Stepping up of pay of Seniors drawing lesspay than the Juniors consequenton fixation of pay due to implementation of 6tn CPC recommendations between Direct Recruits and Promotees- item No.8 and para no.20 & 2t of the Record Note of the meeting of the Standing Committee of National Council JCM held on 7th MLav2014.

NFIR desiresto invite kind attention of the DoP&T to the item No.8 (ptaru2| e,2D of the RecordNote of the meeting of the StandingCommittee of NC/JCM held on 7t'Yuy 2014 wherein the Official Side statedthat the issue has beenconsideredcarefully by the Governmentand agreed to grant stepping up of pay of seniors, if their pay happensto be lower than the junior direct recruitsjoined orr or after 01/0120A6. The Official Side furiher brought out that since this issueis presently sub-judice, it may not be possible to considerthe issue at this stage,pending on outcome ofthe court cases. In this connection,NFIR wishes to draw attention of the DoP&T, to the order passedby the Principal Bench, CAT on 0710512014 in OA No.367912012wherein the ltibunal has held the action of the Government discriminatory in granting less pay to the directly recruited staff nurse prior to 0110112006 in comparison to those appointedon or after 0110112006 is violative of Article 14, 16 and 39 (d) of the Constitution. Federationis reproducing below the operative part of the order of CAT, referred to above :In view of the above position, we allow this OA and quash and set aside the impugned speaking order dated 2710812012.Further, we declare that the discrimination in granting the pay scalesto the directly recruited Staff Nurses prior to 0110112006 and after 01/0112006is in violation of Articles 14,16 and 39 (d) of the Constitution of India. We, therefore, direct the Respondent No.L to treat the Applicants at par with the Direct Recruits Staff Nurses appointed after AIn0n006 and grant the PB-2 scalesof Rs. 9300-34800with the grade of pay of Rs. 4600 w.e.f. 0110112006 and fix their pay accordingly. The applicants are also entitled for all consequential benefits including arrears of pay and allowances with up to date interest at rate applieable to GPF deposits. The aforesaid directions shall be compiled with, within a period of two months from the date of receipt of a copy ofthis order.
