BILL NO. 503 ORDINANCE NO. 503 CONSIDERATION OF APPROVAL OF BILL #503, AN ORDINANCE AMENDING TITLE 2 OF THE MESQUITE MUNICIPAL CODE ENTITLED “BUSINESS LICENSE REGULATIONS” BY AMENDING MESQUITE MUNICIPAL CODE TITLE 2 CHAPTER 1, SECTION 2-1-11 ENTITLED, “SEMIANNUAL GROSS SALES;” SECTION 2-1-12 ENTITLED “GROSS SALES; SCHEDULE OF FEES;” SECTION 2-1-13 ENTITLED “SPECIFIC FEES AND REGULATIONS ENUMERATED; AND TITLE 2 CHAPTER 2, SECTION 3A-17 ENTITLED “UNSUITABLE LOCATIONS;” AND TITLE 2 BY ADDING A NEW CHAPTER 15, ENTITLED, “PUBLIC UTILITIES;” AND OTHER MATTERS PROPERLY RELATED THERETO. WHEREAS, the City of Mesquite is a growing community; WHEREAS, Nevada Revised Statutes 266.355 grants the City the authority and power to regulate and impose a license fee on professions, trades, and businesses; WHEREAS, it is reasonable and appropriate for the City of Mesquite to review and revise business license provisions; WHEREAS, it is reasonable and appropriate to amend the Mesquite Municipal Code from time to time; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MESQUITE AS FOLLOWS: SECTION 1: Chapter 1, of Title 2 of the Municipal Code of the City of Mesquite, Nevada is hereby amended as set forth in Appendix A: SECTION 2: Chapter 3 ARTICLE A, of Title 2 of the Municipal Code of the City of Mesquite, Nevada is hereby amended as set forth in Appendix B: SECTION 3: Title 2 of the Municipal Code of the City of Mesquite, Nevada is hereby amended by adding a new Chapter 15, entitled, “Public Utilities,” as set forth in Appendix C. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. The City Clerk is instructed and authorized to publish the title to this ordinance as provided by law. SECTION 6. This ordinance shall become effective upon passage, approval and publication. SECTION 7. The provisions of this ordinance shall be liberally construed to effectively carry out its purpose in the interest of the public health safety, welfare and convenience.
SECTION 8. If any subsection, phrase, sentence or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions. SECTION 9. The City Council finds that this ordinance is not likely to impose a direct and significant economic burden upon a business or directly restrict the formation, operation or expansion of a business, or is otherwise exempt from Nevada Revised Statutes Chapter 237.
