2.1 On Monday 10-01-2007,

at approximately 3:14PM, Texas Ranger Lieutenant Shawn PALMER interviewed Erica Leigh MANLEY, WfF, DOB/ 06-02-1985. MANLEY .stated the following: A. MANLEY is employed as a dispatcher for the San Angelo Police Department. Approximately one (I) month prior to the interview, MANLEY was on duty and received a call from a female subject (Jane DOE (PseudonYm). The female subject stated she had been assaulted at the Oasis. The female subject identified the suspect as Chief Tim VASQUEZ. MANLEY notified San Angelo Police Department Sergeant Fred DIETZ about the call. MANLEY also notified her (MANLEY) supervisor Georganna KENNEDY. B. One (1) or two (2) days later, San Angelo Police Department Sergeant Victor VASQUEZ notified MANLEY that Chief VASQUEZ wanted to speak to MANLEY. MANLEY and Sergeant VASQUEZ met with Chief VASQUEZ and Assistant Chief Robert MARTINEZ. Chief VASQUEZ wanted to tell MANLEY his (VASQUEZ) side of the story and Chief VASQUEZ wanted to make sure the particulars of the call did not get out. that was caught talking about the call. Chief VASQUEZ told MANLEY the allegation was due to the upcoming election. Chief VASQUEZ stated Detective Jeff DAVIS was running against the Chief and the woman who made the allegation was an informant for Detective DAVIS. The Chief felt that was the reason the call was made. Chief VASQUEZ asked MANLEY about why MANLEY had asked the female complainant if she had already spoken to someone. After MANLEY explained why. MANLEY had asked that, the Chief said that detectives had questioned the female complainant. The Chief said that after the detectives questioned the female complainant she no longer wanted to go forward and she wanted to drop all charges. The Chief said the detectives who questioned the female believed she had spoken to someone beforehand. MANLEY provided Ranger Shawn PALMER with a typewritten statement hereafter identified as Exhibit #2.1.

2.2 On Tuesday,

10-02-2007, at approximately 9 :OOAM, Ranger Shawn PALMER interviewed Sergeant Fred DIETZ. DIETZ had previously contacted Ranger Shawn PALMER by telephone in reference to a typed document Chief VASQUEZ had given Sergeant DIETZ. DIETZ stated that on Friday, 09-29-2007, DIETZ found a seven (7) page typed narrative, which appeared to have been prepared by Chief VASQUEZ. DIETZ noticed there were two (2) copies of the first page of the narrative. One (1) of these copies of the first page had handwritten notes on it. DIETZ recalled being provided with the printed narrative after a meeting in which Chief VASQUEZ told DIETZ and other officers that a report would be written about the incident. Ranger Shawn PALMER asked DIETZ the following questions and DIETZ provided the following answers: Question: Did Chief VASQUEZ tell you to treat the allegation by DOE (PseudonYm) like any other Class C on an officer and not do anything differently? Answer: There was some discussion about handling the allegation like a normal Class C but in the end that is not how the Chief wanted it handled. Question: After DOE (PseudonYm) asked you to wait to write a report until after she spoke to her attorney, did Chief VASQUEZ tell yOU" that you could get started on your report 10/28/200710:14:31

Answer: No. I (DIETZ) think Chief VASQUEZ told me (DIETZ) to have all my information available in case I needed to do a report the following morning, but he did not tell me (DIETZ) that I could start a report.

2.3 DIETZ provided

Ranger Shawn PALMER with a typewritten statement (Exhibit #2.2) and the typed narrative which VASQUEZ had given DIETZ (Exhibit #2.3).

2.4

On 10-02-2007, at approximately 10:00AM, Ranger Shawn PALMER contacted Assistant United States Attorney Jeff HAAG. HAAG stated he (HAAG) had been contacted by Chief VASQUEZ in reference to the allegation made by Jane DOE (PseudonYm). Chief VASQUEZ told HAAG about a request for records filed by the Combined Law Enforcement Association of Texas (C.L.E.A.T.). HAAG reviewed the C.L.E.A.T. request. HAAG determined the information requested by C.L.E.A.T. did not appear to identify DOE (Pseudonym) as an informant. HAAG spoke with a representative of the San Angelo City Legal Department. HAAG requested that reports related to the pending Federal Court cases not be released. Later, Chief VASQUEZ contacted HAAG. HAAG told Chief VASQUEZ that fulfilling the request from C.L.E.A.T. would be alright.

2.5 On 10-02-2007,

at approximately 1:25PM, Ranger Shawn PALMER interviewed San Angelo Police Department Assistant Chief Kevin HaLLWAY, W/M, DOB/ 05-21-1957. HOLLWAY stated the following: A. Around August HaLLWAY was at work and noticed there appeared to be individuals inside Chief VASQUEZ' office with the door closed. HOLLWAY noticed Assistant Chief Robert MARTINEZ and Sergeant Matt BALDWIN were among those coming or going from the Chief's office. HOLLWAY asked MARTINEZ what was going on and MARTINEZ told HOLLWAY a woman had made an allegation against the Chief. HOLLWAY asked MARTINEZ what type of allegation and MARTINEZ told HOLLWAY the allegation was that the Chief had grabbed the woman's butt. Around the next day or the day after that HOLLWAY sat in on a discussion in the Chief's office with the Chief, Lieutenant Tracy FINCHER and Sergeant David HOWARD. and the fact the complainant was an informant. There was discussion about a press release and about protecting the complainant's identification. There was discussion about the use of a Pseudonym form. HOLLWAY was initially told the female complainant had decided she did not want a report completed in reference to the incident. B. HOLLWAY was also present during a discussion in which Chief VASQUEZ discussed that information about the alleged incident had been provided to the media and there was media attention. Chief VASQUEZ stated he (Chief) wanted a report written about the incident. Chief VASQUEZ ordered all officers who were involved to write reports or report supplements. There was discussion about Chief VASQUEZ doing a report of some type. There was also discussion about completing a false report to a peace officer report. In one of the discussions Lieutenant FINCHER and Sergeant HOWARD discussed not releasing information about the complainant who was an informant. There was discussion about not thinking the fact the complainant was an informant should be in the report. The Chief discussed something about being able to tell his side of the story.

2.6 Ranger Shawn PALMER noticed HOLLWAY appeared

evasive. Ranger Shawn PALMER began a question and answer type interview with HOLLWAY. The questions asked by Ranger Shawn PALMER and the answers given by HOLLWAY included the following: Question: Did you think that the fact the female complainant was an informant should have been in a report? 2.7 On wednesday,

10-03-2007, at approximately 10:52AM, Ranger Shawn PALMER interviewed San Angelo Police Department Sergeant David HOWARD, WIM, DOBI 03-21-1965. Present during the interview was attorney Bob GORSKY. HOWARD provided Ranger Shawn PALMER with three (3) pages of typewritten notes related to the events that followed the reported incident involving San Angelo Police Department Chief Tim VASQUEZ and Jane DOE (Pseudonym). Said typewritten notes are hereafter identified as Exhibit #2.6. HOWARD also provided Ranger Shawn PALMER with one (1) printed e-mail from Jeff HAAG (Exhibit #2.7), one (1) photocopy of a CLE13A (Exhibit #2.8) and one (1) printed e-mail from Chief Tim VASQUEZ (Exhibit #2.9). HOWARD stated that approximately one and a half (1 1/2) years ago HOWARD assisted with a narcotics investigation in which Jane DOE (Pseudonym) was a suspect. HOWARD reviewed a telephone call from the Tom Green County Jail during which DOE (Pseudonym) stated something about going to hang out with her cop friends at the Oasis. Ranger Shawn PALMER also conducted a question and answer interview of HOWARD. The questions asked by Ranger Shawn PALMER and the answers given by HOWARD included the following: Question: During the meeting on 08-28-2007 in the Chief's office, did the Chief ever express a concern for the safety of the fe~ale C.l. 2.8 On 10-03-2007,

at approximately 2:13PM, Ranger Shawn PALMER interviewed San Angelo Police Department Lieutenant Tracy FINCHER, W/M, DOB/ 06-26-1970. Attorney Bob GORSKY was present during the interview. FINCHER provided Ranger Shawn PALMER with four (4) pages of typewritten notes (Exhibit #2.11), two (2) pages of a typewritten narrative for FINCHER'S report (Exhibit #2.12), one (1) page of a typewritten narrative for Sergeant HOWARD'S report (Exhibit #2.13) and three (3) pages of Treo telephone message information (Exhibit #2.14). Lieutenant FINCHER provided Ranger Shawn PALMER with a typewritten statement hereafter identified as Exhibit #2.15.

2.9 On Thursday,

10-04-2007, Ranger Shawn PALMER contacted Assistant Chief Robert MARTINEZ by telephone. MARTINEZ had left a voicemail message requesting Ranger Shawn PALMER contact him. MARTINEZ stated he (MARTINEZ) wanted to be sure Ranger Shawn PALMER was aware of the threat information directed towards Jane DOE (Pseudonym) which was listed in a printed e-mail (Exhibit #1.7) previously provided by MARTINEZ. Ranger Shawn PALMER informed MARTINEZ that he (PALMER) had already followed up on the threat information. Ranger Shawn PALMER then asked MARTINEZ what had been done by MARTINEZ or any other administrative personnel to follow up on the threat information. MARTINEZ stated nothing had been done by him or other administrative personnel. MARTINEZ then stated he (MARTINEZ) had reviewed the information provided in his typewritten statement. MARTINEZ was concerned about questions Ranger Shawn PALMER had about Chief VASQUEZ releasing information about Jane DOE (Pseudonym) being an informant. MARTINEZ stated he (MARTINEZ) had recalled that on 08-20-2007, Chief VASQUEZ was upset and made outbursts related to Jane DOE (Pseudonym) and the allegation. MARTINEZ stated Chief VASQUEZ had stated something about Jane DOE (Pseudonym) not meaning anything or she was not important. MARTINEZ agreed to meet with Ranger Shawn PALMER at a later date to provide a follow up statement to clarify this information. Ranger Shawn PALMER utilized a digital audio recorder to audio record the conversation with MARTINEZ. Said digital audio recording is hereafter identified as Exhibit #2.16.

2.10 On Friday, 10-05-2007,

at approximately 3:00PM, Ranger Shawn PALMER traveled to the San Angelo Police Department Communications Center to oversee the recovery of computer data from COIpputer equipment recovered from Chief Tim VASQUEZ. Ranger Shawn PALMER had previously spoken to San Angelo Assistant City Attorney Teresa SPECIAL. SPECIAL had obtained written consent from VASQUEZ, which authorized Ranger Shawn PALMER to participate in the recovery of the data. SPECIAL had indicated Chief VASQUEZ would be present. Information Technology Department for the City of San Angelo. EADES informed Ranger Shawn PALMER that VASQUEZ would not be present (or the recovery of the data. EADES recovered VASQUEZ' e-mail information from the server. Ranger Shawn PALMER scrolled through the folder containing the e-mails to attempt to identify any dates or subject information related to Jane DOE (Pseudonym)". Ranger Shawn PALMER did not open or highlight any e-mails to read the contents. Ranger Shawn PALMER did note that there were several e-mails which had subject information which appeared to be related to some type of campaign and also the music band which VASQUEZ plays in. Wayne GILLEY arrived and recovered the hard drive from the desktop computer CPU recovered from VASQUEZ' office. GILLEY informed Ranger Shawn PALMER that on 10-03-2007, someone had successfully logged into VASQUEZ' e-mail account from a computer assigned to VASQUEZ' secretary Sherrie ZESCH. GILLEY and Teresa SPECIAL recovered ZESCH'S computer from the San Angelo Police Department.

2.11 On Sunday,

10-07-2007, at approximately 3:15PM, Ranger Shawn PALMER contacted Sherrie ZESCH by telephone. ZESCH stated she had not logged into Chief VASQUEZ' e-mail on 10-032007. ZESCH stated she has never logged into Chief VASQUEZ' e-mail from her computer. ZESCH stated that when VASQUEZ has requested that she review his (VASQUEZ) e-mail ZESCH uses the computer in VASQUEZ' office. ZESCH believed that on 10-03-2007, she' (ZESCH) left work at approximately 2:00PM and did not return until approximately 4:30PM. ZESCH stated during that time her computer remained logged on.
