Cassandra Wohlgemuth, Sheboygan Police Department, being first duly sworn on oath deposes and says on information and belief: Count 1: DISORDERLY CONDUCT The above-named defendant on Thursday, October 31, 2013, in the City of Sheboygan, Sheboygan County, Wisconsin, while in a public or private place, did unlawfully engage in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct, under circumstances in which the conduct tended to cause or provoke a disturbance, contrary to sec. 947.01(1), 939.51(3)(b) Wis. Stats. Upon conviction for this offense, a Class B Misdemeanor, the defendant may be fined not more than One Thousand Dollars ($1,000), or imprisoned not more than ninety (90) days, or both. The basis of complainant’s charge of such offense is: Official reports prepared by Officer Timothy Anhalt of the Sheboygan Police Department, which reports indicate that on October 31, 2013 at approximately 11:30PM, Officer Anhalt was dispatched to the area of 1000 Clara Avenue, the south side of the street, in the City of Sheboygan, County of Sheboygan, State of Wisconsin, in reference to a male subject holding a female subject down on the ground. The officer was advised that the female subject was yelling help. Said reports indicate that when the officer arrived, he viewed a neighbor, identified as Ronald Klotz, pointing at the rear of 1017 Clara Avenue and saying they just went inside. The officer approached the rear of the residence and was able to hear multiple persons yelling and when the officer came to the side or east door, the officer was able to see a female identified as Kaonou Yang and

the Defendant, Brandon Schweisthal, DOB 07/28/84, arguing in the entryway of that side door. The officer then viewed as the Defendant lunged towards Ms. Yang with both of his hands. The officer then proceeded to knock loudly on the door and viewed Ms. Yang saw the officer in the doorway. She proceeded to attempt to open the door, however, the Defendant had told her not to open the door. The officer knocked again and advised him to open the door, at which point Ms. Yang opened the door and, in fearing that the Defendant would continue to attempt to attack Ms. Yang, the officer instructed him to go to the other side of the kitchen. Said reports then indicate that Officer Anhalt spoke with the Defendant, who stated he was in his vehicle and was using his phone texting some other people when his girlfriend, Ms. Yang, came to the vehicle and pulled the phone out of his hand. The Defendant stated he then grabbed Ms. Yang by the wrist area in an attempt to get the phone and sit on the ground. He acknowledged that neighbors yelled at him, saying something to the effect that police were coming. Said reports then indicate that with other officers standing by with the Defendant, Officer Anhalt spoke with Ms. Yang, who stated that the Defendant had left the residence to have a smoke outside. Ms. Yang noticed it had been about half an hour since the Defendant had left and she proceeded to go outside to make sure he was okay and found the Defendant text messaging other people on the shared phone. Ms. Yang explained that both she and the Defendant have their own separate phones, however, they share a phone together just in case their phones run out of minutes. Seeing the Defendant text messaging on the shared phone, Ms. Yang grabbed the phone and started to walk back to the rear of the residence. Ms. Yang explained that the Defendant then attacked her from behind and somehow the two of them ended up on the ground, with her being face down on the wet grass.
