OFF HIGHWAY VEHICLE OPERATION INSIDE THE CITY OF MESQUITE The Nevada Revised Statue (NRS) and Mesquite Municipal Code (MMC) define an Off-highway vehicle (OHV) as a motor vehicle that is designed primarily for off-highway and all-terrain use. The term includes, but is not limited to: An all-terrain vehicle, including, without limitation, a large all-terrain vehicle, an all-terrain motorcycle, dune buggy, snowmobile, and any motor vehicle used on public lands for the purpose of recreation. All OHV located in the State for more than 15 days are required to be registered with the Nevada DMV, NRS 490.082.3.c and can be registered as either an “Off Highway Vehicle” or “Large All-Terrain Vehicle”. All OHV operated on public lands are required to be registered, unless exempt by NRS 490.082.3. A person may operate a registered off-highway vehicle on any public land, trail, way or unpaved county road unless prohibited by the governmental entity which has jurisdiction over the public land, trail, way or unpaved county road. All OHV operated by government agencies or operated for work conducted by or at the direction of a public or private utility are exempt from registration. NRS 490.082. If an owner chooses and the OHV meets the requirements of NRS 490.043 and carries motor vehicle insurance as defined in NRS 485.185, it can be registered as a “Large All-Terrain Vehicle”. A large allterrain vehicle can operate on general and minor county roads, unless the county has prohibited OHV operation on specific sections or entire county roads as outlined in NRS 403.170. Operation of OHV inside the City of Mesquite is limited to use set in Mesquite Municipal Code (MMC) 6-7-6. “ OHVs shall be used and operated within the city of Mesquite only over such public streets, roads, or highways that are designated by resolution of the city council as open to such OHV use and operation. All streets, roads, or highways that are not open for OHV use in the city of Mesquite shall be posted with signs indicating that OHV use is not permitted.“ OHV operation in the City of Mesquite is limited to no more than two miles on a paved highway; “no person permitted to operate an OHV on a public street, road or highway designated for OHV use in the city of Mesquite shall travel more than two (2) miles on a paved highway on an OHV to reach a private or public area that is open for use by OHVs.” NRS 490.110. b, MMC 6-7-3-D

General Operational Requirements (additional City, County or State laws may apply) 1. All OHV over 70cc (NRS 490.082.3.j) operated in the City of Mesquite and State of Nevada must be registered. NRS 490.082, MMC 6-7-3 2. The operator of an OHV inside the City of Mesquite is required to be 16 years of age or older and possess a valid motor vehicle operators license. MMC 6-7-3, NRS 490.110.1. 3. Helmets shall be required by all operators and passengers of any OHV. MMC 6-7-5-A, NRS 490.130, 3. 4. Traffic Laws Applicable: To the fullest extent practicable, the traffic laws of the state of Nevada, as set forth in the Nevada Revised Statutes, and of the City of Mesquite municipal code are applicable to the operation of OHVs on any designated public streets, roads, and/or highways of the city. NRS 490.130, MMC 6-7-5-G 5. OHVs shall only be used and operated within the city of Mesquite over such public streets, roads, or highways that are designated by resolution of the city council as open to such OHV use and operation. MMC 6-7-6-A. Mesquite Boulevard, Pioneer Boulevard, Sandhill Boulevard and Riverside Road, north of Hafen Lane are closed to OHV traffic. 6.

OHVs shall be operated only on the outer four feet (4') of designated public streets, roads or highways within Mesquite city limits and shall not be operated on sidewalks or marked trails unless posted sign(s) indicate otherwise. MMC 6-7-6

7. Maximum Speed limit, there shall be a maximum speed limit for the operation of every OHV of twenty (20) miles per hour (MPH) within the City of Mesquite. MMC 6-7-5-B 8. No person may operate an OHV on a designated public street, road, or highway for any purpose other than to travel to or from a private or public area that is open for use by OHVs. MMC 6-7-3-E 9. Number Of Occupants Allowed: There shall be no more than two (2) occupants, including any operator and passenger, unless the OHV is expressly designed to seat more than two (2) occupants and is capable of seating more than two (2) occupants. MMC 6-7-5-C 10. Required Equipment: A. Pursuant to Nevada Revised Statutes 490.120 and MMC 6-7-5-D, a person shall not operate an off highway vehicle on any designated public streets, roads, and/or highways of the city, unless the off highway vehicle has: 1. At least one headlamp that illuminates objects at least five hundred feet (500') ahead of the vehicle; 2. At least one tail lamp that is visible from at least five hundred feet (500') behind the vehicle; 3. At least one red reflector on the rear of the vehicle, unless the tail lamp is red and reflective; 4. A working muffler. 11. Parent/Adult Responsibility: In addition to any juvenile culpability which may be imposed due to violations of Mesquite municipal code, the responsibility for complying with the provisions of Mesquite municipal code shall rest upon the adult owner or custodian of any OHV or the head of household where any OHV is kept, whether or not ownership of the OHV is claimed by any other person residing in said household. A husband or wife, or two (2) or more adults living together, may jointly or separately be charged as heads of the household where an OHV is kept. MMC 6-7-7-A
