Unit members will be paid on a twelve-month system, twice a month system, for a total of 24 checks. Effective to July 1, 2014 2015, all unit member salaries shall be increased by 5% 7% to the 2013-2014 2014-2015 salary schedule, as reflected in the attached 2014-2015 2015-2016 certificated salary schedule, Appendix A. The teacher non-regular assignment hourly rate shall be $40.00/hour, effective July 1, 2015. 6.1.1

Credit for prior teaching experience, not to exceed ten (10) years, shall be granted to new unit members at the time of initial placement, effective July 1, 2015. For current unit members, additional prior service credit shall not be owed retroactively, but if a current unit member was only credited five (5) years of prior credentialed teaching experience at the time he or she was first placed, but had more, he or she shall be granted up to five (5) additional years of service credit effective July 1, 2015. It shall be the unit member’s responsibility to notify the district that additional service credit is merited, and the window for requests for additional service credit to be made shall be from June 15, 2015 until Sept 15, 2015.

6.1.2

For fully-credentialed Speech and Language Pathologists (SLPs), credit for all years of prior credentialed SLP experience in any setting shall be granted at the time of initial placement, effective July 1, 2015. For current fully-credentialed Speech and Language Pathologists, additional prior service credit shall not be owed retroactively, but if a current fully-credentialed Speech and Language Pathologist was only credited five (5) years of prior experience at the time he or she was first placed, but had more, he or she shall be granted all additional years of service credit effective July 1, 2015. It shall be the unit member’s responsibility to notify the district that additional service credit is merited, and the window for requests for additional service credit to be made shall be from June 15, 2015 until Sept 15, 2015.

6.5 6.1.3 Any accrued interest on revenue ultimately used for retroactive salary increases shall be used to offset District expenses for the implementation and administration of the IRC 125 Plan, Catastrophic Illness Leave and twelve-month, twice-a-month check payment program system. 6.2

The District will contribute toward the cost of the fringe benefits according to the attached schedule (Appendix C) for the 2014-2015 school year effective October 1, 2014. Each subsequent year, the District will adjust the amount of its contribution so that, of the medical plans identified in Appendix C, the cost of the plan with the lowest cost employee-only option will continue to be fully paid by the District. The same dollar amount adjustment necessary to modify the District's previous year's contribution for the lowest cost employee-only lowest cost medical option will also be applied to the District’s contribution to the medical plans of employees with dependents, and to those of employees choosing other medical plans.

LTA PROPOSAL 1: 5/1/15 2:00 PM The District will shall provide a comprehensive insurance benefits program which will includes: • a vision plan for each full-time unit member and all dependents, • a dental plan for each full-time unit member and all dependents with an annual maximum of $1,500 for each full-time for the unit member and all dependents, and orthodontia for each full-time unit member and all dependents with a lifetime maximum of $1,500 for each full-time for the unit member and all dependents, • an income protection plan for each full-time unit member, and • a medical plan with a chiropractic supplement to be selected by full-time members with optional dependent coverage to be selected by full-time unit members from a list of plans offered by the District. All medical plans will include a chiropractic supplement and will be offered at two tiers. Each tier will include the same services and benefits; Tier I will provide unit members with a lowerdeductible, higher-copay option, and Tier II will provide a higher-deductible, lower-copay option. 6.2.1

The District shall pay the full cost of the vision, dental and income protection plans. The District’s monthly contribution toward the cost of medical benefits for the 2015-2016 school year shall be: • $650 (or the full cost of the plan, if lower) for all employee-only plans, • $950 for all employee-plus-one plans, and • $1,050 for all family plans, as reflected in Appendix C. Contingent upon the medical plan selected, and the possible inclusion of dependents, an employee contribution may be necessary. Each subsequent year, the District will adjust the amount of its contribution toward the cost of medical benefits so that the cost of the lowest cost Tier II employee-only plan identified in Appendix C will be fully paid by the District. The same dollar amount necessary to adjust the District’s contribution to the lowest cost Tier II employee-only plan shall also be added to the District’s previous year’s contribution to all other employee-only plans. The District will also adjust the amount of its contribution to pay at least 85% of the cost of the lowest cost Tier II employeeplus-one plan identified in Appendix C and add the same dollar amount to the District’s contribution to all other employee-plus-one plans, and adjust the amount of its contribution to pay at least 70% of the cost of the lowest cost Tier II family plan identified in Appendix C and add the same dollar amount to the District’s contribution to all other family plans. For unit members enrolled in the Health Net PPO as of 5/1/15, the District shall contribute $750 per month to the cost of the employee-only plan, $1,050 per month to the employee-plus-one plan, and $1,150 per month to the family plan until such time as the District’s contribution to other employee-only, employee-plus-one and family medical plans respectively is greater, at which time the District will contribute the same amount to the Health Net PPO plans as it does all other plans. For unit members who enroll in the Health Net PPO after 5/1/15, the District shall contribute the same amount as it contributes to all other employee-only, employee-plus-one and family medical plans respectively.

6.3 6.2.2 Newly hired unit members shall be required to select from the Health Maintenance Organization carriers for hospital-medical insurance for the first year of employment. Thereafter they shall be eligible to select from the full range of medical carriers plans. b) 6.2.3 Contingent upon the medical plan selected and possible, inclusion of dependents, an employee contribution may be necessary. For the purposes of this Collective Bargaining Agreement, same sex domestic partners will fall under the category of “dependents” unless explicitly stated otherwise and will enjoy the same rights and privileges as spouses/ dependents. A same sex domestic partner shall be defined in terms consistent with the County of Los Angeles Statement of Domestic Partnership (Los Angeles County Code, Chapter 2.210). The employee and domestic partner must execute a formal affidavit, Statement of Domestic Partnership, with Los Angeles County and that document must be on file with the County. The affidavit affirms that the terms of the definition have been met. This arrangement may have tax implications for either partner, but will not carry tax implications for either the District or LTA. Affidavit forms for same sex domestic partnership will be available at the District Office. 2

6.6 6.4 [“Stipends for non regular assignments…” – numbering change only, no other proposed changes to this section] 6.7 6.5 Bargaining unit members who are fully credentialed in the State of California, as a Speech and Language Pathologists (SLP) and have an full-time SLP assignment shall receive a $2,000 $4,000 stipend for each school year, with the first half being paid in December and the second half being paid no later than the final paycheck of the school year.

LTA PROPOSAL 1: 5/1/15 2:00 PM ARTICLE 7: WORK YEARS & HOURS OF EMPLOYMENT 7.1

The annual number of scheduled work days for unit members shall be one hundred and eighty-three (183) days. 7.1.1

Each year, a joint calendar committee of three (3) LTA appointees and three (3) District appointees shall be established. The specific calendar of work days shall be designated determined by the District after consultation with the joint calendar committee.

7.16 7.1.2 Specialists (RSP, Speech, or Teachers on Special Assignment) who may work on a modified calendar (RSP teachers, Speech and Language Pathologists, or and Teachers on Special Assignment) will meet with their principal or supervisor, in a cooperative process to develop, in a cooperative process, the a calendar to distribute the specialist’s time to best meet the needs of the instructional program. The modified work calendar will be written, then provided to the teacher, principal/supervisor, and the Payroll Department. Later Mmodification of the specialist’s prearranged calendar is permissible through upon mutual agreement of the teacher and the site principal/supervisor. This modification may be made prior to, or on the day of, the requested calendar change. Unresolved dDisputes concerning a specialist’s calendar will be resolved by the Superintendent, or designee. d) 7.1.2.1 Upon written request, the LTA President shall be provided copies of unit member modified work calendars. 7.1.3

For the 2015-2016 and 2016-2017 school years, the annual number of scheduled work days for unit members shall be increased by six (6) to one hundred and eighty-nine (189) days – one hundred and eighty (180) days of pupil instruction and nine (9) pupil free days. Five (5) pupil-free days shall be scheduled immediately prior to the first day of instruction and four (4) shall be scheduled during the school year, one (1) for all-day parent conferences and three (3) for teacher planning and preparation. For the eight (8) non-parent-conference pupil-free days, at least 3¾ hours per day shall be utilized for teacher-directed collaboration, planning, grading, and/or classroom preparation (while in effect, this language supersedes the language in Article 7.12). Per Article 7.3, these six (6) additional work days shall be paid at the per diem rate.

The normal on-site work day for unit members shall be from 7:45 a.m.-3:15 p.m. One Friday a month (for a total of nine occasions), a minimum student day shall be utilized to provide an uninterrupted planning time for teachers. On this day, unit members will be allowed to leave campus at 1:55 p.m. if all professional duties have been completed. Mandatory meetings will not be scheduled for Friday after dismissal since it will be reserved for classroom planning. Regular dismissal time for preschool and elementary schools shall be 2:52 p.m. and minimum day student dismissal time shall be 1:38 p.m. Regular dismissal time for the middle school shall be 2:38 p.m. and minimum day student dismissal time shall be 1:38 p.m. At each elementary school site, the principal and kindergarten teachers shall meet to ensure that comparable planning time will be provided for those unit members. 7.5 7.4.1 7.4.2

Unit members assigned to middle school shall receive one (1) period of pupil-free preparation time each day. If a block schedule is in place, unit members shall receive one (1) period of pupil-free preparation time for each full schedule cycle. Unit members assigned to preschool and elementary school sites shall receive one hundred (100) minutes of pupil-free preparation time each week during the instructional day.

7.12 7.6 A Mminimum Dday for students all sites shall be defined as a one-hour early release schedule, 8:15 a.m.- student dismissal time of 1:38 p.m. 7.7 7.6.1 Preschool and elementary unit members There shall have be a minimum day scheduled each Wednesday from 8:15 a.m. – 1:38 p.m. Middle school unit members shall have a minimum day each Wednesday from 8:15 a.m. – 1:48 p.m. From 2:00 p.m.-3:15 p.m., preschool, elementary and middle school unit members are may be required to participate in the following duties: staff meetings, grade-level and/or department meetings, collaboration, program staff development, in-service, education activities, parent conferences, committee assignments, and/or district meetings, staff meetings, or grade level meetings. A principal has the option of not scheduling such any duties during the 2:00 p.m.-3:15 p.m. time, period. and Iif no duties are scheduled, unit members shall utilize the time on-campus for self-directed collaboration, planning, and/or grading. Additionally, preschool, elementary, and middle school unit members may be required to participate in one Back to School Night and one Open House Night per year, outside of the normal on-site workday. 7.7.1

Additionally, preschool, elementary, and middle school unit members may be required to participate in one (1) Back to School Night, one (1) Open House Night, and one (1) Parent Conference Day that may extend beyond the normal on-site workday per year. Back to School Night shall be limited to 90 minutes and Open House Night shall be limited to 60 minutes. Back to School Night and Open House Night shall be scheduled to begin no later than 6:00 p.m. In the event that Parent Conference Day is scheduled to extend beyond the normal on-site work day, it shall end no later than 5:00 p.m., and unit members shall not be required to work more than 6.75 hours on that day.

7.9

Unit members will may be required to perform up to eleven (11) hours of Adjunct Duty per year. Adjunct duty credit will be given on the site-level adjunct duty list to teachers who participate in District new teacher training and any school site level new teacher training. Principals will limit any other adjunct duty responsibilities that are required of those teachers. Other school activities, which enhance the overall school program, will also be scheduled. 7.8.1

Prior to the end of the fifth week of school of each school year, the principal or supervisor at each site shall schedule a meeting with all interested teachers to develop a preliminary list of these activities Adjunct Duties. This list of activities shall comply with will consist of activities which enhance the overall school program. cCommunity needs and school district expectations will also be considered. It is agreed that the responsibility for supporting these activities will be shared by unit members from the site. ¶ Additional activities, which may be included on the list are based on teacher input and interest and would be voluntary. These activities would also help fulfill the individual’s share of the responsibility for those activities described above.

7.8.2

The preliminary list of Adjunct Duties shall be shared with and approved by the School Leadership Team at each school site.

7.8.3

Adjunct duty credit will be given on the site-level adjunct duty list to teachers who participate in District new teacher training and any school site level new teacher training. Principals will limit any other adjunct duty responsibilities that are required of those teachers.

The site administrator shall have the prerogative of allowing requesting unit members to leave the site after the unit member’s last class for good and sufficient reasons.

7.7.1 7.9 Additionally, preschool, elementary, and middle school uUnit members may be required to participate in one (1) Back to School Night, one (1) Open House Night, and one (1) Parent Conference Day that may extend beyond the normal on-site workday per year. Back to School Night shall be limited to 90 minutes and Open House Night shall be limited to 60 minutes. Back to School Night and Open House Night shall be scheduled to begin no later than 6:00 p.m. In the event that Parent Conference Day is scheduled to extend beyond the normal on-site work day, it shall end no later than 5:00 p.m., and unit members shall not be required to work more than 6.75 hours on that day. 7.10

Unit members shall not be required to perform before school yard duty.

7.12

A Minimum Day for students shall be defined as a one-hour early release schedule, 8:15 a.m.-1:38 p.m.

7.13

A Super Minimum Day for students shall be 8:15-11:35 a.m. and shall be utilized on the first and last day for all schools. For the spring Parent Conference Day at the elementary schools the Super Minimum Day schedule will be followed, with teachers needing to supervise students in their own rooms for lunch from 11:35-11:50 a.m. The teacher’s duty-free lunch will follow thereafter.

7.14

The District may utilize other modified dismissal schedules as it deems necessary.

7.15 7.11 The District agrees to permit unit members to utilize ten (10) hours for classroom planning and classroom preparation at the beginning of the school year. The first 7½ hours shall be scheduled within the two pupil-free pre-service instruction days. In the event there is only one pre-service day, 3¼ hours shall be provided. The remaining 2½ hours will be scheduled, exclusive of lunch, after student dismissal on the first pupil day of instruction, which is a super-minimum day. 7.16

Specialists (RSP, Speech, or Teachers on Special Assignment) who work on a modified calendar will meet with the principal or supervisor, in a cooperative process to develop the calendar to distribute the specialist’s time to best meet the needs of the instructional program. The calendar will be written, then provided to the teacher, principal/supervisor, and the Payroll Department. Unresolved disputes concerning 6

LTA PROPOSAL 1: 5/1/15 2:00 PM a specialist’s calendar will be resolved by the Superintendent, or designee (Deputy Superintendent or Assistant Superintendent). Parameters for development of specialist’s written schedule will be as follows: a)

Two two-week blocks of vacation time will be made available in the specialist’s schedule. These blocks shall be exclusive of Christmas and other times when school is not in session. Extenuating circumstances may allow other large blocks of time to be developed in the cooperative planning process, with final approval from the principal/supervisor.

b)

Schedules may be individualize for each specialist.

c)

Modification of the specialist’s prearranged calendar is permissible through mutual agreement of the teacher and the site principal/supervisor. This modification may be made prior to, or on the day of, the requested calendar change.

d)

Upon written request, the LTA President shall be provided copies of unit member modified work calendars.

22 26 29 31 for core Math, Language Arts, Social Studies and Science classes; 24 for Math, Language Arts, Social Studies and Science intervention classes as well as English Language Development classes; 33 for PE & Exploratory/Elective classes.

LTA PROPOSAL 1: 5/1/15 2:00 PM ARTICLE 21: SPECIAL EDUCATION 21.1

The rRegular classroom teachers will be informed of and have immediate access to a copy of the Individualized Educational Program (IEP) for of each individual student with exceptional needs placed in their classes on by the first instructional day of the school year, or five school days prior to the student's placement in his/her their classroom when reasonably possible, providing that student has been previously enrolled in a program within the Lennox School District.

21.2

When a regular classroom teacher requests a review of any part of the Individualized Educational Program IEP of an individual a student with exceptional needs the following process will be implemented: [Step 1] - aAn informal review/staffing by meeting of the student's counselor, special education and regular classroom teachers and any other staff member involved with the student's program will be held within five (5) school days of the teacher's request in order to attempt solution of to solve any scheduleing or programmatic problems concerns without a major modification of the IEP. [Step 2] - iIf the issues concerns were not cannot be resolved at that first the informal meeting, A a formal meeting of the school site Eligibility and Planning student’s IEP Tteam, including the parent, to review the IEP will be scheduled to review the IEP as soon as practicable, not to exceed fifteen (15) school days of after the informal review meeting if the issues were not resolved at that first meeting. The Director of Pupil Services Special Education may be called upon by the Eligibility and Planning student’s IEP Tteam to assist in resolution of any conflict disagreements over the student's IEP.

21.3 An LTA/LSD special education committee, consisting of at least one bargaining unit member from each school site, shall be maintained by the District. The committee shall meet at least four (4) times during at least nine (9) months of the school year to address issues related to service provided for students with exceptional needs. Membership on this committee does not count as an adjunct duty. 21.4
