Breakfast & lunch are served at WMS. Menus are distributed each month. Students are issued lunch codes to use in the cafeteria. Students should maintain a credit by bringing in checks/cash at regular intervals or parents may pay and check balances online at mynutrikids.com. Westbrook Middle School’s philosophy sees students as distinctly different learners than those who attend our elementary and high schools. In order to meet these unique needs, our school is designed such that students in grades 6-8 spend each academic year as a member of a particular team. Teaming promotes the formation of important relationships among staff, parents and students. Teams may vary in size or in how they celebrate their members, but all teams have in common the desire to meet the social, emotional and academic needs of each and every student. In order to meet their developmental needs, students in grade 5 are assigned to one teacher for core academics. In some instances, teachers will team together and students will travel to one other teacher for math, science or social studies. We invite you to become an active member of your child’s team or class by participating in School Council, Parent/Teacher Conferences, Principal’s get-togethers and other opportunities.

Your Rights and Responsibilities All students in Maine have the right to a free and full education from ages 5-20 in grades K-12. The law requires you to attend school until age 17 unless conditions specifically listed in Maine Statute (20MRSA/911) are met. In general, Maine state law requires that students attend classes for 177 days of the year. All public schools that receive federal funds must provide free, appropriate education to each qualified handicapped student regardless of the nature or severity of the person’s handicap (20MRSA/3111, Ch.403 and P.L. 94-142). In addition, the 119th Legislature amended Title 20-A, Section 6001-B, Transfer of Education Records, to read: “A school administrative unit shall include in the written notice to parents or guardians of every student enrolled in the school administrative unit that education records must be sent to a school administrative unit to which a student applies for transfer.” Please know that Westbrook Middle School adheres to these regulations. All parents and students share the responsibility to make sure students attend school. Your responsibility as a student is to attend all classes at Westbrook Middle School and to follow the rules outlined in this student handbook.

These are all opportunities for students to set and attain high goals. We encourage students to challenge themselves and we support them in their efforts!

Privacy

Students’ files are periodically scanned to make sure that they only contain appropriate material. From time to time, Westbrook Middle School celebrates its students’ accomplishments by publishing pictures, quotes, writings, and other articles of interest through local media, Westbrook Middle School publications and web page and facebook. These may also include television, radio, newspaper, yearbook, Westbrook School Department web page, and local bulletin boards. We feel this is an excellent way to promote positive school happenings, develop self-esteem in our students, and instill a sense of school pride within the communities we serve. If you choose to give permission for your son’s or daughter’s picture to be made public, please complete the media use form sent home with your student on the first day of school and turn it in to the attendance office. The school reserves the right to search or clean lockers without warning. Upon request, parents may also inspect their child’s locker. Students should have the same expectation for computer files which they keep on the school’s computer.

Daily Schedule

The regular school day at Westbrook Middle School begins at 7:50 a.m. with the pledge of allegiance and morning announcements in homeroom. We will begin dismissing students to buses at 2:30 p.m. Students who stay after school to participate in activities should always be under the supervision of a school employee.

Conduct Students are expected to conduct themselves in an appropriate manner conducive to the learning environment at all times. With mutual respect and understanding, we can cooperatively sustain a positive school climate here at Westbrook Middle School. Students are prohibited from making insulting, vulgar or debasing remarks to faculty, staff and/or fellow students regardless of the reason. Intentional cruelty is not permitted in school or at school sponsored activities. The School Committee recognizes that appropriate student conduct is best achieved by clear expectations that promote self-discipline, self-respect, and respect for others. The administrative staff and faculty are responsible for developing and implementing behavior and code of conduct standards in the schools and for disseminating the standards to school staff, students, and parents in accordance with established administrative procedures. To that end, the administrative staff, in cooperation with the faculty, is charged with the responsibility of determining such standards of conduct, as they deem appropriate, together with the necessary means for their enforcement. In the development of these standards, the Committee recognizes the right of the teachers to take such reasonable action as any parent might take in securing compliance with the established code. Teachers are the first level of student management and are authorized to utilize consequences to include the following: • Issuing warnings • Assigning detentions • Removing the student who is disruptive to the educational process from the classroom • If necessary for safety reasons, restraining a student who is physically violent • If warranted, denying specified privileges granted to other students Westbrook Middle School strives to provide every student the opportunity to receive the best possible education. Our community’s existence depends on the willingness of every member to follow certain expectations. To that end, we expect all students will choose to act responsibly with regard and respect for others. Students are expected to converse with and respond positively to reasonable requests from any member of the faculty/staff (to include: administrators, teachers, resource officers, secretaries, substitutes, educational technicians, custodians, bus drivers and food service personnel) in a polite, respectful, and compliant manner. Blatant disregard of reasonable requests or directives is an example of insubordination. This may result in removal from school and appropriate consequences based on the seriousness of that behavior relative to the offense. The entire Westbrook Middle School faculty, staff and administration are committed to the belief that all students are entitled to a learning environment free from all forms of harassment. We encourage any student who believes that he or she is being unfairly treated or subject to harassing behavior to bring such acts or conduct to the attention of the administration immediately. Students may seek the assistance of their teachers, advisors, coaches and/or counselors to aid them in the process of resolution. Confidentiality will be observed as appropriate.

Sports

There are a wide variety of competitive, interscholastic sports available for students in grades 6-8 to participate in (they are listed in the text box on page 5 of this handbook). Announcements are made prior to each new sport season indicating sign-ups and try-out information. Student athletes are required to have a physical examination every 2 years from their family physician. Student-athletes who are assigned to the Student Success Center or suspended from school as a consequence for inappropriate behavior will not be allowed to participate in interscholastic competition or performances on the day(s) they are in the Student Success Center or suspended from school. Suspensions and assignment to the Student Success Center may impact eligibility.

Extracurricular Eligibility Guidelines

There are a variety of extracurricular activities and sports in which students may participate at Westbrook Middle School. Students typically work hard on schoolwork and positively contribute to the culture of the school when they participate in an activity, sport or team of any kind. It is an honor for a student to participate in an extracurricular activity and represent Westbrook Middle School. In order to take part in extracurricular activities (NOTE: the following guidelines do not apply to clubs, with the exception of the Drama Club.), students must remain eligible based on the three categories of the WMS Habits of Work and Learning (HOWL): Classroom Expectations, Preparation and Engagement, and Pillars of Excellence (see page 22). Students become ineligible if they earn a score of 1 in any one of the standards within the three HOWLs or more than 33% 2s in any one HOWL. Initial eligibility is based on the previous grading period; for instance, Winter I eligibility is based on quarter 1 scores. Once a student is found to be ineligible, his/her scores are monitored and re-evaluated every two weeks. While on monitor status, students may practice with their club or team but may not participate in games, meets or performances. Three determinations of ineligibility in any one period (a season for sports, a quarter for other activities) will result in removal from the team or activity; the students will no longer be able to practice or attend meets, games or performances as a member of the team or activity. Students who are suspended or assigned to the Student Success Center will not be allowed to participate in any after school activities on the assigned days. Any student who receives an out-of-school suspension of two or more days is automatically ineligible to participate in games, matches or performances for the two-week period following the suspension.

Attendance

Maine state law allows absences for the following reasons: 1. Personal illness, 2. Appointments with health professionals, 3. Observation of religious holidays, 4. Family emergencies and 5. Planned absences for personal or educational purposes which have been approved in advance by an appropriate administrator. When your child needs to be absent, please call the school before 9:00 a.m. If a parent/guardian is unable to call, please send a written notification documenting the reason for the absence with the student when he/she returns to school. This written notification should be given to the secretary in the attendance office. Notes from home concerning absence should contain the following information: 1) Date(s) of absence, 2) Full name of student, 3) Reason for absence, 4) Signature of parent or guardian. If a student is absent for the first part of the day, the student must bring a written excuse to the Main Office unless a parent has called in advance. The student will then receive a pass admitting the student to class. Households of students who are absent and not reported out will receive an automated phone call notifying parents/guardians of their student's absence from school. Perfect attendance is being present at school each and every day, all day.

Early Dismissals

Approved reasons for absences also apply to dismissals. If a student is to be dismissed from school, he/she needs to be signed out of school in the main office. If the person dismissing a student is not on the child’s pick up list, a parent must send a note with the student or call the school first thing in the morning. If a student becomes ill during the school day, he/she must report to the nurse. A student will not be dismissed unless a parent/guardian or emergency contact can be contacted.

Bus Conduct The School Committee will provide transportation for all students living beyond a reasonable distance from their school or from a scheduled bus stop as defined by the School Committee. This distance for grades 5-8 is .5 mile. For health and safety reasons, students are expected to follow the rules explained by the bus driver, posted on every bus and listed in the Westbrook School Department transportation guide. Riding the bus is a privilege not a right. All school rules apply while riding the bus. Failure to comply may result in consequences including loss of bus riding privileges.

Bus Pick-Up/Drop off

All students outside the defined walking distance will be transported to and from school. A maximum of 2 pre-defined bus stop(s), one primary and one alternate, for the picking up and dropping off of students will be allowed for each student each school year and will be set at the beginning of the year. It will be the responsibility of the parent/guardian for any alternate transportation needs. Due to space limitations on our buses, exceptions can not be granted. Transportation will not be provided outside each school district area. If only one student is assigned to a bus stop and he/she will not require transportation, the Transportation Department should be notified first thing in the morning. If no one is present at the bus stop for three consecutive days, the bus will not return until the Transportation Dept. has been notified to reinstate the bus stop. If a student normally rides the bus home from school, but has made arrangements with his/her parents/guardians to walk home instead, the main office must be notified in advance. The Transportation Department can be reached at 854-0807.

After School

Students may stay after school if they are with a teacher, administrator, or other adult. This could be with one of their regular teachers, a coach, club advisor, or intramural activity supervisor. Students need to have a signed late bus pass to ride the late bus. The late bus leaves the school between 4:10pm and 4:25pm. Under no circumstances should a student remain on school grounds after school, unless he or she is participating in a WMS sport or activity or is under the direct supervision of a staff member.

Breakfast Students who eat breakfast at school may proceed to the cafeteria at 7:30 a.m. The staff on duty will dismiss students to their scheduled class by 7:40 a.m.

Progress Reports

Reports detailing student performance and academic achievement will be issued at the end of each academic ranking period. Report cards will be available approximately one week after the ranking period ends. Progress Reports (5-8) are issued directly to the student. The end of year progress report is mailed home. Parents are asked to sign the progress reports indicating they have seen them and have their students return them to their homeroom teachers. Students in grades 5 through 8 will receive report cards documenting achievement based on standards. Progress reports will reflect students' progress with Student Responsibilities and the Pillars of Excellence.

Dress Code

Appropriate dress sets a tone for the entire educational setting. Students are expected to take pride in their personal appearance; students are to be clean, neat, and dressed in clothing that follows school standards. The school principals will make the final decisions as to whether a student is properly dressed. Student dress should not disrupt the educational process or constitute a possible threat to the safety and health of the student or his/her peers. Appropriate dress should be worn during the instructional day as well as to all school activities. The following items should not be worn to school: • Inappropriately short skirts or shorts (must be mid-thigh length at all times.) • Boxer shorts or bicycle spandex shorts as outerwear • Over - or undersized clothing which reveals underclothes, including sports under garments • Bare midriffs, offensive or suggestive clothing will not be allowed. • Shoes which mark/damage floors • Clothing which implicitly or explicitly refers to illegal substances (including controlled substances such as alcohol and tobacco), profanity, violence, harassment, or sex. • Jewelry which promotes illegal use of controlled or illegal substances • Chains or studded apparel • Clothes with tears or holes, which inappropriately expose flesh or underwear due to style or condition, are not permitted. • Sleepwear • Dark sunglasses are not permitted inside of the school building unless there is a documented medical need to do so. • Head wear such as caps, bandanas, hats, hoods, kerchiefs or “doo rags” may not be worn. Students wearing head wear serving religious purposes is certainly NOT a violation of this policy. Parents may be contacted and asked to bring appropriate clothing to school or students may be asked to wear clothing provided by the school.

Backpacks

Students may use backpacks to bring books and possessions to and from Westbrook Middle School. Students must store them in their lockers at all times while they are in the building. Backpacks should not be used to store or transport MLTI laptops.

Lockers

Lockers are the property of the Westbrook School Department. At no time does the Westbrook School Department relinquish its exclusive control of lockers provided for the convenience of students. School authorities may conduct locker inspections for any reason, at any time. The school is not responsible for any personal or school issued property that is lost or stolen. Students requesting a combination lock will be issued one by the school. Personal locks are not allowed. Students are not allowed to use tape or stickers to hang or attach items to their assigned lockers.

Electronic Devices and Cell Phones

The Westbrook School Committee believes that students learn best in classrooms free of unnecessary disruptions. Devices that may interrupt the teacher and the class have no place in the classroom. Students may use personal electronic devices (except laser pointers, during academic time at the discretion of the teacher. Examples of such articles include, but are not limited to the following: i-pods, cell phones, and other electronic devices. Such devices that are out during academic time or cause disruptions may be confiscated by a staff member and held in an Assistant Principals' office until the end of the school day. Repeat offenses will result in additional consequences. Electronic devices may not be used in any unethical or illegal manner. Electronic devices may not be used to harass, intimidate, or bully another person or to invade and violate another person’s privacy. Please see School Board Policy JICJ.

Laptop Use by Students

Students’ use of the laptops will be governed by WMS’s laptop protocol. Acceptable use guidelines will be provided to all students and parents. Teachers will review protocol guidelines with their students. Our Laptop Responsible Use rubric is on page 23 of this student planner.

Parent – School Communication It is our experience that students do best when the communication between home and school is timely and consistent. The best tools for communication are notes in student agenda books, emails, and phone calls. Parent concerns should FIRST be addressed with the student's teacher. A team approach between home and school is the most effective way to support your child.

Telephone

Students may use school telephones for reasons deemed legitimate by a staff member. When using a school telephone, students must ask for permission and be under the supervision of a staff member.

Homework Policy

The Westbrook School Committee believes homework is an important part of a student’s education. The amount of homework assigned should be gradually increased from grade to grade. As a child advances through school, it is reasonable to expect the amount of homework can be increased. Students are expected to make up any homework missed due to absence. Suggested Guidelines: Grades 3-5: A maximum of 60 minutes per night for all subjects combined Grades 6-8: A maximum of two hours per night for all subjects combined.

Homework Request Procedure • • •

When a student is going to be absent for a single day, teachers, upon the return of the student, will review with the student the work that was missed. If a student is going to be absent for more than one day, homework can be picked up after school in the attendance office on the day following notification. Please contact any of your student’s teachers by e-mail or phone for clarifications of homework requests.

Academic Honesty

Honesty in schoolwork requires that students do their own work. To be honest, students must give credit for any ideas, language, or thoughts, which are not their own. If they do not credit the source of the idea, it is plagiarism (academic dishonesty). It is dishonest, of course, to copy someone else’s test or homework. However, it is also dishonest to: 1. copy from a book or online resource without acknowledgment 2. paraphrase (put in your own words) without giving credit to the source 3. use all or part of someone's paper word-for-word 4. rewrite someone's paper 5. use another's ideas; pretending they are original 6. use an idea or a clever expression without crediting the original author 7. use of online translation programs in modern/classical language classes 8. give work to others 9. do the work for others Academic dishonesty of any sort is unacceptable. Students caught cheating may not use the assignment as evidence toward meeting the standard. Teachers will notify their team leader, an administrator, and parents/guardians any time cheating occurs.

Gifted and Talented Program

The Westbrook School Department offers gifted and talented education services in four academic areas and in the visual arts. Identified students receive services through the Challenge Plus gifted and talented program in Humanities, Mathematics, Science, Social Studies and/or Visual Arts in grades 5-8. The screening process begins with a student, parent, or teacher nomination for the academic programs and includes further screening through the use of a nationally normed test and a teacher recommendation. The visual arts screening process includes the use of nomination forms and an art task. Nomination forms for all five programs can be accessed on the Westbrook School Department’s website.

Dances

Dances are a privilege. School dances are held each year for grades 6-8. Guests are not allowed to attend. Dances are either from 2:40 p.m. – 4:30 p.m. or 6:00 p.m. to 8:00 p.m. Parents are asked to pick children up promptly at the end of the dance at either 4:30 p.m. or 8:00 p.m. A separate 5th grade dance/activity will be held.

BAM (Body and Mind)

BAM is a one-day, school-wide event. The goal of BAM is to positively connect students and staff members around activities that exercise both Body and Mind. There are a wide variety of on- and off-campus offerings, including sports, arts and crafts, life-long fitness, and hands on academic enrichment.

Positive Behavior Blast

The Positive Behavior Blast is open to all students who meet certain criteria on our Habits of Work and Learning rubric in the areas of Classroom Expectations, Preparation and Engagement and Pillars of Excellence. The purpose of the program is to recognize and reward the many students at Westbrook Middle School who do the right things each and every day. The Behavior Blast will occur quarterly. Students who qualify to participate will be invited to attend a special activity.

Behavior Expectations

The teachers, staff and administration want all students to have a safe, successful, and fun learning experience at Westbrook Middle School. Our goal is to create a school where students can concentrate while they learn, where they can be safe when they travel from place to place, and where they can be assured that they will be met with kindness and consideration when they work with others. Your role is important as we ask you to observe the following guidelines. Hallway • • • • • • • • •

Expectations Walk – do NOT run Remove your hat before you enter the building Carry all sports equipment- no bouncing basketballs, soccer balls. No swinging lacrosse sticks, bats or field hockey sticks. Keep all objects and personal items to yourself- no throwing objects Walk on the right-hand side of the hall and the stairs Keep your hands and your feet to yourself – no pushing, shoving, kicking, holding hands, grabbing backpacks, horsing around, etc. Move through the halls quietly – yelling, screaming or using noisemakers is prohibited (poppers, whistles, etc.) Carry a hall pass, bathroom key, or Falcon card when in the hallway Travel in a timely manner – no visiting or going places you shouldn’t be

Cafeteria Expectations • Take a seat and remain in that seat until your row is called (except for 8th grade) • Sit 8 at a table – no exceptions • Remain in the seat you choose – do not move from seat to seat. If you need to get up for any reason, raise your hand and wait to be acknowledged by a staff member. • Listen to and be respectful of the adults supervising and serving lunch • Talk only to kids at your table • Keep your voice at a conversational level, - no yelling or screaming • Leave food on trays – no throwing food, putting food on the floor, or leaving food on the table • Taking others' food is not permitted • Take care of your tray and all your trash and dispose of it in the appropriate bins • Wait to be dismissed to recess or class – your table has to be dismissed by an adult • Push in your chair when you get up to leave Recess Expectations • Refrain from bringing any food or drinks outside • Walk recess equipment to the equipment cart at the end of recess • Jumping off and running between the swings is not allowed • Wrapping swings over the bars is not allowed • Swing straight – do not bump into others • Pushing others on the swings is not allowed • Standing on or jumping over the wall surrounding the patio is not allowed • Line up in your teacher/team line when the whistle sounds to end recess • Keep your hands and your feet to yourself – no pushing, shoving, kicking, holding hands, etc. • Remain in designated areas – basketball court, field, and patio area- stay out of the woods, the tall grass, and the marsh • Stay away from the front door entry area during recess • See an adult on duty if you need to enter the building to go to the bathroom or the clinic • Walk into the building, when your team/teacher is called, quietly following all the hallway expectations

Class Arrival Expectations • Arrive to class on time. • Enter the classroom quietly and politely • Take care of basic needs before arriving to class (breakfast, bathroom, locker, clinic, etc.) • Be prepared (Pencils, Laptop, Agenda, Notebook= PLAN) • Be ready to work with a positive attitude- Respectful and kind towards all • Put electronics away and get right to work. Keep an independent reading book with you in case you have wait-time at the beginning of class. Save chatting for lunch/recess time. Violations of these expectations may result in verbal warning, detentions, or other further action if deemed necessary. Students failing to meet cafeteria expectations will be spoken to by staff and may be removed. Removal from the cafeteria may result in a student’s eating in an alternative setting and/or additional consequences.

Illnesses

The health of all students is of vital concern. Your support on the following guidelines will help keep a healthy school environment. • Parents of children who become ill, or have symptoms of illness at school will be contacted to pick them up. If parents are not at home, the person designated on the emergency information sheet is called to care for the child until a parent can take over. It is IMPORTANT to notify the school of any changes that need to be made on the emergency information sheet at any time during the school year. • Children should not be sent to school when ill or showing the following symptoms: nausea, rash, fever, or diarrhea. • Please note that if a child is well enough to be in school, he/she is expected to participate in all classes (unless a written note from your physician is provided). • It is a school policy that parents notify the school office when their child will be home sick. When your child returns to school, please send a written note explaining the absence. • Students who wish to be dismissed from school because of an injury or illness are required to see the nurse who will determine whether or not a dismissal is warranted. Students may be dismissed into the custody of a parent/guardian or emergency contact person only.

Medications

Keeping the nurse informed of students’ health concerns is critical. The only medications considered necessary to be taken at school are those prescribed by a physician to be taken on a schedule that cannot be adjusted to outside school hours. The student ID sheet (given out at the beginning of each school year or at registration) needs to state any medications that are necessary to take at school, including aspirin, Tylenol, ibuprofen, inhalers etc., and must be signed by the parent/guardian. Students who possess, take, or distribute any form of medication outside of these guidelines are subject to the consequence as spelled out by school committee policy. • All medications will be kept in the clinic and taken only under adult supervision. The medication must be brought in to school by a parent or guardian in a pharmaceutical bottle that is clearly labeled with name of medicine, name of child, dosage, frequency, and physician’s name. • Medication to be used on an as-needed basis, such as bee sting kits, asthma medication, etc., must also be accompanied by a signed medication permit form available through the clinic.

Health

Maine State Law requires that all children meet certain immunization requirements. If a child is not in compliance with the state law, the school nurse will notify the student’s parent(s) or guardian (s). OSHA regulations restrict the use of many chemicals and cleaning agents in school. Therefore, for health and safety reasons Westbrook Middle School does not permit students to bring spray bottles and aerosol cans to school. This would include perfumes, colognes, deodorants, etc.

Medical Screenings

Screenings are done for 5th and 7th grade vision.

Student Services

Guidance Services The guidance department has 3 full-time guidance counselors and a secretary. Referrals to counselors are received from staff members, students or parents. All referrals are handled confidentially. The guidance department offers the following services: • Consultation with teachers, parents & community resources • Individual & group achievement testing • Crisis intervention • Classroom instruction, academia, personal/social issues, career topics • Coordination of programs such as tutoring

Social Worker Services • The school social worker provides support for students and their families when issues arise which may impede the student’s social, emotional or academic development. • Casework services may be provided on an individual basis or in a group setting. • The school social worker is a resource for referral to a wide variety of community resources. Substance Abuse Counseling Services • Substance abuse counseling services are available to students, parents and staff. Students are seen for a variety of issues that may directly or indirectly affect them regarding alcohol, drug or tobacco use/abuse. • Concerned parents, staff or students may make referrals. Students may also self-refer.

Crisis Response Plan

Westbrook Middle School has worked closely with state and local law enforcement officials, fire and rescue personnel, and other schools in our district to develop a comprehensive crisis response plan. Several safety drills including evacuation and school lockdown are conducted throughout the school year.

Library

The Library provides various forms of print and non-print materials to support the middle school curriculum and to encourage recreational reading among young adults. We support students and teachers by meeting their various needs such as studying, individual and class research, browsing, book selection and suggestion, and reading to name a few. Library hours are from 7:40 a.m. to 3:00 p.m., Mondays, Tuesdays, Thursdays and Fridays during the school year.

Textbooks and Library Materials & School Issued Items

Students are held responsible for the proper care and return of textbooks, library materials, and other school issued items. Textbooks are to be covered. Students will be charged for damage to or loss of school property.

Theft

During the course of any school year, students will report items being lost/stolen. Unfortunately, the school cannot take responsibility for these items. To protect personal property, the school strongly recommends that students avail themselves of the school issued locks to secure their belongings. Administrators and teachers investigate these matters and administer consequences when appropriate. The police may be notified. Students should not bring valuable possessions to school (i.e, Ipads, collectible cards, cameras, electronic gaming systems or large sums of money). It is recommended that you write your student’s name with a permanent marker in his or her jacket, hat, sneakers, etc.

Passes For safety purposes, students must have a signed agenda book, hall pass, bathroom key, or Falcon Card whenever they are unsupervised and moving about the building. Students must have signed passes when traveling to other rooms during lunch/recess or intervention.

Drinks

Students are permitted to bring water bottles. They must be made of clear plastic and may only hold clear liquids. Energy drinks, i.e. Red Bull, are not allowed at school.

Skateboards

Skateboards are not allowed to be used on school property.

Visitors

All visitors need to check in at the main office to sign in and obtain a visitor's pass. Students may NOT bring visitors to school without prior administrative permission.

Bullying (Policy JICK)

It is the intent of the Westbrook School Committee and Westbrook Middle School to provide all students with an equitable opportunity to learn. To that end, the committee has a significant interest in providing a safe, orderly and respectful school environment that is conducive to teaching and learning. Bullying is detrimental to learning and achievement. It interferes with the mission of the schools to educate their students and disrupts the operations of the schools. Bullying affects not only students who are targets, but also those who participate and witness such behavior. The School Committee believes that promoting ethical and responsible behavior is an essential part of the school’s educational purpose. Ethics, responsible behavior and “character” are important if a student is to leave school as a “responsible and involved citizen” as described in the Guiding Principles of Maine’s system of Learning Results. Bullying interferes with the accomplishment of this goal.

Bullying Prohibited

Bullying, as defined in this policy, is not acceptable conduct in our school and is prohibited. Any student who engages in conduct that constitutes bullying shall be subject to disciplinary consequences up to and including suspension and expulsion. A student’s bullying behavior may also be addressed through other behavioral interventions.

Bullying Defined

For the purpose of this policy “bullying” means any physical act or gesture or any verbally, written, or electronically communicated expression that: Α.

A reasonable person should expect will have the effect of: 1. Physically harming a person or damaging a person’s property. 2. Placing a person in reasonable fear of physical harm or damage to his/her property; or 3. Substantially disrupting the instructional program or the orderly operations of the school; or Is so severe, persistent, or pervasive that it creates an intimidating, hostile educational environment for the student who is bullied.

Application of Bullying Policy

This policy applies to bullying that takes place at school or on school grounds, at any school-sponsored activity or event, or while students are being transported to or from school or school-sponsored activities or events. Examples of conduct that may constitute bullying include, but are not limited to: A. Physical contact or injury to another person or his/her property; B. Threats of harm to a student, to his/her possessions, or to other individuals, whether transmitted verbally, in writing, or through cyberspace; which include, but are not limited to, text message, social networking site posts; C. Blackmail, extortion, demands for protection money, or involuntary loans or donations; D. Non-verbal threats and/or intimidations such as use of aggressive or menacing gestures; E. Stalking; F. Blocking access to school property or facilities; G. Repeated or pervasive taunting, name-calling, belittling, mocking, put-downs, or demeaning humor relating to a student’s race, color, ethnicity, gender, sexual orientation, ancestry, religion, disability, or other personal characteristics, whether or not the student actually possesses them, that could reasonably be expected to result in disruption of the instructional program or operations of the schools, or that results in a hostile educational environment for the student. The determination of whether particular conduct constitutes bullying requires reasonable consideration of the circumstances, which include the frequency of the behavior at issue, the location in which the behavior occurs, the ages and maturity of the students involved, the activity or context in which the conduct occurs, and the nature and severity of the conduct.

Delegation of Responsibility

The Superintendent/designee will be responsible for developing and implementing procedures for: A. Student and parent reporting of bullying to staff and school administrators; B. Staff reporting of bullying to school administrators; C. Review of reports and investigation of bullying incidents; D. Intervention with and/or discipline of students who engage in bullying;

E. F. G.

Support for students who are victims of bullying; Training staff and students in bullying prevention; and Periodic evaluation of bullying prevention, intervention, and training efforts in the Westbrook schools and reporting to the School Committee upon request.

Reporting of Bullying

Students who have been bullied or who observe incidents of bullying are encouraged to report this behavior to a staff member or school administrator. Staff should report bullying to the building principal. Acts of reprisal or retaliation against any person who reports an incident of bullying are prohibited. Any student who is determined to have falsely accused another of bullying shall be subject to disciplinary consequences. Any Westbrook School Department employee who participates in bullying behavior, witnesses bullying, or becomes aware that bullying is taking, has taken, or will take place, and fails to report the behavior and take any further appropriate actions in accordance with the Westbrook School Department policies, violates this policy. Employees who violate this policy may be subject to disciplinary action in accordance with the Westbrook School Department collective bargaining agreements and all relevant rules and regulations.

Responding to Bullying

In determining the appropriate response to students who engage in bullying behavior, school administrators should consider the ages and maturity of the students involved, the type of behaviors, the frequency and/or pattern of behaviors, the context in which the incident occurred, and other relevant circumstances. Students who violate this policy may be subject to disciplinary action in accordance with the Westbrook School Department’s policies, including but not limited to JK – Student Discipline; JKD –Suspension of Students; JKE – Expulsion of Students.

Dissemination of Bullying Policy

Notice of what constitutes bullying, the School Committee’s prohibition against bullying, and the consequences for students who bully shall be communicated to students and parents through the Student Code of Conduct and Student Handbook.

Video Surveillance on School Property (Policy EEAEFA)

The Westbrook School Committee recognizes the school’s continuing responsibility to maintain order and an appropriate learning environment in and around schools to ensure the safety of staff and students. After carefully balancing the need for safety with student and staff interests in privacy, the School Committee supports the use of video surveillance cameras on school grounds and in areas of common use within buildings. Areas of common use include but may not be limited to parking lots, school entrances, hallways, cafeterias, libraries and gymnasiums. In an effort to maintain order and school safety, the cameras may be used to monitor activity during the school day and monitor activities in and around the school property at any time.

Tobacco Use and Possession (Policy ADC-R2) In order to promote the health, welfare and safety of all students, staff and visitors and to promote the cleanliness of all Westbrook School Department facilities, the Westbrook School Committee prohibits smoking and all other use of tobacco products in school unit facilities, on school grounds and on school buses at all times by all persons. In addition, students are further prohibited from possessing, distributing, selling or dispensing tobacco products in school buildings, facilities and on school grounds and buses during school-sponsored events and at all other times.

Drug and Alcohol Use by Students (Policy JICH)

The Westbrook School Department is truly concerned with the student as a “whole” person and his/her overall growth and development. Substance use/abuse is recognized as a treatable disease which may interfere with the learning process, create severe interpersonal problems and cause physical and emotional suffering to the user as well as to family and close associates. Substance use/abuse is unhealthy and illegal and may permeate all facets of the community. Therefore, the school system will cooperate with effective organizations to help detect, assess, and treat affected students. The School Committee unequivocally endorses the philosophy that the schools and school activities should be free from drug use and alcohol and their detrimental effects. In order to ensure the highest possible standards of learning and performance, as well as the safety, health and well-being of students and student participants, the School Committee endorses a substance abuse policy which will aid students to abstain from the use of drugs and alcohol, provide for early intervention when use is detected, corrective disciplinary sanctions when necessary, and aftercare support as appropriate. Compliance with the school system’s Code of Conduct and extra-curricular Code of Conduct related to substance abuse is mandatory. This policy applies to any student who is on school property, who participates in extra-curricular activities or is in attendance at school or at any school-sponsored activity, or whose conduct at any time or place directly interferes with the operations, discipline or general welfare of the school.

Alcohol and Other Drugs: Use and Possession (Policy JICH-R)

The use, possession, dispensing, sale or distribution of any mood-altering substance by students is prohibited. No student shall manufacture, be under the influence of any substance, legal or illegal, or have within their possession any paraphernalia associated with the same. Possession of prescription or non-prescription drugs without prior approval of the administration or the school nurse shall be considered part of this policy as well as the possession of any look-alike substance. This policy applies to any student who is on school property, who is in attendance at school or at any school-sponsored activity or whose conduct at any time or place directly interferes with the operations, discipline or general welfare of the school. The goal of this policy is to create a safe, substance free environment, conducive to learning and to assist students in abstaining from the use of alcohol and other drugs. This policy provides for intervention when use is detected, consequences when necessary and support as appropriate. A. Use and Possession of Alcohol, Other Drugs, and Drug Paraphernalia 1. First Infraction a. The Westbrook Police Department is notified immediately when appropriate. All drugs and drug paraphernalia will be confiscated and turned over to law enforcement. b. Parent/Guardian will be notified and a conference is held with the student, parent/guardian and the building Administrator. c. The student leaves school with his/her parent/guardian unless the Police Department requires a different procedure. d. An appointment will be made for the following day with the Substance Counselor for a drug/alcohol education program assignment, which the student will be required to complete. Both the student and his/her parent/guardian will attend. This will be followed by an assessment with the student and the Substance Counselor. Recommendations will be shared with the student and his/her parent guardian. e. A seven-day in-school suspension will be assigned, reduced to five days if the student agrees to meet with the Substance Counselor for three sessions. The suspension begins on the school day immediately following the infraction. 2. Second Infraction a. The Westbrook Police Department is notified immediately when appropriate. All drugs and drug paraphernalia will be confiscated and turned over to law enforcement. b. Parent/Guardian will be notified and a conference is held with the student, parent/guardian and the building Administrator. c. The student leaves school with his/her parent/guardian unless the Police Department requires a different procedure. d. An appointment will be made for the following day with the Substance Counselor for a drug/alcohol education program assignment, which the student will be required to complete. Both the student and his/her parent/guardian will attend. This will be followed by an assessment with the student and the Substance Counselor. Recommendations will be shared with the student and his/her parent guardian. e. A ten-day out-of-school suspension will be assigned, reduced to five days of out-of-school suspension if the student agrees to meet with the Substance Counselor for a minimum of three sessions and complete 30 hours of community service. The suspension begins on the school day immediately following the infraction. The community service option will be reflected in a contract between the student, the school and any outside agencies, which is developed by the substance abuse counselor and overseen by an administrator. 3. Third Infraction a. The Westbrook Police Department is notified immediately when appropriate. All drugs and drug paraphernalia will be confiscated and turned over to law enforcement. b. Parent/Guardian will be notified and a conference is held with the student, parent/guardian and the building Administrator. c. The student leaves school with his/her parent/guardian unless the Police Department requires a different procedure. d. An appointment will be made for the following day with the Substance Counselor for a drug/alcohol education program assignment, which the student will be required to complete. Both the student and his/her parent/guardian will attend. This will be followed by an assessment with the student and the Substance Counselor. Recommendations will be shared with the student and his/her parent guardian. e. A ten-day out-of-school suspension will be assigned. The suspension begins on the school day immediately following the infraction. As the natural consequence to this third infraction, the Principal may recommend to the Superintendent that an expulsion hearing before the School Board be initiated. B. Distributing or Selling Alcohol and Other Drugs 1. The Westbrook Police Department will be notified immediately when appropriate. All drugs and drug paraphernalia will be confiscated and turned over to law enforcement. 2. Parent/Guardian will be notified and a conference is held with the student, parent/guardian and the building Administrator. 3. The student leaves school with his/her parent/guardian unless the Police Department requires a different procedure. 4. An appointment will be made for the following day with the Substance Counselor for an assessment. A developmental educational component will be assigned. Both the student and his/her parent/guardian will attend. 5. A ten-day out-of-school suspension will be assigned. The Principal may recommend to the Superintendent that an expulsion hearing before the School Board be initiated. The suspension begins on the school day immediately following the infraction.

Extra-Curricular Code of Conduct Drug and Alcohol Use by Students Administrative Procedure (Policy JJ-R) The following behaviors by Westbrook students in grades 6-12 who are participating in extra-curricular activities are prohibited: A. The consumption, possession or illegal transportation of alcoholic beverages; B. The use or possession of tobacco products; C. The use or possession of unlawful drugs; D. The use or possession of any substance presented as a mood-altering substance, whether legal or illegal. School nurse, coach or advisor will be responsible for prescription medications; E. Students are prohibited from being present where underage drinking or illegal drug usage is taking place. However, if a student finds himself or herself in a location where such activity is occurring and leaves that location within a reasonable amount of time, administrative discretion will be exercised taking into consideration the circumstances as presented. It is the student’s burden to show that he or she complied with this policy by leaving as soon as practicable. F. Participation in any acts that are not consistent with standards of acceptable behavior stated in the System-Wide Code of Conduct; G. Suspensions will carry over from season to season and year to year. ñ Should the suspension carry over from one season to the next, students will be allowed to try out for the activity. Suspension would then continue once the student has been selected to participate in the activity. The number of days between the end of school and the beginning of the next preseason activity in the next school year shall not counted as part of the suspension. H. All violations one year (365 days) from the date of the first infraction are cumulative and will be monitored by the Athletic /Activities Director. I. Sport season is defined according to Maine Principals’ Association guidelines or until the activity’s end of season banquet or awards ceremony or the beginning of the next sports season whichever comes first. J. Competitive activities include (but are not limited to) the following: Academic Decathlon, Jazz Band, Marching Band, Model United Nations, Math Team, Speech and Debate, and Sock n’ Buskin. Failure to comply with the full policy may result in the student’s removal from the team or activity. First Infraction The first infraction of any of the above, as determined by the school administration and after due process, shall result in: A. A two (2)-week suspension from participation in all extra-curricular activities concurrent with any suspension provided in the System-Wide Code of Conduct. B. After one (1)-week, students may be able to practice. Students may not, however, participate in games, competitions or performances. C. Student must comply with conditions set forth from the school’s administration that may include: a. Student must attend a minimum of three (3) counseling sessions through the school Substance Abuse Counselor. One of the three (3) sessions must be attended by the student and his/her parent/guardian. b. Complete approved Student Intervention & Reintegration Program (SIRP) c. Participate in restorative practices with necessary stakeholders. d. Complete community service D. The student must complete the specified requirements or submit a written plan that meets administrative approval in order to return to activities. E. Students shall forfeit leadership positions for that particular season. F. Student will be ineligible to receive individual honors or awards from the school activity, but will be allowed to receive a letter or certificate if he/she fulfills criteria established by the coach / advisor. Second Infraction A second infraction of the above, as determined by the school administration, and following due process, will result in: A. Suspension from all athletic teams and/or all competitive activities for ten (10) weeks or the remainder of that season whichever is later. The suspension shall be concurrent with any suspension provided for in the System-Wide Code of Conduct. • The suspension will begin on the date of the incident or the date that the incident is discovered, whichever is later. • Suspension will include a minimum of one game, competition or performance. B. After two (2)-weeks, students may be able to practice. Students may not, however, participate in games, competitions or performances. C. Students involved in non-competitive activities may continue to participate with documentation from their advisor that they are fulfilling thirty (30) hours of community service. Participation will be with a documented plan / process monitored by the activity’s advisor. D. Students must comply with conditions set forth by the school’s administration and must attend a minimum of three (3) counseling sessions through the school Substance Abuse Counselor before he/she will be allowed to participate in any extra-curricular activity. One of the three (3) sessions

must be attended by the student and his/her parent/guardian. A developmental educational component will be assigned as part of the counseling. Student will be ineligible to receive individual honors or awards from the school activity but will be allowed to receive a letter or certificate if he/she fulfills criteria established by the coach/advisor. Students shall forfeit leadership positions for that season.

Third Infraction A third infraction of the above, as determined by the school administration, and after due process, will result in: A. Permanent suspension from all athletic teams for the remainder of that season and/or from all extra-curricular activities for the remainder of the school year, concurrent with any suspension provided for in the System-Wide Code of Conduct. B. Interscholastic ineligibility for the next two competitive seasons as defined by the Maine Principals’ Association. C. Extra-curricular activity ineligibility for one year (365 days). D. Students must comply with conditions set forth from the school’s administration and must attend a minimum of three (3) counseling sessions through the school Substance Abuse Counselor before he/she will be allowed to participate in any extra-curricular activity. One of the three (3) sessions must be attended by the student and his/her parent/guardian. A developmental educational component will be assigned as part of the counseling. E. Student will be ineligible for awards. Referral Procedures The referral process exists for students to seek help safely for themselves (self-referral) or for other students (concerned-person referral) whom they suspect or know are involved with tobacco, alcohol, illegal drugs or the misuse of legal substances. On the first report of either type of referral (self or concerned person) the student receives help and is not suspended from participation provided the student is not involved in an incident. The student is referred to the school Substance Abuse Counselor.

Weapons, Violence and School Safety (Policy JICIA) The School Board believes that students and staff are entitled to learn and work in a school environment free of violence, threats and disruptive behavior. Students are expected to conduct themselves with respect for others and in accordance with Board policies, school rules, reasonable unwritten behavior expectations, and applicable state and federal laws. School staff are required to immediately report incidents of prohibited conduct by students to the building administrator/designee for investigation and appropriate action. I. Prohibited Conduct Students, staff and all other persons are prohibited from engaging in the following conduct on school property, while in attendance at school or at any school-sponsored activity, or at any time or place that such conduct directly interferes with the operations, discipline or general welfare of the school: A. Possession and/or use of articles commonly used or designed to inflict bodily harm and/or to threaten, intimidate, coerce or harass another person except as otherwise permitted by this. Examples of such articles include but are not limited to firearms, BB guns, pellet guns, any other kind of gun, ammunition, explosives, cross-bows, brass knuckles, switchblades, knives, chains, clubs, Kung Fu stars and nun chucks; B. Use of any object, although not necessarily designed to be a weapon, to inflict bodily harm and/or to threaten, intimidate, coerce or harass another person. Examples of such articles include but are not limited to bats, belts, picks, pencils, compasses, objects capable of ignition (e.g., matches, lighters), files, tools of any sort and replicas of weapons (including toys); C. Violent or threatening behavior, including but not limited to fighting, assault and/or battery, taking hostages, threats to commit violence against persons or property (e.g., verbal or written death threats, threats of bodily harm, bomb threats); D. Verbal or written statements (including those made on or through a computer or other electronic communication devices or technologies) which threaten, intimidate, or harass others, which tend to incite violence and/or disrupt the school program; E. Willful and malicious damage to school or personal property; F. Stealing or attempting to steal school or personal property; G. Lewd, indecent or obscene acts or expressions of any kind; H. Violations of the school unit’s drug/alcohol and tobacco policies; I. Violations of state or federal laws; and J. Any other conduct that may be harmful to persons or property.

II. Disciplinary Action Principals may suspend and/or recommend expulsion of students who violate this policy based upon the facts of each case and in accordance with applicable state and federal laws. Conduct which violates this policy is deliberately disobedient and deliberately disorderly within the meaning of 20-A MRSA § 1001(9) and will be grounds for expulsion if found necessary for the peace and usefulness of the school. Such conduct may also be grounds for expulsion under other provisions of 20-A MRSA § 1001(9 and 9-A) that specifically prohibit the use and possession of weapons, infractions of violence, and possession, furnishing and trafficking of scheduled drugs. Students who are found to have brought a firearm to school shall be expelled for a period of not less than one year, unless this requirement is modified by the Superintendent on a case-by-case basis. All firearms violations shall be referred to law enforcement authorities as required by law. Other violations of this policy shall be referred to law enforcement authorities at the discretion of the Superintendent. Students with disabilities shall be disciplined in accordance with applicable federal and state laws/regulations and Board Policy JKF

Annual Notice of Student Education Records and Information Rights (Policy JRA) The Westbrook School Department shall comply with the Family Educational Rights and Privacy Act (“FERPA”) and all other federal and state laws and regulations concerning confidentiality and maintenance of student records and student information. A. Directory Information The Westbrook School Department designates the following student information as directory information: name, participation and grade level of students in recognized activities and sports, height and weight of student athletes, date of attendance in Westbrook schools, and honors and awards received. The Westbrook School Department may disclose directory information if it has provided notice to parents (and eligible students over 18) and has not received timely written notice refusing permission to designate such information as directory information. B. Military Recruiters/Higher Education Access to Information Under federal law, military recruiters and institutions of higher education are entitled to receive the names, addresses and telephone numbers of secondary students and the Westbrook School Department must comply with any such request, provided that parents have been notified of their right to request that this information not be released without their prior written consent. C. Information on the Internet Under Maine law, the Westbrook School Department shall not publish on the Internet any information, that identifies a student, including but not limited to the student’s full name, photograph, personal biography, e-mail address, home address, date of birth, social security number and parents’ names, without written parental consent. D. Transfer of Student Records As required by Maine law, the Westbrook School Department sends student education records to a school unit to which a student applies for transfer, including disciplinary records, attendance records, special education records and health records (except for confidential health records for which consent for dissemination has not been obtained). E. Designation of Law Enforcement Unit The Westbrook School Department may disclose student education records without parental consent to personnel of its law enforcement unit, provided that they have been designated as school officials with legitimate educational interests for the purpose of compliance with FERPA. The School Committee hereby designates its School Resource Officer(s) as the Westbrook School Department’s law enforcement unit for the purpose of disclosure of student education records. F. Health or Safety Emergencies As permitted by FERPA, the Westbrook School Department may disclose personally identifiable information from a student’s educational record to appropriate parties, including parents of an eligible student, if, taking into account the totality of the circumstances, it determines that there is an articulable and significant threat to the health or safety of the student or other individuals and knowledge of the information is necessary to protect the health or safety of the student or other individuals. In the event of disclosure, the Westbrook School Department will record the articulable and significant threat that formed the basis for the disclosure and the parties to whom it has disclosed, and maintain such record with the student’s educational record. G. Administrative Procedures and Notices The Superintendent is responsible for developing and implementing any administrative procedures and parent notices necessary to comply with the applicable laws and regulations concerning student education records and information. Notices shall be distributed annually to parents and eligible students concerning their rights under these laws and regulations. A copy of this policy shall be posted in each school.

Harassment and Sexual Harassment of Students (Policy ACAA)

The Westbrook School Committee recognizes the right of each employee and student to a working and learning atmosphere which is free of discrimination, intimidation, hostility, unwelcome sexual advances and offensiveness. In order to ensure such an atmosphere, employees and students are not to engage in harassment of any other person. Acts of harassment based upon race, color, sex, religion, age, national origin, sexual orientation or disability are not only a violation of this policy, but also constitute illegal discrimination under state and federal laws and City of Westbrook ordinance. Harassment of students because of race, color, sex, religion, ancestry or national origin, sexual orientation or disability is prohibited. Such conduct is a violation of School Committee policy and may constitute illegal discrimination under state and federal laws. Harassment includes but is not limited to verbal abuse based on race, color, sex, religion, ancestry or national origin, sexual orientation or disability. Harassment that rises to the level of physical assault, battery and/or abuse is also addressed in the School Committee policy JICIA – Weapons, Violence and School Safety. Sexual harassment includes but is not limited to unwelcome sexual advances, requests for sexual favors or pressure to engage in sexual activity, physical contact of a sexual nature, gestures, comments, or other physical, written or verbal conduct that is genderbased that interferes with a student’s education. School employees, fellow students, volunteers and visitors to the school, and other persons with whom students may interact in order to pursue school activities are required to refrain from such conduct. Harassment/sexual harassment of students by school employees is considered grounds for disciplinary action, up to and including discharge. Harassment/sexual harassment of students by other students is considered grounds for disciplinary action, up to and including expulsion. The Superintendent will determine appropriate sanctions for harassment of students by persons other than school employees and students. The Affirmative Action Officer will investigate complaints of harassment in accordance with the Student Harassment Complaint Procedure. School employees, students, and parents shall be informed of this policy/procedure through handbooks and/or other means selected by the school administration.

Hazing (Policy ACAD)

Maine statute defines injurious hazing as “any action or situation, including harassing behavior, that recklessly or intentionally endangers the mental or physical health of any school personnel or a student enrolled in a public school.” Injurious hazing activities of any type, either on or off school property, by any student, staff member, group or organization affiliated with this school unit, are inconsistent with the educational process and shall be prohibited at all times. “Harassing behavior” includes acts of intimidation and any other conduct that recklessly or intentionally endangers the mental or physical health of a student or staff member. “Acts of intimidation” include extortion, menacing, direct or indirect threats of violence, incidents of violence, bullying, statements or taunting of a malicious and/or derogatory nature that recklessly or intentionally endanger the mental or physical health of another person, and property damage or theft. No administrator, faculty member, or other employee of the school unit shall encourage, permit, condone, or tolerate injurious hazing activities. No student, including leaders of students’ organizations, shall plan, encourage, or engage in injurious hazing activities. Students who violate this policy may be subject to disciplinary action which may include suspension, expulsion, or other appropriate measures. Administrators, professional staff, and all other employees who violate this policy may be subject to disciplinary action up to and including dismissal. In the case of an organization affiliated with this school unit that authorizes hazing, penalties may include rescission of permission for that organization to operate on school property or to receive any other benefit of affiliation with the school unit. Persons not associated with this school unit who fail to abide by this policy may be subject to ejection from school property and/or other measures as may be available under the law. These penalties shall be in addition to any civil or criminal penalties to which the violator or organization may be subject. The Superintendent/designee shall be responsible for administering this policy. In the event that an individual or organization disagrees with an action—or lack of action—on the part of the Superintendent/designee as he/she carries out the provisions of this policy, that individual or organization may appeal to the School Committee. The ruling of the School Committee with respect to the provisions of this policy shall be final. This right to appeal does not apply to student suspensions of 10 days or less or to matters submitted to grievance procedures under applicable collective bargaining agreements. A copy of this policy shall be included in all school, parent, and employee handbooks or otherwise distributed to all school employees and students.

Video Camera Use on School Vehicles (Policy EEAEF)

The Westbrook School Committee recognizes the School Department’s responsibility to maintain order on school buses and other vehicles used to transport students to ensure the safety of staff and students. After carefully balancing the need for discipline and safety with students’ interests in privacy, the School Committee supports the use of video cameras on school vehicles. When the resulting video recordings are used as a basis for discipline, parent/guardian(s) will be notified in writing and given the opportunity to view the video recording of their child. Students in violation of school discipline and conduct codes shall be dealt with in accordance with established School Committee policy, administrative guidelines and school practices. Notice of use of video cameras for disciplinary purposes in school vehicles will be provided to all students, parents and staff on an annual basis. Moreover, notice that video observation may take place will be posted in each transportation vehicle. All video recordings will be maintained for thirty (30) days by the Superintendent / designee. The Superintendent / designee may provide access to video recordings only upon request by a Westbrook School Department administrator. Video recordings may be viewed by students and/or parents under the supervision of a School Department administrator. Only segments of the video recordings relevant to the student conduct will be reviewed.

Questioning and Searches of Students (Policy JIH)

The School Committee seeks to maintain a safe and orderly environment in the schools. School administrators are authorized to question and/or search students in accordance with this policy and accompanying administrative procedures. Students shall not bring, possess or store at school any items or substances which are prohibited by law, Westbrook School Committee policies and/or school rules, or which interfere with the operations, discipline or general welfare of the school. Student use of all school storage facilities, including but not limited to lockers, desks, and parking lots, is a privilege granted by the school. All storage facilities are school property and remain under the control, custody and supervision of the school. Students have no expectation of privacy in school storage facilities or for any items placed in such storage facilities. School administrators have the authority to inspect and search storage facilities and their contents on a random basis, with or without reasonable suspicion, and without notice or consent. If a search produces evidence that a student has violated or is violating the law, School Committee policies and/or school rules, such evidence may be seized and impounded by school administrators and appropriate disciplinary action may be taken. Evidence of criminal conduct shall be forwarded to law enforcement authorities as required by law or as deemed appropriate by school administrators. School staff, students and parents shall be informed of this policy on an annual basis through handbooks and/or other means selected by school administrators. The Superintendent is authorized to develop and implement, with input from legal counsel, administrators, staff and others as appropriate, any administrative procedures necessary to carry out this policy.

Employee/Volunteer – Student Relationships (Policy GBEBB)

The Westbrook School Department expects all staff members, including teachers, coaches, counselors, administrators and others, including volunteers, to maintain the highest professional, moral and ethical standards in their conduct with students. The interactions and relationships between staff members and students should be based upon mutual respect and trust, predicated by an understanding of the appropriate boundaries between adults and students in an educational setting, and consistent with the educational mission of the school. Staff members are expected to be sensitive to the appearance of impropriety in their contact with students. Staff members are encouraged to discuss issues with their administrators or supervisors whenever they are unsure whether particular conduct may constitute a violation of this policy. The School Committee recognizes, is appreciative of, and wishes to be supportive of the manner in which staff members attempt to care for students in a personalized and caring manner, and in no way wishes to place unnecessary barriers to the myriad of times, places and positive ways that staff work to serve our students. The School Committee also realizes that in communities in which many teachers are themselves parents or relatives of our students, many sorts of informal and outside relationships with students are healthy and normal, and the School Committee does not wish to interfere with these. By attempting to legislate behavior in this realm, the School Committee is primarily attempting to make explicit its intolerance for behavior motivated or prompted by an unwillingness or inability to respect the physical and emotional health of our students. The School Committee recognizes that simply by adopting policy it can not mandate safe and appropriate behavior to those bent on doing otherwise, but conversely, it wishes to explicitly state that its support for collegial relationships or its decision to not ban outright many sorts of student / teacher interactions should in no way be seen as a plausible defense to deleterious contact with students. Prohibited Conduct: Examples of unacceptable conduct by staff members that are expressly prohibited include but are in no way limited to the following: • Any type of sexual or inappropriate physical contact with a student, or any conduct that might be considered harassment under the School Committee’s policy on harassment and sexual harassment of students; • Using sexual banter, allusions, jokes or innuendos, sexually suggestive, flirtatious or unduly coarse language with students; • Encouraging or allowing a student to confide to the staff member or sharing with a student the staff member’s personal or family problems and / or relationships or other private matters with the intent or result that the staff member’s relationship with the student blurs the professional boundaries between student and teacher, and as a consequence is or may become unhealthy or unsafe for the student. Staff members are expected to promptly refer acute or serious chronic problems expressed by students to administrative, counseling or health care staff. • Singling out a particular student or students for personal attention and friendship within the school environment that displays or appears to display a lack of fairness and equity for other students and is done for other that appropriate educational purposes. Conduct Requiring Administrative Approval: Before engaging in activities like the following, staff members shall review the activity with the principal or appropriate other supervisor.

• Inviting or allowing students to visit the staff member’s home, or visiting a student’s home unless on official school business, or done in another context, such as a parent or other relative or when such contact is tangential to the purpose of the visit. • Maintaining personal contact with a student by telephone, e-mail, Instant Message, Internet chat rooms or other communications media beyond contact regarding homework or other legitimate school business, unless such contact is linked to a legitimate relationship with the student outside the school. • Exchanging personal gifts beyond customary student / teacher gifts unless the exchange occurs as part of a legitimate relationship with the student outside the school. • Socializing with students outside of school-sponsored or community organized events unless the socializing is explicitly pre-approved of by a parent or guardian of the child, arises out of a legitimate relationship with the student outside of the school, or is incidental to socializing with other adults. Reporting Suspected Violations - Students and/or parents or guardians are encouraged to notify the principal if they believe a teacher or staff member may be engaging in conduct which violates this policy. Staff members are required to notify promptly the appropriate building administrator or Superintendent if they become aware of a situation that may constitute a violation of this policy. Neither students, parents, guardians nor other staff should undertake an investigation before notifying administrators. They need only have reasonable grounds to suspect that a violation may be occurring to make a referral. Disciplinary Action - Staff violations of this policy shall result in disciplinary action up to and including dismissal. Violations involving possible sexual or other abuse will also result in referral to the Department of Human Services and/or law enforcement in accordance with the School Committee’s policy on Reporting Child Abuse and Neglect. Policy to be Included in Handbooks - This policy shall be included in all employee, faculty, student and volunteer handbooks.

Bomb Threats (Policy EBCC)

The School Committee recognizes that bomb threats are a significant concern to the school unit. Whether real and carried out or intended as a prank or for some other purpose, a bomb threat represents a potential danger to the safety and welfare of students and staff and to the integrity of school property. Bomb threats disrupt the instructional program and learning environment and also place significant demands on school financial resources and public safety services. These effects occur even when such threats prove to be false. Any bomb threat will be regarded as an extremely serious matter and treated accordingly. The School Committee directs the Superintendent to react promptly and appropriately to information concerning bomb threats and to initiate or recommend suitable disciplinary action. A. Conduct Prohibited- No person shall make, or communicate by any means, whether verbal or non- verbal, a threat that a bomb has been, or will be, placed on school premises. Because of the potential for evacuation of the schools and other disruption of school operations, placement of a bomb or of a “look-alike” bomb on school premises will be considered a threat for the purpose of this policy. It is also a violation of Board policy to communicate by any means that any toxic or hazardous substance or material has been placed, or will be placed, on school premises with the intent to endanger the safety and welfare of students or staff and/or to disrupt the operations of the schools. For the purpose of this policy, “toxic or hazardous substance or material” means any material or substance, including biomedical materials or organisms, that, when placed as threatened, could be harmful to humans. B. Definitions 1. A “bomb” means an explosive, incendiary or poison gas bomb, grenade, rocket, missile, mine, “Molotov cocktail” or other destructive device. 2. A “look-alike bomb” means any apparatus or object that conveys the appearance of a bomb or other destructive device. 3. A “bomb threat” is the communication, by any means, whether verbal or non-verbal, that a bomb has been, or will be, placed on school premises, including possession or placement of a bomb or look-alike bomb on school premises. 4. “School premises” means any school property and any location where any school activities may take place. C. Development of Bomb Threat Procedures- The Superintendent/designee shall be responsible for developing and implementing procedures specific to bomb threats as part of the school unit’s Crisis Response Plan. These procedures are intended to inform administrators and staff of appropriate protocols to follow in the event that a bomb threat is received and should include provisions to address: 1. Threat assessment (for the purpose of identifying a response that is in proportion to the threat, in light of what is necessary to ensure safety); 2. Building evacuation and re-entry (including selection of potential alternative sites for those who are evacuated); 3. Incident “command and control” (who is in charge, and when); 4. Communications contacts and mandatory bomb threat reporting; 5. Parent notification process; (parents will be notified when the threat is determined to be credible resulting in students remaining outside of the building for an extended period of time, being sent home or being relocated to an alternative site). 6. Training for staff members; 7. Support services for students and staff; 8. School Committee notification The initial bomb threat procedure will be subject to approval by the School Committee. The Superintendent/designee will be responsible for overseeing a review or evaluation of bomb threat procedures prior to the Committee’s required annual approval of the Westbrook’s Crisis Response Plan, or following implementation of the procedure in response to a specific threat. D. Reporting of Bomb Threats- A student who learns of a bomb threat or the existence of a bomb on school premises must immediately report such information to the building principal, teacher, the School Resource Officer or other employee in a position of authority. An employee of the school unit who learns of a bomb threat shall immediately inform the building administrator. The building administrator shall immediately take appropriate steps to protect the safety of students and staff in accordance with the school unit’s bomb threat procedure, as developed under Section C, and inform the Superintendent of the threat. All bomb threats shall be reported immediately to the local law enforcement authority, as provided in the bomb threat procedures. The Superintendent shall be responsible for reporting any bomb threat

to the Department of Education within two business days of the incident. Reports will include the name of the school, the date and time of the threat, the medium used to communicate the threat, and whether or not the perpetrators have been apprehended. E. Student Disciplinary Consequences- Making a bomb threat is a crime under Maine law. Any student suspected of making a bomb threat shall be reported to law enforcement authorities for investigation and possible prosecution. Apart from any penalty imposed by law, and without regard to the existence or status of criminal charges, a student who makes a bomb threat shall be subject to disciplinary action by the school. The administration may suspend and/or recommend for expulsion any student who makes a bomb threat. The making of a bomb threat will be considered deliberately disobedient and deliberately disorderly within the meaning of 20-A M.R.S.A. § 1001(9) and will be grounds for expulsion if found necessary for the peace and usefulness of the school. In addition, a student who is found after hearing by the School Committee to have brought a bomb to school shall be expelled from school for at least one year in accordance with 20-A M.R.S.A. § 1001(9-A) and Policy JICIA, except that the Superintendent may modify the requirement for expulsion based on individual circumstances. A student who has been identified through the PET process as having a disability and whose conduct in violation of this policy is related to the disability shall be disciplined as provided in Policy JKF. F. Aiding Other Students in Making Bomb Threats- A student who knowingly encourages, causes, aids or assists another student in making or communicating a bomb threat shall be subject to the disciplinary consequences described in Section E of this policy. G. Failure to Report a Bomb Threat- A student who fails to report information or knowledge of a bomb threat or the existence of a bomb or other destructive device in a school building or on school property may be subject to disciplinary consequences, which may include suspension and/or expulsion. H. Staff Disciplinary Consequences- A school system employee who makes or communicates a bomb threat will be reported to appropriate law enforcement authorities and will be subject to disciplinary action up to and including termination of employment. Disciplinary action taken shall be consistent with collective bargaining agreements, other employment agreements and School Committee policies. A school system employee who fails to report information or knowledge of a bomb threat or the existence of a bomb on school premises will be subject to discipline up to and including termination of employment. I. Civil Liability- The school unit reserves the right to bring suit against any individual responsible for a violation of this policy and to seek restitution and other damages as permitted by law. J. Lost Instructional Time- Instructional time lost as a result of a bomb threat will be rescheduled at the most appropriate opportunity, as determined by the School Committee. Time lost may be rescheduled on a weekend or vacation day, or after what would normally be the last day of the school year, except on days when schools must be closed as required by law. K. Notification Through Student Handbook- All student handbooks shall address the school unit’s bomb threat policy and procedures and explain the educational consequences of bomb threats. In addition, student handbooks shall notify students and parents that bomb threats violate Board policy and civil and criminal law.
