Companies which is one of India's leading business conglomerate having multi-billion infrastructure
dollar investments
in oil, steel. energy,
ports. shipping.
and services sectors in India, This information is being
placed before the Hon'bie Court by the petitioner's society for its kind consideration and appropriate directions.
This Hon'ble Court has on the issue of corruption developed public law and framed guidelines in the past e.g. Vineet Narain vs. UOI - Jain Hawata Case (1998) 1 SCC 226; in the CVC case (CPIL vs. UOI (2011) 4 SCC 1) the doctrine of institutional SCC : CPIL vs. UOI)

The internal emails and documents from one of India's biggest business group reveal how in violation of the Constitution and the laws of the land, major corporates like Essar manage to influence the political executive, the bureaucracy, the police and the media, in order to serve its business interests rather than public interest which they are legally obligated to uphold. The emails show how Essar attempts to bribe by bestowing favours on Ministers, top politicians, top bureaucrats and police officers in violation of various sections of the Prevention of Corruption Act 1988.
These favours are in the form of expensive gifts and jobs to the persons they recommend.
The
entire
matter
is
crying
out
for
a
thorough
oourt-monitored
investigation by an SIT or CSI since the same is necessary to uphold democracy. the rule of law and rights of the citizens under Articles 14 and 21 of the Constitution of India. The prevailing corruption in the country in high places seriously impairs the right of the people of this country to live in a corruption free society governed by rule of law. This is a violation of Article 14 and 21 of the Constitution. The right to life guaranteed to the people of this country also includes in its fold the right to live in a society, which is free from crime and corruption.
The conduct of the journalists and media companies in taking favours from corporates
and in carrying out planted stories is in violation of
journalistic norms and ethics. The Government
of India is obligated to
withdraw the privileges like subsidized land, newsprint, houses etc. that have been extended to media organisations
and journalists
who are
indulging in paid news. or publishing news reports to favour corporates, or who are taking favours from corporate.
The instant case has several similarities with the Radia tape case (yVPC 16 of 2011) which showed Many illegalities and corrupt activities that have been exposed include appointment & functioning of regulators for extraneous considerations.

27.08.2012 Mr. Krishnamurti prepares Monthly Information System (MIS) report on various business interests of Essar including Steel, Mines. Shipping etc. The chapter on steel sector of the said report inter-alia states: "Planted Parliamentary

20.04.2012 'Daily Calling Report' of the day indicates that Essar officers are regularly meeting scores of politicians, bureaucrats and journalists everyday to plant questions in Parliament, push public policies, gain access to confidential information and documents from inside the ministries and to plant stories in the media.
23.07.2012 Mr. AnI! Agarwal, Senior Vice President, Essar writes a summary of his meeting with the Chairman of SAIL Mr. C.S. Verma. He states in his email toMr.Krishnamurti:
"Chairman mentioned that Essar was planting stories thru media on NMDC pricing which was not in good taste. He mentioned specific recently

which is one of India's leading business
conglomerate having multi- billion dollar investments in Oil, steel, energy, ports, shipping. infrastructure and services sectors in india.
The Petitioner, Centre for Public Interest Litigation (CPIL). is a registered society (No. S-14654 ) formed for the purpose of taking up causes of grave public interest and conducting
public interest litigation in an organized
manner. Its founder President was the late Shri V.M. Tarkunde and its Executive Committee consists of several senior advocates including Shri Fali S. Nariman, Shri Shanti Bhushan,
Shri Anil Divan, Shri Rajinder
Sachar, Shri Colin Gonsalves among others. Over the years, the petitioner has established
itself as a credible public interest organisation.
The
petitioner SOCiety has filed severat important PILs in the past, like for the investigation of 2G scam and cancellation of licenses. investigation into Radia tape case, Air India scam, illegal disinvestment
of public sector
undertakings, etc. Ms. Kamini Jaiswal, General Secretary of the Petitioner Society is authorized to file this PIL. Petitioner is a non-profit body (PAN No. AAA IT 6941 G ). The requisite certificate and memorandum/rules the society are filed along with the vakalatnama.

The petitioner has no personal interest, or private/oblique
motive in filing
the instant petition. There is no civil, criminal, revenue or any litigation involving the petitioner, which has or could have a legal nexus with the issues involved in the PIL. The pentloner has not made any representation to the respondent authorities owing to the urgency and gravity of the issue.
THE CASE IN BRIEF

The present writ petition deats with the phenomena of corrupt nexus
between
business
and government.
The
nation was
shocked
when
recently several arrests were made and FIR lodged In connection with secret and confidential papers being systematically copied and allegedly passed over to powerful commercial
interests.
This petitioner society,
through a confidential source whose identity needs to be fully protected, has come in possession on internal emails and documents of Essar Group of Companies
(hereinafter 'Essar'), which indicate how Essar has been
cultivating ministers, polilicians,
bureaucrats
and journalists
in order to
serve its business interests, Essar, In turn, apparently gets favoured from such influential persons who can take executive decisions, change public pouctes, raise questions
in Parliament,
leak confidential
government
documents and plant stories in the media. This Information Is being placed before
the
Hon'ble
Court
by
the
petitioner's
society
for
its
kind
consideration and appropriate directions.

This petition, apart from placing certain material and information,
deals with the broader and significant questions and seeks this Hon'ble Court's intervention to frame guidelines, norms and standards in relation to

Access,
meetings and interviews
bureaucracy and the representatives/employees
between the ministers & of commercial interests
including consultants, facilitators, middlemen and lobbyists;
b)
The
phenomenon
of
corporate
gifts
and favours
being
bestowed on public servants or on those who can exercise influence over public servants.
c)
The issue of paid news/stories planted in the media through
journalists who are conferred various favours by corporate houses.

In Parliament
In Parliament, the MPs have a right to question the Government on
various
issues
including
issues
concerning
economy. After the "cash-for-questions' sting operation showed Parliament,

GROUNDS
A. That the intemal emalls and documents from one of India's biggest business group reveal how in violation of the Constitution and the taws of the land, the major corporate like Essar manage to influence the political executive, the bureaucracy, the police and the media, in order to serve its business interests rather than public interest which they are legally obligated to uphold, B. That the emails show how Essar bribes and bestows favours on Ministers,
lop politicians,
top bureaucrats
and police officers in
violation of various sections of the Prevention of Corruption Act 1988. These favours are In the form of expensive gifts and jobs to the persons they recommend. C. That the conduct of the journalists and media companies in taking favours from corporates
and in carrying out planted stories is in
violation of journalistic norms and ethics. The Government of India is obligated to withdraw the privileges like subsidized land, newsprint, houses etc. that have been extended to media organisations and journalists reports
who are indulging in paid news, or publishing
to favour
corporates,
or who are taking favours
news from
corporates D. That the entire matter is crying out for a thorough court-monitored Investigation by an SIT or CBI since the same is necessary to uphold democracy, the rule of law and rights of the citizens under Articles 14 and 21 of the Constitution of India.
E. That the prevailing corruption in the country In high places seriously impairs the right of the people of this country to live in a corruption free society governed by rule of law. This is a violation of Article 14 and 21 of the Constitution. The right to life guaranteed to the people of this country also includes in its fold the right to live in a society, which is free from crime and corruption.
PRAYERS In view of the facts & circumstances

Issue a writ of mandamus or any other appropriate writ directing a

guidelines regarding: a) the phenomenon of corporate gifts and favours being bestowed on public servants or on those who can exercise influence over public servants, b) access, meetings and interviews between the ministers & bureaucracy and the representatives/employees
of commercial
interests including consultants, facilitators, middlemen and lobbyists, and c) the issue of paid news/stories planted in the media through journalists who are conferred various favours by corporate houses.
d.
Issue or pass any writ, direction or order, which this Hon'ble court

We have Aegis that recrult young people on a regular basis .. where we can keep a certain number of vacancies for people recommended by political bosses, bureaucrats etc. We at Dalhl are under pressure on this front, and I am sure this Is the case wlth Ahmedabad, Che-onal etc. also·.· Therefore, I request at least 200 jobs be earmarked for this kind of requests and a strategy worked out by Business divisions to entertain qualified applicants who come under this category. Essar GM arrested for paying protection money to Maoists Supriya Sharma. Sep 27, 2011 RAIPUR: Dantewada police have arrested a general manager (GMl of Essar group on charges of paying protection money to Maoists. This is possibly the first time ever that a senior corporate executive has been held on such charges.
DVCS Varma, the general manager of .Essar Steel Limited, was arrested from Kirandul, the mining town where the company operates an Iron ore beneficiation plant. He was produced before a magistrate who sent him to two days of police custody for further interrogation. The police have arrested him under sections 121 and 124 (Al of the Indian Penal Code that amount to waging war against the state and sedition. Dantewada police superintendent Ankit Garg also said he was dispatching a team to Chitrakonda, in neighbouring Orissa's Malkangiri district. to arrest the company's deputy manager C Srinivas. The current investigation was sparked off with the arrest of B K Lala, a building contractor of Essar, who was picked up at a weekly village bazaar on September 9. The police claim he was carrying 15 lakh rupees. which he confessed he was delivering to the MaOists through alleged naxalite associate Lingaram Kodopi on behalf of Essar, Since then, the police served legal notices to Essar as well as Jai Johar, a Jagdalpur based non-profit organisation that carries out CSR activities funded by the company. The co-managers of Jai Johar, two brothers, Pawan Dubey and Narendra Dubey went into hiding as soon as the notice was served. ''The fact that they are unwilling to be questioned and are absccnding only reinforces our suspicions," said Garg. Investigators claim the income of both Pawan Dubey and B K lala has nsen 'exponentially' in the last one year, a time period that coincides with Essar's attempts to repair its pipeline damaged by the MaOists in May 2009. The police believe both the men mediated Essar funds to the Maoists to buy peace. "We have hard evidences ccrroborating what lala has told us," said Garg, refusing to divulge more details, calling it a 'sensitive case'. In a statement,

allegations, stating, "Such baseless allegations are being made to hurt the image and reputation of the group, which is a law abiding corporate. " Essar does not mine iron ore in Oantewada but sources iron ore fines from the waste dumps of government mining firm NMOC, mixing them with water and transporting the slurry to the port town of Vishakapatnam through a 267 km pipeline running through Maoist territory in Chhattisgarh and Orissa. In a background note, the company has claimed its pipeline and plant have been damaged at least 15 times ever since they turned operational in October 2005. The note also pointed out that, "Industries in the area do not have access to any security cover". It is widely believed that any group, small or large, that engages in economic activity In Oantewada, whether it is collection of beedi leaves, or road construction. or mining activity, need to pay levies to gain Maoist sanction. Essar group, the largest private sector company operating in the region, in particular, has been under a cloud since its pipeline cuts through Maoist heartland. The speculation of the company striking deals with the Maoists got a boost after a leaked Wikileaks cable, dated 11 January 2010, sent by the US consulate at Mumbai, quoted an unnamed Essar representative as stating that the company "pays the Maoists 'a significant amount' not to harm or interfere with their operations." The company denied the allegations.

The aforesaid team shall report to Shri Vivek Priyadarshi, Superintendent of Police, CHI (ACB), New Delhi and the overall supervision shall be of Sbri Santosh Rastogi, DIG and Head of Branch - CDI, ACB, New Delhi, 1'10 team shalt, after going through the transcript submit a report whether the conversation gives an indication of commission of criminal offence by the conversarionist, A rtpOn based on the analysis to be done by the team shaU be submincd in this Court within four months from today.
