Background: ALGA’s Local Roads and Transport Congress is our opportunity to meet, collaborate and represent the sector’s interests. Council has been invited to attend the 2016 Roads Congress, which will take place in Toowoomba, Queensland from the 9th to 11th November 2016. The Roads Congress is an important opportunity to engage with the Government on how its policies will impact on the provision and maintenance of local roads as well as the broader infrastructure and transport agenda. The Congress will feature national and international speakers and the relevant Government and Opposition representatives have been invited. “Council’s attendance at this year's Roads Congress strengthens the work that ALGA and your state and territory association is doing to secure better funding for local government roads and infrastructure. Your voices and your knowledge will show the Commonwealth Government the value you place on working together to deliver positive results for all our communities”. Background The purpose of this report is to remind councillors and designated persons of the necessity to lodge Pecuniary Interest Returns. A Councillor or designated person holding that position on 30th June in any year must complete and lodge a Pecuniary Interest Return by 30th September in that year. The returns can be inspected by members of the public and assist in ensuring transparency and accountability in Local Government decision-making. The obligation upon councillors and others to returns is as much a protection for them as it is to the community. Information and blank returns have been emailed to you or posted out. Recommendation Council note the information received in relation to Pecuniary Interest Returns and ensure that returns are back to Council by 30th September 2016.

E2.3.5 Caretaker Provision - Elections to be held in September 2016 Ross Earl, General Manager

Background: Like the Commonwealth and State Government, Local Councils are expected to assume a caretaker role during the election period to ensure that major decisions are not made which would limit the actions of an incoming Council. On 22nd June 2012 amendments were made to the Local Government (general) Regulation to mandate what were formally caretaker conventions. the commencement of the caretaker period. The term “controversial development application” is defined as one for which at least 25 persons have made submissions by way of objection. Appointing or renewing the appointment of the General Manager or terminating their employment. (This does not include the appointment of an acting or temporary General Manager).

In particular cases these functions may be exercised with the approval of the Minister. The caretaker provisions in 2016 will commence on Friday 12th August 2016, which is 21 days from the election scheduled for 10th September 2016. Financial Implications: There are no significant financial implications for Council envisaged at this stage. Recommendation That Council receive and note the information in respect of the Caretaker Provisions under Clause 393B of the Local Government (General) Regulation 2005.

P4.2 Delivery Program and Operational Plan Review as at the 30th June 2016 Phil Johnston, Manager of Tourism & Development Ross Earl, General Manager

The integrated planning and reporting process has been in place for the duration of this Council’s term. The long term planning that this has allowed has been a valuable tool to survey the community about their wants and needs, to assist with long term financial planning, to ensure staffing levels were adequate to meet the needs of the long term plan and to assist in priority setting for each year’s operational budget. The overall framework can be seen below.

The process began through the development of a community engagement process and the delivery of a number of community workshops across various sectors and in the Villages. This gave Council an opportunity to listen to the wishes of the public but also record these wishes in the Community Strategic Plan. Each quarter Councillors have reviewed progress towards these goals and assessed these in the context of our four year Delivery program.

Overall many positive results have been achieved. These have included: Priority area

Achievement

Timber Bridge Replacement Program

This is one of the highlights for Council. The ongoing priority given to this item has meant that Bourke Shire Council is now in a position to finalise this program in the current financial year. For many Council’s, this remains a concern but fortunately for Bourke Shire Council this is all but achieved.

Plant replacement program

This is another priority area for Council as Bourke Shire is very dependent on road contracts and maintaining our heavy fleet is vital. Each year throughout this term this has been met and often early in the term.

Updated LEP and State of the Environment reporting

Updating the LEP is a difficult task that was completed during this term of Council. The process again involves community consultation and the updating of our local land use strategy and conforming with a State based template. It is interesting to note that with the likely development of an Abattoir for Bourke Shire that there will be a need to review this strategy in the next term of Council and update the land use strategy.

Village Maintenance Program

The Village maintenance program and ongoing Village meetings have been successful. Each year the needs of the residents are assessed and over time improvements have been made. This includes hall upgrades, waste disposal upgrades and assistance with the Rural Fire Service as examples.

Development of Walkden’s Bore

Identified in the town water feasibility study to assist in drought proofing the town. Council will now continue to pursue the issue of raising the weir which was our highest priority for town water security.

Mertin St and Warraweena St well replacement

Both identified for replacement in the short term as part of the 10 year strategy and long term asset replacement. Both wells now completed at a cost of $1.9M.

Ongoing Youth Program

This has been an important focus for Councillors. It has meant for example that half of the community contributions budget is quarantined for Youth activity, it has meant the further improvements to the Randall Centre for PCYC, support for Youth off the Streets and the establishment of a Summer youth program. Important infrastructure has also been built such as the Bourke Skate Park and a focus on Central Park for playground activities.

Meeting long term financial targets

Long term improvements in key financial ratios have been met including our debt ratios and availability of cash. Council staff have continued to improve our assets plan and undertook a revaluation of assets over the term of this Council.

Growing the Tourism industry

Growth in the tourism sector has been maintained and has been a priority of Council. The tourism sector is an important supplement to our rural economy and assists in dry times. Bourke Shire Council has encouraged the ongoing development of the Exhibition Centre, improved marketing activities, continuation of our attendance at Caravan and Camping shows and the support of the Outback Show.

While improvements have been made in many areas and in some cases works complete there are some areas which will need attention if they are to remain a priority for the next Council term. Internally this means additional resources in the area of the coordination of training and the development of a coordinated training approach across the whole of Council. In regards to the Community we have not been able to achieve a return of air services or improved mobile telecommunications in areas of our Shire. While these priorities are largely outside of the scope of Council resources it is important to continue to advocate for these improvements. Overall the Integrated Planning and Reporting Framework has been of benefit to Council and more importantly the wider community. In the new term of Council a review of the plan will be conducted and the new priorities of the community and Councillors reflected. Recommendation: That the report in regards to the Community Strategic Plan presented to the Council meeting on Monday, 22nd August 2016 be noted.

TYPES OF APPROPRIATE MANAGED FUNDS Cash funds invest solely in cash and bank bills, but offer much greater flexibility than Council investing in bills direct (which are held to maturity), since they offer immediate access to funds at all times with no penalty. Both Rated and Unrated Cash-Plus funds invest primarily in bank bills and floating rate notes and only make strategic entry into longer term government securities when appropriate to enhance returns. They aim to outperform bank bills over a 6-12 month time horizon and should primarily be used for Council’s longer-term “core” investments. Access to funds is still normally available within 24 hours at no penalty. 2. All relevant legislative requirements together with political, social and economic environments are to be taken into account in Asset Management. Asset Management principles are to be integrated within existing planning and operational processes. BACKGROUND Council is committed to implementing a systematic Asset Management methodology in order to apply appropriate asset management best practices across all areas of the organisation. This includes ensuring that assets are planned, created, operated, maintained, renewed and disposed of in accordance with Council’s priorities for service delivery. Council owns and uses approximately $274,300,000 $224,186,000 of non-current assets to support its core, business of delivery of service to the community. Asset Management practices impact directly on the core business of the organisation and appropriate Asset Management is required to achieve our strategic service delivery objectives. Adopting asset management principles assists Council in achieving its Strategic Longer-Term Plan and Long Term Financial objectives. A strategic approach to asset management ensures that the Council delivers the highest appropriate level of service through its assets. This provides positive impact on;  Members of the public and staff; 

Council’s financial position;



The ability of Council to deliver the expected level of service and infrastructure;



The political environment in which Council operates; and



The legal liabilities of Council.

VISION Bourke Shire Council’s vision for Asset Management is to provide and manage an appropriate mix of infrastructure at the lowest life cycle cost in a sustainable manner to support our community. KEY COMMITMENTS The following is a set of key commitments that the Bourke Shire Council will adhere to in relation to total asset management. Bourke Sire Council will develop, maintain and adopt Asset Management Plans covering all major Asset Classes:  Transport (Roads, Bridges, Footpaths)  Water Supply  Sewerage Services  Stormwater Drainage  Parks and Landcare  Buildings The format of Asset Management Plans will align with the Institute of Public Works Engineering‘s International Infrastructure Management Manual (IIMM), which ensures that best practices are incorporated, including community consultation for levels of service. Bourke Shire Council will develop and maintain an Asset Management Improvement Strategy (AMIS) with a planning horizon of 4 years and which sets out continual improvement for asset management systems and processes in line with the State Government’s Integrated Planning and Reporting Framework. Prior to considering changes to services levels and / or new capital works, Council will consider the following:  Alignment with the strategic objectives of the community (Community Strategic Plan).  Options for service delivery without Council owning an asset (third party asset ownership).  Options to renew assets before acquiring new assets.  The full lifecycle cost of owning the assets (whole life cost)  Whether the whole life cost of asset ownership can be accommodated within the Long Term Financial Plan. Bourke Shire Council will regularly review (in line with the AMIS) the need for asset ownership and will implement a process to dispose of redundant or poor performing assts. Bourke Shire Council will develop, maintain and adhere to the Defined Asset Management Policy (DAMP). Bourke Shire Council will establish and maintain a multi-disciplinary, cross functional Asset Management Work Group (AMWG) to guide the development of asset management practices, systems and processes.

Asset Management Bourke Water Supply

PROPOSED REVIEW DATE: POLICY  This policy relates to the connection of water services to properties within Bourke Shire. 

In Bourke and North Bourke, a dual water supply is provided, being a filtered metered water supply and an untreated, unmetered raw water supply. In Byrock, there is only an untreated supply with meters fitted which are used for monitoring only. In the other villages, only an untreated, unmetered supply is provided.



Council will provide water services to a property to the nearest point of the property to Council water mains. It will be the responsibility of the landowner to extend this service throughout the property to the desired locations. Council may upon request by the property owner install this service to an alternate location, on the condition that there will be no additional cost to Council, or alternately if the property owner agrees to pay for any additional works required.



Council will supply a water meter to each NEW filtered water connection to the water supply. The property owner will be responsible for any costs associated with the repair and maintenance of the water meter thereafter. This work will be completed by Council and charged to the property owner. (Refer to Tampering with and Vandalism to Water Meters Policy.) Council is responsible for general maintenance through normal wear and tear of the service connection from the Council main, up to and including the tap on the water service inlet to the property. Any fittings or materials on the service after the tap (including the water meter) are the responsibility of the property owner.





The property owner is responsible for the rectification of any damage to the water service connection, including vandalism. For example, if a water service connection is run over by a vehicle (that may or may not be owned by the property owner), then the property owner is responsible for all costs associated with the repair.



In North Bourke, the filtered and raw water supply must meet Council’s Engineering standards Development Application consent which allows for a storage tank and pressure pump assembly.



For Bourke township and the Villages, under no circumstances may a pump of any type be connected to the water service connection. Should a property owner require the use of a pump, it will be necessary to install a storage tank on site, and then pump out of the tank, allowing the storage tank to refill under normal mains pressure. A section 68 application and approval is needed for any pump and storage system. A special application form and fee will be

needed to apply for this pump and storage system, in accordance with Section 68 of the Local Government Act. 



The Bourke Shire Council Management Plan defines the specified Rates and Charges for the connection of water to properties within Bourke Shire. These Charges cover the following materials and services: o In Bourke and North Bourke, the supply and installation of a water service (including water meter for filtered services), of a size selected by the property owner. Whilst the property owner may request the preferred size, the General Manager reserves the right to reject any such request where this may be a detriment to the water supply system, particularly if considered by the General Manager to impact on other users. o In all Villages, a maximum size connection of 20mm applies. Rates and charges will be as per the Schedule of Rates and Charges in the Council’s current Management Plan, reviewed by Council each financial year. The charges include any excavation and reinstatement works required.

3.7.9 Internal Filtered Water Leaks

PROPOSED REVIEW DATE: POLICY  This policy relates to internal water leaks on the property owner’s / resident’s side of the filtered water meter at properties located in Bourke and North Bourke. 1.

Council is responsible for general maintenance through normal wear and tear of the service connection from the Council main, up to and including the tap on the water service. Any fittings or materials on the service after the tap (including the water meter) are the responsibility of the property owner.

The property owner is responsible for the rectification of any damage to the water service connection, including vandalism. For example, if a water service connection is run over by a vehicle (that may or may not be owned by the landowner) then the property owner is responsible for all costs associated with the repair of the same.

Once water has passed through and registered on any water meter, cost of the water is the responsibility of the property owner.

In extremely extenuating and exceptional circumstances, when an excessive filtered water meter reading is recorded, a concession may be given under the following conditions: 

The variation exceeds the average use for the two previous corresponding water account periods by greater than 50%.  The pipeline is in good condition and constructed of approved material for domestic use.  The leakage was located on the main internal water supply pipe servicing the premises. A defect in the service has occurred which is totally hidden, and not visible. The General Manager is satisfied that there has been immediate and effective action to make repairs.  A copy of the invoice for repairs by a Licenced plumber and a signed report by the plumber that provides the address and details the nature and location of the repairs is provided to the General Manager. A signed statement that the defect was not readily visible or apparent will also be required in this report.  The property owner / resident will be required to provide a statutory declaration setting out the date, how the leak was identified and what action was taken. The statutory declaration along with the plumbers report is to be forwarded to Council’s rate section within 2 weeks of the work being carried out. Arrangements will then be made for the water meter to be read as soon as practical by Council staff.  A similar claim has not been granted for the property in the previous 3 years. (This is due to the condition of the internal water piping and the possibility that it may need replacing).  A similar claim has never been granted to that person as a ratepayer either as a sole owner or on any joint ownership arrangement.  The customer has a good credit payment of accounts record with Council. Council reserves the right to have a Council Staff member inspect the condition of the water line if it is felt necessary.

The General Manager is authorised to determine applications for variations to accounts due to hidden leaks on internal services in accordance with the above conditions.

Should the request for an adjustment to the charge be approved, the concession granted by Council will be to reduce the volume of water to be charged to 50% of the difference between the volume metered and the average of the volume metered for each of the same corresponding water billing periods in the previous two years. If so determined by the. General Manager, one or more of these figures may be adjusted to daily rates to facilitate calculations. Note: While-ever there is no volumetric charge for raw water, there is no need for consideration of applying a similar policy for raw water. Property owners are to be encouraged to ensure that there is no excess usage or wastage of raw water.

As discussed, the Bourke Arts Council offers an expression of interest to acquire the building and site known in the Bourke Community as the “Community Hall” or the “Assembly Hall” located on the Bourke TAFE site. Members of the Bourke Arts Council have become aware during the last 12 months of the changes occurring in the delivery of TAFE services in Bourke and the possibility of parts of the Bourke TAFE site being made available for other uses besides the needs of the Bourke TAFE. The “Community Hall” has quite a history. It is located on Oxley Street between 2WEB and Mission Australia. Initially it was used by the former public school as an assembly hall for the primary school and for other functions prior to the school’s move to its current site in Green Street. The Hall is currently used by TAFE to store equipment and is not available for use by the local community. Attached is an extract provided by the Bourke Library related to the history of the establishment of TAFE at the Bourke site, “History of Bourke, Volume 11, pages 460 to 463. TAFE was provided in 1986 with corporate sponsorship from the local Dalgety’s business. The funding enabled the hall to be renovated and to be used by the community. The funds allowed for the addition of a small kitchen and toilets to be installed. Funds were also provided for the mural on the stage and the instalment of an honour roll. To that extent, the hall is partly community owned, not solely TAFE owned. TAFE did use the hall for Art and Wool classes. In 1993 and ‘94 the hall was used for exercise and circuit classes and Aboriginal community work. Concerts were held there by the Pera Bore and Koinonia Christian Schools. The Bourke Music Group used the Community Hall for practice nights. Other uses of the Community Hall until its closure a last few years ago were:  Drama rehearsals for plays including “The Trial of Ben Hall”.  Ballet classes for children and bars installed for the purpose.  Exercise classes – cardiac, pilates, yoga. The seniors exercise class moved to the Senior Citizens Centre but would prefer to be in the Community Hall as the space is more comfortable.  Polling booth for elections (State and Federal). Funeral wakes. Luncheons for visiting groups, for example Garden Clubs. First aid classes. Bourke Aboriginal Health Service used the hall for staff education. Fund raising events. Radio Station 2WEB used it for training purposes. Teddy Bear and Doll shows – up to 100 articles entered every year for a number of years. Monthly meetings of the Garden Club. Annual Spring Flower Show. Annual Rose Flower Show.

Events are now being held elsewhere by organizations which would prefer to use the Community Hall, including:  Weekly choir practice, line dancing and band practice groups.  The annual “Festival of 1,000 stories” which was commenced four years ago and is held in September.  The Bourke Library is interested in holding its murder mystery plays in the Community Hall.  Local artists – Aboriginal and non-Aboriginal - are interested in showing their artworks in special art showings/exhibitions.  The yearly Waste to Art competition. The Bourke Arts Council sees the Community Hall as being used by the community as the Bourke cultural and artistic community hub. The Bourke Arts Council has a close relationship with the Regional Arts Outback Centre located at Coonamble and with cultural officers located at Brewarrina, Cobar, Coonamble, Lightning Ridge, Nyngan, Walgett and Warren. The Bourke Arts Council would be pleased were TAFE to move to transfer the right to occupy the hall so that it can again be used as a centre for the wide range of artistic cultural and craft endeavours engaged in by the Bourke community. 21st July 2016 Leigh Byron, Mayor of Balranald Shire and President of the Western Division Councils and Emma Bradbury the CEO of the Murray Darling Association will both attend the July meeting of Council to give presentations to Council. Councillor Byron in his capacity as President of Western Division is keen to meet with all member Councils to discuss issues impacting on the individual Councils to ascertain if those issues may be dealt with more effectively on a joint basis. Emma will be looking to determine in conjunction with Council the best way forward to progress the proposed initiative to establish a Fresh Water Research Station at Bourke and to get Council’s view on any other issues that are also covered by the Murray Darlings Association.

The next Ordinary Meeting of Council to be held on Monday, 25th July 2016 will commence at 9.00am in the Council Chambers. All meetings of Council and Committees of Council where all members of that Committee are Councillors are open to the Public. A Public Forum is scheduled at each Council Meeting at 10.00 am. It would be appreciated if you wish to attend the Public Forum if you would please contact Kai Howard-Oakman on 68308000 or by email at [email protected] so that your item can be placed on the agenda and if necessary any background information can be obtained.

During the 2015/2016 financial year Council received approval to cart water to Byrock immediately the need arose with the approval lasting a twelve (12) month period. That approval was due to finish on the 30th June 2016 so a further approval was sought from the Minister for Lands and Water, The Hon Niall Blair MLC for the 2016/2017 financial year. Advice has now been received that the Minister Blair has approved Councils request to be able to commence carting once the need arises at Byrock for the twelve (12) month period 1st July 2016 to 30th June 2017. The extended approval process provides assurances for both residents and Council.

The Minister for Regional Development, Skills and Small Business Hon John Barrilaro MP last week unveiled a plan to revamp TAFE across New South Wales. It would appear that the previously discussed proposal for Bourke is consistent with the new plan for the State generally with TAFE looking to divest itself of what they see as underutilised assets.

It would appear much of the Bourke TAFE operations will be relocating, some of the buildings will be demolished while some of the buildings at the current site will be retained to be utilised to assist in the provision of mobile services. Existing tenants in parts of the complex that are currently leased will remain and once the relocation takes place the section currently being used for administration may also be available for lease. Consideration will be given to the possible disposal of some sections deemed surplus following further community consultation. There has been some interest expressed in the use of the of old TAFE hall as an “Arts Precinct”.

There was a good attendance at the Bourke Business Group Meeting on Tuesday night with around twenty people in attendance representing a broad cross section of the businesses and nongovernment organisation sector in Bourke. There was a strong focus on tourism related matters with a genuine desire to see the tourist product in Bourke grow and develop with a number of initiatives suggested. In addition the progress in relation to the establishment of the proposed abattoir was also well discussed as was a Christmas promotion in town, in an attempt to continue to encourage people to shop locally. The plans to bring the NBN to Bourke was raised as well and the exact type of service to be provided. It was agreed that contact be made with the community consultative branch of the NBN and ask them to come to Bourke and speak to members of the Business Group and other interested parties so that they can fully articulate the plans involved in the connection of the NBN in Bourke including the timeframe. The NBN will be of great benefit to the business sector and as such they indicated a strong desire to find out a little more in relation to this very important project.

Since the restructure of the Rural Counselling Service operations in Bourke, staff members have been unable to commit to the ongoing maintenance of the community calendar which they had previously undertaken as part of their community service role. To fill this void Council has a dairy of community events which organisations are encouraged to consult when planning a function. Whilst there is no guarantee of avoiding the possibility of a clash with another function it should serve to minimise the chance of a clash happening, leading to better attended functions and a spread of events across the social calendar of Bourke.

Mayor Andrew Lewis and I travelled to Cobar on Tuesday to attend a seminar convened by our Insurers, Statewide Mutual, in relation to “Integrity Management in Local Government”. The seminar was presented by the Australian Institute of Company Directors and not only looked at the leadership roles generally within Local Government but did so in relation to Governance and Risk and Integrity. The Seminar was attended by representatives from Cobar, Bogan and Central Darling Shire Councils. It is good to be able to undertake such training without the need for time consuming travel and the associated expense.

The SEO are keen to ensure that any individuals or groups who are considering nominating as a candidate/group of candidates know their funding, disclosure and compliance obligations. The relevant information for candidates and groups can be found on their event website (www.votensw.info) or can be discussed via their call centre on 1300 135 736.

The NSW Electoral Commission has started its publicity campaign in relations to the elections with advertisements now appearing in the press in relation to enrolments. Owners, rate-paying lessees or occupiers of rateable land which is not their primary place of residence can enrol or nominate someone to be on the non-residential roll for the council election. Non-residential rolls lapse after each election so you must enrol using the forms available from Council’s website. Claims for inclusion on the non-residential roll must be lodged with Council by 6.00pm Monday 1 August 2016

The cold weather has contributed to a number of water breaks recently and Council wishes to apologise for any inconvenience caused. When it is anticipated that outages will be for an extended period advertisements are placed on the local radio to minimise that inconvenience. Council is currently evaluating other options to notify the owners/operators of businesses which are dependent on water for the operation of their business so that they can be forewarned if possible or notified of the anticipated period of outage in times of unplanned outages. This may take the form of a text to a mobile, an email or the utilisation of the various forms of social media.

28th July 2016 Council has sold, or has under offer all blocks at the North Bourke Development as well as keeping one for its own use. This is a tremendous result and Council will now turn its attention to the availability of further land which can be utilised for residential building purposes. In all there were 16 blocks available and the fact that they have all been sold is a positive economic indicator for Bourke.

Council are still trying to firm up a date for the meeting with representatives from TAFE Western in relation to the future of the current TAFE campus in Bourke. Council at Monday’s meeting awarded the tender for the construction of the Splash Park at the Bourke Memorial Pool to Sydney based firm Hydrocare. Hydrocare are an experienced firm and have undertaken a number of similar projects in the past. Hydrocare have indicated that they will be utilising locally based tradespersons for some of the work. The funding for the project was made available under a Clubs NSW grant of $720,000

Brewarrina Shire Council have written to Bourke Shire as the lead Council in the Barwon Darling Zone of The NSW Rural Fire Services (RFS) indicating that they will not be paying the increased contribution proposed by the RFS and will only be paying the same as the 2015/2016 contribution plus a 1.8% increase in accordance with the increase allowable under rate pegging. At the meeting of Bourke Shire on Monday Councillors were sympathetic to the stance taken by Brewarrina and resolved that they too would write to the RFS indicating that Bourke Shire is only prepared to pay a maximum 1.8% increase over the 2015/2016 figure with a similar proposal. At the recent meeting of Western Division Councils in Cobar Mayor Andrew Lewis indicated that Bourke Shire would take the inequity of the substantial increases being suggested for Bourke and Brewarrina Shire Councils back to the RFS and would do so on behalf of other Councils if they forwarded information in relation to the increases that they were likely to face.

Council at Monday’s meeting considered the tenders receive for the replacement of the Bitumen Patching Unit and resolved to accept a tender from Tracserv in Dubbo for an Isuzu Truck fitted with a Paveline Auto Patch Unit. Council will hold onto the old unit and look at the feasibility of fitting the truck chassis with a water tank to increase the capacity of Council’s fleet in this regard. Should Council decide not to proceed with that option then the old Unit will be sold by public auction or private offer which ever would seem most advantageous.

Emma Bradbury the CEO of the Murray Darling Association provided Council with a presentation at the July Meeting last Monday detailing the operation of the Murray Darling Association and answered a number of questions from Councillors. Emma was also keen to hear a more about the proposal to establish a Fresh Water Research Station in Bourke. Also in attendance at the meeting was Leigh Byron, Mayor of Balranald Shire and President of the Western Division Councils and also a Board Member of The Murray Darling Association. Leigh’s main focus since assuming the Presidency of the Western Division was to make himself known to all members of the Councils who belong to the Western Division and given the size of the area he is to be commended for his dedication and commitment. Mayor Andrew Lewis, Councillor Jack Bennett and I took the opportunity to welcome both Emma and Leigh and his wife Dianne to Bourke and joined them for dinner on Sunday night. I have been selected as a founding member of the StateCover Workers Compensation Advisory Committee. StateCover is the Workers Compensation Insurer for the vast majority of the Local Government Councils in New South Wales. The first meeting of the Advisory Committee is scheduled for the week beginning 12th September 2016. Having previously owned and operated my own consultancy business providing advice to employers on workers compensation matters for around eight (8) years, I am looking forward to the challenge and being able to make a positive contribution to StateCover which has become a very important and well run organisation benefitting all members Councils.

The countdown is on until the Annual Louth Races to be held on Saturday the 6th August 2016 and it should be another great day. As usual Council staff will undertake a clean-up of the village and weather permitting try and ensure that the road network in and around the Louth area is in good condition.

I have had discussions with the member for Barwon Kevin Humphries MP regarding the fact that the four (4) operators who had expressed interest in providing flights to service Bourke and Walgett have now apparently decided not to continue with their expression of interest. There is still a number of options that can be canvased and Bourke Shire Council will continue to work with Mr Humphries in an attempt bring to fruition the return of service for Bourke.

The NSW Office of Environment and Heritage have advised that Alluvium Australia who are the consultants appointed by them to assist in developing a preferred option for water management on Tooralé will be back in Bourke on the 5th and 6th August to update local stakeholders, including Council on progress with the project and to provide opportunity for further input. Their report is due to be delivered on the 31st August 2016 which is a little later than anticipated due to weather interruptions to field work and in order to accommodate stakeholders’ availability to contribute to the business case

4th August 2016 Unfortunately the filtered water tower in Charles Street has developed a significant leak and has been taken “off-line” while an assessment is made of the problem and the options available for the repair required. Council has two (2) water towers that usually service the town with the other tower located in Wortumertie Street; the Wortumertie Street tower has the capacity to keep the town supplied and maintain adequate pressure. Arrangements have been made for experts in this field to visit Bourke as soon as practical to undertake the required assessment.

Next Tuesday, 9th August 2016 is Census night and I would encourage all residents to complete the necessary forms. From a Council point of view it is important that the census reflects the actual population of the Shire with a number of grants being population based and also providing valuable information regarding the demographic structure of the shire i.e. the age profile which in turn helps various agencies plan for the future.

Louth Races are on again this Saturday, 6th August 2016 and once again a big influx of visitors will swell the population of the village for this very popular event on the Western NSW racing Calendar.

The NSW Office of Environment and Heritage have advised that Alluvium Australia who are the consultants appointed by them to assist in developing a preferred option for water management on Tooralé will be back in Bourke on the 5th and 6th August 2016. I will be meeting with Ross Hardie of Alluvium Australia and if anyone would like to have the opportunity to discuss the work that Alluvium Australia are doing, they are invited to meet with him at Diggers on the Darling after 2.30pm on Friday.

The Manager of Tourism and Economic Development will travel to Sydney this weekend to represent Bourke and the Orana Region at the Country Week Expo to be held on Saturday and Sunday. On the way home he will also represent Council at the Orana Freight and Logistics Forum organised by Orana Regional Development Organisation.

Council is still trying to get a firm date from representatives from TAFE Western for their proposed visit to Bourke to discuss plans for the current TAFE site. Council has offered to assist with the advertising and coordination of community consultation process.

Councillor Sarah Barton represented the Mayor Andrew Lewis at the NAIDOC Week ceremony to recognise the important contribution made by Indigenous Ex-Servicemen and Ex-Service Women. The service was held last week at the Bourke Aboriginal Health Service whilst I had the honour of laying a wreath on behalf of Bourke Shire Council. There was once again a very good attendance at the ceremony.

The Annual Conference of LGNSW will be held in Wollongong from Sunday, 16th October 2016 until Tuesday, 18th October 2016. The Conference will no doubt have a strong focus on the current Local Government Reform Process and given that it is being held about a month after the Quadrennial elections it is expected that a number of new Councillors will take the opportunity to attend to familiarise themselves on the working of Local Government New South Wales.

President of Local Government New South Wales (LGNSW), Councillor Keith Rhoades and the Chief Executive Officer of LGNSW, Donna Rygate have indicated that they will be visiting Bourke on the 14th September 2016 as part of their ongoing commitment to meet with as many member Councils as they can. Prior to Bourke they will visit Brewarrina Shire Council.

Council is still awaiting the outcome of its application for funding under the Water and Sewage Infrastructure Backlog Programme with funding being available via Restart New South Wales. Council has two (2) projects for which applications for funding have been submitted with these being funding for a new Water Treatment Plant and funding an additional pond at the Sewerage Treatment Facility.

The first instalment for the rates is due on Wednesday, 31st August 2016. If you are having difficulties meeting your obligations in relation to the payment of rates please contact the Revenue Officer at Council so that, if possible, suitable arrangements can be put in place.

Representatives of CAPRA Pty Ltd, the proponents of the proposed Abattoir were in Bourke yesterday and met with representatives of Council regarding the status of the planning approval for the Abattoir.

Members of the Murray Darling Basin Authority will be in Bourke on Wednesday, 10th August 2016 to meet with invited members of the community to discuss the Northern Basin Review and other water management issues. The meeting is one of a series of follow up meetings to those held earlier this year and these meetings will be held in 10 locations across the Northern Basin. The meetings will be held in two (2) sessions with a more formal presentation in the morning touching on: The work to date  Water recovery scenarios being looked at and the decision making process  How water recovery influences environmental outcomes  Findings from the social and economic research A number of local people have been invited to attend this session. Mayor, Councillor Andrew Lewis and I participated in “Bourke’s Big Sleep Out” on Tuesday night along with around 12 other people. The initiative for Bourke was coordinated by Centacare with the “Sleep Out” being held in the Bourke High School Multipurpose Centre. There was a good representation from a broad cross section of community organisations in Bourke. The problem of homelessness is one of those seemingly “silent problems” within our community and indeed many other communities and the “Big Sleep Out” is designed to increase the awareness of the problem.

I have written to the Rural Fire Service informing them of Council’s decision and the similar decision of Brewarrina Shire Council that neither Council is prepared to pay the proposed 27.5% increase in contribution as requested by the RFS but limiting the increase to 1.8% above the 2015/2016 contribution in line with the allowable rate increase for Councils. This payment was made by the due date of the 1st August 2016 I have also prepared a brief submission on behalf of the Western Division Councils detailing the inequity of the proposed increase as requested at the meeting of Western Division Councils held in Cobar on 11th July 2016. While Bourke and Brewarrina Shires are currently looking at increases of over 27% the figure for Carrathool is even higher. Clearly Councils who have their rates capped at 1.8% cannot sustain increases of the magnitude proposed by the RFS.

The video conferencing equipment that was made available to all Councils who are members of the Far West Initiative has finally been delivered and should be operational with the next week. The equipment was supplied via the Minister for Local Government, the Hon. Paul Toole, MP and Office of Local Government and will provide the opportunity for more effective communication between the eight (8) member Councils of the Far West Initiative. The equipment will lend itself to a number of other uses within the Councils including training and seminars. Staff often forgoes the opportunity to attend training and educational initiatives because of the travelling involved and if these are able to be presented “on-line” it should be beneficial.

The good flows in the river should continue for a while yet which is good news for all those along the river system. It will also mean that a good supply of water should be available for irrigation purposes after a period of limited availability which has impacted on the ability of the cotton growers to plant crops and the resultant impact on the local economy.

As we move into spring I would encourage all residents to keep their nature strips clean and tidy and in doing so significantly improve the appearance of the town.

When using the parks and ovals or generally walking around town, please use the rubbish bins provided to dispose of your rubbish. Quite often there is a considerable amount of litter left behind for either the function organisers or Council staff to clean up and with a little bit of thought much of this additional work could be avoided. “Do the right thing - put it in the bin”

There will be an election in Bourke Shire Council with 13 candidates nominating for the ten (10) positions on Council. The elections will be held on Saturday, 10th September 2016. The Elections for Bourke Shire Council are being conducted by the State Electoral Commission and all details in relation to the election are available on their website www.votensw.info this includes arrangements for pre-poll voting and postal voting. Advertisements appearing in the Western Herald today show the location of polling places as well as a list of candidates and again this information is available from the website www.votensw.info

A very noticeable absence from the list of candidates is the current Mayor, Councillor Andrew Lewis who after fourteen (14) years on Council and the last eight (8) as Mayor and also a period of Deputy Mayor has elected not to recontest this election and will retire from public office and focus on his private interests. Andrew’s has made a positive contribution to Bourke Shire and Local Government in the western section of New South Wales. The next meeting of Council is scheduled to be held on Monday, 26th September 2016, it is at this meeting that the new Mayor will be elected. All other Councillors cease to hold office at midnight on the 9th September 2016 and those ten (10) Councillors to serve for the next quadrennial term will be determined on the declaration of the poll following the 10th September election.

Councils (OROC) Councillor Bill McAnally who is the Mayor of Narromine and Councillor Wincen Cuy the current popularly elected Mayor of Broken Hill City Council. Councillor McAnally has been a tremendous worker for OROC during his time as Chair. Councillor Andrew Lewis was one of the Deputy Chairs of OROC so there will be a significant changing of the guard in that organisation. Many people underestimate the amount of work done whilst holding these regional positions and the fact that they generally require a significant amount of travelling and often being available at short notice to attend meetings and deal with issues.

Investigations in relation to the leak in the Charles Street reservoir are continuing. Until the assessment is completed, the remedial action and the cost of that action will not be known.

Councils as of last Friday moved into what is termed as “caretaker mode”, which comes into effect for the four (4) weeks prior to the elections and means that Council is unable to: Enter into any contract or undertaking involving an expenditure or receipt by the Council of an amount equal to or greater than $150,000 or 1% of the Council’s revenue from rates in the preceding financial year (whichever is the larger).  Determine a controversial development application, except where a failure to make such a determination would give rise to a deemed refusal, or such a deemed refusal arose before the commencement of the caretaker period. The term “controversial development application” is defined as one for which at least 25 persons have made submissions by way of objection.  Appointing or renewing the appointment of the General Manager or terminating their employment. (This does not include the appointment of an acting or temporary General Manager).  In particular cases, these functions may be exercised with the approval of the Minister.

Council has had to update its Local Emergency Management Plan and much of the work in this regard has now been completed and will be circulated to all members of the Local Emergency Management Committee for their comments and hopefully, subsequent endorsement. The plan highlights the greatest risks within the Council area as well as identifying key personal, location of emergency evacuations centres, control facilities plus much more information in a concise document able to be utilised in times of emergency.

The water storage facility at Byrock is full, which good news is for the residents of the village who are reliant on this non- potable supply for much of their everyday usage.

Council is mindful of the limited supply storage at Byrock and as mentioned in previous columns sought and obtained approval to undertake emergency carting if and when that situation arises.

The first meeting of the Inaugural StateCover Advisory Board to which I have been recently appointed as a representative is scheduled for the 15th September in Sydney and I am looking forward to representing the interests of all Councils on that Board and in particular ensuring issues relevant to regional and rural New South Wales Councils are addressed.

Well done to Council’s roadworks gangs who worked extremely hard to ensure that the road network was brought back to a good condition following the recent heavy rainfall. From the positive comments received by Council from those traveling to Louth for the races it seemed that most people were impressed that the road conditions were able to be presented so well despite the ongoing issues with the wet weather and damage caused by usage during that period.

A representative from Echelon the auditing arm of our Liability Insurers Statewide Mutual was in Bourke to undertake an audit of our Work Health and Safety systems and in doing so interview a number of staff including all managers and myself as well as undertaking an audit of the documentation that Council has available. The audit was undertaken at the request of Council and aimed in ensuring that Council has compliant systems and more importantly that these systems are utilised. It is essentially designed to ensure that Council is meeting its obligation in respect of Workplace Health and Safety.

A meeting is being scheduled this week involving Bourke, Brewarrina and Walgett Shires to develop an implementation plan relating to the funding received by the three (3) Councils under the Office of Local Government Innovation Fund. The Councils will be working closely with both Waste Aid and Netwaste to ensure that the funding provides some tangible results for all three (3) Local Government areas.

Excellent visitation has continued for both the Jandra and the Exhibition Centre throughout July with numbers exceeding this same time last year for both attractions. Interestingly overall numbers are slightly down on last year which highlights in my view an increased length of stay, improved product and better local word of mouth pointing visitors towards these attractions. The Enngonia Races again proved popular and the Big Red Bash at Birdsville meant additional traffic through our area. Overall those I have spoken with report numbers about the same as last year over the winter period. The Louth Races were once again a huge drawcard in early August which will hopefully mean the busy period continues. Graph showing the number of visitors per month to the Tourist Centre

The next phase of the Darling River Run promotion is nearing completion and ready for public release. Brewarrina and Bourke Shire’s along with National Parks have partnered up to redevelop some of the Darling River Run promotion. While the promotion will feature the areas around Bourke, Brewarrina and the National Parks it will include mapping and activities over the full stretch of the Darling. The development includes a new website, social media promotion, magazine style stories and the gathering of new promotional images. More on this to follow!

Love the Life We Live! Bourke Shire Council is participating with many Orana Councils in the development of a promotion labelled Love the Life we Live. The promotion is aimed at attracting new residents to the Orana region and answering the many questions that often get asked when somebody is looking to the West to relocate. The promotion is largely web based as the questions and answers lend themselves to be asked across social media. For the first time the group took this branding to the Country Living Expo in Sydney. The promotion is in its infancy but the Orana group is keen to see it further developed. The image shows one of the couples that we spoke with in Sydney during the recent promotion. Festival of a Thousand Stories Planning continues for a busy Festival this year which starts in early September. The Arts Council have events that run throughout the week as part of the Festival and the Sydney Story Factory will be here throughout the week to work within the Schools. Highlights this year will once again include the Poets Trek which heads to Brewarrina for the first time along with performances by the Roweths, Darren Hanlon, Frank Pova and much more. The Festival continues to grow and particular efforts are being made this year to ensure an online archive is available which will feature performance from those visiting guests as well as examples of the stories and poetry written. A copy of the latest program will be handed out during the meeting.
