SECTION J_O: DEFINITIONS As used in this MOU. the (TRANSPORTATION FACILITY )Airport Chci.:kpoint Digital Closed Circuit Television ("ACDTV'') system. referred to as the CCTV system in the Other Transaction Agreemenl ( ··oTA") hetween the Departmen! of Homeland Security ("DHS"). SECTION 4.0: PURPOSE The purpose nf this MOU is to: (I} change the term that is used in the OTA to refer to the. CCTV system at (TRANSPORTATION FACILITY)lo ACDTV: (2) restatt:. with modifications. Installation. Maintenance. and Operation (Article IIT.B., Section 1.0) in the OT A in Section 5.0 below: ( 3) restate. with modifications. CCTV Access and Control (Artick IJLB .. Section 2JlJ in the OTA in Section 5.() below; (4) restate. with modifications. Gcncrnl Functional Rcquin•mcnts (Appendix A) in the OTA in Section 5Jl helow: and (5) provide a Limitation of Liability clause in Section 11.0 hel\lw. Article 111.B. Sedion 2.0. Appendix A from the OTA and portions or Anide 111.B. Sedion 1.0 survived the expiration of the OT A.

Section 5.2 Ownership; Access to the ACDTV System and Data 5.2.l Ownership; Securing the ACDTV System The Transportation Authority shall be the owner and custodian of the ACDTV system as well as any video media generated from the ACDTV system and will secure all such ACDTV media and data at all times pursuant to 49 C.F.R. parts 1520 and 1542. 5.2.2 Access by Persons Other than DHSfl'SA Access to all ACDTV system data output will be limited to the Transportation Authority an

Section 5.3 Operation, Maintenance, and Rcportin�

5.3.1 Opcrntion The Transportation Authority v.'ill npcratc the ACDTV system continuously and ensure the system records continuously with accurate date and time displayed. The ACDTV system will be deployed in accordance with the ..:mne:ra view requirements devdopt:d by the Tran,\pnrlalio11 Authority and TSA ITRANSPORT/\TION rACILITY)as shown in section 53.4 below.

5.3.2 Maintenance The Transportation Authority will maintain all ACDTV l.'quipmcnl. Reconfiguration and/nr modification of the (TRANSPORTATION f.:ACI [ JTY )screening: locations and exit lanes may result in a need to modify camera angles and/or placement. At TSA 's request. the Transportation Autlmri l y wiI l make these modi fieations. If thi.: Transportation Authority ddi:rmincs modifications ni:cd to be madi: r.::garding camera angle and/or placement at these locations, modifications may be made with TSA · s agreement. The Tran-;portation Authority \.\'Ill conduct operational test-; confirming functionality of lhe ACDTV system at least monthly. Upon Jiscon!ry or any system malfunction inn>hing the camera., focused on scn.:cning locations and exit lanes. the Transportation Authority will immediately notify the FSD or designcc and take conccti\'c action. TSA (TRANSPORTATION FACILITY)will immediately notify the Transprntation Authority of any issues pertaining tn physical equipment nr camera views which arc either not working:, nn longcr show dcsircd views or appear to ht_, out of focus and the Transportation Authority will take corrective action.

The effective date of thif> MOU is the date on which it is signed by appropriate representatives for DHS/TSA and the Transpottation Authority. and shall be the date of the hl'-1 signature.

SECTION 8.0: NO OTHER AGREEMENTS

But for the OTA dated /\ugust 9, 2007, between OHS. TSi\ and chc Transportation Authority which, except for cenain tenns, expired August 9. 2009. this MOU represents the full and complete understanding of the parties with respect to the usc/rc,·icw of ACDTV video from including FOIA rcqt1L'sls for such ACDTV video.

SECTION 9.0: MODfflCATION

This MOU m;iy not he modified without the prior mutual written consent of DHS/TSA and the Transpm1ation Authority.

SECTION IO.O: TERMINATION

This MOU shall c:ontinuc for as long as federal law, DIIS or TSA requires.

SECTION 12.0: GOVERNING LAW

SECTION 13.0: SEVERABILITY
