Federationdoes not agree with the view taken by the Railway Ministry in this caseas conveyedto NFIR vide Board's letter dated17120-Il-20t7. Federationwants that the Railway Ministry shouldprepareproper casebasedon the facts and contentionsof NFIR as explainedin our letterdated2810812017 to be placedbeforeDoP&TAvIoF. n. Federationreiteratesthat as a result of issuanceof instructionsdated 1710812017, a situation has arisen wherein the Railway employeesin Pay Level 3, drawing pay Rs. 21,700/and aboveupto Level 8 hitherto entitled for TransportAllowance @ Rs. 3600 + DA thereon(in AllA classcities and in other cities @ Rs. 1800+ DA thereon)havebeendeprivedof the said rate due to the new nonn for entitlementonly when their pay reachesPis.24,2001-. UI. Further it is relevant to take note that pursuantto acceptanceof the recommendationsof 5ft CpC and 6ft CPC,the ratesrevisedas follows:(a)

IV. From the comparisonof two tables mentionedabove, it could be seenthat the Railway employeeswere allowed higher rate of Transport Allowance on drawing pay Rs. 7440/irrespectiveof Grade PaylPayBand. The modified Board's instructionsissuedvide letter dated 03108/2017and I7/08l20I7,have deprivedthe TransportAllowance@ Rs. 3600+DA thereonto those in Pay Level 1 and 2 (7* CPC) due to impositionof restrictioni.e. reachingthe pay Rs. 247001-ignoring the fact that the staff were already drawing pay @ Rs. 7440 in 6mCPC Pay Band/GradePay. Federation,thereforerequeststhe Railway Ministry to kindly anangeto make out casein the light of NFIR's contentions for rendering justice to those staff of Pay Level | & 2 for granting Transport Allowance at rate i.e. 36001- + DA thereon when they reach the correspondingpay @ Rs. 217001-and not 242001-to meetthe endsof justice and refer to MoF. A copy of the referencemadeto the MoF may be endorsedto the Federationfor taking follow up action. Yours faithfullv.
