SUBJECT:
COLLECTION OF FEES/CHARGES FOR THOSE WHO MAY AVAIL OF "THE MABUHAY LANE" (EXPRESS SERVICE UNIT) REVENUE OPERATIONS GROUP, ON CERTAIN APPLICATIONS FOR TAX EXEMPTION.
Pursuant to the provisions of Section 54, chapter 12, Book IV of Executive Order No. 292 (Administrative code of 1987), authorizing the collection of fees/charges by government entities, etc. for services rendered in the exercise of their functions, and in consonance with Executive Order No. 197 dated January 13, 2000, this Department hereby adopts a schedule of service fees/charges as herein below provided:
SECTION 1. Filing fees/charges - A non-refundable fee/charge shall be collected from the applicant/customs broker/ representative upon every submission of request/ application with complete documentary requirements to the express service unit "THE MABUHAY LANE", hereinafter referred to as the "UNIT" covering the following sectors: 1. 2. 3. 4. 5. 6.
Export - oriented firms (130I, etc.); Importations under Sec. 1058; Importers of books, periodicals and other similar items/articles; Non-stock, non-profit educational institutions; Local Sale of motor vehicles; Returning residents, persons coming to settle permanently including "balikbayan", recalled foreign service personnel, and other persons similarly situated such as foreign consultants; 7. Importations under PD 87 (oil), PD 972 (coal), PD 1442 (geothermal) and RA 7156 (mini hydro-electric power);
which fees/charges shall be as follows, to wit: VALUE OF IMPORTATION

/2 SECTION 2. Processing Fees - A Processing Fee in an amount equivalent to one and one-fourth percent (1,25%) of the value of importation shall be assessed and collected from the applicants/representatives upon processing but prior to the approval of the application. The fee/charge shall be non-refundable. SECTION 3. Action within 24 hours - Application with complete documentary requirements and with the necessary data needed in the encoding of appropriate indorsements shall be acted upon within twenty four (24) hours from date of receipt thereof by the Unit, provided that the necessary fees/ charges herein above indicated are paid.
SECTION 4. Inclusion of additional sectors - Upon appropriate application, the secretary may include additional sectors in the list mentioned above that may avail of the express service "THE MABUHAY LANE", upon payment of such fees/charges. SECTION 5. Utilization of proceeds (funds) from fees/charges - A portion of the proceeds from fees/charges authorized to be collected herein shall be in the nature of and treated as a trust fund and as such shall be expended/utilized for the expenses in the procurement of office supplies, materials and equipment to upgrade the office facilities of the "Unit". SECTION 6. Effectivity - This Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
