New Revised Rules of Practice of the Courts of the Twenty-Fourth Judicia'J Circuit of Missouri (effective April 1, 194Ul RULE 1.. The Sheriff and Clerk, or deputies, shall be in the courtroom at all times when court is in session. RULE 2. The Sheriff or his deputies shall main· tain order in the court room and enforce' the rule against smoking therein during sessions of court. RULE 3. Cost rteposit upon the filing of a case shall be $18 when service by publication is ordered and $13 in all other cases, except no de-posit is required upon the filing of all application to sue as a poor person and in partition cases.

4. A receipt must be given to the Clerk by attorneys taking papers from the Clerk's office, and such papers shall be returned within five days. All such papers shall be returned to the Clerk ,b y 9 a. m., on the opening day of each term of court. Papers should not be taken from the courtroom or the Clerk's office while court is in session. RULE 5.
Upon request of counsel for one or all parties to a case the court will set a convenient date and time for a pretrial conference. RULE 6. Motion Day in each county shall regular· ly be on Monday, two weeks prior to the first day of each term. All motions then pending shall he disposed of on those days. A list of such motions shall be prepared by the Clerk and sent to counsel of record in such cases at least five days in advance. After

Council shall at that time announce which cases are for trial. Trial dates will be determined that morning, a reset docket shall be prepared and made available to cOllnsel along with a list of the judicial days for that term. RULE 10. Counsel shall prepare instructions in civil cases in advance of the completion of the offering of evidence. No delay can be granted for preparation of instructions on issues which should reasonably have been anticipated.

RULE 11. Confirmation of reports of sale or commissioners' reports in partition shall not be heard before the third day (not judicial day) after filing of s uch report, to allow for filing of exceptions to same.

RULE 12. All members of the bar are officers of th e court while court is in session. Therefore, it is not necessa ry for attorneys to be sworn prior to testifying in a quiet title or partition suit or similar matter.

RULE 13. At any time after the trial docket is set and judicial days announced at opening of a term, counsel for any party in any equity case or law case in which jury has been waived and in which the issues are made up may request the court to set same for t rial on a judicial day during the term. No more than one such special case win be set on one day. It will be set at 10:00 a. m. to allow for handling of routine matters first, "and th e Clerk will notify oppos ing counsel a t least twenty days prior to the trial date. Such notice shall be the equivalent of a setting of the opening day of the term.
