AMENDED C O M P L A I N T The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:

PROBABLE CAUSE REMAINS THE SAME; OFFENSE AMENDED TO ADD COUNT 4:

Complainant, Charles Valleau, of the Brooklyn Center Police Department, has investigated the facts and circumstances of this offense and believes the following establishes probable cause: On May 15, 2012, Brooklyn Center Police Officers were dispatched to a shooting that occurred at 6819 Humboldt Avenue North in Brooklyn Center, Hennepin County, Minnesota. Upon arrival, officers located a male victim identified as G.M.D. outside the apartment building with a gunshot wound to his back. G.M.D. was transported to North Memorial Medical Center. Officers spoke to A.M.B. at 6819 Humboldt Avenue North, Apartment #101. A.M.B. told officers that DEONTE ANDERSON, defendant herein, is the ex-boyfriend of her sister A.M.L. The defendant had called A.M.L. several times during the evening and said he was coming over. The defendant and A.M.L. have a history of domestic violence. At the time, A.M.L., A.M.B., G.M.D. and K.G.W. were inside Apartment #101. A short time after the defendant stated he was coming over, A.M.B. observed him walking down the hallway toward the apartment. The defendant had a handgun with a scope in his hand. A.M.B. ran into the apartment and the defendant followed her inside. The defendant went into the back bedroom and struck K.G.W. in the head with the handgun. Officers observed an injury to K.G.W.’s head. A.M.B. stated she tried to help K.G.W. and pushed him out of the bedroom at which time the defendant was alone with G.M.D. in the bedroom. A.M.B. heard a single gunshot and observed G.M.D. run out of the apartment bleeding. The defendant then left the apartment.

Officers learned that the defendant had left the area in a tan vehicle. Officers arriving at the scene observed a tan vehicle leaving the area that matched the suspect description. As officers caught up with the vehicle, the female driver pulled over and exited the car. Officers observed the defendant slide over to the driver’s seat and drive off at a high rate of speed. Officers activated their lights and sirens and pursued the defendant several miles before the defendant crashed the vehicle. The defendant fled on foot and was taken into custody on top of a nearby roof top. Officers conducted a show up and A.M.B. identified the defendant as the person who had the gun in the bedroom, the person who assaulted K.G.W., and the person who was alone with G.M.D. when he was shot. Your complainant has learned that G.M.D. suffered a gunshot wound that entered his upper back and exited his upper chest. G.M.D. also suffered a collapsed lung.

That on or about May 15, 2012, in Hennepin County, Minnesota, DEONTE ANDERSON, using a dangerous weapon, assaulted G.M.D. and inflicted great bodily harm.

COUNT 2:

ASSAULT IN THE SECOND DEGREE (FELONY) MINN. STAT. § 609.222, SUBD. 1; § 609.101, SUBD. 2; § 609.11 PENALTY: 3-7 YEARS AND/OR $4,200-$14,000

That on or about May 15, 2012, in Hennepin County, Minnesota, DEONTE ANDERSON, while using or possessing a firearm, assaulted G.M.D.

COUNT 3:

FLEEING A PEACE OFFICER IN A MOTOR VEHICLE (FELONY) MINN. STAT. § 609.487, SUBD. 3 PENALTY: 0-3 YEARS AND 1 DAY AND/OR $5,000

That on or about May 15, 2012, in Hennepin County, Minnesota, DEONTE ANDERSON did by means of a motor vehicle, flee or attempt to flee from a peace officer acting in the lawful discharge of an official duty, who DEONTE ANDERSON knew or reasonably should have known was a peace officer.
