Each year IEC releases its scorecard of important environmental votes in order to educate the public about their elected official’s voting record in Springfield. This year’s scorecard is particularly indicative of our success in Springfield. Our biggest issues where a vote was taken passed with nearly unanimous support with bi-partisan, geographically diverse leadership. Both recreation liability (SB1042) and fracking regulation (SB1715) were priorities for the environmental community and passed nearly unanimously. I want to caution, however, that because of our successes on priority legislation, this year’s score card is not as representative of relative environmental voting strength as previous years. Because so many environmental bills passed with unanimous support, the distinction between legislators who did and did not vote our way on bills that are not top priorities may appear overstated. Two examples of bills passing with unanimous support: •

This year the environmental community passed a bill to bring back recreation liability protections for private landowners who open their land to the public for recreation, conservation, and education. After Senator Harmon and our conservation groups worked hard to come up with language to which all parties agreed, this bill passed both chambers unanimously.



We also include in this scorecard the vote on SB1715, a regulatory bill on hydraulic fracturing. While a moratorium is the safest and best result to regulate hydraulic fracturing, IEC supported this negotiated bill

because it achieved not only the strongest regulatory standards on mining in Illinois, but also the most comprehensive legislation in the nation. Therefore, while we considered a “yes” vote supportive of environmental regulation, we did not want to penalize legislators that felt the bill did not go far enough to protect the environment. For this bill, we also awarded a point to legislators that signed on as a sponsor of the moratorium bills – SB1418 and SB630 in the Senate and HB3086 in the House. Scorecards aren’t perfect. They are snapshots of the complicated politics of the state legislature. There is a great deal that happens in the General Assembly that can’t be measured in a vote chart. It is particularly hard to reward legislators who sponsor bills or take positive environmental votes in committee on legislation that never makes it to the floor. Additionally, even though IEC works very hard to make our position on these environmental bills known, we are competitive with other sources to get our message to legislators. This scorecard is provided as an informational service to our members and affiliates. We encourage our supporters to keep up to date on the weekly environmental news that IEC provides during session to get a clearer picture of the legislature’s work. The environmental community is also grateful to the Illinois Legislative Green Caucus – particularly chairs Rep. Ann Williams, Rep. Mike Fortner, Sen. Heather Steans, and Sen. Pam Althoff – for their organizing and support around environmental issues. Explanation of Scoring For each bill, legislators are evaluated on whether they voted with the pro-environment position (“+”) on the bill or against it (“-“). For bills that the environmental community supports, a YES vote is a + and a NO vote is a -. For bills that are opposed, a NO vote is a + and a YES vote is a -. The votes are then tallied and an overall score is calculated. For instance, someone who voted pro-environment on six bills and against on four bills is given a 60% score. The only votes not counted are those when a legislator had an excused absence (noted in the chart as “A”), which generally meant that the legislator was not in Springfield on that day due to an illness or other unexpected circumstances. Legislators who had excused absences were scored according to the other votes they cast. In the House, We only awarded our 100% award to legislators on this scorecard that were present and voted for at least 6 of the 8 bills scored in each chamber. Two other voting possibilities are included. On occasion, a legislator may vote “Present,” which is essentially an abstention. We have counted these votes the same as a no vote on the bill because the impact on the bill’s potential to pass is the same as if that legislator had voted no. These are shown in the voting chart as “P” and counted the same as a “+” when it helps the pro-environment position, and shown as “p” and counted as “-“ when it hurts. Similarly, when a legislator is in Springfield but does not vote on a bill, we have counted it the same as a “no” vote on the bill. This is noted in the chart as “NV” and counted the same as a “+” when this action supports the pro-

environment position. It is noted as “nv” and counted as “-“ when it does not support the pro-environment position. Legislators have many reasons for voting “Present” or for not voting at all. They may vote “Present” because of a philosophical conflict on the issue, or simply because they don’t want to commit publicly one way or the other. They may miss a vote because they were in an important meeting, were in the bathroom at the time of the vote, or were at their desk but decided not to vote. Regardless of the reason, all of these actions have significant consequences for whether or not a bill passes, and therefore we have decided that it is appropriate to hold legislators accountable for their actions whatever they may be. We recognize that there is some unfairness between the chambers in this scoring because the Senate does not regularly give excused absences on a vote. Because it is not possible to tell whether a legislator was a way for an excused reason or not, we have decided to score “Not Voting” the same way in each chamber. While the environmental community supported SB1715, the hydraulic fracturing regulatory bill this year, the safest and best solution to this issue is a moratorium on fracking. Because of this, if a legislator voted no or present on SB1715 because they felt the bill was not strong enough, we awarded them a point in the House if they also co-sponsored HB3086 and in the Senate if they voted YES on the vote taken on SB630 – a motion to adopt the moratorium amendment to a shell bill. HB1522 creates a new financial tool for Peoria and DuPage counties to manage stormwater, including providing incentives for green stormwater infrastructure. HB1522 passed the House by a vote of 79-31 and the Senate by 38-11.

SB1715: Hydraulic Fracturing Regulatory Act Sponsors: Sen. Michael Frerichs and Rep. John Bradley SB1715 provides regulation of high volume horizontal hydraulic fracturing. This bill requires public notice, provides for transparency, and establishes legal standing to challenge fracking operators. SB1715 passed the House by a vote of 108-9 and the Senate 52-3-4

SB1042: Recreation Liability Sponsors: Sen. Don Harmon and Rep. Ann Williams SB1042 provides liability exemptions to private landowners who open their land to the public for recreation, conservation, and education, providing an incentive to open more natural areas to the public.
