DEPARTMENT ORDER NO. _ _ 23 July 2010 In the exigency of service, with the recent transfer of Undersecretary Estela V. Sales, all matters relating to the Revenue Operations and Legal Affairs Group will be addressed and resolved by the undersigned. Furthermore, the authority of the Director IV, Revenue Office, to sign and approve action documents/papers from the Revenue Office shall be limited to the following: (1)
Importations under international agreements (UN, ICAO, etc.);
(2)
Importations under RP-US Mutual Defense Treaty;
(3)
Diplomatic importations (Section 105[k], TCCP, as amended);
(4)
Importations of SSS (under RA 8282); GSIS (under RA 8291); BSP (under RA 7653); COMELEC (under RA 8436); Red Cross (under PD 1264);
(5)
Importations of books under Section 105 (s) of the TCCP, as amended, and 109 (r) of the NIRC;
(6)
Importations of books and others under UNESCO Florence Agreement;
(7)
Importations of ADB pursuant to Sections 45 and 34 of the existing Headquarters Agreement between Government of Republic of the Philippines and ADB;
(8)
Importations of household goods and personal effects and vehicle of returning DFA employees and attaches under RA 7157;
(9)
Importations of household goods and personal effects of Philippine Retirement Authority's participants under,EO 1037;
(10)
Importations of household goods and/personal effects of expatriates under Section 105 (h) of the TCCP, as amended;
(11)
Importations of international airline companies;

(12)
Importations of telecommunications companies pursuant to their respective franchises;
(13)
Importations of PAGCOR and NAPOCOR;
(14)
Importations of energy/petroleum operators/contractors under contract with the Department of Energy under PD 1442, PD 972, PD 87, and PD 7156;
(15)
Importations of coal operators/petroleum exploration concessionaire operators;
(16)
Importations of government contractors;
(17)
Importations of Philippine Sports Commission (under RA 6847); Inventors (under 7459); Cooperative Code (under RA 6938); Electric Cooperatives (under PD 269); Labor Organizations (under RA 7165); Philippine Overseas Shipping (under RA 7471); Jewelry Development Act (under RA 7665); International Rice Research Institute (under RA 2707); Manila Jockey Club, Inc. (under RA 6331); Philippine Racing Club, Inc. (under RA 6632); Veterans Federation of the Philippines (under RA 7291); National Commission for the Culture and Arts (RA 7356); and, TESDA (under RA 7796);
(18)
Importations of Export Processing Zone - PD 1991 (PHIVIDEC), and its locators;
(19)
Importations of National Government agencies, local government units, including government owned and/or controlled corporations;
(20)
Importations of household goods and personal effects of OFW returning residents under Section 105(f) of the TCCP, as amended;
(21)
Importations of household goods and personal effects of expatriates without visa under Section 105(g) of the TCCP, as amended;
(22)
Importations of capital equipment/spare parts of BOI registered firms under EO 226 Section 39(I), 39(f), EO 528, and RA 8479;
(23)
Importations of livestocks with approval of NEDA under the last paragraph of Section 105(r) of the TCCP, as amended; and

(24)
Authorizing the payment of duties and taxes of imported motor vehicles of embassies, ADB and others.
Copies of all signed documents/papers pursuant to this Order shall be submitted on a weekly basis to the Office of the Secretary for monitoring purposes. Authority to sign documents or papers on other importations/applications or requests for exemptions not enumerated above, delegated under previous orders and issuances to the Revenue Office, shall revert to the Secretary while there is still a vacancy in the position of Undersecretary for Legal and Revenue Operations Group, in addition to those that the Undersecretary for Legal and Revenue Operations Group regularly signs and approves. Accordingly, the following action documents/papers from the Revenue Office shall be signed and approved by the Secretary while there is still a vacancy in the position of Undersecretary for Legal and Revenue Operations Group: (1)
Importations for donations to relief organizations/foundations (Section 105[l], TCCP, as amended);
(2)
Importations of non-stock, non-profit educational institutions under Section 4(3), Article XIV of the New Constitution; state colleges and universities;
(3)
Generally, all importations under Section 105 of the TCCP, as amended, unless otherwise indicated.
All concerned are hereby enjoined to strictly observe and follow the foregoing delineated functions. This Order accordingly revokes or otherwise amends all orders and other issuances inconsistent herewith. Let a copy of this Order be furnished to the Bureau of Customs for their observance and proper guidance. This Order shall take effect immediately.
