report.

1.50 DIETZ further stated: A. DIETZ met with the complainant to discuss the external complaint form. The complainant told DIETZ she did not want to complete the external complaint form and DIETZ' report should be good enough. DIETZ told the complainant that he would document what both the complainant and VASQUEZ told DIETZ about the incident. office. VASQUEZ told DIETZ to hold off writing the report until they heard back from Lieutenant FINCHER. VASQUEZ said hopefully the complainant would not want a report written. BALDWIN said something about not caring whether the complainant wanted a report or not he (BALDWIN) thought a report should be written. At approximately 7:43PM, DIETZ received a call from Lieutenant FINCHER. FINCHER told DIETZ the complainant would be calling DIETZ shortly. The complainant called DIETZ and told him phe (complainant) did not want a report written until she had spoken to her attorney. At approximately 10:30PM, DIETZ received a call from the complainant. The complainant told DIETZ she wanted to drop everything and she did not want a report written. DIETZ related the information to VASQUEZ. B. On Tuesday 08-28-2007, DIETZ was off duty but was contacted by Robert MARTINEZ. MARTINEZ directed DIETZ to go to the station and said something about there being a change in the way they were going to handle the allegation made by the complainant. DIETZ went to the station and met with MARTI~EZ, VASQUEZ, BALDWIN, Lieutenant FINCHER, Sergeant HOWARD and Assistant Chief Kevin HaLLWAY in the Chief's office. VASQUEZ stated some things had come up in reference to the allegation made by the female complainant and he (VASQUEZ) wanted a report written. VASQUEZ stated DIETZ would do the original report. VASQUEZ later told DIETZ to list VASQUEZ as the complainant and list the female as an nother" on the report. DIETZ asked VASQUEZ if he (VASQUEZ) wanted DIETZ to include the information about the female being an informant for Jeff DAVIS. VASQUEZ said yes but said the female would be listed by a Pseudonym name. VASQUEZ told DIETZ to use the PseudonYm form because ,he (VASQUEZ) wanted to protect the female. DIETZ had never completed a pseudonYm form and asked records clerk Charla OWENS for assistance. VASQUEZ told DIETZ to type the report on a computer in Dustin HALL'S office.

1.51 DIETZ provided

Ranger Shawn PALMER with a typewritten statement hereafter identified as Exhibit #1.30. A copy of the report completed by DIETZ was attached to the typewritten statement. the time period that Ranger Shawn PALMER was meeting with DIETZ, he (PALMER) received several telephone calls from DOE (Pseudonym). DOE (Pseudonym) was upset because her teenage daughter had gone missing from their residence. DOE (Pseudonym) later called Ranger Shawn PALMER after locating the daughter.

1.53 On 09-27~2007,

at approximately 3:10PM, Ranger Shawn PALMER interviewed Communications Supervisor Willie Georgana KENNEDY, W/F, DOB/01-06-1967. 'KENNEDY stated the following:

A. KENNEDY was on duty on 08-20-2007. Dispatcher Erica MANLEY contacted KENNEDY in reference to a call. MANLEY told KENNEDY that she (MANLEY) had taken a call in reference to a sexual assault and the suspect was Chief Tim VASQUEZ. Officer Chris $OTO had dispatched the call to Sergeant DIETZ. A short time later DIETZ, Sergeant BALDWIN and Sergeant Victor VASQUEZ came in the dispatch area to listen to the call MANLEY had taken. The following morning, Sergeant VASQUEZ told KENNEDY that Chief VASQUEZ wanted to see KENNEDY. KENNEDY and Sergeant VASQUEZ walked over to the Chief's office. Chief VASQUEZ and Assistant Chief MARTINEZ were inside. Chief VASQUEZ told KENNEDY that she was there in reference to the incident that was reported. Chief VASQUEZ stated there had been some rumors going around and someone had spoken to Sergeant DIETZ about the call. Chief VASQUEZ said the allegation was unfounded and the woman had recanted. Chief VASQUEZ described the incident. B. Chief VASQUEZ said if he found out who is talking about it then he was going to fire them on the spot. KENNEDY was surprised and a little scared to hear the Chief say this .. KENNEDY provided Ranger Shawn PALMER with a typewritten statement hereafter identified as Exhibit #1.37.
