Independent School District 194 Lakeville Area Public Schools Use of School Facilities and Equipment Procedure Addendum to Policy 902 Use of School Facilities and Equipment Effective June 11, 2013 I. GENERAL A. Priority for scheduling school facilities and equipment is provided for school district sponsored activities. The school buildings and equipment are also open and available for community use. B. Exception to the procedure would involve regular school activities as well as school-related activities and meetings which shall be scheduled by the Building Principal or their designee. C. The school district shall establish an annual schedule of facilities and equipment needs for all regular school activities as well as school-related activities and meetings by July 1 preceding the school year. Following this date, applications will be accepted for community use of buildings and equipment in accord with this procedure. D. Use of school district facilities or equipment for personal business or recreation without being scheduled and approved is prohibited except as provided within this procedure. E. Exception to the procedure will be made at the discretion of the Director of Community Education in consultation with the Superintendent. II. APPLICATIONS A. Applications for building and equipment use shall be directed in writing to the Community Facility Use Coordinator. There will be an application processing fee of $15 for each application requesting one to five dates and a processing fee of $30 for each application requesting six or more dates. Effective July 1, 2013, application processing fees will be charged as follows: $15 for each application requesting one to five dates $35 for each application requesting six to twenty dates. $50 for each application requesting more than twenty dates The processing fee will be returned if the request cannot be filled. B. Permits to use school facilities and equipment and fee assessments, if any, shall be issued by the Community Facility Use Coordinator. C. Applicants shall not advertise their activities until a facility use permit is received. D. All permits to use school facilities and equipment shall be revocable and shall not be considered a lease. The school district reserves the right to reject any application or cancel any permit. III. CLASSIFICATIONS A. Class 1 groups are permitted use of school district facilities rent-free in accordance with other provisions of this procedure, but still may incur other fees as per the Use of School Facilities and Equipment Fee Schedule. Class 1 groups include: Local school groups, Local non-profit youth groups, Local non-profit adult groups (except for adult non-profit groups in Class 2), Local government units, school board, as well as local, state and national election polls and caucuses. B. Class 2 groups will be charged rent for facilities and equipment as indicated on the Use of School Facilities and Equipment Fee Schedule. Class 2 groups include: Local non-profit adult groups which charge admission, sell merchandise or generate a crowd of 200 or more, Non-Local, non-profit youth groups, Non-Local, non-profit adult groups,

Organizations conducting religious activities (churches will be classified under Class 1 if their activity does not include religious content.), Other K-12 schools and school organizations, Colleges and universities. C. Class 3 groups will be charged rent for facilities and equipment as indicated on the Use of School Facilities and Equipment Fee Schedule. Class 3 groups include commercial and for-profit groups. D. A group is considered local under this procedure if one or more of the following apply: The individual named on the permit is a resident of I.S.D. #194 or the organization named on the permit is located within I.S.D. #194, The event’s participants are at least 50% residents of I.S.D. #194, The primary purpose of the event is to benefit I.S.D. #194. IV. FEES A. The school district Use of School Facilities and Equipment Fee Schedule is based on a single occasion for a maximum block of time. If use on the single occasion exceeds the block of time, there shall be an additional fee assessed for actual time. A single occasion requiring staff services will require a minimum staff service charge of two hours. B. All non-school groups shall be assessed fees as per the Fee Schedule in conjunction with their use of school facilities and equipment: a. Custodial overtime if the activity takes place during hours when a custodian is not on regular duty. b. Food Service overtime when a kitchen is used. c. Salary for any special services or supervision by school personnel which is deemed necessary by the School Principal or Community Facility Use Coordinator. d. Those groups using an auditorium, computer lab or stadium with synthetic turf, but not paying rent will be assessed an hourly consumable fee as indicated on the Fee Schedule. e. Local, organized, aquatics programs, which provide their own properly certified staff, using a pool on a long term basis will be assessed an hourly consumable fee as indicated on the Fee Schedule. C. Lakeville athletic groups hosting summer camps shall pay a Summer Camp Fee per participant to the school district. Camps shall be scheduled in school facilities in accord with this procedure. The athletic group shall provide a camp roster, a check for the total number of participants attending the camp, and a certificate of liability insurance. V. EQUIPMENT A. Special requests for equipment must be made at the time of application for facility use. B. Any apparatus, equipment or supplies moved into the building must have prior approval from the school district and must be removed promptly following the activity. School district owned equipment or furniture may not be removed from buildings. VI. LIABILITY AND DAMAGE A. Organizations using school district facilities shall agree to indemnify the school district for any and all damage by any person(s) attending the activity and likewise the school district against any and all liability and any and all damages to any person(s). B. The school district may require a non-profit or school-related organization to furnish a certificate of liability insurance to guarantee the conditions of this agreement or any liability incurred by it. C. The school district shall require a for-profit organization to furnish a certificate of liability insurance to guarantee the conditions of this agreement or any liability incurred by it. D. The certificate of liability insurance shall be for at least $1,500,000 per occurrence and will name “Independent School District #194” as an additional insured. VII.

LEASES

A. School district facilities and land may be leased on a space-available basis by individuals and by profit or non-profit organizations which offer educational or service-related programs. Lease arrangements shall be negotiated with the Executive Director of Business Services in consultation with the Community Facility Use Coordinator. VIII. BUILDING USE A. Each group should review their permit upon receipt as not all requested dates may have been approved. B. Supervisors (coaches, troop leaders, etc.) are responsible for the conduct of participants and spectators. C. Youth group supervisors must arrive before the first member of their group and stay until the last member leaves the school grounds. If youth are left in or outside a building after the youth group supervisor leaves, the building supervisor or custodian has the option of calling the police department for custody. D. Requested rooms, areas and equipment must be returned to their original condition before the group leaves the building (replacing tables, chairs, picking up garbage, raising basketball hoops, etc.) Groups should not take down pictures, erase boards or move furniture and equipment from one area to another unless specifically approved on the permit and supervised by a custodian. E. Commons, gyms, halls and most carpeted areas are prohibited for food and drink. Groups should check with the Community Facility Use Coordinator on appropriate food, drinks and craft project areas. F. Groups have access only to rooms and areas specified on the permit. Groups should limit traffic in halls. Running or ball play is not permitted in hallways or lobbies. G. The school district reserves the right to assess groups a fee for building supervisors scheduled for their activities, if the groups cancel repeatedly with no notice. H. Alcohol or tobacco use is prohibited in school buildings or on school grounds. I. Weapons and firearms are prohibited on school property with the exception of authorized safety and training programs. J. The school district is not responsible for lost or stolen personal or organizational items. K. Groups using school district facilities are required to abide by regulations set forth by the Americans with Disabilities Act (A.D.A), and civil rights laws. L. All local and state ordinances and laws concerning public safety and fire must be observed. M. The individual named on the permit and the sponsoring group will be held jointly responsible for any damage done to the facility or equipment as well as liability of any kind and further agrees to hold harmless the school district for any liability. N. Custodians are trained to deal with the cleanup of blood and other bodily fluids. Groups should contact them in case of an accident. O. The school district reserves the right to bill organizations for damage and custodial overtime, and/or refuse permission to use facilities or equipment because of poor supervision, vandalism, damage and poor clean up. The school district also reserves the right to assign additional custodians or building supervisors to large events at the cost of the organization.
