A Work Session of the Town Board of the Town of Williamson, County of Wayne and State of New York was held in the Town Complex Court Room located at 6380 Route 21, Suite II, at 7:00 PM on Tuesday, July 14, 2015. The following were PRESENT: Supervisor James D. Hoffman Councilman Gary Orbaker Councilman Anthony Verno Councilman Michael Bixby Councilman Thomas D. Watson ABSENT: None Councilman Orbaker made a motion, seconded by Councilman Bixby, to enter into Executive Session to discuss litigation and a personnel matter on a particular employee at 7:05 PM. The motion was carried. Councilman Watson made a motion, seconded by Councilman Bixby, to return to Open Session at 7:22 PM. The motion was carried. The Board reviewed bills for payment. The Regular Meeting of the Town Board of the Town of Williamson was held in the Town Complex Court Room located at 6380 Route 21, Suite II, following the Worksession at 7:30 PM on Tuesday, July 14, 2015, by Supervisor Hoffman with the Pledge of Allegiance. The following were PRESENT: Supervisor James D. Hoffman Councilman Gary Orbaker Councilman Anthony Verno Councilman Michael Bixby Councilman Thomas D. Watson ABSENT: None Nancy Gowan, Kurt Allman, Highway Superintendent, Joanne & Curt DeBrine, Wilma Young; Sun & Record and undersigned Town Clerk was also present. A notice having been published for a Public Hearing in accordance with Section 135-3 of the “Property Nuisance Abatement Code” regarding tax parcel #66116-00-115955, located at 4215 Pearsall Road and owned by EPCP Pro Property Management Corp., 460 State St., Suite 308, Rochester, New York 14608. Supervisor Hoffman then declared the Hearing open at 7:31 PM. Supervisor Hoffman reviewed the violations regarding the unsafe condition of raw sewage seeping up through the soil and running onto the neighbors property which has created a health hazard to residents residing at said property. No one was present on behalf of the property and nothing has been done to correct the problem. The Board agreed to move forward to correct the conditions and the cost will be applied to the 2016 Town and County tax bill. Supervisor Hoffman closed the Public Hearing at 7:33 PM with a motion made by Councilman Verno, seconded by Councilman Watson. The motion was carried.

CURTIS DEBRINE WILLIAMSON BOARD OF ASSESSMENT REVIEW WHEREAS: Curtis DeBrine has decided to retire from the Board of Assessment Review, and WHEREAS: Curt was first appointed as a member of the Board of Assessment Review on January 12, 1989 to finish out the term of Steve Haywood and has served diligently for the past 26+ years as a Board member and as Chairman of the Board, and WHEREAS: the Williamson Town Board on behalf of the Town residents wish to commend Curt for his dedication to the Town of Williamson and his service to our community as a member of the Board of Assessment Review, NOW, THEREFORE, BE IT RESOVLED: that the Williamson Town Board consisting of Supervisor James D. Hoffman, Councilman Michael Bixby, Councilman Gary Orbaker, Councilman Anthony Verno, and Councilman Thomas Watson, on behalf of the residents of the Town of Williamson, hereby formally recognize Curtis DeBrine for this many years of service to the Town of Williamson and wish the contents of this Resolution be recorded for posterity as an official record of the Town of Williamson. Public Comment: No one wished to make a comment. Supervisor Hoffman made a motion, seconded by Councilman Verno, to accept the Consent Agenda containing the following items: a. previous minutes – June 23, July 6, 2015 b. Town Clerk’s report & Tax Receiver’s report c. monthly dept. reports The motion was carried. Councilman Bixby made a motion, seconded by Councilman Verno, to authorize the Town Supervisor to sign a maintenance agreement with Water Wise Inc. for complete water treatment service program of the Evaporator Cooler, Glycol Loop and Hot Water Loop. The cost of this maintenance agreement will be $1,450.96 from July 1st, 2015 to June 30, 2016. FYI – the cost of this contract last year was $1,408.70 (an increase of $42.26). This does not include glycol that may be needed for makeup.

Councilman Bixby made a motion, seconded by Councilman Watson, to accept the resignation from Curtis DeBrine who has served on the Assessment Board of Review for the past 20 years. The Town wishes him well and want to thank him for his many years of hard work. The motion was carried. Councilman Bixby made a motion, seconded by Councilman Verno, to direct the Town Clerk to advertise for the upcoming opening on the Board of Assessment Review. The position will be to complete the term of Curtis DeBrine and will end on September 30, 2017. The advertisement will appear in the official town papers the week of July 20, 2015 with applications being accepted until August 19, 2015 at 4:30 PM. The motion was carried. Supervisor Hoffman made a motion, seconded by Councilman Verno, to authorize the Town Supervisor to sign a water/sewer budget review agreement with Bernard P. Donegan, Inc. for the 2016 water/sewer rate study. The cost for these services are not to exceed $5,000.00. The motion was carried. Councilman Bixby explained the Park Committee has been discussing putting solar panels on the new Pavilion being built at the Town Park. They will be checking to see if there is any grant monies for the project and if not, find out what it would cost out of their budget. Councilman Orbaker presented the following Resolution and moved its adoption. It was seconded by Councilman Bixby. WHEREAS: The Town of Williamson is proposing to construct a Sediment/Salt Storage Facility behind the Highway Barns on Route 104, in the Town of Williamson, to be known as (the "Project"), and WHEREAS: the Town of Williamson has applied for a grant to assist in the financing of said Project, and WHEREAS: In order to aid the Town Board in determining whether such project and financing and other related actions of the Town in connection therewith (the"Action") may have a significant effect on the environment, the Town Board has caused to be prepared the appropriate Environmental Assessment Form (EAF), and WHEREAS: The Project has been identified as a “Type II Action” pursuant to the State Environmental Quality Review Act (SEQRA) and the Town Board has expressed its desire to act as lead agency for SEQRA review purposes, and WHEREAS: All other potentially involved agencies have been contacted by letter and none have objected to the Town Board of the Town of Williamson acting as lead agency, and WHEREAS: The Town Board has duly reviewed the EAF, map with respect to the above-referenced project, as well as any public comments and any correspondence from interested or involved agencies, and has duly considered the impacts that may be expected from the proposed action and compared the same with the criteria set forth in the applicable SEQRA regulations, NOW, THEREFORE, BE IT RESOLVED: By the Town Board of the Town of Williamson, Wayne County, New York, as follows: 1. The Town Board hereby declares that it is acting as lead agency for the purpose of SEQRA review concerning the Project and all actions related thereto.

2. Based upon its review and consideration of the EAF and other necessary criteria, the Town Board hereby finds that (a) the proposed capital project constitutes a "Type II Action" and that (b) the object of the above-referenced action and the approval of any financing therefore will result in no major adverse impacts and, therefore, is not an action which "may have a significant effect on the environment" and that since said action will not have a "significant effect on the environment", no "environmental impact statement" need be prepared, as such quoted terms are defined in the applicable SEQRA Regulations. 3. By reason of the foregoing, the Town Board hereby authorizes and directs the Supervisor to execute and file a Negative Declaration in the form attached hereto and to sign the first page of the Short Environmental Assessment Form EAF submitted by the Project Engineers designating that the Project and all actions related thereto will not have a significant impact on the environment. 4. The Town Board hereby authorizes the Supervisor to forward, upon request copies of this Resolution and the Negative Declaration to all appropriate agencies. 5. The Town Clerk is hereby directed to maintain for public inspection a file containing a copy of this Resolution, the Negative Declaration and all submissions to date concerning the Environmental Review of this project and all actions related thereto. 6. This resolution shall take effect immediately. Roll call vote on the Resolution was as follows: AYES: Supervisor James D. Councilman Verno made a motion, seconded by Councilman Bixby, to direct the Town Clerk to advertise in the official Town papers the week of July 12, 2015 to cancel the Solarize Williamson Campaign meeting scheduled for July 18, 2015 and to advertise that the next meeting will be held on July 25, 2015 from 10:00 AM until 11:30 AM. The motion was carried. Councilman Orbaker made a motion, seconded by Councilman Watson, to approve disposal of fill dirt at property located between Redman Road and Townline Road. The property is owned by Dan VanAcker. Fill dirt will be disposed of as per Consent to Entry and Release of Liability Agreement signed by the owner. The motion was carried.
