Heads of Bureaus and Offices under the Ministry including the Office of Local Government Finance
Pursuant to the fiscal restraint policy, the Office of the President has directed all Heads of Ministries and Agencies to comply with all policy pronouncements embodying restrictions on government expenditures. In Memorandum Circular No. 895 dated March It 1976, the Office of the President has reiterated strict observance of the policy against retroactive appointment. In the implementation thereof, the Ministry issued Department Order No. 26-74 directing, among others, that promotional appointments shall take effect only upon assumption of duty of the appointees but not earlier than the date their appointments or the corresponding proposal, as the case may be, are received in the Personnel Division of the I 'finistry. It has been observed, however, that proposed appointments are submitted to the Ministry even before supporting documents are completed and/or the rules on promotion are complied with. More often than not, such appointments are returned without action but already bearing the stamp of receipt by the Ministry. Appointments thus submitted would entitle the appointee, upon assumption of duty, the salary differential between the date of receipt of the appointment by the Ministry and the date of actual issuance thereof. Such practice should be discontinued as the same is not only violative of the spirit of Memorandum Circular No. 895 but also defeats the objectives for the promulgation of retrenchment measures in government operations. To carry out the President's directive and to ensure the implementation of the retrenchment policy of the Government, it is hereby directed that, henceforth, promotional appointment shall be made effective upon assumption of duty of the appointee but not earlier than the date of the appointment as indicated therein by the appointing official. All existing Orders,, Memorandum or Circulars contrary to or inconsistent herewith are hereby amended accordingly. This Order shall take effect immediately and all concerned shall be guided accordingly.
