Apr 5, 2017 To: Supervisor of Elections Employees and Public Officials Ref: Refusal to Release Text Message Public Records requested after the Feb 27 meeting with myself and Ms. Rhonda Cole. 1. I have made repeated requests over the past five weeks for the remaining public records that non of you have provided. Those requests applied to each of the four staff members of the Hardee County SOE office. Each person has chosen to ignore this request through the records custodian, Ms. Diane Smith. 2. Below are copies of emails to SOE Smith. 3. I know there are many other text messages that have not been given to me both before and after the messages that each of you staff members created during the Feb 27 meeting while we were in your office. Here is an example of those messages that you provided to the Feb 27 request (Chet Huddleston and Loni Larimer coaching Sergio Jimenez while SOE Smith was at the eye doctor during working hours). You left out messages before and after the meeting and the rest of the public records request.

4. Public employees, you are breaking the Florida State laws. These are criminal offenses. 5. I understand there are other citizens that have made similar requests for public records that have been ignored.

6. SOE Smith and former SOE Chet Huddleston, does your status as a Constitutional Officers exempt you from these laws as well as all of the other actions you two have taken regarding use of Huddleston campaign funds for Smith campaign; Huddleston campaigning for Smith while being the SOE of Hardee County; Huddleston applying for a vacancy in his own agency while the SOE of that agency; hiding a vacancy from the public for months and Smith giving the job to Huddleston after taking office with a pay rate above class?

As a followup can you please provide the following records: 1. Any notes, memos, emails, recordings or other memorials/communications made by employee Chet Huddleston, yourself and any other staff member before, during or after the meeting on Feb 27 involving any matters that we discussed. 2. Text messages to/from Chet Huddleston on his phone, your phone, or any staff members phone to anyone else on Feb 27 that has content related to our meeting; anything we discussed at our meeting; the public record requests by Ms. Cole and myself; the inquiries about how Mr. Huddleston obtained his position; or a complaint called into the Wauchula PD. Ms. Smith, this request will likely require each of the four staff members present on Feb 27 to carefully, accurately and completely make a copy of their text messages from Feb 27 and redact only those messages or portions of messages clearly not germain to the public information request. This includes messages to other parties outside the office if the content falls within the context of agency business requested above. Can we agree to have these records available for my viewing on Mar 7? Followup Request -- Text Message Records delivered on Mar 7, 2017 from request of Feb 27. As a refresher >>>> We (Henry Kuhlman and Rhonda Cole) met on Feb 27 at the desk of Sergio, clerk of the Supervisor of elections (SOE) office, to pick up public records. The Elected Official, Diane Smith (and records custodian) left as we found out for an eye appointment. While the two citizens were viewing the records, mostly applications on file for the SOE job Chet Huddleston got and asking questions about how the hiring process works, they were not aware that four public paid staff employees of the SOE were Group Texting each other and coaching Sergio on how to outwit the citizens (Sergio at his desk, Loni at a desk off to the side, Chet hidden behind a wall, Diane Smith ($100,000 per year Director at the eye doctor). Also, in a two additional side text conversations, the SOE Director Smith and the former SOE Director Huddleston (who was given backdoor, UTT {under the table) job on Jan 9 by SOE Smith) were in conversation with the Sheriff of Hardee County, Arnold Lanier, before the meeting until he was requested to send police officers. The two citizens were never aware of these conspiracies. Around 11:00 SOE Smith returned to the office and took Sergio's place behind the desk where Mr. Kuhlman and Ms. Cole asked her straight foreward questions from their previous requests that remained unanswered. Questions like, "How many persons did you interview for Chet Huddleston's job? Did you interview Loni, standing behind you that submitted an application? Did you take any notes during the interviews? Do you have a calendar that shows when you did the interviews? Did you advertise or post the job to the public in the newspaper or at Career Source Heartland? >>>>>> These were the primary questions. SOE Diane Smith's answers were the same for each -- "I don't have to answer that question." All followup questions involved trying to find how she satisfied her responsibility for providing equal opportunity to all qualified persons (high school education) for this job, and her obligation to fine the Most Qualified person for the job. The discussion became circular with no progress but was civil and respectful at all times. The two citizens told SOE Smith which records they wanted copies of and got up to leave. Ms. Smith was most gracious and came around from the desk and to their complete surprise, gave each citizen a big hug! So, with that they left out the front entrance to the sidewalk only to find a police women (Amy, who is a friend of Ms. Cole) going into the SOE office. Ms. Cole asked her what it was about and she said she needed to speak with Ms. Smith. The citizens left, only to find out later SOE Smith said she was being Harassed by someone named Coleman but would not give the nature of the discussion or specifics. She would not file a formal complaint but the incident remains an offical document with the Wauchula PD and the Hardee Sheriffs Office, even though it falsely reflects how the call was made (not called into the Sheriff dispatch as recorded but by Text Messages from SOE Smith and former {two months ago} SOE Chet Huddleston). The records imply that these high paid public officials used all available resources from low level staff employees to the top cop in the County to impede the investigation of two citizens looking at how they appear to have entered a corrupt quid pro quo pact that began on Aug 30 when Chet Huddleston lost the Republican Primary. Reference attached pictures of text message pages delivered yesterday. Request the following:

1. Please rearrange the pages that you gave me according to which telephone each page is associated with. Annotate the pages with the phone number and the name of the person that go with each one. Number the pages for each phone in the order the messages were created. Write next to each message in pen and ink, the name of the person who wrote the message. Write the time of each message at the top of the message. 2. SOE Smith, I assume that each of the four staff members each provided sets of text messages from their telephones for this request. Yes or NO? Which if any did not? 3. The request for text messages in item #2 of Feb 27 was for all messages before, during and after the meeting for the entire day. The messages you provided ended for your staff person, Loni with the word, "Good" just before you got back from the eye doctor during a work day, Ms. Smith, is that correct? The last message from Mr. Chet Huddleston was his message to Sheriff Lanier saying, Henry has raised his voice a few times, Diane has asked him several times to please respect her. I have heard this conversation escalate over the past 30 min. Not horrible yet but it's starting to get rough. That was around 11:35 or so SOE Smith. Sergio left when you came around 11:05 and I'm not sure if he came back. Your last message was telling Sheriff Lanier, NO!!!! (you were not alright in response to his request just after 11:30). SOE Smith you and your staff did NOT comply with the request for records on this item. I demand the rest of these text messages in the proper format by close of business, Friday. Each message should clearly identify the date, the writer, and the person the message went to. The text messages from different staff members should MATCH UP or Pair. This is why I want the texts from each staff member in separate packages from 8:00 AM until the office was closed for business on Feb 27. Four sets for the day. SOE Smith, if you give me blank pages again with content only, I will proceed with legal action immediately. I'm not buying your line about the way you transfer "stuff" off your Gmail. 4. SOE Smith, In your case, do not forget I need all messages and emails at anytime during Feb 27 (for this request) With All Header Information Provided -- with any member of law enforcement, any Hardee County Commissioner, any member of the Tenth Judicial Circuit, Attorney Ken Evers, the Hardee Clerk of Court office or their attorney, the IDA or EDO office or staff, and the planning and zoning board member Nick Timmerman.
