Depafiment Administrative Order (DAO) No. 07, Series of 2006 ("lnstituting the Simplifiedand Uniform Rules of Procedure for Administrative Cases Filed with the Department of Trade and lndustry (DTI) for Violations of the ConsumerAct of the Philippinesand Other Tradeand Industry Laws") WHEREAS,it is imperativefor the Departmentof Trade and Industry (DTl)to assure,as far as practicable, simpleandeasyaccesson the partof the consumersto seek redressfor their complaintsand grievancesas prescribed underTitleV, Chapterlll, Article159of RepublicAct No.7394or the Consumer Act of the Philippines; NOWTHEREFORE, certainprovisions of DAONo.5, Seriesof 2007and DAO No. 7, Seriesof 2006, are herebymodified/amendedirepealed, for the guidance information, and compliance of all concerned. RULEI - TITLEand SCOPESection 1. Title. This Order shall be referredto as "Amendments to CeftainProvisions of DAO No. 05, Serlesof 2007and DAO No.07, Senesof 2006". Section2, Scope.ThisOrdershallapplysolelyto consumer complaints underTitleV, Chapterlll,Article159of Republic Act No.7394or theConsumer Actof the Philippines. Noticeand Scheduleof Mediation.On the day a consumer complaintis received, the DTIshallissueimmediately on the saiddatea written (Annex Noticeof Mediation "A') settingthe date, time, and place of the mediationconferenceand serving noticesto all Partiesthrough,courier, personaldeliveryor postalserviceswjthproofof serviceand receipt. All actionsinformation includingproofof serviceand receiptof a copyof the noticeand scheduleof mediation throughany of the aforementioned means of communicationare duly recordedand updated in the DTI Customer (CRM)System,specifically Relationship Management in itsActionModule. For the purposeof this Order,DTI CRM is a browser-based application that facilitatesand systematizes the flow of documentsor reportsof a record. Further,it is a processof trackingthe record,currentuser,descriptive details and statusof all consumercomplaintdocuments. Finally,it providesup-to-date andaccuratedocumentinformation relativeto consumercomplaints receivedby theDTl. Section 2, Mediation Conference.Mediationis mandatory,meaning, any complaintshallnot be submittedfor arbitration withoutpassingsaidstage, More than one conferencemav be scheduledfrom receiptof the consumer complaint by the DTl. Section 3. Mediation Agreementand Terminationof Mediation. (a) MediationAqreement.When mediationis successful,a Mediation preparedand executedby the Agreement(Annex"B') shall be immediately parties.SaidAgreementshallbe finalandexecutory. (b) Termination of MediatioA. Whenno settlement is reached,or the party complainedof or his/herduly authorizedrepresentative fails or refusesto appearor participatein the scheduledmediation,the MediationOfficershall immediately issuea Noticeof Failureof Mediation(Annex"C') and submitthe casefor adjudication. When the consumer complainantor his/her duly authorized representativefails or refuses to appear or participatein the scheduled mediation,the MediationOfficershalldismissthe complaintwithoutprejudice andarchivethe same. Section 4. Duration of MediationPeriod. The total numberof days underRulell on Mediationshallnot exceedten (10)workingdaysfrom receipt of the complaint.

RULEIII - ADJUDICATION _ Section1. Noficeof Adjudicationand Submissionof PositionPaper. On the day of the receiptof the Failureof Mediation, the Adjudication Officer shallissueimmediately (Annex"D') on the saiddate a Noticeof Adjudication directingbothpartiesto simultaneously submittheirrespectivepositionpapers withstatementof facts,arguments, supporting affidavits and otherdocumentary evidencewithinfive (5)workingdaysfromreceiptof suchNoticeof Adjudication and/orsettingdateis of hearingif necessary. Said Noticeof Adjudication, which is equivalentto a summonsand/or datesof hearing,shall be servedthroughcourier,personaldeliveryor postal serviceswithproofof serviceand receipt. All actionsinformation includingproofof serviceand receiptof a copyof the noticeand scheduleof Adjudication throughany of the aforementioned meansof communication are duly recordedand updatedin the DTI Customer (CRM)System,specifically Relationship Management in itsActionModule. Section 2. Effect of Non-subrnissionof Position Paper.When despite notice,no positionpaperis submittedby eitherof the Partieswithinthe period statedin SectionI above,an Ordershall be issueddeclaringeitherPartyto havewaivedits rightto file one and submitting the casefor decisionbasedon the documents or evidenceavailableon records. Section3, Review,Assessment,Renditionand Serviceof Decision. (a) Renditionof Decision.The AdjudicationOfficer shall review,assess and renderas shownin Annex"E" hereof,a Decisionin writing.The Decisionshall be clearandconcise,and shallcontainstatements on the: (a) relevantfactsof the case; (b) issue/sinvolved; (c) applicable lawand/orjurisprudence; (d) conclusions and reasonstherefor;and (e) relief/sgranted,if any,and the admrnistrative penalty/ies imposed,if any. (b) Seruiceof DecisionA copyof a Decisionshallbe servedon the Partiesto the case by personalserviceor registeredmail with proof of servicethrough postregistryreturncard. Section 4, Durationof AdjudicationPeriod.The totalnumberof days shallnot exceedtwenty(20) workingdaysfrom underRule lll on Adjudication receiptof the Failureof Mediation. RULEIV _ DURATIONOF MEDIATION ANDADJUDICATION PERIOD_ Section 1. Duration of Mediationand AdjudicationPeriod. In the total accordancewith Rule ll on Mediationand Rule lll on Adjudication, Page3 of4

number of mediationand adjudicationperiod shall not exceed thirty (30) workingdays. RULEV - P O S T P O N E M E N- T Section1. Postponement-In additionto the periodspecifiedin RulelV, Section1 above,postponement for valid reasonsmay be allowedfor a total periodnotexceedingfive(5) workingdays. RULEVI - OTHERPROVISIONS _ Section 1. Repealing Clause.All other provisionsof DAO No. 05, Seriesof 2007and DAONo.07, Seriesof 2006or anvDortionthereofand other DAOs,DepartmentOrders(DOs),issuances,or any portionthereofthat are inconsistent with this Order are herebyrepealed,or modified,or amended accordingly. Section 2. Separahility Ciause, lf for any reason, any section, provision, or part of this Order,or the application of suchsection,provision, or part to any person, group, or circumstancesis declared invalid or unconstitutional, the remainderof this Order shall not be affectedby such declarations. Section 3. Effectivity. This Ordershalltake effectfifteen(15)days after its publication in two (2) newspapers of generalcirculaiion Three(3) copiesof thisOrdershallbe sentto the NationalAdministrative Registerat the University LawCenterandto the OfficialGazette. of the Philippines lssuedthis 18Inday of December 2013in MakatiCity,Philippines,
