CITY OF O)AI HISTORIC PRESERVATION COMMISSION MINUTES Regular Meeting Thursday, April 14, 2016 Call to Order Chair McCredie called the regular meeting of the Ojai Historic Preservation Commission to order at 5:00 p.m. on Thursday, April 14, 2016, in the Ojai City Hall Council Chambers, 401 South Ventura Street, Ojai, California. Roll Call On a call of the roll, the following Historic Preservation Commissioners were present: Chair McCredie and Commissioners Aikens, Convery, Hill, James, Quinn, and Voogd. Absent: None Staff present: Kathleen Wold, AICP, Community Development Director Matthew T. Summers, City Attorney. Museum Liaison, Mark Lewis. Pledge of Allegiance

Oath of Office Steve McClary, Deputy City Manager, acting as Deputy City Clerk issued the oath to the new Commissioners, Cynthia Convery, Valerie James, Tiese Quinn, and Anthony Voogd. Public Communication

Mayor Blatz welcomed and congratulated the new commissioners.

Museum Representative Report excused.

Nomination open: Commissioner Hill nominated Commissioner Aikens for Chair. Commissioner Aikens nominated Chair McCredie to remain Chair. There were no other nominations. Nominations were closed.

Motion: Commissioner Aikens moved and Commissioner Convery seconded to approve Chair McCredie to remain as Chair of the Historic Preservation Commission to serve for thirteen months to the May 2017 meeting. The motion passed as follows: AYES: Aikens, Convery, Hill, James, Quinn, and Voogd NOES: None ABSTAIN: McCredie ABSENT: None Nomination open: Commissioner Hill nominated Commissioner Aikens for Vice Chair. There were no other nominations. Nominations were closed. Trash and Recycle Cans, Picnic Tables and Benches Project Chair McCredie turned the time over to Greg Grant, Public Works Director who presented the staff report. Questions for staff Commissioner Convery • Asked where the trash can are made. Mr. Grant answered in Temecula, California made of all recycled products. Commissioner Voogd • Thinks this is a terrific idea but has problems with the proposal and the jurisdiction under which the approval falls. • If the Trash and Recycle Cans, Picnic Tables and Benches Project are going to be placed in the arcade, that is a landmark, and needs a work permit. Commissioner Convery • Questioned the need for the City to pull permits for trash and recycle cans. Mr. Summers, City Attorney, read the following code section: Sec. 4-8.15. Permits for work affecting landmarks. (a) Approval from the Historic Preservation Commission, or the City Council on appeal, shall be required before the following actions affecting a landmark may be undertaken: (1) Construction and reconstruction; (2) Alteration, restoration and rehabilitation; (3) Relocation; (4) Demolition. Mr. Summers clarified that

the replacement of trash and recycle cans does not fit in any of these categories or rise to that level of review or discretion to require a work permit. Commissioner Hill • Asked about the connection between the trash cans and the arcade in an aesthetic sense. Mr. Summers explained the aesthetics of whether the trash cans fit in with the look of the arcade is independent of a work permit. It is his assessment that a work permit is not required as the trash cans construction, reconstruction; alteration, restoration or rehabilitation of the building. Ms. Wold asked Mr. Grant if he could provide time frames as to when the trash and recycle cans are expected to be installed. Mr. Grant answered roughly 3 months.



Chair McCredie Asked if Planning Commission has reviewed this item. Mr. Grant answered that the Planning Commission has reviewed this proposal.

Ms. Wold offered to have Mr. Grant bring back detailed information on the proposed trash and recycle cans to the HPCs next meeting if the Commission would like. Ms. Wold asked the Commission to provide feedback to Mr. Grant. Commissioner James • Asked if other colors are available. A color that might match the building. Mr. Grant answered that there are many colors options, but it is the City's intent to use a milder color. The City is also trying to standardize the colors throughout the City so they have spare parts and such for repairs and maintenance. Commissioner Hill • Noted the Commission needs to be precise and accurate with their recommendations. If it takes a Work Permit to accomplish that then he would vote to require a Work Permit application be submitted. Mr. Grant asked if he could submit a Director's Exemption from Design Review application. Mr. Summers answered that a Work Permit application is the appropriate application to be submitted for Historic Review. Vice Chair Aikens • Supports the project. • Would like to see how the landmark designation for the Arcade reads. Commissioner Convery • Likes the look of the proposed cans and supports the project.

Does not think it should be considered as an architectural feature. She feels architectural features are attached to the structure. She is fine with the project being categorized as a replacement as they are mobile.

Commissioner Quinn • In her opinion the trash can replacement should not require a permit. • If she was allowed to vote on a color she would chose white. Chair McCredie • Understands why this is an informational item. • Appreciates Mr. Grant for bringing the project to the Historic Commission as a courtesy for their comments. Chair McCredie closed the item.

Informational Item 3. Training Presentation by Matthew Summers, City Attorney, in compliance with AB 1234, regarding ethics, conflicts of interest, the Political Reform Act, constitutional concerns, transparency laws, competitive bidding requirements, and fair decision-making requirements. This training is expected to last about two hours, with time for questions. Chair McCredie turned the time over to Mr. Summers who conducted the training. After the training Chair McCredie asked the Commission if they had any questions for Mr. Summers. Commissioner Voogd disagrees with certain things Mr. Summers raised for the record. Mr. Summers passed around a sign-in sheet for proof of receiving the training. He informed the Commission that he has a certificate of completion for them proving they completed the AB1234 training requirement. Chair McCredie closed the item.

Future Agenda Items 4. Ms. Wold reported on the items that have been submitted to the City for Historic Preservation Commission review. Commissioner Comments Commissioner Hill inquired about the items that were set for the February 11, 2016 meeting and then the meeting was cancelled. He asked if there were any items that did not move forward to this meeting.

There was discussion on how to proceed with the review of the Municipal Code Ordinance UpdateText Amendment (TA 15-10) the proposed amendments to the Ojai Municipal Code, Title 4, Chapter 8, Cultural and Historic Preservation and report of Ad Hoc Historic Preservation Commission Committee's consideration of these amendments, related to cultural and historic preservation and landmark regulations and procedures. It was decided to continue with the workshop format that was originally planned for the February 11, 2016 meeting. Commissioner Voogd asked that all previous documents for the Request for Proposals (RFPs) be provided to him.

Planning Report 5. Ms. Wold reported on the following projects: 700 San Antonio Street and explained the owner withdrew his application. 334 E. Ojai Avenue has gone through a concept review. 718 Foothill Road owner is interested in making repairs to the house but the application is on hold. Council Liaison

Mayor Blatz was in attendance and addressed the Commission.

Adjournment There being no further business brought before the Commission, Chair McCredie adjourned the meeting at 8:25 pm.
