This is a brief interim standalone update, I’ll return to a continuation of the correspondence dated 4 March 2016 later in the week.

The SDP REPORT 3 attached, by an accredited entity, confirms, yet again, the Blu Nite kitchen canopy exhaust air flow rate remains in breach of AS1668.2, ergo, there remains and continues, as confirmed therein;



A Clear & Present Fire Risk



A Clear & Present Food Preparation Risk



A Clear & Present OH&S Risk to Blu Nite’s Staff & Customers

Charles Gardiner, ABL, in his correspondence and documentation, attached, includes a report with a set of measurements which have no relevance to AS1668.2 and furthermore were taken, to now, by a second non-accredited entity, without formal capability to refer to AS1668.2 in their report of irrelevant measurements.

Charles, as previously written, per the following extracts and which continue to apply;

“Charles, having read your correspondence, ABL - Letter dated 19 February 2016.pdf, attached, I view it as not more than a continuing attempt to confuse and distract the circulation. Rather than lose time to deal with it point by point I choose to cut to the chase and deal with reality.”

“I leave it to the circulation to make their own minds in that regard.”

Mark Leibler, I re-state, per the following extract and which continues to apply;

“Mark, I seek again, as Senior Partner, Arnold Bloch Leibler, you bring your full influence to bear such that I not continue to receive correspondence of the type issued by Charles Gardiner, ABL - Letter dated 19 February 2016.pdf.”

Charles, can you have the circulation understand the basis of authority upon which you write and continue to make statements such as;

“For the avoidance of doubt, you are not authorised to access or inspect any part of the duct system for the building.”

“Please remove our client and this firm from all future correspondence concerning the extraction system and related matters. Our client does not propose to engage with you any further in relation to this issue.”

Mark Leibler, I seek you confirm to the circulation the Charles Gardiner properly reflects your disposition in the manner with which he writes?

Until such time as Blu Nite is brought into full compliance with respect to the following it remains my intention and right, as I view it, as an Australian Citizen to write to whomever it concerns;


