Sky Zone, LLC, et al.: Docket No. BURL-L-2453-15 There has been a proposed Settlement of claims against Sky Zone, LLC, Sky NJ, LLC and Sky Zone Franchise Group LLC and their affiliated companies (“Sky Zone”). The Settlement would resolve claims against Sky Zone in a lawsuit in which the Lead Plaintiff alleges that the Sky Zone Participant Agreement contained a release of liability provision which requires the class member to waive certain rights which plaintiffs allege violates the New Jersey Truth in Consumer Contract Warranty and Notice Act. Sky Zone disputes this allegation. You received this because you or someone in your family may have entered into a Participant Agreement, Release of Liability and Assumption of Risk at a Sky Zone facility located in New Jersey at one of the following locations: Moorestown/Maple Shade; Ocean Township; Allendale; Mt. Olive; South Plainfield; Pine Brook; and Lakewood between June 20, 2014 and June 6, 2017, inclusive. The Court has not ruled on the merits of any claim or defense. Instead, the parties have compromised and entered into the proposed settlement. Under the Settlement Agreement, if finally approved by the Court, Sky Zone has agreed to provide one (1) coupon per class member that would provide for 60 minutes of free-style jumping at a Sky Zone facility (listed above), that would be redeemable within six (6) months and would be subject to time and use restrictions as set forth in the coupon. All administrative expenses, attorney’s fees and expenses awarded by the Court, if any, and the Class Representative Incentive awarded by the Court will be paid by Sky Zone. The Stipulation and Agreement of Settlement, available by request, describes all of the details of the proposed Settlement.
