Please take your seats. Okay. Good evening, everyone. Welcome to the special meeting with the Village of Woodbury Board of Trustees. My name is Tim Egan. I'm the Deputy Mayor of the Village of Woodbury. On tonight's agenda we have a public hearing on a resort gambling facility by Caesars Entertainment and Flaum Management Company, the details of which will be read by our attorney in a few minutes. Before we get started with the meeting, though, please note the nearest emergency exits, there's some in the back there, a couple in the corner here, as well. Also, please turn off, or silence, your cell phones for this public hearing. I would also like to take this opportunity to thank the IBEW for the use of their facility. It's a wonderful facility, and we really appreciate them letting us use it tonight. Will you please rise for the Pledge of

To get started, I would like to introduce our board members present. On my far left is Trustee David Sutz. Next to him is Trustee Neil Crouse. To my immediate left is Trustee Tom Flood. My name is Tim Egan, Deputy Mayor. To my immediate right is Rick Golden, our counselor. To his right is Dennis Lindsay, our village attorney -- I'm sorry, village engineer. My bad. Also with us tonight is Town of Woodbury Supervisor John Burke, Village of Harriman Mayor Steve Welley, Town Councilman Bob Hunter, Town Councilwoman Marilyn Prestia, Katie Bonelli, who is a County Legislature, and on behalf of Steve Neuhaus, the County Exec, representing him is Harry Poor. DEPUTY MAYOR EGAN: Before we commence with the reading of the public notice and the presentation by Caesars, I want to place this hearing in the context of an upcoming decision to be made by the Village of Woodbury Board of Trustees to take place on June 12th. A similar process will be undertaken by the Town of Woodbury Town Board later this month, or early next month. In 2013, Governor Cuomo signed into law the Upstate New York Gaming Economic Development Act, which outlined the process and criteria for siting no more than four destination resort casinos within the state, including up to two resort casinos in our

Hudson Valley/Catskill Region, which includes Orange, Sullivan, Ulster, Dutchess, Columbia, Greene and Delaware Counties. For Caesars and those other casino developers that have paid their million dollar application fee to the state, there's a deadline of June 30th to submit their full proposal to the state. One condition of submitting such proposal is that each casino developer must obtain a Host Community Resolution of support of its application for a gaming license. This public hearing tonight is for the Village Board of Trustees to hear the public's comments prior to their making a decision whether to support Caesars submitting its application for a gaming license in Woodbury. It is anticipated that the site selection decisions for the four statewide casinos will be made sometime in November, although no firm date has been set yet. Sometime on or before that date, the State Gaming Commission will issue gaming licenses to those casinos selected and passing all the financial and other background checks by the state. It's important

to understand that if Caesars receives its host community support and is selected by the state siting board to construct a resort casino here in Woodbury, that approved casino use will still be otherwise subject to Woodbury's local zoning code, and will have to proceed through Woodbury's Planning Board process, including all environmental reviews, just like any other applicant in the village. At this point, I'll ask our counselor, Mr. Golden, to read the public hearing notice. MR. GOLDEN: "Notice of public hearing regarding a resort gambling facility by Caesars Entertainment Corporation and Flaum Management Company, Inc. proposed to be located in the Village of Woodbury, County of Orange, New York. Please take notice that on Thursday the 22nd Day of May 2014, at 7:00 p.m., or as soon thereafter as the matter can be heard, there will be a public hearing before the Board of Trustees of the Village of Woodbury, New York, at the IBEW Union Hall located at 67 Commerce Drive South, Harriman, New York, concerning a proposed application by Caesars Entertainment Corporation and Flaum Management Company, Inc.,

on a site of approximately a hundred and twenty-one acres, known as Parcel Site A on the Interchange Commerce Center Development, located east of New York State Route 17, between the Harriman Train Station to the south, and the former Nepera vacant property to the north, and known on the tax maps of the Village of Woodbury as Section 243, Block One, Lots One through Twenty-five. The purpose of this public hearing is, one, to have the applicants present to the Board of Trustees and the public, their proposal that includes a resort hotel, a casino gaming area, restaurants and convention center, and, two, for the Board of Trustees to make inquiry of the applicants, and to receive public input on that proposal. Speaking first tonight will be Asher Flaum, President of Flaum Management, and followed by Asher, will be Jan Jones, Executive Vice-president of Communications and Government Affairs, and Greg Miller, Executive Vice-president of Development from Caesars Entertainment. At this time I will turn it over to Asher. AHSER FLAUM: Thank you, Deputy Mayor, Village Trustees. Thank you all for having us, and thank you to the public for coming out this evening. I've been spending some time in Woodbury meeting people. It's been a great experience. I was here a couple of months ago for the first informal presentation, and tonight, I'm very -personally very excited about, and excited for the residents to hear the -- hear about the full project and to hear all the details that

everyone has really been -- been asking for, so, and also very proud and honored to be presenting Caesars Entertainment here this evening, Jan Jones Blackhurst, Greg Miller, Mike Saltzman, the Caesars team, they're here, my father, David Flaum, the CEO of Flaum Management. So, very exciting opportunity for myself and my family, and also for the residents of Woodbury. This is a once in a lifetime opportunity, and I think that, you know, this is -- this is a first class team, and you can't do better than Caesars Entertainment, world class leader in gaming, over forty-five million people in there Players Club, existing customers. So, this is -- this is a powerhouse group, and I just couldn't be more excited to, you know, be here together with them to, you know, discuss the project and fill everybody else in. So, without further ado, I guess Jan is going to take over, and thank you all for coming out, and here's Jan Jones Blackhurst from Caesars entertainment. Thank you.

Hollywood, among them, just to name a few. As Asher mentioned, we have forty-five million players in our customer loyalty system that we met in different places around the world, and come to visit us in all of our properties. We have nearly seventy thousand employees. We operate three hundred and ninety restaurants, bars and clubs, and we have celebrity chefs, including Guy Fieri, Gordon Ramsey and Bobby Flay. In fact, we are just operating a new restaurant at our most recent property, The Cromwell, welcoming Giaga from New York. We are forty-four thousand hotel rooms, three hundred and two retail shops, one point six million square feet of meetings and space for meetings and conferences, and we operate seven golf courses. And we say this, because we want you to understand, we are a true hospitality company. We've been in this business for decades. We know how to operate. We're good operators, and we enjoy the business that we're in. Caesars operates under what we call our code of commitment. The code of commitment is

JAN JONES: I need someone else to do the technology. Well, before we start, I just want to thank all of you for taking your time to come to this presentation tonight. We're very excited about the opportunity to be a partner with the City of Woodbury. I'd like to thank the Deputy Mayor and all of the trustees for hosting, and certainly Local 363 for the use of this absolutely splendid facility. I wanted to take some time tonight and really introduce you to who Caesars Entertainment is, the kind of company that we are, the principles that we stand for, and then talk about the project specifically, and then some of the benefits and concerns that the community may have as we move forward with the discussion around this project. Caesars Entertainment is the world's largest gaming entertainment company. We actually operate 53 casinos in a myriad of states, in five countries -- or seven countries and five continents. We have more than twenty black brands, including Caesars, Harrah's, Horseshoe, World Series of Poker, Planet

a code that we put in place over a decade ago, that's actually become the standard for the gaming industry, but we were the lead. The tenants of the code, the first is to our community, and the commitment to the community is that we will create vibrant jobs, careers, jobs that are high paying, and the benefit to people who live and work in that surrounding community. We have a commitment to our customers to be responsible to operate in the highest levels of integrity, and put in place responsible gaming programs that lead the industry. We have a commitment to code green, which is our sustainability programs, making sure that we give back to the community in terms of environmental awareness, and putting in place programs that do minimal negative impact in the community. And the final commitment is to give back, and not just give back with tax revenues that go into goods and services and education, but to give back philanthropically. We have hundreds of thousands of employee volunteer hours, and dollars that come into the community

where we do business, and we want you to understand that because when we come in, we're partners. We want to be your partner. We want to be a part of the community. We want to know what best suits you and how we can make sure that we deliver on all the promises we make. Before I get into some of the other specifics, we want to talk about the project itself, so we can address that, and to lead that discussion, I'd like to introduce you to Greg Miller, who is our Senior Vice-president of Development and in charge of this project. GREG MILLER: Thank you, Jan, and I'd like to echo Jan's thanks to the Board of Trustees, you, the residents of Woodbury and the surrounding communities, for coming here to listen to us, allowing us to share our ideas of the project, and, in fact, our company itself. We really haven't been formally introduced until today. So, as we go through the project itself, I think many of you are familiar, very familiar with the general site, but this will be the first time we've gone through in public with really the details of how we intend to develop

experience. As you look at the map up here on the bottom, you'll see the site that's been described, and consistent with the idea of a destination resort, what we're doing is, we're taking advantage of the topography that the site itself presents to us, and we are having a destination entry road toward the south end of the site, and while we haven't locked in the specific area, you can see it's about two-thirds of the way down there. Where somebody will come onto that road and really have the opportunity to come up through the natural terrain, and -- and have an entry into the -- the project itself, that we think will be very special and be fitting of the types of guests that we know will come here. The program that we're offering, as Asher had mentioned earlier, will be, and I think the Deputy Mayor mentioned in the proclamations, will include a luxury hotel component. We're planning on three hundred hotel rooms to start. That will include a very nice spa product that we've developed at Caesars Palace in Las Vegas and our other Caesars properties, we branded as

Caesars New York as a true destination resort, a destination for people who live here in the community, a place for people to go and simply have fun, as well as a destination for the customers that we have relationships with, both in the United States and overseas, to come and enjoy really everything that Woodbury and the surrounding area, combined with our entertainment offerings, have there. Jan had mentioned earlier, it's very important that as a company, we tend to have about 25 percent of the business in any one of our sites, comes from other properties where people have a relationship with us. We're -because of our geographic diversity that Jan referenced, we're the only company that's really able to have an experience with somebody in one market, and then offer them that same hospitality, and that same customer relationship with them, when they come to any of our other properties. So, as we look at Caesars New York here in Woodbury, we're thrilled with the potential to offer those guests and everybody in this community what we think will be a very special

Qua. It's really a very wonderful experience. We will have some small retail offerings. We certainly won't be able to compete with the extensive retail offerings around here, but resort type of retail. We will have a state of the art casino floor, befitting of the Caesars Palace brand, that takes into account everything that we, as a company, know how to offer great casino entertainment. We're going to develop a 20,000 square foot flexible meeting and entertainment facility for local meetings to occur, weddings, concerts, shows, that type of entertainment here. We found that to be very successful for us in many parts of the country. We're going to add about ten restaurants and bars to the project itself, and those are very important here. What we develop as a company, as a product, really is a mixed use entertainment destination. It's the casino, but it also has just great restaurants, great spas, great other offerings that I'm describing here. Our current plans show us also developing an outdoor amphitheater. So, we'll theme it

something in the Roman vernacular, and it will be an outdoor amphitheater that really will be a home for a wonderful summer concert series. Again, as we've gone throughout the country and done these things, we know that people really enjoy that type of entertainment, and it's something that's really fun for everybody involved, and it's good for our business. We also intend to develop a substantial parking structure, along with valet operations. We know that it's most convenient for our customers to have a structured parking, as opposed to a lot big surface parking around the facility. So, that's what we'll be offering here. So, again, as you look here, you can see those elements that I was just describing. You can see the hotel, you can see the portochere, the casino, the garage. All of that together is what we're going to propose as Caesars New York. As we as we think about translating that plan into design and architecture, obviously we have to be very respectful of just the surroundings and the area. So, as we work with

our architects, who've done a lot of great projects, both with us and companies like Disney, around the world, we really challenge them, how to you do something that works locally, but is sophisticated and is a place that tourists from around the world will want to come to, and what they've come up with and this is some inspirational imagery, is architecture from places like, I think it's Aspen up top here, or down below, other, other areas with similar terrain, and similar simply beautiful surrounding areas, where it combines natural materials, along with modern touches, to create a very sophisticated, and what we think will be a very wonderful destination. This is our first artist rendering of what the portochere area would be as people come up to Caesars to be dropped off at our valet, and come into either the hotel or into the casino itself. And again, as you walk into the casino area, it's going to be a very sophisticated, really high class quality casino, consistent with -- with our brand, our Caesars brand, that delivers that everywhere we do it.

Our guest rooms, again, will be at the level of quality that is needed to attract that type of tourist who we know travel with us. For the customer we have who lives in Chicago, who comes to New York, we know the type of room product they want, and that's what we'll deliver here. But we know we have a substantial challenge to realize the vision and the destination resort that -- that I just described, and we're going to have to work cooperatively with, really, the community and everybody who is an important stakeholder to make dramatic improvements to the current traffic conditions. While I'm not going to go through this pie chart per se, we're going to break it down into a few details, and at least give you our current thinking as to ideas that can improve traffic overall, and do more than simply offset the impact that our casino will bring. Our goal is knowing less than to go past the impacts here, and improve the existing conditions. So -- so, the data that we have, and we've been working with TRC Engineers, who is very 20

familiar with the traffic problem here, to help us develop solutions that benefit the community and help improve the traffic in the area. So, the data we have today says that on a peak hour, which could be an evening rush hour, or a Saturday, there are approximately 4,800 trips an hour, and as we look at the volume and the business, we expect to do -- we are mindful of the fact that we will be adding approximately 1,300 trips. So, we take a very fact-based approach towards, how do we really make sure we have a solution, and I can't underscore how important that is to us. We're going to be making a big investment in this facility, and if we don't improve the traffic, if we don't more than offset the 1,300 and go to the -- to really improve the conditions for the balance of the traffic, we won't get a good return on our investment. So, as Caesars comes to the community and are working to address this traffic issue, the one thing you can count on, is that our interests are perfectly aligned. If we don't find a way to improve traffic, we won't achieve our business goals here, and that's not

something that we -- we would find acceptable. So, as we go through, we've identified, and really in a preliminary basis, several very specific improvements, improvements to the -to the traffic here. One is to create a dedicated ramp from the toll plaza to Route 17 southbound, and I'm going to show this graphically in just a moment. Another is to work on a new Route 17 southbound on/off ramp and eliminate one signal. Again, we'll go through this in more detail in a minute. And then finally contribute to the initiative that's already in place to improve the technology related to the signals as you move up and down the corridor here. We understand it's already underway, and you can definitely count on our support to help push that over the finish line in whatever way is necessary. So, again, we'll just walk through a little bit more graphical detail on that, and what you're going to have after the presentation itself, we have our colleagues from TRC Engineering here, who, as you all have any detailed questions around this, we've got a board over here, after the meeting and after

overpass crosses the 17. We would envision working to remove that railroad overpass, improve the view sheds in that area, make that four lanes overall, and really take that all the way down to the entry into -- into the casino. So, it's a fair distance that -- that we're talking about doing this. And in an aggregate, we're very mindful of the fact that we're going to have a substantial economic commitment that we're going to have to stand up and make to deliver these, but we're fully willing to do that. So, as we thought through the project that I just walked through and how it can potentially benefit the community, we think there's several very important areas that our project can -- can be a source of benefit. The first is what I've just mentioned. We can be a force that's going to be willing to dedicate substantial capital towards improving the traffic issues that you all face every day here. The second, and the next few are really well contemplated in the law that was passed in New York last year, for Woodbury, there would

the public comment period, where we can go through and share with you our preliminary adaptations to the existing plans and points that we find important, and have some give and take and understand your points of view on these specific areas. So, the first I'd mentioned was this dedicated -- it's up top on the right-hand side, this dedicated ramp to 17 southbound, so it will collect people coming off the toll road and move people southbound without having to cross and take a left. And then there's this larger move down below it, near Locey Lane, that would have an on/off and allow us -- allow the community to eliminate the signal. That's the one to the north within that second quadrant there. Finally, the adaptive signaling that I had mentioned. Our plans actually do push beyond that, although admittedly, as they push beyond it, to head further south, they're not as directly dealing with the existing issue, but we know that to make our destination resort work, we're going to have to widen the road as we move south. There's the area where the railroad

be a ten million dollar benefit in terms of local revenues that would be related to the state gaming tax. So, in other words, our revenues, as they go, if we achieve our revenue targets, and we're confident we will, Woodbury would get ten million dollars a year from the state gaming tax. We've calculated that there will be a 19 million dollar incremental property tax that Woodbury would be a beneficiary of, and then beyond that, there would be an additional ten million that would go to the Orange County coffers, directly related to our project. The reality, when you look at the casino industry and do a deep study of the casino industry, if you look at how like sites perform, the Caesars and our network of properties, tend to perform at about a 25 percent higher productivity rate. So, we -any analyst would predict that we would generate more revenue than any other gaming competitor who would come to this site, because of our network and relationships with people that I had described before. So, the revenue numbers we're talking about here, are a little

bit above of what the state projections have, and it's based on our internal expectations of what the revenue we would do. And of course what I didn't just mention and it is important is, we're intending to invest over $750 million into this project, and while we won't finalizes that number for the next month or so, we know it's going to be at least that, and the consequence of that will be, fifteen hundred union construction jobs, and we're very committed in our company across the country to working with -- with union labor, and already have an agreement, a preliminary agreement in place for that here. We -- we expect to have over three thousand permanent jobs, and these are good paying jobs when you look at -- at the -across the rest of our network as we come into communities. It's a job that would have an average compensation, including salaries, wages, benefits, tips, of about $50,000 per position. We're also very committed to working with veterans and the Armed Forces. We have formal processes in place right now to work with

welcome any communities to go and talk to the mayors and community leaders, the fire chiefs, the chiefs of police, of any of the communities that we're in, and you get the -- you get validation of what I'm saying on how well we integrate to the community there. We've already started dialogues here locally on how we're going to work together with the fire, police, EMS services, to create solutions for our projects. We certainly know that there's going to be issues related to water and sewer, that we have to make sure that we're offsetting whatever capacity we're using on the local infrastructure, we're committed to doing that. We look forward, very much, to partnering with SUNY Orange to establishing programs that could be good training programs that augment the curriculum of that institution very effectively. So, again, we're introducing ourselves here. We look very much forward to getting questions and feedback from the community as we go forward, and in Jan is going to come back up and really close with a bit of a description on

veterans, and we think certainly this market with its history and relationship to the Armed Forces, is a great opportunity for us to put those programs to work. So, we'll be deploying our Lifting Heroes Project -- Program here to hire veterans. We'll host a military job fair here, et cetera. And we're also very active at hiring diverse work forces, and certainly, at a minimum, we'll reflect the community as we do that. As we typically go through and hire, over 90 -- well over 90 percent of the people who are employees of the project will come from the immediate surrounding area. So, finally, you know, our commitments to Woodbury are very, very clear. You know, we're mindful of maintaining the quality of life in Woodbury. Our company, our company really is unique. There's nobody else who has 53 casinos around the world. We're the biggest, not because we created one big model head, but it's because we have 53 different relationships with communities. We know how to do this and deliver on commitments to communities better than almost any other company. We are very proud of our track record in that regard. We

how we plan on integrating with the community, and do so in other areas. JAN JONES: I want to talk a little bit more about what it means to be a partner with Caesars. As I mentioned when I first began the introduction, we operate on what we call our code of commitment, and it's a promise, as I said, to employees, to treat them with respect and provide career opportunities. To our guests, operate with integrity and have responsible gaming. Communities, to help make Woodbury a healthy and vibrant place to live and work. And to the environment, to be responsible stewards. When we talk about the jobs, and I think this is really important for a community to understand, sometimes when you talk about casino entertainment, the people think it is all service jobs. In fact, there is a wide variety of jobs, gaming, relationship marketing, human resources, legal, finance, hotel, food and beverage, information technology, total service. So, they're career jobs. They're good jobs. Our average employee makes 50,000 a year, plus benefits, and I would

say, today we signed our PLA with the building trades, which we were very proud of, and I want to say that even though the state requires labor agreements for both the hotel and for the building trades, Caesars Entertainment has more union partners nationwide than any other gaming company, and it's because we believe doing the right thing by our employees, and we believe in union partnerships. Caesars wants everybody who gambles at our casinos to be there for the right reasons, and that's simply to have fun, and it's really important to understand that this resort is about entertainment. It's about fun. We're the first casino company to recognize and operationally address problem gaming. Our programs serve as the models for the entire industry. Countries and governments actually take our regulatory structures and training and put them into their own programs and legislations, because we really set the standard. We've received the first corporate award given by the National Council on problem gaming. We funded the creation of the first national help line for problem gaming. We

lightly, which is why we put the programs in place. And actually, one of the things that I think is interesting, that studies that have been done around the world, not just around the United States, have shown that the entrance of new gaming product does not increase the incidents of problem gaming. In fact, in many countries, in the UK and Australia, they've actually seen a reduction as the markets have stabilized and the proper regulatory programs have been put into place. On sustainability, I talked a little bit about code green. Responsible stewardship of the environment is a clear business imperative, and by that, it's not something that we think it's nice to have. It's something we believe is a have to have. We look at programs that incorporate energy efficiency, use of recycled materials, leed certification in all of the buildings that we put in place. When we look at reducing the carbon footprint, this is something we take very seriously, and we, actually, we have a goal of 25 percent by 2015, and we've already achieved that goal.

regularly contribute to and assist international, national and local problem gaming agencies. We're the first to offer nationwide self exclusion, self restriction. That's where if a customer doesn't want to be part of the casino, or doesn't want to have marketing sent to their homes, they can sign up and we'll make sure that that doesn't happen. We're a commitment to effective responsible gaming training for all of our employees. Every employee at Caesars Entertainment is trained in responsible gaming, and a certain level of employee called our ambassadors, are actually trained to be on a floor, and if a customer asks them for help, to direct them to services and help lines, where they can get the help that they're asking for. The other thing that's important to understand with responsible gaming, because this will come up, and I think the more you're educated, the better it is when you have questions in the community. The incidents of pathological gaming is usually about 1 to 1.2 percent of the population. Statistically, it's a small number, but it's not something we take

Across our network, we have a proven track record of community reinvestment, employee engagement, volunteerism and charitable giving efforts across the network. We talk about being a partner, and if we're going to be a partner in Woodbury, we hope it's a long-term partnership. So, building a community that you're proud of, is building a community that we're proud of. The code in action, when Katrina hit New Orleans, we had to close. The whole city closed. We kept all of our employees on payroll for ninety days, and even afterwards, we kept up all their health and benefits, so that those employees who were out of work, didn't have to worry about caring for their family, our family. Your family is our family. Tourism impact, Harrah's New Orleans, in the ten years we've done business there, we've spent over 95 million with local partner hotels, and more than 45 million with local restaurants and attractions, and that's because, we want our customers to come and experience the area. We don't want them to just come and come to the resort. We want them

to go out and visit your businesses, visit your restaurants. If there's hotel rooms, we partner share. And it's because, if the tide rises, we want all the ships to rise with it. Economic revitalization, there's an interesting, we're in Harrah's Joliet, and many of you may not even know where Joliet is, but if you've ever seen The Blues Brothers, it's a city that at one time was only known for its prison. Today, it's one of the most vibrant cities in all of Illinois. They had a twenty-five year redevelopment plan and they've achieved it in ten years, and it was because of the capital investments, the people, the jobs, the reinvestment in the community, that really gave them the opportunity to create a vision, and do it in an incredible time frame. Local business partnership with Renu Oil. Our partnership with Renu Oil is an organization that collects and recycles cooking oil, food waste and glass, from Caesars Resorts in Las Vegas, and it exemplifies our commitment to working with local businesses to and for sustainability. We actually came up with a program where

many of our minivans, actually, are running on Ethanol fuel, which is a byproduct of these reused cooking oils. Our foundation, Caesars Foundation last year gave out over seventy million dollars to reinvest in the communities where we do business. We're actually the single largest gift giver to Meals On Wheels. In over ten years, we've given over fifty vehicles that augment the Meals On Wheels programs in communities where we do business. Clean The World, which is a program where we take all of our used soaps and shampoos and conditioners, and send them to other countries, where they have huge need for these supplies. It's been incredibly successful. We were actually the first casino company to be part of Earth Day. We were the first casino to turn off all of our neon lights, and tried to set the standard for others to follow. From Jan 2010 through the first half of 2011, our Hero Volunteers contributed more than a hundred and seventy-three hours to communities and the environment. This is employees giving of their time, because as I

said, they care about the communities they live in. They care that we're partners, and this is something that we're doing together. We share a financial success with our communities by donating a portion of company profits to community and charitable events. This is not something we do sometimes. This is something we do all of the times. (Whereupon, at this time a video is played.) JAN JONES: We made a focus on seniors, because we thought that often they were forgotten, and we were very pleased that we could have made such an impact in so many important programs, but we also give to education. We give to healthcare. We give to children's charities. We try to be there for every part of the community where there's a place we can help. As I said when I started, we want to be a part of your community. We're very excited about the opportunity for this project. We see it as a long-term relationship, and we want you to know that tonight is just the beginning of the relationship. We're not coming to come in 36

When you were talking about the resort, you were mentioning that there would be three hundred rooms in the hotel, and you said to start. Is there, or are there plans to make more than three hundred rooms for the hotel, or are there plans to make it bigger? GREG MILLER: Does this work, or no? On is good. So, we don't have plans to go beyond the three hundred. If I said to start, it wasn't intended to imply anything beyond that. Our program is what I had mentioned, which is the three hundred, and I apologize if I misspoke and said to start, to imply something different. TRUSTEE SUTZ: Okay. That's fine. I just wanted to clarify that. Thank you. I guess my other question was, and I just wanted to clarify this, as well, when you showed a slide of Woodbury potential revenue, it showed ten million dollars as a state game tax, and I'm assuming, from the way you

presented it, that that ten million dollars goes directly to Woodbury and nowhere else, if the revenue that you hoped to reach was achieved. Is that correct? GREG MILLER: Yeah, that's correct. The way the legislation was drafted, it would be 5 percent of the gross gaming revenue, it will go directly to the -- the local community, in this case, Woodbury. TRUSTEE SUTZ: The host community. GREG MILLER: Yes. The host community, yes. TRUSTEE SUTZ: And then the nineteen million dollars in property tax, that's total tax, school, property, whatever, village and town tax, as well? GREG MILLER: It is town property tax specific. There are almost certainly taxes beyond that, things like hotel taxes that would be included. For purposes of that slide, we focused on the property taxes. TRUSTEE SUTZ: Just to clarify, you're not asking for any kind of tax abatement of any kind? GREG MILLER: That's correct.

TRUSTEE SUTZ: I'm good. TRUSTEE CROUSE: Okay. I don't want to ask too many questions. I want to give an opportunity to hear from the public. I do have one question. On the traffic proposal that you had there, have you been speaking to, or planning to speak with the New York State DOT? Because there right now is, on the board they have their own designs. Are you going to be coordinating with them to make sure that the flow of traffic is eased through this intersection? GREG MILLER: We haven't started a formal conversation yet. We've gone through and been studying the situation and coming up with the point of view that we shared up here today on how to augment the existing plan that we're quite familiar with, with the New York Department of Transportation. Obviously, we would have to coordinate in a cooperative way relative to funding and scope, in order to proceed. TRUSTEE CROUSE: I would believe that would be very critical, because we spent years, 40

and the DOT has spent years in the local municipalities in this area, on looking at a design for that, and I would think it would be vital to the project that this was -- that this was coordinated, and coordinated well with the DOT. GREG MILLER: Yeah, we respect that point, and it's the same in every jurisdiction we operate in, we wouldn't have a right to do the work on our own. What you hear from us is our commitment to make a substantial capital investment to help those projects, enable those projects, because we understand there have been frustrated at times historically based on lack of funding. JAN JONES: This is just an update, we actually have begun those conversations with the department of transportation. TRUSTEE CROUSE: Thank you. Anything, I want to reserve. I would be interested in hearing from the public. TRUSTEE FLOOD: You might as well stay there. Thank you. I just have one question. What are your plans on -- to impact -- to

mitigate the impact on our local services, such as our policemen, our fire department, and our EMS departments? GREG MILLER: Yeah, we've certainly started detailed conversations on each of those different areas. We're very mindful of water and sewer, as well. Our goal is as simple as, whatever impact we create, then we will offset and make sure there's funding sufficient to offset it. So, there's different examples in each of those obviously, but those conversations are clearly have already begun. TRUSTEE FLOOD: Would that include the Harriman, as well, one of our great neighbors? GREG MILLER: Yeah, it would potentially -- it would certainly potentially include Harriman, as well. I think Harriman might be a very important player on the water side of the equation, for example, so... TRUSTEE FLOOD: Thank you. DEPUTY MAYOR EGAN: Okay. You've already answered the DOT questions that I had, because there is a substantial plan in place, as Trustee Crouse has stated, and you're clearly going to have to work with the DOT, so I'm not

going to reiterate that. But I do have a question on the salaries, because there was little bit of discrepancy. One slide said 50,000 including benefits, the other slide said 50,000 plus benefits. So, I would like some clarification on that, because that could be pretty substantial. For example, a family plan for health insurance with good dental could be close to $20,000. That would be a big discrepancy. GREG MILLER: Okay. The first slide that was in the presentation that I went through was very detailed, certainly indicated it was all inclusive, the 50,000, for the average employee across all functions in the casino. DEPUTY MAYOR EGAN: Okay. So, with benefits. GREG MILLER: Including benefits, all inclusive. DEPUTY MAYOR EGAN: Okay. Thank you. Okay. That was it for me. Thanks. Gentlemen. MR. GOLDEN: I have none. MR. LINDSEY: The only thing I have to say is that, it's nice to see that you're prepared

to make a commitment to the traffic issue down there, because there are many issues in the situation here, and I look forward to reviewing the studies and the plans, when you have detailed plans. DEPUTY MAYOR EGAN: Thank you, Dennis. Mr. Turner, our Village Planner, I know he's in the room. Do you have any comments? MR. TURNER: I have no comment at this point. I think Dennis indicated, there's going to be a series of studies that will be coming forth addressing all of the questions that you have raised and others will raise. DEPUTY MAYOR EGAN: Okay. Thank you, Stu. As you -- as the public comes up to make any comment, please just leave the mic on the table. It's sensitive enough for people to hear, and it causes too much background noise. First, before we go any further, I would like to recognize Assemblyman James Skoufis, who came in, and Town Councilman Tim Marone, who is also here in the room. Before we go to the printed list, I'd like to ask any public officials that are in the room that would like to make any comment, that 44

My name is Harry Poor, and I'm here as the representative of County Executive Steven Neuhaus, and the reason why I'm here tonight -- and by the way, I want to thank my friend Sam Fratto of Local 363 for making this available, and thank the board also, Deputy Mayor, Trustees, for having this forum. I think it's very important. I think the turnout shows how important it really is to have this. I'm here representing the County Executive because we, in the county, are surprised somewhat that Orange County is in play. I've lived most of my life in the Hudson Valley, and whenever there was talk through the decades, any decades, about casinos, it was always Sullivan County. Now when it comes down to actually happening, Orange County is in the mix. Why is Orange County in the mix? We're in the mix because we have the population and because we have the market place, and the

County Executive and his staff has looked at all of the positives and possible negatives of this opportunity, and we see it as a very strong positive, and it's for all the obvious reasons that was stated by those in the presentation. We're going to have non-property tax revenues to a degree that does not come along every day. There will also be property taxes, property taxes by the development itself. There will be employment opportunities that we desperately need in this county. There will be linkages with our county college for training. When you look at it in every aspect, it all seems to be a positive thing. Now, having said that, we are very hopeful that there will be one, at least, wonderful if you can get two, casinos in Orange County, but it will be up to the local governments where these things are going to be located, to say yes or no, and we in the county, County Legislature Katie Bonelli is here tonight, passed a resolution, I think it was 20 to 0, or 20 to 1, saying, we want a casino somewhere in Orange County, but if it will be in Woodbury, or if it will be in Newburgh, or if it will be

in some other place in the county, it will be up to the local governments to do that, but we think on whole, on balance, this is a wonderful opportunity for Orange County, an opportunity that does not come along very often, and an opportunity that will have a substantial positive impact for the local government that hosts it, and for the county that it's in. Thank you. DEPUTY MAYOR EGAN: Thanks, Mr. Poor. Any other elected officials before we move onto the public? Okay. I see none. Oh, excuse me. RICH COCCHIARA: Gentlemen, my name is Rich Cocchiara, Town Councilman for the Town of Hamptonburgh. I will be respectful of the fact that this is your decision, and the town and village will do what they feel prudent, but from the Town of Hamptonburgh's perspective, the only thing we're concerned about, is that a majority, say a signature amount of our people, do come down Route 208, get on 17, and take the New York State Thruway south into Jersey. So, any kind of traffic impact, please be mindful of the fact that, we're going to be added to

that. So, there's a lot of people that do come up that route, and will be impacted by whatever traffic will occur. I am encouraged, though, by what I saw here, the fact that significant tax benefits to the village and town, and to the county itself, and also the fact of additional jobs, both construction and permanent. All these things we need, but again, my own concern, and the only thing I'm here for, for Hamptonburgh, is to just talk about the traffic. Thank you, gentlemen. DEPUTY MAYOR EGAN: Thank you. We will start with Saaed Moslem. SAAED MOSLEM: Good evening, Town Board, ladies and gentlemen. As a business owner here in Woodbury, as a long-time resident in 48

Woodbury, twenty years I -- twenty years ago, I could never believe that we'd have the opportunity to have a casino in Woodbury, but with the growth that Woodbury has had, this is a win/win situation for everybody. This is a one in a million opportunity. This is almost like hitting the lottery. We cannot let this opportunity pass us by. With the amount of revenue that it will generate, with the jobs that it will generate, with fixing the traffic problem, which is our biggest problem in Woodbury, this is just a win/win, and I don't see anything that can go wrong here. Thank you. DEPUTY MAYOR EGAN: Jan Palaia from Palaia Vineyards. JAN PALAIA: I just wanted to add that we are for this, as well. We live -- we are at the complete opposite end of town, on a 200 year old property, and I cannot see how this is, in any way, bad for our town. I was just at a Governors Conference for beer, wine and cider, and the Governor is very interested in getting tourism out of the city and up the Hudson Valley, and improving the Hudson Valley,

and I'm for that, also. I just wanted to say that everyone up in our neck of woods, at the other end of town, is for this, and we encourage you to be for this also. Thank you. Peter McGoldrick, long-time resident of Central Valley, and I think I classify myself as a long-time volunteer and a person dedicated to the Town of Woodbury and the Village of Woodbury, and I do agree with what's been said about traffic. It's a tremendous issue, and I am encouraged by what we saw, you know, on the commitment to -- to fix the traffic issues that we have, especially the monetary commitment to do that. I am in favor of this, and that really is the message that I want to bring to the board. I'd like the board to -- to really consider approving this and moving this on to the planning process, where, you know, all of these issues that we, we as residents of Woodbury,

are concerned about, can be vetted out, you know, with a good DEIS and good scoping session and, you know, a good plan to make this work. So, I appreciate the time, and thank the board for their consideration. DEPUTY MAYOR EGAN: Thank you. Next up is Wayne Corts. WAYNE CORTS: Wayne Corts, 3 Victoria Court. I've lived in town for twenty-five years, and I run a local business, Fallkirk Estate & Country Club, and I would urge the board to move as quickly as possible to get, you know, get a first class project like this approved, and get it done. It would help me tremendously. And I want to thank the Asher group and Caesars for coming to our town, and I would urge the board to do whatever it could to move forward quickly. Thank you. DEPUTY MAYOR EGAN: Barry Fixler. BARRY FIXLER: I think -- I think it's great, excuse me, I think it's great. My family thinks it's great. I'm a returning war veteran. I've served this country. Orange County has a huge veterans population, and veterans coming back from the war, needs jobs.

The casino promised thousands and thousands of jobs. I think it's very patriotic. I think it's a great deal, and I'm 100 percent for it. Thank you. DEPUTY MAYOR EGAN: Fred Unger. FRED UNGER: I respectfully decline to speak. DEPUTY MAYOR EGAN: James Weber. JAMES WEBER: Good evening, Deputy Mayor Egan, Trustees, neighbors. Thanks for this opportunity to be able to speak this evening. I'm going to apologize, because I'm not a long-term resident. We're fairly new here. We had a brief thirty-two year hiatus in the Air Force. So, we're back in New York now. And I do have some concerns, because as I read it, you mentioned ten million dollars in gambling proceeds, but it's my understanding that ten million is supposed to be split between Orange County and the -- the environments of Woodbury. Also, I'm sorry, also, the -- I truly would like to see a guarantee upfront that a corporation like Caesars is not going to apply for a ten year property tax abatement. And I have nothing against Caesars. I've left plenty 52

of money with you folks, and the siren song of having you close by is hard to resist. The other thing, the other concern that we have, my neighbors have, is the interchange, because it's my understanding, from the time that you are approved, if you're approved, that you have to have the casino built in two years. Is that correct? GREG MILLER: The law requires two years after license is awarded. Very recently the gaming commission clarified that to be two years after the completion of the SEQRA process. JAMES WEBER: Okay. Because, again, I grew up on Long Island. So, one of the things I'm really good at is cynical, and getting the plan changed from starting the interchange construction, I think it's 2017, get a whole new plan, move track trestles, get rights of way, widen roads and everything, within the two years that you're going to build, just seems to be aggressive. gentleman had a comment. My wife tells me I talk enough. The previous gentleman had mentioned a concern that the ten million dollar benefit to the -- to Woodbury, was -- was divided somehow. The way we represented it up on the screen actually was accurate relative to the law. The expectation is it would be ten million dollars to Woodbury, and plus ten million dollars to the county. It was the way the law is written. JAMES WEBER: So then you're saying the State of New York calculations were off by 6.2 million dollars. GREG MILLER: I have to look at the details of what you're saying, but based on our revenue projections and the regulations that are in place, we're quite confident in that number. JAMES WEBER: The original New York State numbers were 13.8 million, of which 6.9 would go to Woodbury, and 6.9 to Orange County. GREG MILLER: That is true. That was the state estimates. Again, our revenue estimates, we tend to estimate more revenue, because we're more successful. It was based on our internal

the town payroll, because how's -- they tell us they're going to give us an impact fee. To me, an impact is a one-time deal, but once someone is on the payroll, it's all the time. So, this ten million they're going to give our town, the people might have high inspirations, oh, ten million dollars, it's going to be a wash with salaries for EMS, firefighters, court and whatever police we may need, maintenance workers, sewer department, highway. Other 19 million to reduce our taxes. Our school budget is a 157 million dollars. The biggest question for me is, the money that they're going to bring into our town, if you break it down by a month, what is maybe $100 a month worth for me for the inconvenience for the traffic. No one mentioned morality. No one mentioned anything else. But I'm just saying, for any inconvenience that our citizens will deal with, for 80 to $100 a month, that they -- their projections that we might get, is it really going to be worth it? DEPUTY MAYOR EGAN: Caesars, would you like to respond to that at all? JAN JONES: I think there are always

projections beyond that. That is an accurate statement. DEPUTY MAYOR EGAN: Okay. Move on now. Andrew Lubeskie. ANDREW LUBESKIE: Hello, I'm Andrew Lubeskie. I've only been living in Woodbury, Highland Mills, for eleven years. I'm a good fan of Caesars. I've gone to Atlantic City and Las Vegas, but for all the reasons Caesars is a good product, I don't want them here. I worry -- I'm worried that the ten million dollars that they estimate, which the state estimates is less, with the town is going to be a wash. They tell us, they came to Brigadoon, where I live, they told us that they're going to have an impact fee. How could our one EMS volunteer, how could our one Harriman fire department, which is volunteer, service our community, and the three hundred bed hotel? These are going to have to come full-time positions. I'm not going to talk about the police. I grew up near Philadelphia. The Vet, for Eagles games, brought it in the community. Our courts are going to have to become more involved. We're going to have more people on

concerns when a project of this scope comes to a community. When it comes to the traffic, I would respectfully say that you already have the problem. The problem exists. I think that we're an opportunity to rationally address that problem and come up with a solution that is good for the city and is good for the increased people that will be coming to the community. The questions, increase services, that's absolutely correct, and I would restate, we're committed to work with the city in coming up with whatever it is that you need in increased fire or police, any services as a result. When it comes to questions of, and it was referred to of crime -AUDIENCE MEMBER: Morality. JAN JONES: Well, morality is a question that I would say, 68 percent of citizens in the United States are perfectly fine with casino entertainment. The average casino gambler is higher educated, earns more money than the average person. So, I absolutely respect people who are opposed to gambling, but there's 70 percent of the public who is absolutely not opposed to gambling, and I would go back that

these resorts, the gambling is a piece of the entertainment. The entertainment that's offered goes far beyond. It's a tourist destination that not only brings new people, new revenues, and to Greg's point, it's not just the gaming tax. There's sales tax. There's room tax. There's all of the new revenues that are as a result of growing a new vibrant industry. And the last thing I would say, because I think it's really important, and I know there was an editorial in the paper this morning talking about the increase of crime associated with casinos, and I will tell you that that is categorically untrue. The 1999 Federal Impact Gambling Study, as well as the University of Chicago, the National Opinion Research Center, they both did studies that showed there was statistically no increase in crime. In fact, communities with these resorts have actually found that crime has gone down, because of the regulatory environment, because of the public safety and the security that we have in these facilities, and I think just of interest, that they found, that there is more increase in

crime associated with big box stores, such as Wal-Mart, than with casino resorts. DEPUTY MAYOR EGAN: One other thing, as an objective point, that I would like to point out that, Caesars and Flaum has to work with the emergency services organization in our village, and anything they decide we need in order to handle the project, they have to pay for, over and above what we currently have, just as an objective point. AUDIENCE MEMBER: Is that a one-time deal or is it an annual deal? DEPUTY MAYOR EGAN: As far as I understand it, whatever needs to happen annually and forever, they will pay for it. MR. GOLDEN: Just also as a point of clarification from a legal point of view, the amounts that were discussed here, either the 6.9 million per year the state comptroller has estimated generally in the Orange County area, or the 10 million that's estimated, those -those are yearly amounts. And in addition to that amount, there's another amount that goes to the county, but those are yearly amounts. That's not a one-time fee. Those are yearly

amounts that are required on the -- that are based upon the gaming tax. DEPUTY MAYOR EGAN: Okay. Moving on, I'm not going to attempt the last name, Christine, so why don't you just come on up? You can tell me how to pronounce it later, if you'd like. CHRISTINE DEROHANNESIAN: It is Derohannesian. And you did say three minutes, right? DEPUTY MAYOR EGAN: Yes. CHRISTINE DEROHANNESIAN: In my next lifetime I promise to be brief, but for now, I'm not. My name is Christine Derohannesian, and my sight includes experience as a current member, previous vice-president of the Woodbury Chamber of Commerce, affiliation and close relationship with many local and county organizations and networking groups. I'm a local business owner of Bungafly, current resident of Woodbury, and a mother of two in the Monroe-Woodbury School District. My business has evolved over the past few years in town, all focusing on my efforts of community connection and enrichment. I have 60

organized many community events in chamber, and through my own business, proven that I keep community interests first. I was brought up in a home with a warm and loving father, who was a gambler. I'm trying not to cry. He had the American Dream to come and offer his children the best he possibly could, but his trade would never support that. In gambling, you know, how that story can positively go. When I heard the proposed casino, my heart dropped to the pit of my stomach, as I was immediately attaching gambling to my experiences. I started extensive research on the proposal, facility and what it was all about. I even wrote the developers my personal concerns and interests in the community. With all my finding, as I was surprisingly -- surprisingly I saw many positive opportunities. First, I was pleased to see that gaming and the casinos took responsibility and action and awareness of potential problems of gambling. It's not like days past where you sweep those things silently under the rug.

I recognize that gaming was also a fraction of the proposal, and the big picture was a bunch of larger and greater than that. I started to weigh the pros and cons of the issues at hand, and facts at hand, from all of heart. My dedication and best interest for the community quickly outweighed my personal experiences. I found the best option to preserve and promote Woodbury's current struggling businesses was this opportunity with the resort. I found, when considering preserving family lifestyle, including to provide additional jobs, so parents can work from home, remain involved in their children's communities and lives, and had to even afford to stay here in the acclaimed Woodbury, we need this opportunity. I'm 100 percent in support of the opportunity it brings to support the local businesses, to support the community, and the resort, the highly acclaimed Caesars Foundation, and what I found they stand for in community and societies, is absolutely my 100 percent choice in having them in my backyard,

Am I allowed to ask questions to the presenters? I have two questions and one general comment. The traffic statistics, they showed, in regard to the number of trips and potential increase, was that based on an actual traffic study? GREG MILLER: Yes. JOHN BARANOWSKI: I think you said commuter trips. You didn't specify what time of day. GREG MILLER: Peak hour. JOHN BARANOWSKI: Peak hour being Memorial Day weekend, 4th of July weekend, Columbus Day weekend, Labor Day weekend, every weekend during the summer, spring and fall, not to mention Thanksgiving weekend. I'm concerned that any mitigation problem -- any mitigation project that's put into place, in conjunction with -- with the state, in conjunction with the private developer,

cannot possibly mitigate the ongoing problems we have periodically, and those periods are increasing in frequency. I don't see that this is the correct solution at all to our traffic problems in this town. My other question is for Flaum Management. I hear from some of my friends up county, this is -- this is not the first casino proposal that you floated in the Hudson valley. That there was something floated up in the Shawangunk Ridge. Is that correct? DAVID FLAUM: Yes. JOHN BARANOWSKI: Has that disappeared? That's no longer -- I haven't seen that in the various applications for the licenses. DAVID FLAUM: Yeah. I own the land, 350 acres up there. I've owned it for about fifteen years, and when many people hear described it was going to be Sullivan, I thought it was going to be Sullivan. Then when they included Orange County, I knew that Orange County was definitely the place. JOHN BARANOWSKI: So, you withdrew your interest in that other property based on knowing where casinos could be sited here in 64

Orange County? DAVID FLAUM: I didn't withdraw my interest. I love that piece of property, but I will not been building a casino on that piece of property. JOHN BARANOWSKI: Okay. Thank you. My general comment is that, over the past few years, both the town and the village, through the work of their comprehensive plan committees, and I was a member of the town comprehensive plan committee, the approach was, we spent months and months devising a plan for growth for this community, careful, considering organic growth, considering thoughtful development, as we continue through housing, businesses, and I think that was something that members of both the village and the town comprehensive plan committee were quite proud of, that it was a careful, well thought out, well discussed process. Suddenly, something falls out of the sky, and the feeling I get is that, let's just throw that all over our shoulders and run willy-nilly, because a deadline has been set up, and let's forget what we said about the

importance of careful thoughtful growth. I'm concerned that the size and scope of this is so large, against the deadline that seems so unreasonable, that we cannot possibly make a good decision by accepting this proposal, or approving a resolution to have it go forward. First off, I'd like to thank the village board for being prudent and for making the tough decisions and keeping their budget below the 2 percent cap that's recommended by the state, and that's without cutting services. I applaud you for that. It hasn't gone unnoticed, or not appreciated. Don't count that against my three minutes. If I may, I'd just like to say that it's no surprise and no secret to anyone that New York State is in financial difficulty. Our county is in financial difficulty. And it won't be long before Woodbury is in financial difficulty. That just runs true to form. We have an opportunity here to partner

circulating a petition, and they gave it to me because they thought I wouldn't lose it, but there are about 150 signatures on this of people that are residents that are for this project, and most of them couldn't attend this evening. So, I would just like you to know that. Thank you. DEPUTY MAYOR EGAN: Harold Reynolds. HAROLD RENYOLDS: Good evening, Harold Reynolds, owner of Reynolds, Incorporated, oil company for 79 years, keeping people warm. Spent about six years in the Navy. Very upsetting to see so many houses for sale around here. It's not a good sign. And people moving, going out of state as well. Something has to be done. Hopefully you guys are the answer, because nobody seems to care. It's not a good situation. Thank you so much. DEPUTY MAYOR EGAN: Scott Doscher. SCOTT DOSCHER: Good evening. So -- so, I'm here to share my opinion. I thank you for the opportunity. My father was a compulsive gambler, like this lady'S over here, and it didn't work out so well. It bankrupted him. with a situation that was not available. By the way, I was the chairman of the comprehensive plan committee in Woodbury. I was also the chairman of the town planning board, and the village planning board, through four administrations. That means I play well in the sandbox with people, and I understand the difficulties of getting a project through, as well as mitigating it. I believe, of all the opportunities that have presented itself in Woodbury, this is probably the most important that has ever come along. We face many issues from outside communities that have very serious expansion plans, and we're left to go unabated. We have lawsuits that we have to fund. And also, we have properties that we need to buy to make sure that they're not in the wrong hands. This is a good partnership. We should not let it slip through our fingers. I appreciate your consideration. Thank you. Can I just say one thing, because I didn't use up my three minutes? Someone handed this to me tonight, another resident, and I guess they just started

about losing, leaving a lot of money with Caesars, is not really that funny, although, you know, it got kind of a nice chuckle, but I'm speaking not from an emotional standpoint on this issue, although I have seen it personally. I think that in this day and age, I'm in a high-tech business myself, so I know that there's tons of ways to abate huge problems. So, I have -- I have a lot of confidence that the -- with the proper planning and engineering, that all of the stuff we saw on the slide could help. I really do believe that. It was a very polished presentation, but I think there's a lot of smoke and mirrors going on here with the money. I think it's a very short-sighted plan, quite frankly. I'm all about economic and community development, but this is not the kind of business that I want in my community. You know, the lady from the vineyards up there said that everybody in, you know, her part of the neck of the woods is for this. I'm in that neck of woods and I'm not for this. So, I just want to present an alternative view for the

I'm just going to tell you, coming from a city, I always forget. So, I apologize. SCOTT DOSCHER: I know. You forgot who we were, yeah. We're a town. We're a village. But if we start to go down this direction, guess what, we will be a city. And the important thing here is, once we go down this road, and we bring all the things along with it, there is no turning back. You do not undue something like this. Okay? So, anybody that's, you know, driven anywhere near Atlantic City, you know, Las Vegas, you look at those places, you look at what's going on there, it's just a matter of time. I don't want to sound like an alarmist. I'm not. But I'm just saying, once you go down this road, there's no turning back. You don't undue it. I'm a resident of the Town of Woodbury, at 6 Olympus Road. I've been there ten years. I'm a former resident of the Village of Harriman for about forty years. I've seen this area go from a farm community to a, I guess to a community that commutes to the city, and I'm also a Local 17 laborer. We really have to -- we really need jobs here, and we really have to have -- to have this -- have this project here. We're going to have traffic problems no matter where this project goes. Even if it goes to Sullivan County, we're still going to have problems. We're still going to have problems on Route 17, and also getting off of Route 6, and also the Thruway. So, I am for this project very much, and that's all I have to say. Thank you very much. DEPUTY MAYOR EGAN: Jonathan Swiller. JONATHAN SWILLER: I just have four questions that mostly have been touched on to

some degree, that I'm hoping will be addressed as we move forward looking at this project. We have the revenue projections from the state slightly different than the one from the developer. I'm hoping that the village and/or town together, will try to come up with realistic projections. Even if we have to lay out some money for a study ourselves, I think it would be worthwhile. Secondly, the traffic, obviously, is a major consideration. Not only will the DOT have to be consulted, but I believe that for that ramp from the Thruway, we may have to work with the Thruway Authority, who are really a pain in the ass to deal with. They could make our traffic situation much easier already, if they had any interest in doing so. They've resisted that. One thing that wasn't touched on, I have no idea of the answer to this, but in other, perhaps similar developments, what has the effect on home values been? And lastly, emergency services was mentioned. I'd just be a little specific. The police department can rely on the town. The 72

fire department is supported by the village. The ambulance service is totally independent, not supported by either. Right now, nearly 20 percent of our calls are coming from Woodbury Common, and they, I believe, they contribute nothing to us. Pretty much, yes. So, I would very much hope that we get a very clear commitment, before we move forward, on taking care of whatever added expenses. Our ambulance corps. right now is one of the few fully voluntary ones. If our call volume goes way up, that may have to change, and that would be quite expensive. Thank you. GREG MILLER: If I could respond to the ambulance point, which I find to be a very important and valid point. So, we had met with one of the gentleman's colleagues recently, and we understood the point that they're -- that it's challenging for them to imagine providing any more service than they already do, and as a result of that, our internal plan right now is to hire a certified private company that would service and provide all the needs of our destination. So, there would be no additional burden on that -- that

area of EMS at all. JAN JONES: And I understand the concern on towns and villages and cities, but we don't just operate in cities. We also operate in Cherokee, Council Bluff, North Kansas City, Tunica, Mississippi, Joliet, and those are all still towns and villages. They just have the resources now to give back to their communities, build their communities, and the residents have jobs that allow them to buy houses and live the American Dream. DEPUTY MAYOR EGAN: Janet Acosta. Janet Acosta. JANET ACOSTA: Good evening. I'd like to echo the concerns regarding the tax issues, and the traffic concerns in this area. As everyone knows, during the weekend, this area does go into a lock-down. Residents cannot get to their homes, and often times we have to drive out two to three exits to get to our homes. I'm not against the casino. I'm sort of right in the. Middle I think the casino would be a good idea for Woodbury. However, I see there are very valid concerns raised by residents of Woodbury.

concert. I just don't think this is the arena, the neighborhood for this type of facility. And those are my -- those are my concerns. I think that if Caesars and Flaum do address these concerns, many more residents would be open to having the casino in our backyard. So, I would like to thank you this evening. DEPUTY MAYOR EGAN: Thank you. Colleen Pearce. COLLEEN PEARCE: Okay. I'm Colleen Pearce. I've been a resident for about forty years, and I'm also a business owner. So, I look at this from both sides. I think, as a business owner, I think it's definitely a plus for all of us, but I'm also looking at it as a resident. Most of you know me, and I would never do anything to hurt this community. Everything that I do is for it. When I first met the people from Caesars, I was quite surprised that, I was thinking casino, like Monticello, Yonkers, Atlantic City. This isn't like that. This is, they want to partner with us and help our community. They want to help us grow. If you look at the

I would like to see some kind of guarantee that residents of Woodbury, some sort of a commitment that they would employ at least 20 percent from the Woodbury area, because I feel that the Woodbury Commons doesn't do enough. I mean, our taxes have gone up astronomically, and that continues to happen, and we really haven't seen any benefits from the Woodbury Commons in the Woodbury area. I also would like to see a study conducted on crime. I disagree with crime not being an issue. I believe that casinos do bring crime to the area, and I'd like to see the impacts of crime in our neighborhood, with a casino in our neighborhood, and how that would impact our property values. We all moved into this area for a reason. I didn't see anything in the proposal addressing our youth. We have the Monroe-Woodbury, Harriman School Districts. We have many thousands of school children in this district. I saw a film addressing certain parts of the community, but I would like to see some type of facility for family and youth. And I'm vehemently against an outdoor

communities around us, we're all going downhill. There's no positive growth. I think Caesars will come in. I think we'll have some good things happen. If you have any doubts, if any of the people have doubts, talk to them. They have plenty of money behind them to back up these promises. Roads, roads, yeah, we have major problems with traffic. I don't see anything good happening. If they don't work on this to make it better, they're not going to benefit from it. I think most of the things I heard tonight are the same things I have to say. I think it would be a sin if we let this opportunity go by, because I think this is a first class group that wants to help us and become part of our community. Also, from a moral standpoint, I've had a couple of people say to me, no, no, gambling is against the Bible, we shouldn't do this. I consider myself a very moral person. I try to do good every day. I talk to God a lot, and God kind of tells me, do what I have to do to make things work, and I think there's more

pluses with this than minuses, and I think it will help our community. Most of the people that I talk to are for it. I have a few that are against it, but I think their concerns can be addressed if they would talk to the people and -- from Caesars, and see that they will back up their promises, and that's about it. That's all I have to say. DEPUTY MAYOR EGAN: Daniel Vaughn. DANIEL VAUGHN: Hi, good evening. I'm Daniel Vaughn. I've been a resident here for well over twenty years. I also have a business here. I think this is a great opportunity. I think the jobs are well needed. I think that the income is well needed. I'm also a real estate agent, and I do see a lot of vacant homes becoming available too. here is the Woodbury Commons, and basically they pay minimum wages. These taxes we have, they can't pay the taxes. I went today down to where I live in Highland Mills, and I went down to the -- they told me my property went down 22 percent. I pay close to 600 seven years ago, brand new house, and it's worth nothing. You understand me? So, with Caesars and Flaum deciding to come into the community, I think that's the best opportunity. And the guys, I heard them say one thing that, they don't want a tax abatement. That's like a gift. The Woodbury Commons come here, they have abatement for many years, and this company comes and invests in our community. I don't see what is -- what is -- what is not to give them the way to go. They're talking about the crimes in the community. Commons is about two miles away. We have a very good police force. They know everyone who live in our community. So, if they see strange car driving around, they're going to knock on their door, ask them what they're doing. So, I don't believe that it's going to be like a burden to us.

We need some help. For example, the sewer system can't handle the sewer. The state is broke. Caesars is rich. So, why don't we invite them to come in? A couple more things. I have a suggestion for the -- one minute, suggestion for the traffic. Why don't you back up the property and cut a ramp that way to Caesars Palace? Instead of coming to Exit 16, you have Exit 15 and 1/2, and that's for the casino. You understand me? I may not be the smartest one in here, but I have a lot of common sense. Let's make this thing happen. Get behind them. Have a good night. DEPUTY MAYOR EGAN: Toby Schack. here in Woodbury, and I just don't believe it. Orange County has always been a water-poor county, and I don't know what the situation is locally for this, but not only the three hundred people in the hotel, but all the toilets flushing, and all the other things that are associated with it, I just don't think the water is there to support it. Sewage, where does all that water go, you know, from all that -- those toilets flushing? Where does that water go? We've had problems with the Harriman Sewage Treatment Plant. The county has had a hard time dealing with it. I just don't see that being resolved, mitigated very easily. Traffic wise, yes, everybody has admitted there are traffic problems, but I apologize, I came a little bit late, but what about all those buses that are going to be bused in with people coming in for the day. It's not just those three hundred people. All the support people you've mentioned. Yes, it will create jobs. It will create some growth. But it will also create induced growth, and the need for more housing, and that would be another problem

in of itself. Someone else mentioned, you know, what we see here in Woodbury, and the type of business that we want, and the view sheds here. You know, I just don't think it's as nice as it was, as it was thirty years ago. I understand we need growth, but I really need to question, again, like a previous speaker, what type of growth do we want, and also, you know, as another previous speaker, the master plan. Harriman areas here in Orange County. I'm here tonight to speak in support of the Caesars Entertainment casino project, and there are a few brief points I would like to make. Caesars is committed to build a world class casino, and using local resources during and after construction. Once completed, this project will generate millions in yearly tax revenues in Woodbury and Orange County. Caesars is working on a comprehensive traffic mitigation plan, and is committed to use their own funds for a significant portion of the Route 17 Exit 131 project. Caesars policy is to hire locally, buy locally, and support the local community and its charities. Lastly, this project would provide, literally, thousands of good-paying, permanent operational jobs when completed, with hiring preferences being given to local residents and veterans, and good-paying construction jobs during the build phase. While everyone is very passionate about their position on this issue, I would respectfully request that the Woodbury Village Board pass the resolution in favor of this

project, allowing it to go forward in the application process. Thank you for your time and consideration. DEPUTY MAYOR EGAN: Paul Cassel. PAUL CASSEL: Good evening, I'm Paul Cassel, and I currently reside in Wallkill, and have been a resident in the Hudson Valley for the past 43 years. I'm a representative for the Northeast Regional Council of Carpenters Local 279. I'm in favor of this project. I currently believe that it will bring many construction jobs to the area. It will benefit the local business owners, and it will also be a win/win for a good citizen partner, Caesars. Once again, I am in favor of this project. Please move forward. DEPUTY MAYOR EGAN: J. leaving New York in droves, you have someone willing to make a seven hundred and fifty million-dollar commitment to this area, and that's just -- that's just the iceberg. I can say one thing, for an entity to come in and partner with a community, and also to come in and make a commitment to serving the area standards, not bringing in substandard labor prices, people who take the money and run, but people who stay here and spend the money in the community. On behalf of the Northeast Regional Council of Carpenters and its 27,000 members, we whole-heartily endorse this project and we would ask you to act in the same capacity. Thank you very much. of the best facilities in New York State. It will draw from all over across America. I'm also a field representative for Laborer's Local 17. We're always looking for work for our members. It's been a very slow few years. They've signed a project agreement that will -- that shows their commitment to the community. They'll be paying full assessment on taxes. Most projects are looking for tax abatements. They're willing to pay full tax, full taxes on these projects. I urge the board to approve the project and allow Caesars Entertainment to continue with the process of approval. Thank you. DEPUTY MAYOR EGAN: Todd Diorio. TODD DIORIO: Thank you for the opportunity to speak today. Speaking on behalf of the Hudson Valley Construction Trades Council, I represent roughly 10,000 members in Hudson Valley, Orange, Ulster, Sullivan, Dutchess County, many of them in Orange County, I do want to say, I've been dealing with a lot of casino developers. I had to meet with all of them before this process gets done. There's some that you meet with that you don't have

that warm cozy feeling of trust. This group, I got to say, I spent the last couple of days with some of the people from this organization Caesars, and I kind of shuffle the cards around a little bit, I have a lot of business cards here in the last couple of days, and Caesars is very good to deal with. I feel very trust from them. Some of them I don't, some of the other casino developers. They've committed to a project labor agreement, not only for this project and new construction. They're committed to renovations and additions after they're done, and there's a commitment to the maintenance work in here moving on. They have good-paying jobs. They didn't ask for any concessions. We're pretty much in full labor agreement for this project. Some people mentioned veterans even in their language. They were instrumental in including language in the agreement with us that the labor agreement will include language that incorporates and establishes apprenticeship training, or training programs which shall benefit, create construction work opportunities for veterans, minorities and

females in the Hudson Valley, and are committed to bringing in new members. Obviously when these casinos go, I never thought I would have to say this in the Hudson Valley, but we may have a labor shortage and we'll be bringing in new members, premised on minorities, females, residents, the whole points of the Hudson Valley, it will be the Hudson Valley around here, so, we support this group 100 percent. Even the jobs after construction are going to be good jobs. They're all union. There's not a big union density of hotel workers and people that do jobs in hotel industry. They're going to be good wages, with benefits, health and pension. So, on behalf of the Hudson Valley Building Construction Trades Council, we whole-heartily support this project. Thank you. Minor point, Meals On Wheels is nice, seeing all that stuff is nice, but you're putting a casino in it, and I would like to know more about the casino. The restaurants, the spa, the shops, those are all things that are inclusive. So, the idea is that you go to the casino and you stay at the casino. You don't go to the local stores. You don't go to the local shops. You go there. You stay there and you spend Honor money there. I think that's a problem, especially for a community where you kind of branch out. You have a nice community. My experience, I'd much rather see us go back to looking at the programs that we had, plans that we have laid out, and utilize some of that community resources to develop businesses, local businesses, local jobs in a more organic manner than look for one quick fix. The whole thing going on right now in New York State, everyone is trying to get a casino in the neighborhood. Here's millions of dollars we're going to drop it right here. What's going to happen five years down the road? Rockland County is going to want a

casino. The closest casino to the city wins. New Jersey is going to want to put one closer to the city. The closest casino to the city wins. So, whatever we're left with here, is going to fall apart, and I hate to see that ten years from now, we have some delapidated properties down the road, much more houses on the market, a lot more people out of work, and we're saying, what are we going to do. We create the problem now, we're not going to get out of it. So, I think we have to take a lot of time to look at it. It shouldn't be a rush decision. It shouldn't just show up here and, I need an answer from you in two weeks, can you do it. This is a much bigger issue. This is a long-term project. This is a community that I think we have to really come together to do the homework. That's all I'm asking, do the homework. Is this going to be here ten years from now? Is this the way we want to go about doing this, where we become a city and no longer a town? So, thank you very much. DEPUTY MAYOR EGAN: Liz Ridgeway. LIZ RIDGEWAY: Hi, Liz Ridgeway. I'm in

the Town of Monroe, and I just had a couple of questions. One of the problems we have here is the rail system, the single line that we have, and I went to the Blooming Grove presentation from Kordish and Penn National, and someone in the audience asked, were there any mitigation plans for the rail system at all. I don't know if anybody looked at that, or if it's a possibility, but that's one question. Water and sewer, I know that our sewer is just about at capacity, our sewer plant, and any growth to that, I just wonder where all the, you know, waste water is going to go, and if they've looked at adding to the sewer plant that we have here in Harriman. And when they showed the map of the road that they were going to put in, it actually went right in front of the Central Valley Elementary School off of 32 and Nininger, and almost looked like it was taking up some of that property to the school. So, I mean, maybe it wasn't an exact map, I don't know, but it looked very close to where the school was, and a gentleman had came up before and mentioned 92

something about fifteen and a half or whatever he said the exit, new exit could be, but they discussed something like that for the Tuxedo proposal, where they would put a 15B in over there. Why have the traffic come in front of an elementary school, instead of maybe come prior to that, and in that way, rather than up where we're already very problematic in front of a school like that. And, you know, we're asking the casino, what are they going to do, what are they going to do, what money are we getting, but the money that we do get, the Blooming Grove project was mentioning that ten million dollars was going to go automatically right to the Monroe-Woodbury Central School District, and I wonder what money is going to go to the school district from this project. I didn't hear that come up, I don't think. If it did, I missed it. But how is the county and the state going to spend this money? I think that we are in an environment here where we have problems with our government, and how they make decisions and spend our money. So, I wonder if this revenue coming in, is

it going to be spent wisely, and how -- what the county and state projections on how they're going to spend the money that's coming in from a project like this, but I think our area is very stagnant, and it really needs some help, and I think if we address a lot of the issues that are on the table, it would be a good, maybe, fit, I don't know, but we definitely need something here, because we can't wait for any other small businesses or bigger businesses to come. Nobody has come. Nobody has fixed the roads. So, I think it's a good thing, and we need to get our house prices back on the rebound where we're just kind of stagnant right now, and employment opportunities, I think, will do that. DEPUTY MAYOR EGAN: Does anyone want to respond to those questions? There was a series of questions there. I would ask you to come up to the mic, please. GREG MILLER: Yeah. As I understand the series of questions, and please add any that I missed, there were questions related to the traffic solutions that we put forward, and one of the members of the board had asked earlier

if this is an independent plan of Caesars or something that's coordinated with the New York Department of Transportation. I believe that the specific solutions that were just referenced related to the school area were a part of the public right-of-way and were, at least, contemplated of the pre-existing plans that have been in place, and I do want to re-emphasize if I wasn't clear before, and I apologize if I wasn't, that the traffic solutions that we're discussing were really derivative of, and we believe, cohesive with, the overall plan that the state has been working on for many years. The areas we were focusing on were the areas we found most important to ensure that we weren't creating an additional burden based on our project, down to the south. And I'm sorry, if -- were there other questions there? DEPUTY MAYOR EGAN: So, school money, what money would be going to the school district and how it would be spent. GREG MILLER: My understanding is that the law very clearly calls out that there will be a sharing of the proceeds between the schools and

other local areas. We -- we, as a company, don't presuppose that we would be influencing that public policy. We think the law already contemplates that, although I can't tell you exactly what apportionment the law is at this moment. And I think there was another question on trains and train capacity and -DEPUTY MAYOR EGAN: Single versus two lines. GREG MILLER: Yeah. We have not, to date, engaged in meaningful conversations around adding to the train capacity to the area. We've had preliminary conversations, but not meaningful conversations on that. We've really focused on the vehicular traffic to date. TRUSTEE SUTZ: And there was a certain issue about water and sewer. GREG MILLER: We know that we're going to have to work with the county on sewer, and I believe it's the Village of Harriman on water, but broadly, with water, to make sure that we have a clear proposal in place that offsets the impacts that we create. We know that. We don't have those agreements finalized at all 96

yet, but we hope to have that in the very near future. AUDIENCE MEMBER: Can I just ask that question in a different way? DEPUTY MAYOR EGAN: I'm sorry. So, after this gentleman, if anyone else wishes to speak, just start to come forward, please. CRAIG SHITTEL: Craig Shittel, Highland Mills. I was also on the Citizen Action Committee for DOT with the 131 interchange, and yes, in deed, the Central Valley ramp piece of property was part of that plan. I really just have one question in terms of sewer. Is the water and sewer part of the additional services that you would have to -that you would have to pay a fee? You know, so, we talk about police and fire. So, is the additional -DEPUTY MAYOR EGAN: I think if I understand your question, you're asking is, do they have to cover the cost of the additional

water and sewer that that project would use, is that correct? Is that what you're asking? CRAIG SHITTEL: Yes, including infrastructure. GREG MILLER: So, the short answer is yes. If there's additional capacity that's required based on our project, we're committed to funding that, and we have to reach the agreements with the bodies I described earlier, on how we're doing that, to make sure it's acceptable to you. So, obviously these are very complicated issues around capacity, public infrastructure. So, that's what I was specifically commenting on earlier, is that the capacity needed, as well as the on-going costs, we need to reach agreements on -- with the governing bodies on that. DEPUTY MAYOR EGAN: To expand on that just a little bit, the applicant would have to go through the full planning process, as I stated earlier. They would have to go through SEQRA, all the environmental reviews. They've already started that process with the pre-planning needs of the planning board, and they, like any other project, would have to go through that

planning board process, and all of those issues with regard to the water and sewer would be dealt with during the planning process. Are there any other -- okay. FRANCES WONG: Francis Wong, Woodbury. Something I haven't heard anybody talk about at all, and I think it's important, we never talked about the property next-door to where you're thinking about building, Nepera. I don't know where they dumped their stuff. They have some in Maybrook that had to go into a super fund site. That's a super fund site at Nepera. Have we looked at any of that? Have we done any kind of soil samples? How far down? DEPUTY MAYOR EGAN: That is, before Asher responds that, that also will be dealt with during the planning process. I can tell you that the parcel they're looking at is not the Nepera site, but I understand your concern. I'll ask Asher, it looked like you wanted to answer that question. AHSER FLAUM: Yeah, there's some existing baseline studies from when the property was, you know, previously being contemplated for

development. So, there is an existing phase one and phase two from the previous development that we will be doing an update for, yes. FRANCES WONG: The Nepera property has been abandoned for quite a long time. They have Mercury underneath their parking lot, which was supposed to be kept covered. I used to be on the tap for Nepera. That's why I know all this. They have not. They have not kept, maintained the parking lot. It has a lot of cracks in it. So, I'm sure that Mercury has come out and could be going downstream somewhere, and it's just a very big concern that that could be going somewhere. Also, when you were speaking before, you had said something about, we're going to contribute money to the traffic we create. So, does that mean you're going, like if you think you're going to create 20 percent more traffic, that's how much of the bill you'll pay for improvements to the roadways? GREG MILLER: That's a question? FRANCES WONG: Yes. GREG MILLER: Okay. Yeah. What I had said earlier in the presentation was that our 100

intention is to not only offset the traffic that we're creating, but to go beyond that. Now, we're not saying that we're going to fund the entire state plan that was there, but we are very clear in our intention to pay for whatever we would cause, and then go beyond that, to try to help that. FRANCES WONG: How much? GREG MILLER: Well, it's really a function of how we would interact with the state, but our commitment would go beyond that, because the most important thing is, if that traffic problem doesn't get solved, it's not good for our business. So, we haven't, as I mentioned earlier in response to a question, had the in-depth conversations with NYDOT yet on how we solve it, but those economic conversations, I'm sure, will be part of it, but we're committed to going beyond just that which we're causing, to help find the solution. FRANCES WONG: Okay, because the problem is, the DOT in New York State has said they don't have anymore money for any of that funding, and that's why they keep putting it off and off.

DAWN HOGLER: Hello, my name is Dawn Hogler, and I'm a homeowner in Woodbury, and my value of my home is sinking, but I am more concerned about the state of our economy generally, the whole United States. Since the crash of 2008, the two big banks have only gotten bigger. Derivatives in the investments that they're investing in has been increased, and everyone is lying about the economy, saying it's getting better slowly, but getting better. That's a lie. We are about to experience another crash even worse than 2008, and so to invest in something where people need extra kind of luxury funds to go to something like gambling in a casino, I think is very foolish at this point, and I know in New Jersey, because the

laws were past for allowing casinos to be in New York State now, Atlantic city is going bankrupt, the casinos there. Caesars, in -- in Atlantic city, unless I'm completely wrong, do you not own the Rubell? GREG MILLER: No. DAWN HOGLER: Who does? GREG MILLER: It's a privately owned company. It's not owned by any of the one big casino companies. DAWN HOGLER: Okay. Well, there are some casinos in Atlantic City that are now going bankrupt, because they're losing business to other places, and New York -- New Jersey taxpayers are on the hook for 40 percent of that investment loss, because that's the deal that they made. I don't know what New York State or county, you know, if you're making any deals like that, if there was to be a bankruptcy. Are you? DEPUTY MAYOR EGAN: I can tell you that the village has not invested any money in this project. DAWN HOGLER: What about New York State?

DEPUTY MAYOR EGAN: I can't speak for New York State. DAWN HOGLER: Because if they stick us with any kind of a, you know, loss risk, we'll be paying taxes on a casino that's long gone, and I don't see it as a good investment at this moment. Until the Glass Legal Act is reinstated, and we can really stabilize our financial system, I don't see it. DEPUTY MAYOR EGAN: Thank you. Jan, do you want to respond? JAN JONES: Just to reiterate, there are no subsidies by the town. There are no subscribers by the state. This is totally private financing, and there would be nothing that changes that. We won't come forward ever in front of you and say we want something else. DEPUTY MAYOR EGAN: Mr. Golden has comments. MR. GOLDEN: The statute itself that created this, has no provisions in the state statute that created this, for the state to be on the hook for anything with respect to any of the casino developments. There's nothing in the state statute with respect to requirements 104

that the county or the local municipalities do so. As you heard from the Deputy Mayor, the village is not investing any money in this. Mr. Poor may be able to, from the county, represent the county. My understanding is, the county is certainly not investing any money either in this, but Mr. Poor can respond to that, if he wishes. HARRY POOR: That is absolutely true. There is no intention, no plan, no interest in investing any county money in this project at all. As a matter of fact, just the opposite. Our enthusiasm for the project is based on the fact that this will create new non-property tax revenues for the county, as well as property tax revenues for the development, and jobs. CLAUDIA ANNATUCCI: My name is Claudia Annatucci. I live in the valley. I live nearby. I just am afraid that the need for good jobs, the lure of revenue in the county and village coffers is blinding us to the fact that this is an entertainment facility to which people will come, and then they will leave, and they -- they don't benefit local businesses. They may or may not pay create such great jobs,

as I think Woodbury Commons is a great example of promises not met. I think a lot of skepticism and carefulness needs to be brought into play here. The major issues have already been addressed. You can't buy a dedicated exit with DOT. They're not going to work with you on that. Water cannot be created from the air. Water and sewage are huge, and you want to build a whole new water treatment plant, then maybe we can talk. You know, the time frame is impossible to get those other, just, infrastructure things done in time. There is no trickle down to the local economy, I don't think, and the whole thing about outdoor noise, thank heavens one person did refer to it, that hadn't been talked about at all in any of the publicity or leads that I heard about, outdoor facility, outdoor music concerts. For those of you that live closer than I do, that could be a nightmare. I just -- I just think not enough thought. I think we're being blinded by our needs, and I think you should be very careful. I'm a resident of Highland Mills. DEPUTY MAYOR EGAN: Take your hand off the mic. ED JONES: I'm sorry? DEPUTY MAYOR EGAN: Just take your hand off the mic. It's giving a lot more sound. ED JONES: My family and my ancestors have all been from this particular area. In fact, I've got four generations in the house I live in now. I started my police career in 1965 in the Town of Woodbury, and it lasted for 34 years. You talk about changes, and changes that are inevitable really, back in 1965, when I started, we didn't have any traffic lights, and very, even, small population, and quite a few farms, but we realized that there's going to be changes. I was instrumental as far as being part of the development of Woodbury Commons, the traffic. I saw some of the problems that we were going to have, and we put our heads together and we stormed all kinds of problems that could be seen. They had some political clout, because it was going to be a very big

outlet center, and things like this, and the political clout that they had, for one thing is, you see the New York State police out there directing traffic on the holidays. This is something that you don't really see too much in New York State. It's because of the tax dollars that are going back up to Albany, and Orange County. We don't get our fair share of it, as far as I'm concerned with any of that. But what my main concern is, is traffic. I don't know if you make a commitment that you're in favor of this to go forward, are we locked in? And my concern is, I think that interchange is a main -- my main concern. No matter where in the Hudson valley this casino goes, traffic is going to impact us. It doesn't matter where, if it's Blooming Grove, if it's in Tuxedo, if it goes up to Sullivan County, because we're going to get the traffic. So, that interchange down there is very important us, and I think with Caesars, and the clout that they have, and the money that they have behind them, that maybe that should be addressed really, to make sure that that interchange is going to be completed before the 108

casino opens, and that's -- that's my concern. If we say it's okay and you give them your blessings, okay, I'm just concerned, if push comes to shove, and there's a legal matter that comes about, because you're preventing them from opening, I think their money is -- is going to be much more valid -- available to them, than it is going to be to the village and the Town of Woodbury. So, that's my biggest concern. Thank you. DEPUTY MAYOR EGAN: Thank you. Anybody else? We're going to limit it one or two more people and then move on. DAVID LINDSTROM: David Lindstrom, resident of Highland Mills. I do have a concern also on the traffic, and I understand the plans were derived from the plans that were probably put forth before -- before a second tourist traction was even conceived. So, you know, I'm hoping that, you know, what was created in those plans, also takes into account a second attraction that may not have been thought of in the first, because I would think that the -- that was to fix the problem of Woodbury Commons, not divert traffic to another

place. And also, as, you know, somebody who's been in a lot of those traffic jams on the weekend, a lot of the traffic is really created by people leaving, you know, not coming to, you know, our area. So, with -- you know, with a dedicated lane to go towards our area, those people have to leave also. Would there be dedicated lanes to leave? The other thing I noticed is, with the train trestle, you know, getting taken away, there is a baseball fields right there. This community can ill afford to lose any kind of fields for the kids. So, would taking that away impact at all, because it's right next to it. You know, would we lose any time for even a season, because there's another baseball field right across from it. Widening the roads at that point, would we lose those baseball fields, or that park right there, because that's also part of the plan is widening the roads, would that create an issue. DEPUTY MAYOR EGAN: First, I'm just going to ask you to hold your response until we finish up with any other board comments, then you can make a final statement, but our attorney would like to make a couple of points. MR. GOLDEN: This is in response to a couple of different comments near the end. One of which, and the others stem from it, if the board passes a resolution at its subsequent meeting to go ahead and support the application, Caesars application for a gaming license, does that mean that Caesars then is all approved and they go ahead and just build it as they want and make whatever arrangements they want for water, sewer and traffic, and the answer to that is no. This is just to start the process for them, and then if the state selects them for this particular site, the state has been very careful to say that it's not co-opting, or otherwise aborting, the normal local zoning process, and the environmental reviews through what's known as SEQRA, the State Environmental Quality Review Act.

So, what would happen is that if they get approved by the state, if the board does give that resolution, and if they get chosen for that site, they then are going through the local planning process, and the local planning process through the environmental review says that they can't get an approval at the very end if they haven't sufficiently mitigated all of those significant adverse environmental impacts, such as traffic, such as water, such as sewer and the other issues. So, those issues are all going to be involved with the local, your local village planning board. If they need any variances from the local zoning, they're going to have to go to the local zoning board of appeals, just like other residents do when they have their projects. So, there's still a long review process that happens with respect to the project should they, the board vote in favor of having them submit their application license, and should the state actually site them, approve the siting of their facility in Woodbury. There's still a long planning process that would address all of these environmental issues. 112

Also, I just wanted to clarify a few things that I heard earlier, and I didn't have the opportunity. We talked about a comprehensive plan that the village had put together. We spent a lot of time on it. I know the town had tried prior to -- is that better, and the town had tried. The property that we're talking about, as far as the comprehensive plan, was originally set up for commercial businesses, warehousing, and some affordable housing. So, we're not really changing the comprehensive plan from what that site was originally designed for. It was designed for businesses. It was designed for, what they called back then, a trans development -- thank you, a transit oriented development, and it was supposed to be restaurants and some nightlife, and some other type of businesses, that when

people got off the train, they would have a place to go, a place to eat, and there would be some housing down there, and there would be a lot of warehousing, and big box retailers, as well. So, that's what the property was designed for, and that's what it's actually zoned for. The state says, and we never knew about casino property coming there, or we probably could have included that, as well. So, that's what it was. I just wanted to clarify that, so there was no misunderstanding, that it wasn't designed for anything other than what would be there.
