MINUTES SCARBOROUGH TOWN COUNCIL WEDNESDAY – SEPTEMBER 7, 2011 REGULAR MEETING – 7:00 P.M. Item 1. Call to Order. Council Chair Roy called the regular meeting of the Scarborough Town Council to order at 7:00 p.m. Item 2. Pledge of Allegiance. Item 3. Roll Call. Rolled was called by Yolande P. Kerry Corthell of 1 Wedgewood Street gave a huge kudus to the Town Manager and the Computer Department for placing all major Town meetings on the Town’s website for public viewing.
Item 5. Minutes: August 17, 2011 – Regular Meeting. Motion by Councillor Rancourt, seconded by Councillor Sullivan, to move approval of the minutes of the August 17, 2011, regular Town Council meeting. Vote: 7 Yeas. Item 6. Adjustment to the Agenda. None at this time. Item 7. Items to be signed: a. Treasurer’s Warrants. Treasurer’s Warrants were signed during the meeting. Order No. 11-73, 7:00 p.m. Public hearing and action on the new requests for a Food Handlers License from Tsan Chau, d/b/a Shogun Japanese Steakhouse, located at 238 Gorham Road and Matthew Howe, d/b/a 38 Mussey Road. Council Chair Roy opened the public hearing. As there were no comments either for or against, the hearing was closed at 7:03 p.m. Motion by Councillor Wood, seconded by Councillor Holbrook, to move approval on the new requests for a Food Handlers License from Matthew Howe, d/b/a Sushi Maine, located at 38 Mussey Road – without conditions and from Tsan Chau, d/b/a Shogun Japanese Steakhouse, located at 238 Gorham Road, with the condition that the owner must stay in compliance with the State Fire Marshal’s Office plan of correction. Item 8. Non Action Items. a. Discussion on the new law changes relating to fireworks. Michael Thurlow, Fire Chief, gave a brief overview on the new law changes relating to fireworks. The other individuals who reviewed the new changes were the Police Chief, the Town Planner and the fire prevention staff. We were pleased to find that most of our concerns had been addressed within the state law. With the protection already outlined in state law it was found there would be no reason to propose further restrictions on the sale or use on consumer fireworks, or to modify the Zoning Ordinance as to where they could be sold with one exception. The current NFPA Code would allow a structure smaller than 6,000 square feet to be used for the sale and storage of fireworks without sprinklering. The fire department has been working on a proposed update to the current Sprinkler System Ordinance and additional amendments would be presented that any building used for the storage or sales of fireworks be sprinkled regardless of the size. Chief Thurlow responded to questions from the Town Council. b. Update on traffic improvement projects – Presentation of signage concepts. Dan Bacon, Town Planner, gave a brief history of the Payne Road Study Committee and the recommendation from that Committee regarding signage and how to direct traffic from the Payne Road area to Route One. Key recommendations were the Haigis / Route One Intersection Improvements, Dunstan Corner Intersection Improvements, Payne Rd Traffic Calming Measures and Way-finding & Directional Signage. Progress thus far – Haigis Route One improvements; Southgate Intersection and a left turn lane from Haigis onto Scottow Hill as well as from Route One into Enterprise Drive. These measures were completed under budget and all projects flowed into one another. The projects are substantially complete and there is a proposal for an Impact Fee on new development to recover a portion of the cost. Mr. Bacon went on to give an update on the Dunstan Corner Project. The cost of this project $3.5 million with a 20% local match. The final Design would be available in October. He went on to give an update on the Payne Road Traffic calming. The passing zone by Flaherty Farm had been eliminated and there would be landscaped island done this fall. He then mentioned the way-finding signage – this would update the current signage and add new signage in pertinent areas giving direction to the different areas of Scarborough. The Town Manager thanked the Council for moving this forward. There are many facets to this project. He then introduced Rand Ardell of Simmons Ardell to present a power-point presentation on the proposed design. Mr. Ardell responded to questions from the Town Council. Item 9. Standing and Special Committee Reports and Liaison Reports. • • • • •
Councillor Ahlquist noted that a Finance Committee meeting would be scheduled soon. He went on to give an update on ecomaine noting an open house will be held on Saturday, September 24th at ecomaine, from 8:30 to 11:30 a.m. located at 22 Blueberry Road in Portland. Councillor Holbrook noted that the Housing Alliance would meet on Thursday, September 8th at 6:30 p.m. Councillor D’Andrea thanked the Conservation Commission and Jay Chace, Assistant Town Planner, for working on the Cottontail Habitat item. Councillor Rancourt noted that the Ordinance Committee would be meeting on Monday, September 12th at 4:30 p.m. Elsie the Elm Tree Committee would be meeting on Tuesday, September 13th at 4:30 p.m. Council Chair Roy noted that the next meeting of the Energy Committee is scheduled for Thursday, September 15th at 7:30 a.m. here at Town Hall.

Item 10. Town Manager Report. Thomas J. Hall, Town Manager reported on the following: • • • • • •
Smart meters will start being installed on September 14th. Notification had been sent out earlier to residents regarding this and gave residents the option of opting out. The funding raising campaign for the Fuel Assistance Program would be starting shortly. He would give an update regarding the status at each Council meeting. The Maine Turnpike Authority and the Eastern Trail Bridge Project will host a ribbon-cutting ceremony on Wednesday, September 28th at the Kennebunk Elementary School to dedicate the new Eastern Trail Bridge over the Maine Turnpike. The Broadturn Farm will be hosting a program called “Forever Farms” in which they participated in with Maine Farmland Trust. This program will raise public awareness about the growing success of farmland protection efforts in Maine. The Council needs to revisit the Higgins Beach parking changes that had been implemented. He asked if this would be an item on a future agenda or if there would need to be a special meeting. He noted that he had received the Maine Town and City Manager’s Leadership Award and was humbled by the recognition. He thanked Council Chair Roy for submitting his nomination.

Councillor D’Andrea reminded everyone that there were free trigger locks at Police Dispatch for Scarborough residents. Councillor Rancourt had attended the 10 year anniversary celebration at Piper Shores, adding that Patrick O’Reilly, a Scarborough resident and former Town Councillor, had been elected the Chair of the Board. Councillor Wood congratulated the Town Manager on his award. Councillor Ahlquist also congratulated the Town Manager on his recognition, stating that it was well deserved. He went on to state that he likes to see the projects come to a close. Councillor Holbrook congratulated the Town Manager on his award. She reminded everyone that School was open and to drive with caution. She also noted that hunting season was just around the corner and if you were out and about to please wear orange. Councillor Sullivan also congratulated the Town Manager. Council Chari Roy congratulated the Town Manager and mentioned that the MMA Convention would be held on October 5th and 6th – any Councillor interested in attending, please contact the Clerk’s Office. She noted that a brochure on the PACE Program [Property Assessed Clean Energy Program] had been sent out with the tax bills. She sent condolences to families of Steve Dougherty; Rena Thorndike and Janet Joy Pillsbury. She also sent condolence to David Nelson and his wife on the loss of her father.
