MINUTES SCARBOROUGH TOWN COUNCIL WEDNESDAY – MARCH 16, 2016 REGULAR MEETING – 7:00 P.M. Item 1. Call to Order. Chairman Donovan called the regular meeting of the Scarborough Town Council to order at 7:08 p.m. [Workshop prior to Town Council meeting ran late.] Item 2.

Pledge of Allegiance.

Item 3. Roll Call. Roll was called by Yolande P. Justice, Town Clerk. Thomas J. Hall, Town Manager was also present. Shawn A. Babine, Vice-Chair Katherine A. St. Clair [Absent] Robert W. Rowan Peter F. Hayes Jean-Marie Caterina Christopher J. Caiazzo [Absent] William J. Donovan, Chairman Item 4. General Public Comments. None at this time. Item 5. Minutes: March 2, 2016 – Regular Meeting. Motion by Councilor Babine, seconded by Councilor Caterina, to move approval of the minutes of the March 2, 2016, regular Town Council meeting. Vote: 5 Yeas. Item 6. Adjustment to the Agenda. Councilor Caterina introduced the Town’s new FaceBook Page. She encouraged everyone to check it out. Information about the town would be placed on this site; e.g. upcoming meeting dates, construction projects, events, etc. Item 7. Items to be signed: a. Treasurer’s Warrants. Treasurer’s Warrants were signed during the meeting. OLD BUSINESS: Order No. 16-017. Act on the request to approve the names that were posted to the Conservation Commission and the Zoning Board of Appeals by the Appointments Committee at the March 2, 2016, Town Council meeting. Motion by Councilor Babine, seconded by Councilor Caterina, to move approval of the names that were posted to the Conservation Commission and the Zoning Board of Appeals by the Appointments Committee at the March 2, 2016, Town Council meeting, as follows: Appoint Charles Spanger to the Conservation Commission to fill a term to expire in 2016. Appoint Michael Richard as 2nd Alternate to the Zoning Board with a term to expire in 2018. Vote: 5 Yeas. NEW BUSINESS: Order No. 16-018. First reading and schedule a second reading on the Bond Order for the 2016 Municipal and School Capital Improvement Projects and the Refunding of Certain General Obligation Bonds of the Town of Scarborough. Thomas J. Hall, Town Manager, gave a brief overview on the 2016 Municipal and School Capital Improvement Projects and the Refunding of Certain General Obligation Bonds of the Town of Scarborough. He and the Finance Director, Ruth Porter, responded to questions from the Town Council. 1

Motion by Councilor Babine, seconded by Councilor Caterina, to move approval of the first reading on the Bond Order for the 2016 Municipal and School Capital Improvement Projects and the Refunding of Certain General Obligation Bonds of the Town of Scarborough and schedule a second reading for Wednesday, April 6, 2016, as follows: BOND ORDER FOR 2016 MUNICIPAL AND SCHOOL CAPITAL IMPROVEMENTS AND THE REFUNDING OF CERTAIN 2006, 2007, 2008 AND 2009 GENERAL OBLIGATION BONDS OF THE TOWN BE IT ORDERED, That under and pursuant to the provisions of Title 30-A, Sections 5721-5729 and 5772 of the Maine Revised Statutes, as amended, and the Charter of the Town of Scarborough, Maine, the following Municipal and School Capital Improvement Projects are hereby approved for funding: 2015-2016 Municipal - Equipment F.D. Extrication Tool Upgrade Project F.D. AED Replacement Project F.D. Tank 3 Re-chassis F.D. Service Plow Truck U7 (replace schedule) C.S. BE IT FURTHER ORDERED, That a sum, not to exceed $3,830,000, is hereby appropriated to provide for the costs of said projects and expenses associated with said projects; and, BE IT FURTHER ORDERED, That to fund said appropriation, the Treasurer and the Chairman of the Town Council are hereby authorized to issue, at one time or from time to time, general obligation securities of the Town of Scarborough, Maine, including temporary notes in anticipation of the sale thereof, in an aggregate principal amount not to exceed $3,830,000 and the discretion to fix the date(s), maturity(ies), denomination(s), interest rate(s), place(s) of payment, call(s) for redemption, refunding, form(s), and other details of said securities, including execution and delivery of said securities against payment therefore, and to provide for the sale thereof, is hereby delegated to the Treasurer and the Chairman of the Town Council; and, BE IT FURTHER ORDERED, That the Treasurer and the Chairman of the Town Council are hereby authorized to issue, at one time or from time to time, general obligation securities of the Town of Scarborough, Maine, in an aggregate principal amount not to exceed $3,800,000, to refund, on an advance basis, the remaining outstanding 2006, 2007, 2008 and 2009 General Obligation Bonds of the Town of Scarborough, Maine, and the discretion to fix the date(s), maturity(ies), denomination(s), interest rate(s), place(s) of payment, call(s) for redemption, form(s), and other details of said securities, including execution and delivery of said securities against payment therefore, and to provide for the sale thereof, is hereby delegated to the Treasurer and the Chairman of the Town Council. Vote: 5 Yeas. Order No. 16-019. Act on the request for the Town Council to consent to the assignment of the Parking Licensing Agreement and a Parking Lease Agreement to the new owners of the Higgins Beach Inn and authorize the Town Manager to sign any and all documents pertaining to this Order. Thomas J. Hall, Town Manager, gave a brief overview on the Order. Motion by Councilor Babine, seconded by Councilor Caterina, to move approval on the on the request for the Town Council to consent to the assignment of the Parking Licensing Agreement and a Parking Lease Agreement to the new owners of the Higgins Beach Inn and authorize the Town Manager to sign any and all documents pertaining to this Order. Vote: 5 Yeas. 3

Item 8. Non Action Items. None at this time. Item 9. Standing and Special Committee Reports and Liaison Reports. 

Councilor Rowan gave an update on the Appointments Committee and posted the following names: Senior Advisory Board: Donnamarie Collins, 1st Alternate, with a term to expire in 2017 Kenneth N. Simons, 2nd Alternate, with a term to expire in 2017 Scarborough Housing Alliance: Marj DeSanctis, Full voting member, with a term to expire in 2017



Councilor Caterina gave updates on the Long Range Planning Committee; the Conservation Commission adding that there would be workshop on “Backyard Composting” on Monday, April 4th from 7:00 to 9:00 p.m. here at Town Hall. Councilor Hayes gave updates on the Senior Advisory Board, the Harbor Committee and the Shellfish Conservation Commission. Councilor Babine noted that SEDCO, ecomaine and the Library Board of Trustees all meeting tomorrow, Thursday, March 17th and he would be attending these meetings. He then went on to give an update on the Finance Committee meetings, noting that the first reading on the proposed FY2017 Budget would be presented at the Wednesday, April 6th Town Council meeting. Chairman Donovan commented on ecomaine’s concerns with the one on one recycling market. He also commented on the Energy Committee.

 



Item 10. Town Manager Report. Thomas J. Hall, Town Manager, gave the follow updates:          

Rick Shinay is the new Land Trust President. The Energy Committee is working on a few items and one of the first is the education piece. He then handed out a flyer that showed stickers that would be placed on the recycling bins to educate individuals to what goes where. Mike Shaw, Public Works Director is working on curbside composting and currently working on central composting sited; the Veterans Home, Wal-Mart and possibly Pine Tree Waste. HE has been working with Garbage to Gardens on options to residents. IT had developed a 7-8 minutes video of the High School Laptop program that shows how well the program has been working. The Oak Hill Pedestrian improvements will be under way starting March 21st and will take 12 15 days to complete. Improvement to the parking on the Eastern Trail has been completed. It is possible that there may be an item that would come before the Town Council to possibly have the rest of the Eastern Trail no parking. There will be a meeting on March 22nd at the Pine Point Fire Barn on the Pine Point Improvement Project. This is similar to the one held at Higgins Beach. The Town has received a “Project Canopy Grant” for trees along Route One. He also mentioned that the first reading on the Municipal and School Budgets would be held on Wednesday, April 6th. There would be recycling trash and composting bins located in municipal buildings and when local events are scheduled; e.g. SummerFest, WinterFest. 4

Item 11. Council Member Comments.   





Councilor Hayes commented on the national politics and what has been happening at that level and hoped that we can chose to be different. Be respectful. Councilor Babine agreed with the prior comments. He wished everyone a Happy St. Patrick’s Day. He commented on the budget process and how well it has been moving along. Councilor Caterina also agreed with the prior comments made by Councilors Hayes and Babine. She encouraged the public to contact any member of the Council or town staff with questions concerning the budget or check out the Town’s website or Facebook page for information as well. Councilor Rowan thanked the Big 20 Bowling Alley for hosting the PTA Fundraiser and to Coles Appliance Center for assisting him with a problem and to Chairman Donovan for reaching out to all Councilors prior to the meetings to see if any of us have questions or concerns. Chairman Donovan loves the fact that we are an A Political Institution where we work with everyone. He was excited about the new “Trash Plan” getting off the ground. He commented on attending the budget meetings and felt there had been good discussions being held. He also congratulated Rick Shinay for being selected as the Land Trust President. He sent well wishing to Councilor St. Clair.
