Dear Estes Park Town Trustees, Mr. Mayor and Larimer County Commissioners, I have noted ongoing comments from Art Messal and Michelle Hiland to the Estes Park Town Board of Trustees & Staff and Larimer County Commissioners. I find many of their claims to be misleading or outright false. I would like to present to you the perspective on these matters, as both Art Messal and his partner, Michelle Hiland, have cost Visit Estes Park, and thus the community we serve, a great deal of time, money, and resources since Fall 2016. Art has claimed the mantle of community leader. This is certainly not our understanding, and is not at all evident to the community. Art is one citizen of this town. He does not hold an elected post. He does not represent any of the town organizations that we know of. We do not know of any constituency that he represents other than himself. This claim about “many in the community” is a prime example of Art making false claims by leaving out important supporting details. As such, we cannot see why we would expend more resources on his agenda than we do on behalf of the rest of our stakeholders who seem to uniformly oppose his agenda. We had the debate with Art and his partner, Michelle Hiland, on the legality of our CORA policy. Michelle lost in court, but not before diverting public money from marketing to the defense of a frivolous lawsuit. They continue to make baseless accusations of wrongdoing regarding VEP. Again, we cannot endlessly revisit every issue merely because they are not satisfied. Once such recent accusation is that VEP is not properly fulfilling CORA requests. Per Art, “Below is the request I sent to the VEP board after receiving a response to a CORA request for bank statements. The response to my request included a large fee, but more problematic the documents were heavily redacted (every document was redacted according to the email about the fee).” The CORA request by Art was: “Monthly statements for each bank account VEP maintains, including canceled checks, for the last 12 months.” Art wanted documentation listing every financial transaction that VEP had conducted over the last year. It took six hours of staff time to compile and redact the voluminous documentation requested, time that could have been spent productively for the benefit of the community we serve. Sounds nefarious, doesn’t it? The CORA statute specifically provides for a fee schedule to discourage broad fishing expeditions such as this one that can easily disable an organization, as well as to compensate for staff time when such requests are made. The nefarious redactions that Art refers to were the bank account numbers and board signatures on the numerous financial documents. This was advised by VEP legal counsel, and it is common sense that VEP should not publish bank account numbers to protect public funds. Our CORA procedures follow state law to the letter, we are absolutely diligent in fulfilling CORA requests, and no documents are ever withheld without legal basis. Art’s accusations regarding VEP CORA requests are completely baseless and are emblematic of all his other false and endless accusations. Not wanting to pay the required fee for the documents, Art requested that the VEP board expand the scope of the document search to two years, and review it at their next board meeting and also hire a third party accountant to create customized documents as requested by Art. It was determined, that to allow one community member to hijack the agenda of the organization by demanding a customized review of every financial transaction to the satisfaction of Art Messal would be irresponsible. If Art demanded that the county or town spend public money to hire an outside accountant to compile a record of every financial transaction from the last two years and review it in detail at the next county or town meeting to the satisfaction of Art Messal because he did not believe that your boards had an adequate understanding of what public money

was being spent on, would you even consider wasting the taxpayers’ resources on such a request? This is the type of engagement that Art has been having incessantly with VEP since Fall 2016. The fact is VEP already has stringent financial controls and reporting. We received a report at a recent board meeting from our outside CPA that VEP has some of the most stringent financial and budget controls of any of the organizations that she works with, and this opinion was seconded by VEP legal counsel. VEP receives a separate audit as part of the Town of Estes Park’s third-party CPA audit, and VEP has received a clean financial audit opinion every year. VEP is one of only 200 DMO’s globally who have achieved international accreditation through Destination Marketing Association International (DMAI). This accreditation can only be achieved through strong financial and budget controls, advanced data & metric reporting, and strict processes monitored by DMAI. Our recent annual report illustrates the success achieved by VEP as well as reinforces the benefits of the organization to the community. Also, VEP was awarded the best marketing campaign in the State at the Governor’s Tourism Conference last Fall. We had double digit growth this past winter, despite the HWY 34 closure. We are delivering the service we were hired to do, and using the funds accordingly. Michelle recently claimed during public comment at a town board meeting on 6/27/17 that she requested the VEP budget and has still not received it. The fact is that the budget was one of the first documents she requested in Fall 2016. She was provided the detailed VEP budget submitted to the Colorado Department of Local Affairs, and she has attended public board meetings where the budget was discussed by the VEP board along with detailed P&L documents distributed to the public, including Michelle and Art. Michelle’s claim that she requested the budget but “I still don’t have it” is simply false and emblematic of her behavior. Moreover, the summary budget for VEP is posted on the partner page of our website in the annual Operating Plan for all to see. None of this will matter to Art Messal or Michelle Hiland, as the facts don’t seem to be an issue of concern to these two individuals. They have finally revealed their real agenda: to take the lodging tax monies paid by overnight guests (not local residents) that were approved by the voters of Estes Park to support a tourism marketing organization, and instead use these public funds for other purposes that these two individuals consider more important, without regard to the will of the voters. There are ways to fund childcare, housing and other economic development initiatives. Discrediting VEP to then transfer monies from the marketing district is not one of them. In order to further their agenda, they are willing to personally and publicly vilify the VEP staff, CEO, and board members in order to discredit the VEP organization, and then point to their own baseless accusations, to give Town Trustees, County Commissioners, and the public the false impression that there is something wrong with VEP. Mr. Messal’s shifting tactics in pursuit of this meritless agenda have included stating, at first, that he and Michelle were looking into personnel issues at VEP in order to protect the staff members from a possible hostile work environment and to maintain their good year-round jobs in town. But, subsequently, both Art & Michelle are now stating on the record in writing that all VEP staff members should be fired because they are all incompetent to work in a marketing organization. Not coincidently, this shift occurred after the staff stated twice publicly that all of Art & Michelle’s contentions of internal personnel problems were baseless, that Art & Michelle did not speak for staff, and that staff likes, admires, and respects CEO Fogarty. Based on VEP Board input, we are not going to continue devoting organizational resources to these individuals, as it is clearer than ever that they will not be satisfied and will not stop harassing the organization, no matter what we do. Feel free to refer to Estes Park EDC CEO Jon Nicholas’ letter that was recently shared with you, for further clarity on that point (We have received a similar letter from the Estes Park EDC Board Chair, Jim Pickering). Both the EDC CEO and Chairman shared the following sentiment in both of their support letters to VEP:

“habitual criticism of the negative sort can be corrosive – it can and often does, sap the energy and spirit of any organization. Take consolation in the fact that habitually negative critics soon become generally regarded as ‘nags and ‘scolds’ and, however altruistic their motives, their credibility inevitably sags and suffers. In dealing with such folks I have found that it is best to just say ‘thank you’ and move on.” Instead of the purported disarray inside the VEP organization, VEP is making great progress in advancing the interests of Estes Park. Rather than finding that, per Art “community members are questioning what is happening at VEP,” we find that the organization has broad and deep support in the community to continue our efforts, as evidenced by many letters of support and public comments from the community. There are many other accusations, and VEP has tried to deal with them constructively, but it continues to be a complete drain on the organization, and there isn’t enough time nor is it responsible use of public resources to go tit for tat with Art, Michelle, and a few others who give them a platform, including the Trail Gazette. However, we felt it incumbent on us to let you know the nature of Art and Michelle’s harassment. Although we support all citizens’ rights to advocate for their policy positions, as evidenced by our numerous avenues for public input and engagement, we feel that it is incumbent upon VEP to correct some of the misinformation and falsehoods that we see you have been receiving from Art, Michelle, and a few others. In the end, we would ask for the Town and County Boards to support VEP and its mission by not being persuaded by isolated individuals without community support who continually make vocal, unfounded accusations.
