Theundersigned is directedto referto Ministryof Finance (Department of Expenditurefs o.M. No' F-12(1)-EV/Ag dated14.5'68regarding counting of servicepaidfrom contingencies with regular service for determining the qualifying servicefor the purposeof grantof retirement benefits. The instructions contained in Ministryof Financds O.M.ibidhavebeenadoptedfor implementation on the Railways. 2' ln termsof theseinstructions , only50%ofthe temporarystatuscasuallabourservicerendqred beforeabsorptionin regularemploymentis treatedas qualifying servicefor the purposeof grantof retirement benefits' Thisprovision hasbeenincorporated in Rule3i. of Railway (pension) services Rules, 1993. 3. lt has been representedby the Staff side that there are certainshortcomings in these instructions whicharecausing severelossto suchstaff. These are:(i) thegapbetweenthe dateof engagement ascasual labouranddateof conferment of temporary statushasbeenverywideasagainst the normal120/360 dayson the expiryof whichthe statusshould havebeenconferred; (ii) the gap betweenthe date of conferment of temporary statusand the dateof screening for regular absorption hasbeenwidebecause of the constraint of non-availability of vacancies; and (iii) therehasalsobeena gap rangingfrom oneyearto morethan threeyearsbetweendate of screening anddateof actualabsorption dueto administrative delav. 4' The shortcomings highlighted aboveare peculiar to the Railways. ln view of the absolute numberof casual labourinvolved andthe consequent managerial problems coupled withthe constraint only50%of temporary statuscasuallabourservice beingallowedto be countedasqualifying,service, a numberot?aiuatlahQlreitherare ineligible fo; pension for wantof requisite qualifying service of ten yearsor aregettinga verymeager amountof pension.,;:Ihis putsthemto a greathardship. 5' In viewof the above,the Ministryof Railways is of the viewthat the existingconditionof only 50%of tempot?rystatuscasuallabourservicebeing countedasqualifying serviceneedsto be liberalized so that suchstaffare in a positionto earna reasonable amountof pensionon their retirementsay,?/,3 rdsof full pension, if not full pension.lt would,therefore,be necessary to modifythe existing condition to providethat 100%of temporarystatuscasuallabour servicewill be allowedto be reckoned for the purposeof determining the quarifying service for grantof pensionary benefits. 6' Ministryof Finance are requested to consider the matterto modifi7 theiro.M. dated14.5.6g to providefor Lo1%of temporarystatuscasual seruice renderedbeforeabsorption in regularemployment beingtreatedasqualifying servicefor the purposeof grantof pensionary benefits. 7'
