A number of referenceshave been received in this office regarding applicability, for departmentalpromotees,of minimumentry pay prescribedfor directrecruits(appointedon or after1.1.2006), in Sectionllbf piri A of the First Schedule of RS(RP) Rutes, 2008. Referenceshave also been received regardingsteppingup of pay of seniorpromoteeswith referenceto such of their directfyrecruitedjuniorswho are recruitedon or after 1.1.2006and whor" U"S" pay is morethan that of their seniors. 2. The matter has been examinedin consultationwith Ministryof Finance. ln this connection'itis cfarifiedthat the revisedpay structureco*ptises grade pays and running pay bands and in the case of t-hoseRailway servantswho were already in service before 1.1.2006,.Sixth Pay Commission has not prescribeda minimum pay in the running pay band with referenceto the minimumentry.level pay prescribedfor Olrebtiecruits appointedon or.after 1'1.2006. Further,the Sixth CPC has not prescribedminimumpay in the pay band-forthe purposeof fixationof pay on promotionin the case of any griO6 -pJy and fixing of minimumpay in pay band in the case grade of each for lhe departmentalpromotees would def6at the very purpose of introductionof ' I runningpay bandd. 3. As far as the'matter relatingto bringingthe pay of existing Railway servantsas on 1.1.2006at par with the pay of direct recruitsrecruitedon or after 1.1-2006is concerned,it is clarifiedthai tne pay of those Railwayservants who joined the Railwayas direct recruitson or aitei 1.1.2006is to be fixed as per Section-ll,Part 'A' of the FirstScheduleto the RS (RP) Rufes,2O0Band the proce_dure of pay fixation is based on a specificrecommendationof the Sixth Pay Commissiort, which hasieen acceptedOythe Government.As far as pay tjxgt]o1 in respbct to those Railway serv,antswho were already in service on 1.1.2006is concerned,the sameis'to be doneas per the provisionsof Rule7 of RS (RP) Rules, 2008 and in accordancewith the fitment tables annexedwith this Ministryrsletter No.PC-VV2A08lltRS'Rp/1 daled 11.9.2008.

Inthe lightof theforegoing, it is clarified thatin termsof RS (RP)Rules,2008:(a)

no minimumpay in the pay band can be prescribedin the case of promotionof Railwayservantsfromone gradeto another(exceptin the caseof changein payband);and

(b)

pay of thoseRailwayservantswho werealreadyin serviceon 1.1.2006 for can'notbe fixedwith reference to the minimumentrypay prescribed joined as thosewho the Railways as directrecruitson or after1.1.2006 per Sectionll, Part'A'of the FirstScheduleto the RS (RP) Rules 2008.

5. However,steppingup of pay of seniorscan be permittedwith referenceto such of their directlyrecruitedjuniors borne on the same senioritylist who are recruited on or after1.1.2006 andwhosebasicpayis morethanthatof the seniors subjectto the followingconditions:-

(a) Steppingup of the basicpay of seniorscan be claimedonly in the caseof and in caseswhere thosecadreswhichhavean elementof directrecruitment junioris actuallydrawingmorebasicpay thanthe seniors a directlyrecruited In suchcases,the basicpay of the seniorswill be steppedup with referenc from the date to-thebasicpay of the juniors.Steppingup will be applicable juniordirectrecruitis actuallydrawinghigherbasicpaythanthe senior.

(b) Further,Railwayservantscannotclaim steppingup of their revisedbasic pay with referenceto entry pay in the revised pay structurefor direct as laiddown in Sectionll of PartA recruitsappointedon or after1.1.2006 of FirstScheduleto the RS (RP)Rules,2008,if theircadredoesnot have or in cases where no junior is drawing an elementof direct recruitment, basicpay higherthanthem. (c) Steppingup of pay of the seniorsshallnot be applicablein caseswhere payof directrecruitshas beenfixedat a higherstageon accountof grantof advanceincrementsetc.at the timeof recruitment. 6.

Thisissueswith the concurrence of the Ministryof of the FinanceDirectorate

Railways.
