Communications / Correspondence – Superintendent Dr. Peter Lancia reported the following hirings:  Katie Trunk has been hired as an LPN / Education Technician III at Westbrook High School. This is a new position approved in the FY 18 budget. She will be paid $20.44 / hour based on twelve (12) years’ experience (Account # 1000-0000-2138-51010-300 NURSE / W H S) per the latest collective bargaining agreement.  Jaimie Appel has been hired for the Drama Club at Congin School and will be paid a stipend of $800 (Account # 1000-9100-1230-51500-020 Intramural Activities) per the latest collective bargaining agreement.  Melissa Perkins has been hired for the Drama Club at Congin School and will be paid a stipend of $800 (Account # 1000-9100-1230-51500-020 Intramural Activities) per the latest collective bargaining agreement.  Eric Peters has been hired for the Yearbook at Congin School and will be paid a stipend of $800 (Account # 1000-9100-1230-51500-020 Intramural Activities) per the latest collective bargaining agreement.  Christine Woolworth has been hired for the College Knowledge Bowl at Congin School and will be paid a stipend of $400 (Account # 1000-9100-1230-51500-020 Intramural Activities) per the latest collective bargaining agreement.  Sharon Beever has been hired for the Nature Club at Congin School and will be paid a stipend of $400 (Account # 1000-9100-1230-51500-020 Intramural Activities) per the latest collective bargaining agreement.  Abby Jacobs has been hired for the intermural Art Club and will be paid a stipend of $600 (Account #1000-9100-1200-51500-060 Middle School Activities Stipends)  Jeremy Turner has been appointed as a volunteer for Girls’ Soccer at Westbrook High School. There is not compensation associated with the volunteer position. Superintendent Dr. Peter Lancia reported the following resignation:  Lauren McKenney from the position of Special Education / Education Technician III at Westbrook Middle School; effective October 2, 2017.

Superintendent’s Report – 1. Teaching and Learning Newsletter Recognition - Darlene Bruns, 2018 Maine Career & Technical Education Teacher of the Year – Todd Fields, WRVC Director presented Mrs. Bruns with a plaque and spoke about the work she does in the center. Presentation by students in the Westbrook High School COMPASS Program – Heather Simpson, Alternative Education Teacher at Westbrook High School spoke about the changes to programming; a project based hands on curriculum. Some of the students spoke about the success they have found in the program. US Naturalization Ceremony on Thursday at Westbrook Middle School Madison Damon selected as the 2017 Samsung American Legion State Finalist Building project Update and Review of Current Change Orders 2. Westbrook School Department

One of the most difficult things a school community can face is the loss of a student. As you likely know, one of our High School seniors, Joshua Rowe, passed away at the end of October. Josh was an outgoing, personable young man who was always smiling and had many friends. The grief we are experiencing - his family, friends, and school staff - is deep, and we are all working to understand the loss. Counselors from outside support organizations have been provided for high school students and staff in the last weeks and will continue to be provided as needed throughout the school year. A community meeting was scheduled for parents to discuss ways to support each other and their children, and others will be held as needed. School counselors and social workers at our other schools and WRVC have also been providing support to children. As we move back into routines and begin to move forward, we are working to comfort all of our students by listening to them, providing space for grief, and reassuring them of our continuous belief in them. During this sad time, I have been heartened by the outpouring of kindness from the entire community toward Josh’s family and friends as well as our entire school family. Thank you for your generosity and support during this time. Westbrook is a resilient community. We care deeply about each other and our children. This gives us hope even in the most challenging of days. If you or your children need support in understanding the loss of a loved one, or are experiencing any kind of trauma or stress, I encourage you to reach out to our school counselors, social workers, and principals. We are here to help. Several community providers are also very helpful, including Center for Grieving Children (www.cgcmaine.org - 775-5216), NAMI Maine (www.namimaine.org - 464-5767). or The Opportunity Alliance (www.opportunityalliance.org - 523-5049.) SCHOOL CANCELLATION PROCEDURES The School Department carefully monitors every potential storm that may affect school. Before 4am, the Superintendent contacts the Director of Operations, Maintenance Coordinator, Transportation Coordinator, Westbrook Public Works, and Westbrook Police, along with several area superintendents. We discuss weather reports, road conditions, power outages, and other related factors. Once the decision is made, whenever possible, we will announce school cancellations or delays between 5-5:30am on local television stations and their websites, on the WSD website, and with an automated phone call, text, and email. Proficiency Based Learning What are Report Cards? Report Cards have been issued for the first quarter. Students in grades K-4 will bring home a printed report card. Please take time to review it with your child. We hope that it will help you prepare for your parent-teacher conference. Students in middle and high school who use Jump Rope will be able to access report cards electronically through the Parent Portal. Because Jump Rope is always “live’ and provides reports on progress all the time, we encourage parents to check in regularly. By checking at the end of the quarter, parents can use the information to prepare for conferences. Senior parents using Infinite Campus can also check the parent portal for updates on progress. Reports cards today are different from ones we may recall from years past. A report card provides an update on a student’s progress at periodic benchmarks throughout the school year. In a Proficiency Based Learning system, grades reflect the accomplishment of learning standards. Some standards are developed over the course of the year and progress is more long term, as in English language arts which is more developmental in nature. A score of 2 (partially proficient) in November is very appropriate since the expectation is to become proficient by the end of the year or course. Other standards are organized in content-based units of study, as in

science or social studies where topics are covered at certain time of the year. Proficiency is expected at the end of a particular unit, so scores below 2.7 do not reflect proficiency. Habits of Work and Learning are also reported quarterly in order to monitor social development standards. Report cards may identify a need for additional instruction in order to make progress. Students needing this support are provided with interventions, first in their classrooms and in possibly in specialized settings. Discuss your child’s need for intervention support during parent teacher conferences. While scores on report cards are not the only indicator of strengths and needs, they may suggest the need for a specific plan to support your child. Be sure to review your child’s report card or progress report before coming to your conference. If you did not receive a report card or are unable to access it on Jump Rope, please contact your child’s school. Also, if you cannot make your conference appointment, please call the school to reschedule it. We look forward to seeing you soon!

MUSIC in WESTBROOK SO MANY of our Westbrook High School musicians were recently accepted to state music festivals! Four students were accepted for the All State Jazz Festival, twelve students were accepted for the District 1 HS Honors Band, four were accepted for District 1 Mixed Chorus, and six were accepted for District 1 Treble Chorus! And we still have All State Band and Chorus to go. Congratulations to our students and to their teachers Sue Proulx and Kyle Smith! CONGRATULATIONS to the WHS Blue Blazes Marching Band who won the Gold Medal at the 2017 Maine State Marching Band finals. Students were judged by national judges in 14 categories, each judge scoring from 1-5. WHS received twelve 5's, and a total score of 4.87! Almost perfect! BRAVO! Here’s a link to their performance: https://www.youtube.com/watch?v=VKguxuVJe3U. Our magnificent band traveled to Allentown, PA on November 4 for the national USBands Competition. Before they left, over 200 people packed the stands at Olmstead Field for the band’s final Maine performance of its award winning show Nostradamus. It was a great send off for the students and a thank you to the community who supports them. In the crowd were current students, family and friends, many WHS marching band alumni, current staff from across the district, and former staff, including retired Music Director George Bookataub. Music and the arts play an essential role of the Westbrook community. Thank you for your support!

HAVING FUN Minions at Sacc... Candy at Congin... Fly Guy at Canal... Waldo at WMS... and pirates at WHS!

Saccarappa now has a new paved parking lot and driveway. Lights will be installed within a few weeks as well. Gas connections have been completed and final earthwork is being finished. Foundation work continues and the shape of the expansion is easy to identify. The outline of the expansion at WMS is also evident, although the most prominent addition is the new stair tower for the wing. Both projects will be framed and enclosed work can move inside during winter months. Be sure to follow the construction project on our website www.westbrookschools.org. The Saccarappa PTO recently purchased a drone to take arial videos of the project. Click on the School Expansion tab to see the videos!

At that time, we no longer needed our two (one year positions) to continue (one at Canal and one at the MS). I also moved an ed tech position from Canal to the MS because of the 4 students moving from the Intensive Support (social/emotional) at Canal to the Intensive Support program at the MS. Presently, for the school year 2017‐18, our needs have increased since June of 2017. Because we have so many students that transition in and out of the district, I am asking for 3 ‐one year educational technician positions. One of these positions would be for Canal, one position would be for Congin, and one for the High School. The students that have moved into our District are in need of intensive support which in order to meet compliance the need for additional staff is needed. Reasons: At Canal: 13 new special education students 4 for Intensive support 4 for FA 5 Resource needing ed tech support At Congin 9 new special education students 4 Intensive support 5 FA At WHS 5 new special education students 2 in Functional Academics (one is returning from Out of District placement) 3 Intensive support Presently, we will only have one student requiring an out of district placement.

TO: Dr. Peter Lancia FROM: Kelli Deveaux DATE: 5 October 2017 RE: NEASC Accreditation Stipends Westbrook High School was last accredited by New England Association of Schools and Colleges in 2009. In 2017 we received word that, due to restructuring of the NEASC standards, our ten year reaccreditation would be delayed until 2020. Late last Spring NEASC released their timeline for the new 2020 cohort, which included appointing two co‐chairs from the staff to lead the work, and the need to begin the self‐ study and action planning stage of the process in the 2017‐2018 school year. In consultation with area high schools who are currently engaged in the accreditation process about their stipends, and after review of the expectations of the co‐chair positions in the new accreditation model, I am requesting that we provide each co‐chair with a stipend of $2,000 for the work that must be completed for the year. The self‐study is comprehensive, requiring careful review of past accreditation reports, a retrospective look at where we have been, our current status‐ informed by data and artifact collection and surveys‐ and the development of goals and objectives, requires both skill, organization and commitment to the institution, and we are seeking quality candidates to assist in the tasks required for Westbrook High School to remain an accredited school with NEASC. Approximately 250 hours of work will be required of each individual receiving the stipend. This will include collecting, analyzing, and reporting different forms of data, writing detailed reports, facilitating meetings with staff, attending required meetings with NEASC, and coordinating information between school and NEASC.

Timeframe:   ● The​ ​trip​ ​is​ ​planned​ ​to​ ​occur​ ​during​ ​April​ ​vacation​ ​of​ ​2017.​ ​ ​The​ ​exact​ ​dates​ ​are​ ​contingent  on​ ​scheduling​ ​by​ ​the​ ​EF​ ​Tours​ ​but​ ​should​ ​be​ ​within​ ​the​ ​vacation​ ​time​ ​frame​ ​of​ ​April​ ​14th  through​ ​to​ ​April​ ​22nd.  ● January​ ​2018:​ ​Students​ ​passports​ ​and​ ​other​ ​documents​ ​will​ ​be​ ​reviewed​ ​and​ ​photocopied.  Other​ ​important​ ​information​ ​is​ ​stored​ ​in​ ​a​ ​database​ ​and​ ​shared​ ​with​ ​building​ ​principal.  ● February-April​ ​2018:​ ​Mandatory​ ​bi-weekly​ ​meetings​ ​about​ ​the​ ​trip​ ​and​ ​safety.​ ​Students​ ​and  parents​ ​sign​ ​behavior​ ​contract​ ​(see​ ​attached).​ ​A​ ​comprehensive​ ​information​ ​packet​ ​will​ ​be  created​ ​and​ ​given​ ​to​ ​the​ ​building​ ​principal.

Safety/Supervision:   ● Students​ ​will​ ​be​ ​chaperoned​ ​by​ ​a​ ​full-time​ ​Tour​ ​Director,​ ​two​ ​Tour​ ​Leaders,​ ​and​ ​additional  adult​ ​chaperones.​ ​The​ ​cost​ ​of​ ​the​ ​tour​ ​includes​ ​a​ ​Tour​ ​Director​ ​who​ ​is​ ​fluent​ ​in​ ​the  language​ ​of​ ​the​ ​host​ ​country,​ ​is​ ​experienced,​ ​and​ ​is​ ​with​ ​us​ ​from​ ​the​ ​time​ ​we​ ​land​ ​to​ ​the  time​ ​we​ ​fly​ ​home.​ ​Please​ ​see​ ​information​ ​below​ ​concerning​ ​Tour​ ​Leaders.  ○

Stephen​ ​Moulen:​​ ​Stephen​ ​has​ ​been​ ​teaching​ ​for​ ​fifteen​ ​years​ ​with​ ​forteen​ ​being​ ​in​ ​the  Westbrook​ ​school​ ​system.​ ​Prior​ ​to​ ​becoming​ ​a​ ​teacher,​ ​Stephen​ ​was​ ​a​ ​Hospital​ ​Corpsman  assigned​ ​to​ ​Marine​ ​Corps​ ​units​ ​in​ ​Japan,​ ​Korea,​ ​the​ ​Philippines,​ ​and​ ​California.​ ​Stephen  taught​ ​CPR,​ ​first​ ​aid,​ ​and​ ​swim​ ​lessons​ ​for​ ​the​ ​American​ ​Red​ ​Cross​ ​for​ ​over​ ​20​ ​years.  Stephen​ ​has​ ​successfully​ ​planned​ ​and​ ​completed​ ​six​ ​very​ ​successful​ ​trips​ ​taking​ ​WMS  students​ ​to​ ​other​ ​countries.  



Junie​ ​Dugas:​ ​ ​Junie​ ​has​ ​worked​ ​as​ ​an​ ​Administrative​ ​Assistant​ ​at​ ​WMS​ ​for​ ​seventeen  years.​ ​ ​She​ ​is​ ​a​ ​community​ ​member​ ​and​ ​mother​ ​of​ ​Westbrook​ ​graduates.​ ​ ​Junie​ ​has​ ​traveled  outside​ ​of​ ​the​ ​United​ ​States​ ​on​ ​a​ ​number​ ​of​ ​occasions,​ ​and​ ​her​ ​administrative​ ​experience​ ​is  most​ ​helpful​ ​in​ ​planning​ ​a​ ​trip​ ​such​ ​as​ ​this.​ ​ ​Junie​ ​helped​ ​lead​ ​a​ ​trip​ ​to​ ​Paris​ ​and​ ​London​ ​in  2013,​ ​and​ ​a​ ​trip​ ​to​ ​Rome​ ​and​ ​Paris​ ​in​ ​2015,​ ​and​ ​a​ ​domestic​ ​trip​ ​to​ ​New​ ​York​ ​City​ ​in​ ​2016.  

 

● Students​ ​will​ ​be​ ​closely​ ​monitored​ ​at​ ​all​ ​times.​ ​ ​Chaperones​ ​will​ ​check​ ​to​ ​ensure​ ​compliance  with​ ​curfew​ ​and​ ​the​ ​behavior​ ​contract​ ​(see​ ​attached).  ● In​ ​the​ ​past,​ ​we​ ​have​ ​enjoyed​ ​a​ ​3:1​ ​student​ ​to​ ​chaperone​ ​ratio​ ​with​ ​staff​ ​members​ ​and  parents​ ​joining​ ​our​ ​trips.​ ​ ​At​ ​the​ ​very​ ​least,​ ​we​ ​will​ ​have​ ​a​ ​6:1​ ​student​ ​to​ ​chaperone​ ​ratio.  ● At​ ​least​ ​one​ ​Tour​ ​Leader​ ​will​ ​be​ ​currently​ ​certified​ ​in​ ​CPR​ ​and​ ​first​ ​aid.  ● Students​ ​and​ ​parents​ ​will​ ​be​ ​required​ ​to​ ​attend​ ​meetings​ ​specific​ ​to​ ​safety.​ ​ ​During​ ​these  meetings​ ​we​ ​formulate​ ​and​ ​practice​ ​contingency​ ​plans​ ​for​ ​events​ ​such​ ​as​ ​getting​ ​lost,​ ​illness,  avoiding​ ​being​ ​pick-pocketed,​ ​the​ ​buddy​ ​rule,​ ​and​ ​etc.   ● While​ ​on​ ​the​ ​trip​ ​students​ ​will​ ​carry​ ​a​ ​laminated​ ​document​ ​with​ ​emergency​ ​telephone  numbers​ ​such​ ​as​ ​EF​ ​Tours,​ ​the​ ​Tour​ ​Director,​ ​the​ ​Tour​ ​Leaders​ ​(each​ ​Tour​ ​Leader​ ​will  have​ ​an​ ​international​ ​cell​ ​phone),​ ​and​ ​host​ ​country​ ​EMS​ ​numbers.   ● Students​ ​and​ ​parents​ ​will​ ​sign​ ​a​ ​behavior​ ​contract​ ​(see​ ​attached)​ ​that​ ​ensures​ ​compliance  with​ ​school​ ​rules,​ ​EF​ ​Tour​ ​rules,​ ​country​ ​laws,​ ​and​ ​club​ ​requirements.​ ​ ​The​ ​contract​ ​states  that​ ​travelers​ ​who​ ​do​ ​not​ ​comply​ ​with​ ​the​ ​contract​ ​may​ ​be​ ​sent​ ​home​ ​at​ ​parent's​ ​expense.   

LIABILITY/INSURANCE:

School​ ​Dances:​​ ​The​ ​Leadership​ ​Club​ ​coordinates​ ​dances​ ​at​ ​the​ ​middle​ ​school,​ ​and​ ​DJs​ ​the​ ​day  dances​ ​sponsored​ ​by​ ​other​ ​groups​ ​in​ ​the​ ​middle​ ​school.​ ​ ​Through​ ​the​ ​use​ ​of​ ​surveys,​ ​the​ ​club​ ​gives  students​ ​in​ ​the​ ​school​ ​the​ ​opportunity​ ​to​ ​pick​ ​songs​ ​for​ ​the​ ​dances,​ ​food​ ​for​ ​the​ ​concessions,​ ​and  other​ ​items​ ​to​ ​purchase​ ​like​ ​glow​ ​sticks.​ ​ ​The​ ​club​ ​reviews​ ​the​ ​songs​ ​carefully​ ​to​ ​ensure​ ​that​ ​they​ ​are  appropriate​ ​for​ ​middle​ ​school​ ​students.​ ​ ​Some​ ​of​ ​the​ ​proceeds​ ​have​ ​also​ ​been​ ​used​ ​to​ ​purchase​ ​DJ  equipment​ ​and​ ​donated​ ​to​ ​the​ ​Animal​ ​Refuge​ ​League​ ​in​ ​conjunction​ ​with​ ​the​ ​school’s​ ​PAWSitive  Club.​ ​ ​Administrators​ ​report​ ​that​ ​they​ ​find​ ​the​ ​dances​ ​to​ ​be​ ​a​ ​very​ ​positive​ ​experience.​ ​ ​They​ ​have  also​ ​noticed​ ​that​ ​the​ ​students​ ​enjoy​ ​the​ ​dances​ ​more​ ​now​ ​that​ ​students​ ​are​ ​the​ ​DJs.    Movie​ ​Days:​​ ​ ​Several​ ​times​ ​a​ ​year,​ ​the​ ​club​ ​sponsors​ ​a​ ​movie​ ​day​ ​that​ ​includes​ ​a​ ​matinee​ ​of​ ​classic  movies​ ​(Mary​ ​Poppins,​ ​Finding​ ​Nemo,​ ​The​ ​Wizard​ ​of​ ​Oz)​ ​for​ ​the​ ​younger​ ​kids,​ ​and​ ​a​ ​scary​ ​movie  in​ ​the​ ​evening​ ​for​ ​older​ ​kids.​ ​ ​Attendees​ ​can​ ​only​ ​get​ ​into​ ​the​ ​evening​ ​movie​ ​with​ ​a​ ​signed  permission​ ​slip.​ ​ ​An​ ​intermission​ ​in​ ​the​ ​middle​ ​of​ ​the​ ​movie​ ​gives​ ​patrons​ ​the​ ​opportunity​ ​to​ ​get​ ​a  snack​ ​and​ ​socialize.​ ​ ​Grandparents​ ​and​ ​parents​ ​particularly​ ​like​ ​the​ ​matinee​ ​where​ ​they​ ​can​ ​share  their​ ​own​ ​love​ ​for​ ​movie​ ​classics​ ​that​ ​they​ ​enjoyed​ ​as​ ​kids.​ ​ ​The​ ​older​ ​students​ ​like​ ​the​ ​opportunity  to​ ​watch​ ​a​ ​movie​ ​where​ ​they​ ​can​ ​chat,​ ​use​ ​their​ ​cell​ ​phones​ ​(as​ ​long​ ​as​ ​they​ ​are​ ​quiet​ ​and​ ​sit​ ​in​ ​the  back)​ ​and​ ​scream​ ​as​ ​much​ ​as​ ​they​ ​want​ ​during​ ​the​ ​really​ ​scary​ ​parts.    Car​ ​Washes:​​ ​The​ ​club​ ​works​ ​with​ ​Rite​ ​Aid​ ​to​ ​help​ ​keep​ ​the​ ​cars​ ​of​ ​community​ ​members​ ​squeaky  clean.​ ​ ​A​ ​portion​ ​of​ ​the​ ​proceeds​ ​is​ ​donated​ ​to​ ​charities​ ​supported​ ​by​ ​Rite​ ​Aid.   

Fun​ ​Night:​​ ​In​ ​the​ ​past​ ​The​ ​Leadership​ ​Club​ ​has​ ​coordinated​ ​“Fun​ ​Nights”​ ​for​ ​5th​ ​grade​ ​students.  The​ ​Leadership​ ​Club,​ ​along​ ​with​ ​other​ ​students,​ ​organized​ ​a​ ​successful​ ​and​ ​enjoyable​ ​night​ ​that  included​ ​concessions,​ ​dancing,​ ​picnic​ ​games,​ ​video​ ​games,​ ​board​ ​games,​ ​dodge​ ​ball,​ ​and​ ​manhunt.  We​ ​hope​ ​to​ ​organize​ ​another​ ​fun​ ​night​ ​before​ ​the​ ​end​ ​of​ ​this​ ​year.    Breakfast/Concessions:​​ ​Concessions​ ​are​ ​offered​ ​at​ ​the​ ​dances​ ​and​ ​at​ ​the​ ​movies,​ ​but​ ​the​ ​club​ ​also  coordinates​ ​special​ ​events,​ ​such​ ​as​ ​a​ ​Valentines​ ​breakfast.​ ​ ​The​ ​Leadership​ ​Club​ ​also​ ​offered  concessions​ ​during​ ​parent/teacher/student​ ​conferences​ ​last​ ​fall. 

   

                 

  Of​ ​course​ ​the​ ​biggest​ ​benefit​ ​to​ ​the​ ​Westbrook​ ​community​ ​is​ ​the​ ​development​ ​of​ ​future  leaders.​ ​ ​Students​ ​take​ ​an​ ​active​ ​role​ ​in​ ​decision-making​ ​that​ ​includes​ ​a​ ​detailed​ ​analysis​ ​of​ ​the  events​ ​to​ ​improve​ ​the​ ​experience​ ​and​ ​ensure​ ​safety.​ ​It​ ​is​ ​rewarding​ ​to​ ​see​ ​former​ ​club​ ​members  coordinating​ ​complicated​ ​and​ ​highly​ ​successful​ ​events​ ​at​ ​the​ ​high​ ​school​ ​such​ ​as​ ​Westbrook  Has​ ​Talent​ ​and​ ​Westbrook​ ​Family​ ​Feud.​ ​Former​ ​club​ ​member​ ​act​ ​as​ ​mentors​ ​for​ ​middle  school​ ​students​ ​and​ ​participate​ ​in​ ​student​ ​government.     While​ ​on​ ​our​ ​trips​ ​we​ ​often​ ​receive​ ​compliments​ ​from​ ​airline​ ​staff,​ ​hotel​ ​staff,​ ​other​ ​Tour  Leaders,​ ​and​ ​Tour​ ​Directors​ ​on​ ​the​ ​conscientiousness​ ​and​ ​deportment​ ​of​ ​our​ ​students.​ ​We​ ​are  confident​ ​that​ ​our​ ​students​ ​will​ ​continue​ ​to​ ​demonstrate​ ​a​ ​degree​ ​of​ ​responsibility​ ​and​ ​maturity  well​ ​beyond​ ​their​ ​years​ ​and​ ​positively​ ​represent​ ​the​ ​Westbrook​ ​School​ ​Department.  Thank​ ​you​ ​for​ ​giving​ ​us​ ​the​ ​opportunity​ ​to​ ​work​ ​with​ ​students​ ​to​ ​support​ ​our​ ​school​ ​and​ ​the  Westbrook​ ​community.   Sincerely,

ELL Teacher / Westbrook High School Meredith Diamond is nominated for this position replacing Regina Clement who took another position in the district. She will be paid on Step 14 of the Master’s +30 scale (Account # 1000-4100-1000-51010-990 ESL TEACHER (9-12)) per the latest collective bargaining agreement. This position was advertised within, on ServingSchools.com and the Westbrook School Department website; there was 5 applicants. Ms. Diamond has a Bachelor's degree in English from Columbia University, a Master’s degree in English, Composition and Pedagogy and a C.A.S in Education from the University of Maine in Orono and an anticipated Ph. D. in Public Policy and Education Leadership from the University of Southern Maine in 2019. She was employed as and English III, Creative Writing and AP English Language and Composition teacher at Mt. Ararat High School, Topsham, ME.

Family and Medical Leave Policy The federal Family and Medical Leave Act (FMLA) provides generally that an eligible employee is entitled to up to twelve (12) work weeks of leave during any 12-month period; (1) for the birth, adoption, or foster placement of a child; (2) to care for a spouse, son, daughter or parent with a serious health condition; or (3) when the employee is unable to work because of the employee’s serious health condition. An eligible employee may be granted FMLA leave of up to a total of 12 weeks in a rolling 12-month period measured backward forward from the first date an employee uses any takes FMLA leave. The next 12 month period would begin the first time FMLA leave is taken after completion of the prior 12 month period. Employees requesting leave shall provide at least 30 days notice whenever such leave is foreseeable. Whenever an employee is absent for five (5) consecutive days the employee will be asked to provide information needed to determine whether the leave is for an FMLAqualifying purpose. All leave taken for FMLA-qualifying purposes shall be counted toward employees’ FMLA entitlement. Any employee taking leave under FMLA shall concurrently use any applicable paid leave available under existing policies or agreements, provided the employee meets all requirements for such paid leave. After such paid leave is exhausted, the balance of the FMLA leave shall be unpaid. The employer will continue to pay its share of the employee’s health insurance premium while the employee is on unpaid FMLA leave. The employee must pay his or her share of the premium on a monthly basis as directed by the administrative office. At the end of the FMLA leave, medical and dental benefits will no longer be paid by the employer. Before returning to work, employees taking FMLA leave for their own serious health condition shall submit a certificate from a health care provider indicating that they are able to return to work and perform the essential functions of the position. Employees who are not eligible for FMLA leave may be eligible for up to ten (10) weeks of unpaid family or medical leave during any two-year period under the Maine Family Medical Leave Act. FAMILY AND MEDICAL LEAVE ACT (FMLA) ADMINISTRATIVE PROCEDURE The following administrative procedure covers the main provisions of the federal Family and Medical Leave Act (FMLA). The guidelines in no way attempt to modify the Act, which should always be referred to when questions about implementation arise. The school unit is responsible for analyzing each employee request for leave to determine whether he/she is eligible under the federal and/or state statute. When an employee is eligible for leave under both the federal and state statutes, the applicable law with regard to each benefit shall be the one that provides the greater benefit (usually federal FMLA). I.

ELIGIBILITY REQUIREMENTS To be eligible under the FMLA, employees must work at a site where 50 or more employees of the same school board are employed within 75 miles of that work site. An employee must have been employed by the school unit for at least twelve months and have worked at least 1250 hours in the previous twelve-month period. According to the law, teachers employed on a full-time basis are presumed to meet the minimum hours requirement. Under the FMLA, an eligible employee is entitled to receive up to twelve weeks of leave during a twelve-month period for the following reasons:

The birth and care of a child;

B.

The adoption or foster placement of a child with the employee;

C.

To care for a spouse, child or parent with a serious health condition; or

D.

The employee is unable to perform the functions of his/her position because of a serious health condition.

ADMINISTRATION A.

If the leave request is due to the employee’s serious health condition, the employee is required to provide medical certification stating the date the health condition commenced, the probable duration, the appropriate medical facts concerning the condition, and that the employee cannot perform the functions of his/her job. If the leave request is due to the serious health condition of a family member, the employee is required to provide medical certification stating the date the health condition commenced, the probable duration, the appropriate medical facts concerning the condition, and an estimate of the time the employee will be needed to care for the family member.

C.

An employee must submit an application for leave at least 30 days in advance when the leave is foreseeable, or as soon as practicable if it is not foreseeable. If an employee fails to provide 30 days’ notice of foreseeable leave, the leave may be delayed to start 30 days after notice is given, provided that the employee had actual notice of FMLA notification requirements.

D.

Any leave taken for FMLA-qualifying purposes (including leave taken under employment policies, bargaining agreements, or contracts) shall also be applied to an employee’s annual FMLA entitlement. When paid leave taken for FMLAqualifying purposes is exhausted, the balance of FMLA leave shall be unpaid.

E.

Upon an employee’s return to work, he/she will be restored to his/her previous position or to an equivalent position with equivalent pay, benefits, conditions and terms of employment.

F.

An employee returning from FMLA leave for his/her own serious health condition is required to submit medical certification that indicates fitness to return to work and ability to perform the functions of the job.

G.

If the employee is unable to return to work because of his/her own serious health condition at the expiration of allowable FMLA leave, a request for extension of unpaid leave may be made to the designated committee. Such requests may be considered on a case-by-case basis. Failure to return to work upon the expiration of FMLA leave may subject the employee to immediate termination unless such an extension is granted.

H.

This policy governs employee leave under 26 M.R.S.A. § 636, “An Act to Care for Families”), referred to in this policy as the “Family Care Act.” Leave under this policy is referred to as “Family Care Leave.” The School Committee recognizes that under Maine’s “Family Care Act,” if an employer provides paid leave under the terms of a collective bargaining agreement or employment policy, the employer must allow an employee to use the paid leave for the care of an immediate family member who is ill. In law and for the purpose of this policy, the following definitions apply: 1. 2. 3.

“Employer” means a public or private employer with 25 or more employees. “Immediate family member” means an employee’s child, spouse or parent. “Paid leave” means time away from work by an employee for which the employee receives compensation. Paid leave is limited to sick time, vacation time, compensatory time and leave that is provided as an aggregate amount for use at the discretion of the employee for any of these purposes. Paid leave does not include paid short-term or long-term disability, catastrophic leave or similar types of benefits.

Employees may take up to 40 hours of paid leave as Family Care Leave per rolling 12 month period, or the amount provided by an applicable collective bargaining agreement, whichever is greater. The 12-month period shall be the same for all employees and shall be a rolling 12-month period measured backward forward from the first date an employee uses any takes FMLA leave and shall be consistent with the 12-month period identified for the school unit’s administration of the Family Medical Leave Act (FMLA).] An employee is not entitled to use paid leave until that leave has been earned. Any employee electing to take Family Care Leave must apply such leave against available paid sick leave and if sick leave is exhausted, against personal leave, then against vacation time until all paid leave available has been exhausted, except as otherwise provided in applicable collective bargaining agreements. Notice/verification of illness for Family Care Leave shall be the same as that required for the employee’s own illness. The employee must specify that leave is being taken pursuant to the Family Care Act. APPLICATION OF FAMILY MEDICAL LEAVE REQUIREMENTS For purposes of applying family medical leave requirements (i.e., FMLA), the school unit shall treat leave under the Family Care Act in the same manner as the employer treats leave for an employee illness. Therefore, Family Care leave and FMLA leave shall run concurrently. Legal Reference:
