The Railway Safety Review Committee 1998 had inter-alia made the following relatingto openingof new branchesof the recognizedUnions:recommendations o,Our committee believesthat there should be an upper limit on the number of branches that a union can set up our recommendation in this regard would be that each recognizedUnion be allowed a maximum of one branch for 5000 men on a Division." The Railway Ministry had considered the recommendations of the Committee and keepingall aspectsinto considerationhad decidedvide letter dated2llIl12002 that 66infuture new branches shall be opened by the recognized Unions only when the membershipreachesthe level of 1000or more'" It was also decidedby the Railway Board vide letter dated 2 l " November 2002 that the ,,opening of new branch with less than 1000 members may be resorted to in n"ry rp..ial circumstances but a decision to that effect will be taken at the highesi level through mutual discussion with the General Secretary of the recognizedunion and the General Manager of the Railway." From the above, it could be seenthat the recognizedUnions can open new brancheswhen membershipreachesthe level of 1000 or more. In this case,the new branch shall get all facilities as a matteiof course. Where the recognized Unions intend to open a new branch with less than 1000membersdue to specialcircumstances,in suchcasesonly, there shall be mutual discussion betweenthe General Secretaryand the GM for the purposeof arriving at consensus.

On Northern Railway, the instructions are misinterpreted to the disadvantageof the URMU when the Union formed new branchwith membershipof over 1000. In terms of Boards letter of 21't Nov 2002, the Zonal Railway should have granted recognition and consequential facilities as the instructions of Railway Board are very clear. It appears,the Northem Railway referredthe matter citing Boards confidential letter dated 6thMay 1965. NFIR contendsthat Railway Boards confidential letter No. E(L)64IJTL-143 dated 6th May 1965 cannot be taken into considerationfor denying the right to URMU for form any new branch when membership is 1000 or more. The said confidential letter need not be taken into considerationat all particularly in the context of subsequentBoards letter dated21't November 2002 wherein a decision was taken'keeping all aspects into consideratiori'and hence the instructionscontainedin letter are required to be respectedby the Zonal Railway. NFIR, therefore, requests the Railway Board to issue clear-cut clarification to the Northern Railway to grant recognition to the new branchesof URMU where membershipis 1000 or more duly endorsingcopy thereof to the Federation.
