Delegationof powersto Ministries/ Departments/Borrowing Organisations to extend deputationtenureupto 7 years in casesof Deputrations covered by DoP&T's OM No. 6/8/2009-E-stt.(Pay-il) dated fih June 2010 regarding.

This Department's oRl No, 6/8r2009-Estt{Pay-ll} dated iTth June 2010 regulatesPay, Deputiation(Duty) Allowance,Tenure of Deputation/ Foreign Service and othertenns and conditionson the subjectof deputation/ foreignserviceof Central Governmentemployees to ex-cadre posts undei the Gentral Governrnent,State Governments,Public Sector Undertakings, AutonomousBodies, Universities/Union TerritoriesAdministration,Local Bodiesetc. and vice-versa(copyenclosed).Subiect to its applicability as provided in para 2 of the OM, these'instiuctions covercasesof deputation/foreign seryice where Central Governmentis either lending authorityor bonowingauthorityor both.lt providesfor durationof maximumDeputationTenureis 5 yearsat a stretch.As per para 8.3.1 (iii)of this OM, no furtherextensionbeyondthe fifih yearshallbe considered. 2. Various administrativeMinistries/Departments/BorrowingOrganisationshave been approachingthis Departmentfor relaxationof the 5 year dLputationtenure condition,on caseto case basis,citingexigencies, quotingprovisionsof para 10 of the oM dated 17.6.2Ci1A ibid. 3. lt has been decidedthat if the administrativeMinistriesI Departmentsand other bonowing organizationswish to retain an officer beyond 5 years, they may extend tenureof deputationcoveredby OM No. 6/8/2009-Esft.1eay-lf; OateOtih June ZO1O, whereabsolutelynecessaryin public interest,upto a periodnot exceeding7 years at a stretch.This shall be done with the approvalof the Ministerof the borrowingMinistry/ Departmentconcernedand in respectof other organizationswith the approvalof tire Minister of the borrowing Ministry/Department with which they are administratively concemed, keeping in view the exigencies and subject to fulfiltment of all other requirementssuch as willingnessand vigilanceclearanceof the Officer concerned, NOC of the lendingauthority,UPSC / ACC approvalwhereverapplicabte.Thus, no caseof €xtensionshall be referredto Departmentof Personnel& Training,New Delhi. 4. .. In caseswhere'thenecessityto havedeputationtenureslongerthan sevenyears is felt, the cqncernedadministrativeMinistries/ Depa(ments/boiowing organisdtions Tay amendthe relevantRecruitmentRules of such deputationpost afurJingly, after fo-llowing the requisite,procedure.No extensionof depr.itationbeyondz years ii to be allowedgnfessprovidedin the relevantRecruitmentRulesof such deputationpost. lt is reiteratedthat no case for extensionbeyondfiveyears shallbe refenei to DoPt. 6. lt ls also clarlfied that cases which are not covered by the OM dated {7.62010 in-cludingdrose where CentralGovernmentis neither llnding authority nor borrowing authqrity, will continue to be decided in terms of the relevant provbions/ rulee/ instructions etc. governing them. 7.

Theseordersshallcome into effectfrornthe date of issueof this OM.
