A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OJAI, CALIFORNIA, AUTHORIZING THE ACQUISITION OF 205 GRAND AVENUE, OJAI CALIFORNIA AND AUTHORIZING DESIGNATED CITY STAFF TO EXECUTE ESCROW DOCUMENTS AND CERTIFICATE OF ACCEPTANCE SUBJECT TO APPROVAL OF THE FINAL DOCUMENTATION BY THE CITY ATTORNEY WHEREAS, the Ojai City Council intends to acquire real property located at 205 Grand Avenue, Ojai, California, Assessor's Parcel Number 021-0-043-170, the legal description of which is included in Exhibit A hereto (the "Property"); and WHEREAS, a written offer to acquire the Property has been negotiated; and WHEREAS, the intended purpose of acquisition for the property is to be available for future uses as determined by the City, potentially including park, recreational, open space, and circulation improvement uses; and WHEREAS, the purchase is consistent with the General Plan's policies which encourage the City to maintain its small-town, low-density, rural character, to maintain a functioning street system for all including pedestrians, bicyclists and vehicles, and to preserve open space, promote a healthful atmosphere, provide space for recreational opportunities and protect public safety. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF OJAI, CALIFORNIA, DOES HEREBY RESOLVE AND ORDER, AS FOLLOWS: Section 1. Authority The City of Ojai is authorized to acquire the Property under Government Code section 37350. Section 2. Approval of Acquisition The City of Ojai authorizes the acquisition of the Property located at 205 Grand Avenue, Ojai, California, Assessor's Parcel Number 021-0-043-170, which is legally described in Exhibit A hereto and is depicted on the site maps attached as Exhibit B. Section 3. Authorization to Execute Sale and Escrow Documents Subject to review and approval of all documentation by the City Attorney, the City of Ojai authorizes the Interim City Manager or his designee to execute sale and escrow documents on behalf of the City of Ojai to conclude the purchase of said property between the City of Ojai and Rick Prinzig (seller).
Section 4. Authorization to Execute Certificate of Acceptance The City of Ojai authorizes the Interim City Manager or his designee to execute a certificate of acceptance on behalf of the City. Section 5. Appropriation The City Council hereby appropriates $200,000 to pay for the purchase of the Property out of Fund 31 with funds transferred in from the repayment of the Redevelopment loan. Section 6. Certification The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be processed in the manner required by law.
