I realize that Solstice Chase Fat Bike Race is a winter cycling event, that frigid cold weather, snow, and ice likely will be present - and I am responsible for taking care of myself and navigation on the event course. I realize that cycling is a dangerous sport and can cause death, injury, and property damage. I promise to assume these risks, release, hold harmless, and waive any and all race promoters, volunteers, and any associated organizations. WAIVER AND RELEASE AGREEMENT Assumption of Risk: I understand and accept that participating in the Solstice Chase Fat Bike Race exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in the Solstice Chase Fat Bike Race. I choose to participate in the Solstice Chase Fat Bike Race in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of participating in the Solstice Chase Fat Bike Race. I understand the inherent risk involved in participating and accept full responsibility for any and all such damage or injury which may result. I specifically release and forever discharge Cyclova XC & Big Rock Creek Farm (also known as Big Rock Creek Retreat), and their affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while participating in Solstice Chase Fat Bike Race. I also specifically release and forever discharge event operators, organizers, contractors, and volunteers. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by any party while participating in any of the events in the Solstice Chase Fat Bike Race. It is my intent by the Waiver And Release Agreement to release Big Rock Creek Farm and/or Cyclova XC as well as the individual operators, organizers, volunteers and promoters of the Solstice Chase Fat Bike Race and hold them harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am participating in the Solstice Chase Fat Bike Race, I will have no right to make a claim or file a lawsuit against the Big Rock Creek Farm and/or Cyclova XC or its affiliates, officers, agents or employees, and/or any of the operators, organizers, volunteers and promoters of the Solstice Chase Fat Bike Race. I further agree to indemnify the Big Rock Creek Farm, and/or the operators, organizers, volunteers and promoters of the Solstice Chase Fat Bike Race as well as Cyclova XC and its affiliates, officers, agents, and employees for any claims and the cost of defending any claims in connection with my participation in this event.
