SURPLUS​ ​DISTRICT​ ​LAND​ ​AND​ ​BUILDINGS Background Land​ ​and​ ​buildings,​ ​when​ ​no​ ​longer​ ​utilized​ ​by​ ​the​ ​District,​ ​may​ ​be​ ​declared​ ​surplus​ ​in​ ​order​ ​to minimize​ ​costs​ ​and​ ​receive​ ​a​ ​recovery​ ​on​ ​the​ ​District’s​ ​initial​ ​investment. Procedures 1. Where​ ​practical​ ​or​ ​financially​ ​viable,​​ ​District​ ​property​ ​will​ ​be​ ​re-used​ ​or​ ​leased. 2. Encumbering​ ​or​ ​disposing​ ​of​ ​land​ ​or​ ​buildings​ ​requires​ ​the​ ​approval​ ​of​ ​the​ ​Board. 3. Prior​ ​to​ ​recommending​ ​encumbering​ ​or​ ​disposing​ ​of​ ​surplus​ ​District​ ​land​ ​and​ ​buildings​ ​to​ ​the Board,​ ​the​ ​Chief​ ​Superintendent​ ​will​ ​ensure​ ​through​ ​the​ ​Secretary-Treasurer​ ​and​ ​the Superintendent,​ ​Support​​ ​Services​​ ​that: 3.1

The​ ​School​ ​Act​ ​and​ ​Provincial​ ​regulations​ ​are​ ​followed;

3.2

District​ ​enrollment​ ​trends​ ​within​ ​the​ ​area​ ​intended​ ​to​ ​be​ ​served​ ​by​ ​District​ ​surplus lands​ ​are​ ​considered;

3.3

District​ ​student​ ​accommodation​ ​and​ ​transportation​ ​issues​ ​are​ ​addressed;

3.4

Consideration​ ​is​ ​given​ ​to​ ​whether​ ​a​ ​school​ ​on​ ​the​ ​surplus​ ​lands​ ​is​ ​included​ ​in​ ​the Board’s​ ​capital​ ​plan;

3.5

Consultation​ ​occurs​ ​with​ ​other​ ​school​ ​boards​ ​with​ ​respect​ ​to​ ​their​ ​needs​ ​for​ ​the surplus​ ​lands;

3.6

District​ ​administrative​ ​procedures​ ​are​ ​followed;

3.7

Conditions​ ​of​ ​applicable​ ​sections​ ​of​ ​the​ ​Joint​ ​Use​ ​Agreement​ ​are​ ​met;

3.8

A​ ​cost​ ​benefit​ ​analysis​ ​supports​ ​the​ ​recommendation;​ ​and,

3.9

The​ ​sale​ ​price​ ​is​ ​determined​ ​by​ ​appraised​ ​value​ ​and​ ​market​ ​conditions.
