Kind attentionof Railway Board is invited to DoP&T's OM dated31" March, 2017 (quotedunder reference) on the subject pertaining to fixation of pay in the case of employeeswho seek transfer to a lower post under FR 15(a),copy enclosed. According to the DoP&T OM dated 21't October 2009, 05n'November 2012 & 31't March 2017, the method of pay fixation in respectof Governmentemployeetransferredto a lower post on his/herrequestshall be as under:-

6.Thepay of the Government employee holding a post on regular basis will be fixed in the revised pay structure at the stage equal to the pay drawn by him/her in the higher level of post held regularly. If no such stageis available, the pay will be fixed at the stage next below in the lower level with respect to the pay drawn by him/her in the higher level of posts held regularly and the difference in the pay may be granted as personalpay to be absorbedin future increments.oo

From the OMs issuedby the DoP&T pursuantto the implementationof the 6ft CPC pay structureas well Tn respectively,the pay fixation on joining lower post shall be with CPC pay matricesw.e.f.0110112006and 0110112016 referenceto pay drawn in higher level ofpost OnZonal Railways etc., pay fixation to those who joined in lower Grade PaylPayMatrix at their requestis not being allowed inspite of DoP&T's OMs cited above,(i.e. ensuring.,pay protectior!"It is also noticedthat Railway Board have not issuedcorrespondinginstructionson the basisof DoP&T OM dated31't March 2017 till now. NFIR, therefore,urges upon the Railway Board to kindly considerthe above facts and issueclarification on the lines of the OMs of DoP&T for granting pay fixation in those casesof employeeswho joined on transfer to a lower post at their request.
