BEWARE OF PROPHECY

It may be confidently expected that DR anomaly among pensioner groups would be removed soon as is evident from the recent Order of the Hon’ble Supreme Court. Had there been no strong merit or legal logic on the issue, the Hon’ble Court might not release the quantum of the DA payment to pre-1997 pensioners to 40%. It HAS become transparent to us that we are about to conquer the first peak of our legal battle and so are positively looking forward to conquer the next peak, i.e., updation of pension. Unless it is achieved, only removal of DR anomaly does not serve the purpose of minimizing the wide differences in pensions among the pensioners arose due to successive wage revisions. The fact is that, after removal of DA anomaly, the pension of an employee retired before 1997 in any cadre will still be remarkably below the pension of an employee in the same rank retired now. And difference will increase year after year. Accordingly, we have submitted amended Writ petition in the Delhi High Court by including the updation of pension as and when wage settlement is concluded. We are proceeding in a positive mind but could not confidently foretell the outcome of Judgment of the second issue. But we find, a few pensioner leaders are so much enthusiastic on the issue that they become Super-positive to foretell that updation of pension is a question of time only and advised in the past to enjoy Bihoo, Onam, Dewali, Navaratri, Eid etc. After the order of the Supreme Court, some even said that information received from reliable sources that the pension would be revised from 1.8.2012 with 40% arrear. The superpositive information unreasonably lifted the expectation of the pensioners. We all know that it is the common nature of the human being to swallow sweet pills. Again, before the proceedings in the Bench of Hon’ble Justice Sanjiv Khanna and Hon’ble justice Sunita Gupta of Delhi High Court on 12.7.2016, a disturbing information of LIC’s seeking with consent from petitioners put our expectations down from a rising crescendo. A cloudy confusion loomed large in the legal atmosphere. Ignoring this, our legal cell members prepared themselves and attended the Court with their Councel. In fact, the Hon’ble Court sat on that date and LIC’s case was taken up itemwise one by one ( i.e. 9, 10, 11, 1, 13, 16). We came to know two important matters. One is, the Hon’ble Court is serious about delivery of court Order by the end of August, 2016 and the other is the query of the Court on how LIC will afford to pay pension in a Funded scheme when interest rate is coming down so sharply. One of the intending entrants, AIIPA made a sarcastic remark about our revised petition having not been found in the tables of judges. These organizations clim to have acquired the status of the regular petitioners. We refrain ourselves from any reply as, sometimes, silence speaks louder than sound. We believe that it is not the time for pin pricking. We don’t want to tinker with anyone who is on the same boat in which we are sailing. We wish, they will also learn.

The General Secretary of the Federation Shri GN Sridharan sent his condolence message immediately after he received our mail intimating the sad news at about 9am on 30.07.2016. The message is quoted below: I am extremely sad to know of the demise of Shri Chandrasekhar Bhattacharya. He is perhaps the last of the old stalwarts of Kolkata who played a constructive role in the Federation of (in service) Class-I Officers Associations. I recall the talk I had with him over phone when I visited kolkata in October,2014 when he told me of his deteriorating health condition but was practical in advising me not to go to his place during the short time at my disposal. I feel I have lost yet another old friend over there. Kindly convey my heartfelt condolences to his family members. – GN SRIDHARAN

Page 5 of 28 GN SRIDHARAN INFORMS : Today's proceedings in Delhi HC : Despite attempt by LIC counsel, as expected, to get two weeks adjournment, the cases came up today ,and there were serious discussions on the issues involved. All the lawyers were present. The Court heard all the cases during almost one hour in the forenoon. On an enquiry by the Bench, the counsel for LIC admitted that they had not filed their counter, and at this, the Judge expressed anguish. Curiously, our Federation's amended petition was also not in the case bundle but our counsel pointed out the same was filed as early as the first week of June 2016 (our counsel is following up with the Registry to get the matter set right). There was mention of the fact by participating advocates that old pensioners seven steps above get pension less than one third of the pension paid to lowest cadre. The Judge made an enquiry on how the funded scheme would sustain increase in pension in the days to come on the falling interest rate. A good deal of explanations emerged. Sometime during discussion, the Judge said discrimination must end'. Mention was also made on the faulty calculation. Judge directed LIC counsel filing an appropriate affidavit within (as heard by us, within four days). LIC is to file counter for amended petitions before the next hearing. The next hearing is to take place on 4th Aug 2016. From the way the Judge was observing, it is obvious that LIC will not ask for adjournment. It looks that the Bench is serious about the time schedules . For further details, we have to wait for the written order to come in a day of two. We are in the process of engaging a Senior Counsel to take forward case. CH MAHADEVAN WRITES "As on 31/03/2015, there is an amount of Rs.32,503.52 cr in the LIC Employees Pension Fund...For 2014-15, LIC has paid Rs.839.42 cr including commuted pension. The interest income alone is Rs.2425.16 cr...Even if our pension is upgraded with an increase by 100% on an average, the pension outgo will be less than 1% of the operating surplus." --- Mr C H Mahadevan in a blog.

Lodha Panel Report

On January 4, 2016, the Supreme Court released the recommendations made by the three-member Lodha panel. The proposals were mainly aimed at structural changes for better governance. Age and tenure caps, one-state-one-vote, accountability and distribution of BCCI's funds were mainly in focus. On July 18th the Supreme Court passed the Order directing BCCI to implement the recommendations of the Lodha Panel in letter and spirit and complete change of constitution and re-election of the Board and affiliated Associations within 6 months under scrutiny by the Lodha panel. Primarily it is a matter relating to Cricket administration in India but deep inside it provides an outline of what should be the structure of any democratic organization for fare administration.

It is a pleasure to inform our readers that the LIC RETIRED OFFICERS’ ASSOCIATION in Kolkata thought in this line long before the Lodha Panel report was made public. On 31st August, 2013 the Annual General Meeting of the Kolkata Association discussed this subject and recommended that the term of a Governing Body Member should be capped to 3 / 5 years depending on the portfolio held. Some relaxations were given for founder members not holding executive positions like Secretary, Jt. Secretary, Treasurer etc. In the same meeting the recommendations were implemented and along with exit of some active members a good team consisting of new faces like Subir Kumar Mazumder took charge of the activities of the Association for the period 2013-14. With minor changes to give effect to the said recommendation, the Team, worked efficiently in 2014-15 & 2015-16. This year again, for 2016-17, there were major changes in the Team. The GS, some of the JSs and the Treasurer took the reserve bench and made room for the new team of active players. The President has also relinquished his chair and will continue to be a member of GB for one more year. The beauty of the process lies in the fact that the individuals who vacate Chairs in favour of newcomers do not take passive role. They remain as active as ever and hence the organization gets larger number of activists for the days ahead. Some of them may again come in after years if the situation so warrants. In fact the outgoing members attend the GB meetings as permanent invitees, regularly attend all weekly meetings on Wednesdays and execute various tasks as they were doing while in office. Finding suitable future replacement is definitely duty of the today’s office bearers. We are proud that our Association could think of such a fair process of formation of GB well before the Lodha Panel was formed. Our experiment to make room for leaders, whose ability is yet to be tested by honourable exit of tested successful leaders proved that the newcomers can exceed the performance of yesterday. Now, it is time for the FEDERATION OF RETIRED LIC CLASS-I OFFICERS’ ASSOCIATIONS and all its affiliated regional bodies to examine how to implement the relevant principle of Lodha Panel in order to provide a healthy environment to nurture future leaders as done by Kolkata Association. DEMOCRACY DOES NOT MEAN HOW MANY ELECTIONS ARE HELD, IT MEANS HOW MUCH CHANGE ARE BROUGHT THROUGH ELECTION.

OUR CASE IN DELHI HC The next date of hearing at Delhi HC is supposed to take place on 4th August’16. Our Federation’s side is managed by a strong team of our leading members. Sri Basudeb Das has been playing an effective roll keeping us assured of the much desired upgradation issue. He is leaving for New-Delhi on 2nd august’16 for being able to actively participate in discussion with our counsel/s.

We are very much worried to learn that amended petition was not in the case bundle despite our having submitted the same on 3rd June'16. This is highly unfortunate and it

shows the lack of seriousness on the part of our counsel. Had the hearing been carried out on that day, our main focus would have lost the sight of the Bench. We cannot afford to lose the case sealing fate of the pensioners. We are fortunate that no effective hearing was held on the day. The Legal committee in its meeting held on 12th July’16 at New-Delhi decided to appoint a very Senior Law-year so that our case is effectively argued before the bench in Delhi High Court leaving no loose thread. During this period, many of us are getting scared at the question raised by Justice Sanjeev Khanna as to the sources of resources, particularly after expression of inadequacy of pension fund by Sri R Ramakrishnan. He was an actuary and any opinion of him on adequacy or inadequacy carries value that cannot be blown away. But, at the same time, we have experienced the opinions of LIC’s actuaries of inadequacy of funds preventing LIC from any wage revision or introduction of Pension. But, Successive Wage revisions have taken place and, also, pension in LIC is a reality. Let us read the beautiful words in a comment by Sri G.Krishna Prasad, a pensioner: "Just as War is too serious a business to be left to soldiers, so is Insurance (including service and allied matters) too serious a business to be left to Actuaries." There are three original petitioners 1) our Federation, known as GNS’s 2) Sri KML Asthana’s and 3) Chandigarh Petitioners. But, reality is that three more are in the fray 1)AIRIEF 2) AIIPA and 3) LIC RETIRED CLASS-I OFFICERS’ ASSOCIATION, HYDERABAD. No pin pricking with the other, even if they claim to be the sole protectors of the pensioners’ interest, is the most sincere appeal with all concerned. It appears that one or more original petitioners are not comfortable with the inclusion of one or more new petitioners for unknown reasons which, we feel, is unjustified. We should embrace all those who are fighting for the cause of Pensioners, without clouding our minds with personal or organizational enmity. And, this has been the stand of Calcutta Association since long for which we have fought relentlessly. After all we should realize that the situation of today warrants TOGETHERNESS and nothing else. The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved the revision of pension of BSNL pensioners and family pensioners, who retired prior to 10.06.2013 by allowing the benefit of merger of 50% DA/DR with Basic Pay/ Pension, effectively amounting to 78.2% DA/DR for the purpose of fitment, and (ii) Modifying the liability of BSNL towards the payment of pensionary benefits to the retired employees. Income tax Declaration by Employees for FY 2016-17 CA Kumar Gaurav

According to the income tax guidelines, income tax is deductible annually for each financial year commencing from 1st of April and ending on the 31st March. The responsibility of the employer has been affixed by the Income tax Department to deduct income tax from the salary of employees monthly on proportionate basis and deposit before the due date ( Monthly) as prescribed and report same to Income tax Department (quarterly as well as annually). The aggregate tax calculated on the estimated projected income will be deducted proportionately in 12 months, thus the assessment needs to be done on at the start of the year.

Page 9 of 28 Therefore, all employees are requested to declare their proposed investments for financial year 2016–17 ,so that proportionate income tax could be calculated & systematic deducted from the salary can be started early. It has to be noted that only the expenditure actually incurred on payment of rent in respect of residential accommodation occupied by the assessee subject to the limits laid down in Rule 2A, qualifies for exemption from income-tax. Thus, house rent allowance granted to an employee who is residing in a house/flat owned by him is not exempt from income-tax. There were various anomaly as well as ambiguity in relation to declaration as well as the submission of details and supporting so CBDT issued Form No 12BB so as to standardize same. We have been receiving complaints from pensioners stating that the recovery of excess/wrong pension payments

Page 13 of 28 are being made in a manner that is not in keeping with the extant guidelines. In this connection, the instructions contained in circular Nos. CO.DGBA (NBS) No.44/GA.64 (11-CVL) 90/91 dated April 18, 1991 and CO.DGBA (NBS) No.50/GA.64 (11-CVL) 90/91 dated may 6, 1991 laying down a uniform procedure in consultation with the controller General of accounts and various non- civil ministries for recovery are reiterated below: a) As soon as the excess/wrong payment made to a pensioner comes to the notice of the paying branch, the branch should adjust the same against the amount standing to the credit of the pensioner’s account to the extent possible including lumpsum arrears payment. b) If the entire amount of over payment cannot be adjusted form the account, the pensioner may be asked to pay forthwith the balance amount of over payment. c) In case the pensioner expresses his inability to pay the amount,the same may be adjusted from the future pension payments to be made to the pensioners. For recovering the over-payment made to pensioner from his future pension payment in instalments 1/3rd of net (Pension + relief) payable each month may be recovered unless the pensioner concerned gives consent in writing to pay a higher installment amount. d) If the over payment cannot be recovered from the pensioner due to his death or discontinuance of pensioon then action has to be taken as per the letter of undertaking given by the pensioner under the scheme. e) The pensioner may also be advised about the details of overpayment/wrong payment and mode of its recovery. The above uniform procedure may be strictly adhered to while effecting recovery of excess/wrong pension payments made to pensioners. 2. As regards the issue of refund of excess/wrong payments to the government, banks may be guided by the guidelines laid down in our circulars Nos. Abidali Neemuchwala, CEO, Wipro Wipro CEO Abidali Neemuchwala took home $1.8 million (approximately Rs 12 crore) in annual compensation during the fiscal year 2015-16, according to a regulatory filing. According to a regulatory filing, Neemuchwala received $859,079 in salary and allowances, $351,213 in commission/variable pay, $575,122 as other payouts and $21,216 as 'long-term compensation' during the financial year ended March 31. N Chandrasekaran, CEO, TCS TCS CEO N Chandrasekaran’s compensation rose 20% to Rs 25.6 crore ($3.8 million) during the fiscal fiscal year 2015-16. A Generous Business Partner! - A STORY FOR SELF-REALISATION One day, a very wealthy man was walking on the road. Along the way, he saw a beggar on the sidewalk. If eyes shows blood-shot, there is retention of waste matter in the system and indicate headache with drowsiness. A wild staring expression of eyes donotes the person has been insane or may be in future. He needs Kali Phos 3 x three tablets every three hours. 10 BEST WAYS TO PROTECT KIDNEYS By Dr. Willie T. Ong (Internist and Cardiologist) Most people know how to protect the heart, but do you know how to care for your kidneys? The kidneys' job is to help remove various toxins (drugs and food wastes), and expel them through the urine. As we grow older, our kidneys will also start to age. A problem with kidney disease is that majority of patients have no warning symptoms. Some time ago, we interviewed Dr. Elizabeth Montemayor, a nephrologist at the General Hospital. Here are 10 ways to protect your kidneys: 1. Limit your salt intake -Too much salt is not only bad for your blood pressure, it's also bad for your kidneys. Many die of kidney disease, which can be partly attributed to a high salt intake and fondness for fish sauce, soy sauce, plain salt and salted fish. Even instant noodles, chips and nuts are teeming with salt. The problem with salt is that it encourages the body to retain water, and can increase your blood pressure (which damages the kidneys). 2. Don't load up on high protein foods such as meat and steaks -A high protein diet like meat, chicken makes the kidneys work twice as hard. Pretty soon, your kidneys could get tired and some of the weaker kidney cells can die. The time-tested doctor's advice of moderation in everything will serve you well. Eat a balanced diet of rice, vegetables, fish and fruit and you can't go wrong. 3. Keep your blood pressure at 130/80 or lower -If your blood pressure is above 140 over 90, this can cause kidney damage within five years. The kidneys are said to be "happiest" with a blood pressure of 130/80 or lower. To help control your blood pressure, you should limit your salt intake, reduce weight and take medicines for high blood pressure,

Page 24 of 28 if needed. 4. Keep your blood sugar below 120 mg/dl -Diabetes and high blood pressure are the two leading causes of kidney failure. A person with uncontrolled diabetes for 5-10 years may develop significant kidney damage. Consult your doctor and keep your blood sugar under control with diet, exercise and maintenance medicines. 5. Drink 8 glasses of water a day -Doctors usually advise people to take in 8 glasses of water a day, but this really depends on your age and condition. If you're sweating a lot and work outdoors, you may need to drink more than 8 glasses a day. However, if you are above 65 years of age, you may do well with just 6 glasses a day. Drinking enough water also prevents the formation of kidney stones. 6. Watch your intake of pain relievers and other drugs Taking pain relievers like mefenamic acid, ibuprofen and the coxibs (like celecoxib) for a prolonged period of time may cause kidney damage. Because of this, we should limit taking these medicines to only a week, or just take them as needed. For those with chronic arthritis, try to look for other ways to relieve the pain such as using a hot water bag, pain reliever ointments, or the safer para cetamol tablet 7. Be careful with tests and procedures using contrast dyes -Some tests, like CT Scans and MRIs, and angiograms, use a contrast dye which helps doctors delineate the organs better. The problem with such dyes is that they can cause kidney damage. To be safe, I would strongly advise you to consult a kidney specialist before undergoing such procedures. 8. Don't drink too much Vitamin C -Excess vitamin C (ascorbic acid) can lead to the formation of kidney stones in predisposed individuals. If you need to take vitamin C, a dose of 500 mg or less is safer. 9. Don't rely on food supplements to protect your kidneys -The above tips are so far the best tips to care for the kidneys. 10. Get a kidney check-up -Simple tests, such as a complete blood count, BUN and creatinine, and a urinalysis are the first screening tests for the kidneys. Finding a trace of protein in the urine can alert the doctor of possible kidney disease. Moral :- Kidney diseases are expensive and difficult to treat. Let's take the necessary steps to protect our kidneys today.

Telo-bhelo: In this extensive field Mother encountered a dacoit couple at dusk when she lost route to Dakshineswar and won their heart by her simple love. The dacoit Bheem Sarder saw Maa Bhabatarini in Maa Sarada. Not only they proved to be harmless but they took her to a nearby grocer's shop and had kept vigil while she rested over the night. A temple dedicated to Mother marks the place where she met the dacoit couple. The adjacent room has a life-size image of dacoit Bheem sardar, which is also offered worship. A Kali temple stands a few feet away from the Mother's temple. The Kali is known as Dakat-Kali, or the Kali of dacoits where they used to offer Puja/Boli before going for dacoity. A temple of Maa Sarada was constructed over that grocer's shop. This extesive field is an hour's drive away from Mother's house, Jairambati. It is easy to visit this place on way to Kamarpukur/Jayarambati from Belur Math, or during return to Belur Math. We need to take a diversion at Arambag to reach Telo-bhelo, which is a 25-minutes drive away from Arambagh. Buses are also avaialble from Arambag. Also like us one can get down at Mayapur rail station, one station before Arambagh, and take vehicle to reach the spot at a distance of 1.5 kms only.
