Delegation of authority to sign official papers and communications acted upon by the Office of Local Government Finance

In the interest of the service, the authority to sign official papers and communications assigned to the Office of Local Government Finance are hereby delegated as follows: I.

To the Deputy Minister fof Administration A.

B.

Papers assigned to the Finance Field Operations Unit 1.

Directives to formally charge, suspend or relieve local treasury and assessment officials and employees and approval of their preventive suspension from office;

2.

Approval of appointments of Assistant Provincial/ City Treasurers and Assessors, Administrative Deputies, Chief Deputy Assessors, Municipal Treasurers/Assessors and their Assistants;

3.

Decisions on protests against appointments of local treasury and assessment officials and employees; and

4.

Actions on requests for reconsideration of previous actions taken on appointments of local treasury and assessment officials and personnel.

Paters assigned to the Local Treasury Operations Division 1.

Recommendations on requests for the extension of services of local treasury and assessment officials and employees beyond compulsory retirement age. Mere transmittals without favorable recommendations shall, however, be signed by the Assistant Secretary for Personnel Development;

Authority for local governments to incur or amortize overdrafts;

Approval or disapproval of requests of local government units for transfer of funds from the infrastructure to the general fund;

4.

Recommendations on applications for loans, provisional advances and credit lines and allied correspondence pursuant to PD 752;

5.

Opinions/rulings on queries on local treasury operations, local credit financing, internal revenue and specific tax allotments, and allied matters in implementation of existing policy; and

Authority to withhold internal revenue allotments for settlement of unpaid loan .obligations of local governments.

Papers assigned to the Real Property Tax Assessment Division 1.

Final actions on the review of Schedules of Values and Building Cost Schedules of provinces and cities to be used as basis for real property assessment;

Approval of applications of local government units for loans from the Assessment Loan Revolving Fund and the corresponding Loan Contracts;

3.

Opinions/rulings on real property valuation and tax assessments;

4.

Decisions on-protests against real property assessments;

5.

Authority to local governments to enter into service contracts for tax-mapping projects; and

6.

Authority to increase the shares of local governments from the additional 1% tax (SEF).

Papers assigned to the Local Tax Ordinance Advisory Boird 1.

Review of local tax ordinances;

2.

Decision/Resolutions on protests against local tax ordinances;

Opinions/Rulings on queries regarding tax impositions under the Local Tax Code and related matters; and

4.

Decisions/opinions on market controversies.

In the absence of the Minister, the Deputy Minister for Administration shall also sign the following:

Decisions/resolutions on administrative'cases involving local treasury and assessment officials and employees below the rank of Provincial/City Treasurers or Assessors, when the penalty imposed is dismissal or forced separation;

2.

Recommendations to the Office of the President on requests of local treasury and assessment officials and employees for" executive clemency; and

3.

Designations as Officer-in-Charge, details and/or transfers of Provincial and City Treasurers/ Assessors and their Assistants.

Referrals of sworn complaints against Provincial/ City Treasurers and Assessors for submission of written explanation;

2.

Referrals of administrative complaints with directive to file formal charges but without the order of suspension or relief of respondents;

3.

Designations of Special Investigators;

4.

Disapproval of appointments of local treasury and assessment personnel lacking the minimum qualification requirements as provided for in existing law and regulations; Actions on applications for terminal leave and retirement of Provincial/City/Municipal Treasurers and Assessors and their Assistants;

Actions on salary adjustments of local treasury and assessment officials and employees;

7.

Designations of Municipal Treasurers as Collection Agents of the BIR, DBP, LBP and other national agencies;

8.

Approval of requests of local treasury and assessment offices for overtime pay and requests for authority to collect per diems in excess of one month but not exceeding three months while on detail as Officer-in-Charge of the municipal treasury and assessment offices; and

9.

Referrals to the Office of the President of requests for permission to teach, authority to collect per diems in excess of three months, and other similar correspondence.

Telegrams/letters/indorsements offering to Provincial/City Treasurers and Assessors or their Assistants vacant positions of Provincial/City Treasurer or Assessor;

2.

Reclassification of sub-classification of provinces, cities and municipalities on the basis of the certification of COA as to their average annual income;

3.

Replies to queries and other correspondence reiterating Ministry Orders, Circulars, Opinions, rulings pr administrative issuances already issued by the Ministry;

4.

Final actions on requests for certification as to the financial viability for conversion of cities into barangays and allied correspondence;

5.

Recommendations on requests of local treasury and assessment officials £of transportation and representation allowances, and allied correspondence;

6.

Referrals of requests of local government units for budgetary aid or financial assistance;

Referrals of official correspondence to national ministries, bureaus, and. agencies pertaining to real property tax administration and allied correspondence; and

2.

Recommendations for approval of'loan applications from the Assessment Loan Revolving Fund; and

3.

Replies to queries and other correspondence reiterating Ministry Order, Circulars and other issuances pertaining to real property tax assessments.

Papers assigned to the Local Tax Ordinance Advisory Board 1.

Replies to queries and other correspondence reiterating Ministry Orders, Circulars, Opinions, rulings or administrative issuances already issued by the Ministry; and

2.

Referrals of official correspondence to national ministries, bureaus and agencies pertaining to local taxation and allied correspondence.

Administrative matters 1.

Office Orders regarding supervision and work distribution, special assignments and corresponding travel orders of personnel of the Office of Local Government Finance;

Payrolls, applications for leave of personnel of the Office of Local Government rinax ce; and

Directives to Regional Directors enjoining implementation of Ministry Orders, Circulars and Regulations.

To the Assistant Director for Local Fiscal Operations 1.

Referrals to Regional Directors and/or Provincial/ City Treasurers and Assessors of administrative complaints involving local treasury and assessments officials and personnel for comment/appropriate action, or for submission of written explanations;

2.

Requests for submission of records/dockets of. administrative cases addressed. to Provincial/City Treasurers and Assessors;

3.

Requests for comment/recommendation/appropriate action on official matters addressed to the Regional Directors for Local Government .Finance and Provincial/ City Treasurers and Assessors pertaining to local treasury operations, personnel transactions, and allied correspondence;,

4.

Requests for comment and recommendation on queries, protests on appointments of local treasury and assessment personnel, appeals from local tax ordinances and other similar correspondence addressed to Provincial/City Treasurers;

5.

Transmittal letters or indorsements to the local governments of requests for allowances, permission to teach, per diems, and other. similar correspondence already authorized or approved by the authorities concerned;

6.

Confirmation or certification of appropriations for the local counterpart fund provided for in local government budgets for purposes of RA No. 917, as amended;

7.

Authority for local government personnel to take delivery of printed forms from national offices;

8.

Actions on requests of local treasury and assessment personnel for change of naive and civil status;

9.

Certificates of appearance of Provincial/City Treasurers, their respective Assistants and officials/personnel of other local government offices;

10.

Replies to queries on status of application for employment or promotion, detail, transfer and/or reinstatement involving local treasury and assessment positions in the local governments;

11.

Actions on requests for information on pending petitions and/or status of separation or removal from office of local treasurers and assessors;

12.

Certificate's of settlement of local treasurers and allied correspondence;

13.

Letters to Regional Directors. and/or Provincial and City Treasurers requesting submittal of reports on local tax collections, income and expenditures, and similar others; and

14.

Calls to meetings/conferences addressed to the t Regional Directors for Local Government Finance and Provincial/City Treasurers.

To the Assistant Director for Real Property Tax Administration 1.

Requests for comment and recommendation addressed to Regional Directors and/or Provincial and City Assessors on queries, protests on real property assessment and allied correspondence;

2..

Requests for submission of assessment records addressed to Provincial/City Assessors;

3.

Letters addressed to Regional Directors for Local Government Finance requesting submittal of reports and information relative to RPTA projects;

4.

Certificate of Appearance of Provincial/City Assessors, and their assistants; and

5.

Telegrams calling Regional. Directors for Local Government Finance and Provincial and City Assessors to come to Manila for conference.

To the Division Chiefs 1.

Requests addressed to the Provincial and City Treasurers and Assessors to submit supporting papers or such requirements necessary to complete or correct sets of correspondence submitted to the Ministry for action; Certification as to the compliance of the necessary requirements on the face of the appointments of local treasury and assessment officials ahd personnel;

3.

Letters to the Regional Directors for Local Government Finance and Provincial and City Treasurers and Assessors furnishing bopies of Ministry Orders, Circulars, regulations and other administrative issuances for information, dissemination and compliance;

4.

Referrals to the Provincial Treasurers of municipal tax ordinances for review;

5.

Certificates of appearances of officials and employees below the rank of Assistant Provincial/ City Treasurers and Assessors when on official business in Manila for a period not exceeding five (5) days.

6.

Transmittal of appointments of local treasury and assessment officials and personnel duly approved by the Ministry and the Civil Service Commission;

7.

Explanatory Memoranda accompanying official actions;

8.

Tracers/follow-up letters addressed to provincial/city treasurers and assessors;

9.

Transmittal of missent papers to Regional or local government offices; and

10.

Time Cards of Division Personnel and reports of attendance.

For purposes of this Order, the abovementioned officials shall sign official papers and correspondence delegated to them in the following manner: . By authority of the Minister:
