STATEMENT OF PROBABLE CAUSE   The Complainant states that the following facts establish probable cause:  

On August 31, 2016, a 14 year old female responded to the Woodbury Police Department to report that she was sexually assaulted at a townhome in the City of Woodbury, Washington County, Minnesota, in the early morning hours of August 31, 2016.  The victim stated that on the evening of August 29, 2016, she communicated with Dan Kevin Zambrano, date of birth: 9/2/1998, about hanging out. Zambrano and T.L. picked up the victim at her house at 1:00 a.m., T.L. was driving, and Zambrano was in the passenger seat. The victim paid T.L. $20.00 for gas, and believed that other girls would be at the house they were going to. They drove to Walgreens on Donegal Drive, in Woodbury, and Zambrano got out and purchased cigarette rolling papers. They then went to the home of C.O., in the City of Woodbury. C.O. opened the patio door and let them in. P.R.-J., another male, was already at the residence with C.O.  The victim went to C.O.'s room with all four suspects. The victim had knowledge that all four suspects were members of a "gang" that called themselves the "CBG gang". C.O. asked the victim "whats you on", which she knew was gang slang for "who are you gonna have sex with". The victim stated she was not comfortable having sex with C.O. while all of the others were watching. C.O. removed his pants and underwear and said, "just suck my c**k, just do it, don't be a p***y," as he pushed the victim's head toward his penis. The victim provided C.O. oral sex, and C.O. removed the victim's pants and underwear.  After a few minutes C.O. stood up and walked to a nearby dresser. He returned with a condom on his penis. C.O.had face to face vaginal intercourse with the victim and asked her if she was "into choking" as he placed a hand around her throat. The victim heard the other males say, "yah, get her unconscious." The victim moved C.O.'s hand from her throat, and C.O. then turned the victim over and continued having sex with her from behind. The victim heard P.R.-J. say "hurry up, I just want to f**k". As C.O. was penetrating the victim from behind, T.L. approached the victim's face and put his penis in her mouth. The victim said, "Hell no, no dude" to T.L. C.O. told the victim, "yah do it so you'll shut up." C.O. continued penetrating the victim and said he wanted to "finish". C.O. then took off his condom and ejaculated into the victim's mouth.  At this point, P.R.-J. began penetrating the victim vaginally while T.L. penetrated the victim orally. T.L. ejaculated in the victim's mouth, and a short time later P.R.-J. also ejaculated in the victim's mouth. C.O., T.L., and P.R.-J. put their clothes on and began to leave the room. As they were leaving, the victim heard one of them say, "you better give head to him or else." She believed this was in reference to Zambrano, who had not participated at this point. The victim was scared by this threat, so she allowed the oral penetration with Zambrano. Zambrano then left the room and left the victim naked and alone. The victim put her clothes on and began crying. The victim called a friend on Facetime and told them she was just raped, and they tried to find her a ride home.  The victim left the residence and walked to the Walgreens, where she waited for 30 minutes for a ride to pick her up. The victim got a ride home, and the next afternoon she reported the incident to police. The victim stated that she hung out with the suspects two weeks prior to this incident and recalled telling C.O. and T.L. that she was 15 years old, even though she was actually only 14 years old.  The victim went to the Hospital the same day and had a sexual assault examination performed on her. The nurse observed that the victim's tonsils were swollen, and she had bruising on her hips.  3

T.L. provided officers with a statement. T.L. stated that prior to picking up the victim she asked him if anyone was expecting her to do anything that evening and he said he was not. T.L. said that when they were in the car he put his hand on her leg and said, "you wanna do anything," and she said "no". T.L. confirmed that they stopped at Walgreens prior to going to C.O.'s house, and that Zambrano went in to buy cigarillos. T.L. confirmed that he and Zambrano picked up the victim and drove her to C.O.'s house, where C.O. and P.R.-J. were waiting. T.L. confirmed that C.O. was penetrating the victim's mouth and took her pants off. T.L. confirmed that C.O. went to a dresser and got a condom. T.L. confirmed that while C.O. was penetrating the victim, C.O. put his hand on her throat, leaned into her, and said, "what did you say?" T.L. stated that P.R.-J. said, "choke her out". T.L. stated that when C.O. was penetrating the victim from behind, T.L. forcibly put his penis in the victim's mouth. T.L. confirmed that the victim said, "oh, hell no". T.L. stated that when C.O. was done, he pulled off his condom and ejaculated in the victim's mouth. T.L. stated that P.R.-J. got a condom on and was "ready to f**k". He said that P.R.-J. got the victim on all fours and penetrated her from behind, while T.L. penetrated the victim orally. T.L. stated he ejaculated in the victim's mouth and then watched P.R.-J. remove his condom and ejaculate in the victim's mouth. T.L. stated that he, C.O., and P.R.-J. left the room and C.O. said something to the victim along the lines of, "you'll do him too," in reference to Zambrano. T.L. stated that there was hesitation on the victim's part during the sexual acts, and that she was coaxed. T.L. said, "there is always convincing between a girl and C.O."  T.L. stated that he had previously been told that the victim was 14 years old. T.L. said that the day after the incident, C.O. called him and asked if he had talked to the victim because, "she's talking that weird s**t." C.O. then told T.L. that the victim went to the police and reported that they "raped" her. T.L. told C.O. not to do anything drastic. C.O. said the victim was on Facetime with friends while at the police station, and told T.L., "I'm skipping states, we're on the road right now." T.L. told C.O. that they have a better chance to fight allegations if they relax, and find credible people to support their side of the story.
