10/7/14 Meeting of the ACSA Human Resources Council 1. Welcome Lunch The 10/7/14 Meeting of the ACSA Human Resources Council began at 12:01. Carol Hansen, Council President welcomed everyone to the meeting, led introductions, and reminded the council of our efforts to go green and that bylaws, minutes, HRC expectations, etc. were emailed to everyone. 2.

a) Note Takers Assigned- Today -Mary Berkey (8) b) Reviewed the Agenda c) Approval of April 2014 minutes Moved Rose Dunn (13) Second Debra Moore Washington (AASPA Liaison) Passed by all unanimously d) HRC Announcements updates and recognitions Travel reminder-- ACSA will pay for Travel to and from the HRC meeting, but the institute, hotel or meals needs to be taken care of by districts, regions, or members. e) Nomination of Legislative Policy Committee Member Carol nominated Steve Hovey (19), Steve Accepted Second Cindy Frazee (18) No other nominees Passed by all unanimously f) Nomination of HRC President - Elect Carol Hansen explained that this decision is pending approval of the newly revised by-laws by the ACSA Board. Before the by-law revision, there was a three year term for President, but not a President elect, and there was no clear role for past president. New President Elect - 1 year President -2 years, Past President - 1 year. Carol nominated David Robinson (Region 4 Rep; Negotiator’s conference planning team) Second Mary Berkey (8) No other nominations Passed by all unanimously

Carol announced that she and & Debra Moore Washington will be at AASPA next week and Tom Stekol will be her representative at Delegate Assembly.

3. Introductions and Regions Check ins All Regions present, except Region 6 due to an emergency. Regions shared common concerns and negotiations update. Statewide common concerns included (1) the current substitute shortage which is compounded by the increased needs for ongoing professional development; (2) Trying to deal with raises, comparison districts, and STRS increases from both districts and employees within the context of the disparity of funding based on LCAP. The ranges of negotiated salary increases are 2% to 8%; (3) Shortage of special education and other hard to fill positions. This is the first year many districts have unfilled vacancies and are being forced to place non-NCLB compliant staff into classrooms. And at the same time CTC is trying to tighten up waivers for SLP’s and others. 4. Update for ACSA’s Educational Services Department (Chris Adams) Update from ACSA Ed Services - Chris introduced himself. He has now been on the job at ACSA for a year after leaving a Superintendent position in Cambria. He shared that Linda Darling Hammond is trying to ramp up teacher credentials and making CTC requirements more stringent. He suggested that there would be great power in having the HRC speak to the CTC about the shortage of teachers and the impact CTC regulations has on district recruitment and filling vacancies. CTC has reached out, we have favor, we need to take advantage and push...getting input from HRC. He further shared the agenda of Ed Services in developing partnerships and professional capital. During his presentation, there was a strong concern expressed by members of the HRC that the Negotiators’ Summit, held in Palm Springs last June was planned without input from HRC. The subject of negotiations has always been an HRC function. There was concern from HRC members that the Negotiators’ Summit was done to us, not with us. There was also a discussion whether a one voice for negotiations initiative is the direction we should be going if we are to bargain in good faith and continue relationships with our own bargaining units. 5. Results of HRC Survey Carol reviewed survey results. Time to exchange ideas is the highest rated item followed by legislative advocacy. Write in topics were recruitment and evaluation. Email was the highest rated for getting and giving information, so everyone is encouraged to get the email addresses of all the HR professionals in their region. Support, networking and learning from each other is a high priority. 6. Creating HRC Actions and Goals Based on the survey, we broke into groups to discuss next steps. Carol recorded these for review and direction. Next steps include: 1) Small group discussions at future HRC meetings on hot topics (see above). Carol will seek input (via email or google forms) on suggested (additional) topics and ask for representatives to lead the hot topic discussions. 2) Sharing of documents and materials about hot topics. 7. Update on Professional Development Activities Personnel Institute Dana Reginato & Julie Mitchell (absent) Reviewed facilitator role for sessions and requested additional sign-ups.

Negotiators’ Symposium Sherri Black & Dana Reginato This year the NS will be held before Martin Luther King Holiday at the Hilton Bayfront January 14-16, so HRC is 13th. Need help with a good lunch speaker for Thursday for 3040 minutes from the role of a practitioner. Request some creative strategies (pocket chart negotiation) in addition to all legal sessions. New Concept --Thursday afternoon, very last session will be a networking session, with topic related discussions. HRC and attorneys can spread out and help with the table topics. Possibly get a media person to talk about how you talk to the media. Need strategies for those in tenuous situations at the table

Legislative and ACSA Updates (Laura & Sal)

STRS - unfunded liability is causing everyone to deal with increase in rates and it will be part of the negotiations. Don’t envision any changes; if a change, not before 5 years because that’s when the legislature will get the report of the impact of the changes; hopefully the legislature will listen to stakeholder groups along with the report; this is still dependent on the market and they could readjust up; Piece of this funding mechanism - the department of finance is this agreement for the state’s share to go up to where it formally had been, the state’s has be reduced, so it’s riding at about 2.3% Governor agreed to increase the state to 4.6% and guarantee the 2% COLA, in return he doesn’t want the new funding plan to continue to fund the defined benefits portion of the program. So it wouldn’t be credit, it would be in supplemental. It’s triggered a payback - every single employee has a different number, their number will be reported to HR at the start of next year, the law requires HR to refund the money to the individual. We have a year to figure this out. Our districts aren’t set-up to receive a payment from STRS and to give it to that employee….what if the employee was fired, died, retired, moved… THIS IS VERY CONFUSING, stay tuned and pay attention. Its one year’s worth of money. Creditable Compensation Regulations - adopted by STRS, beginning January 1, 2015, how the system will apply creditable compensation will be different, some allowed, some not, and some only in certain circumstances. Between now and 1/1/15 ACSA will provide as much guidance and possible to ensure local level understanding of these regs. Entire year is being allowed for contracts to be restructured. During the one year window restructuring may take place, and it won’t count as spiking. STRS audits can only go back 7 years now. They will be looking for consistency of pay and consistency with other districts even though Boards can make their own decisions. STRS is being sued by five administrators and has statewide implications and calls to question rules applied in audits. If courts agree STRS overstepped, Judge could say rules are unconstitutional so the people should be exempt from penalties...would that mean, currently audited people could be exempted too? It could finally say the statute under which STRS operates is vague and needs clarity. Attorney General’s office is defending. ACSA is supporting the plaintiffs. CTA is not currently involved. Retired and very active CTA folks have approached, but currently no partnership.

Creditable Service - Deadline is past for submitting for the exemption for Directors of HR etc. and the statute needs to be fixed. What really defines a member of STRS? What really defines the types of positions that should be STRS eligible? Working towards legislative relief…Sal will work with us to see if there are deficiencies in the new language. Laura--A lot of labor management bills that we were able to defeat. We are the unintended consequence of the sick leave bill. We tried to get subs out of the Bill. Bill was going to be vetoed. The author of the Bill’s family members were substitutes… personal story prevailed…. Governor was able to negotiate out the in-home workers, so the Governor signed...and too late for us. ACSA prevailed in veto 1550 - prohibited last best final offer. Mandated Reporting - Bonilla Bill AB …. For contract renewal, for new hires, for new school years, maybe ACSA will do a video that we can show. AB 215 Teacher Dismissal Bill… analysis...trying circumventing Vergara… some things are better, but doesn’t address everything. Laura passed out ACSA analysis. Vergara - ACSA has been active behind the scene. ACSA’s focus is on teacher effectiveness. ACSA is working to form a Task Force of HR, C&I and others to try and create a teacher effectiveness document for principals and teachers and possibly introducing a bill in January. Currently the media and public are with us so we’re trying to find the balance of what really makes sense. There are some unintended consequences as this issue started as an L.A. Unified issue. We’re trying to establish a floor for improving educator effectiveness…. kind of like the Stull bill…. We’re worried about the outcomes since the judge’s decision in the Vergara case was so poorly written. 9. a.

Liaison Reports CEL Liaison - Sherry Manley All classified employees and mostly confidential employees make up this group. There is a conference in February that is good professional development for administrative assistants and directors in classified leadership. Last year CEL had the biggest conference so far. This year the event will be February 26-27 Hilton Garden Inn in Emeryville. They try hard to make it applicable to classified employees. A new CL Leadership Academy starts October 25 for 5 Saturday sessions in Concord.

b. PASSCO - Steve Hovey Concern with CTC and SLP waivers and Special Ed subs; had a presentation from DOJ about why you get delays and such. Also an attorney presented on Skelly. Edjoin has an IPAD app that allows you to be paperless through the interview--Questions online, keeps scores, totals scores, can see the application side by side. Works seamlessly and they keep your recruitment record for you. We think it will save money. c. AASPA - Debra Moore Washington

American Association of School Personnel Administrators, holding their 76th annual conference next week in Portland, OR. Debra and Carol will be presenting at the event. Like HRC, AASPA is good at helping people become strong HR administrators. 11 Californians are scheduled to attend conference in Portland. They hold a Boot Camp for those interested in becoming an HR Administrator, in Florida in January. Major initiatives, get certified to be HR administrators….focus is about communicating with state leaders about those things that they need to know. 10. Review of Next Meetings 4:40… Carol closed the meeting… Margaret Arthofer was introduced as the staff liaison.
