VILLAGE OF NAPLES FREEDOM OF INFORMATION REQUEST PROCEDURE Adopted November 18, 1998

Village records will be made available by the Records Access Officer at the Village Clerk’s office at 106 South Main Street, Naples, NY. Records should be requested in writing, utilizing the Village’s FOIL form. Included in the request should be a detailed description of the records to be accessed. The requestor will be asked to provide dates, titles, or other pertinent information whenever possible. Once the written request is received, the records will be made available to the requestor by the Records Access Officer or the their designee within 5 business days, unless access is denied pursuant to the Freedom of Information Law of the State of New York. Denial of access to Village records will be made in writing within 5 business days of the information request. Reason/s for denial will be explained and be in compliance with the Freedom of Information Law. The requestor has the right to appeal within 30 days of the denial. A response to appeal will be made within 10 business days by the Mayor of Naples further explaining the denial or providing access to the requested records. Copies of all appeals and responses will be forwarded to the Committee on Open Government for monitoring purposes.

Keeps up to date subject matter list, makes records available in time frame defined above or denies access within the guidelines set forth by Freedom of Information Law. Provides copies of accessible records, certifying that a copy is a true copy. When applicable, certifies either that the agency does not have possession of the requested records or that they cannot be found after diligent search. Records Access Officer may designate another Village employee to assist in these duties or perform them in his or her absence.
